The iconography of the Communion of the Apostles, a theme well established in Byzantine art after Iconoclasm, first appears in a securely dated context in the silver patens from Riha and Stuma. These silver plates were produced in Constantinople sometime between 575 and 578. The iconography with the twofold depiction of Christ is usually explained as a reflection of the liturgical practice of the Eucharist, namely, as a reflection of the two actors in the Eucharistic rite, the priest and a (...) deacon distributing bread and wine. I argue instead that during the early Byzantine period the twofold depiction of Christ is an expression of the two natures of Christ directed against the Miaphysites. I propose that the exceptional appearance of the scene in the two early Byzantine silver patens from church treasures from northern Syria is likely to be explained by its Christological significance with regard to Chalcedonian Eucharistic doctrine during the persecution of the Miaphysites in the 570s. The paper lays the foundations for a duty of sustainable property use based on Kant’s Doctrine of Right. In doing so, it contributes to the project of extending the application of Kant’s philosophy to environmental issues so as to include his legal-political philosophy. After providing some context, focusing in particular on Kant’s property argument, I present and critically evaluate a recent argument for a duty of sustainable property use, put forward by Attila Ataner. Then, I draw on Reinhard Brandt’s (...) and Katrin Flikschuh’s interpretation of Kant’s permissive law in order to develop my own argument. According to my account, the duty of sustainable property use is rooted in Kant’s property argument, it is best construed in terms of interpersonal freedom, and it has a structure resembling that of duties of distributive justice. Unlike Ataner’s, my argument proceeds entirely within the domain of interpersonal freedom; it focuses clearly on the normative sense of usability; it does not overgenerate obligations; and it categorises the duty of sustainable property use within Kant’s taxonomy of duties. It thus constitutes a promising starting point to further investigate the connection between sustainability, Kant’s property argument and its use of a permissive law, and the Universal Principle of Right. Originally introduced by Plato and Aristotle, the doctrine of the mean is the most prevalent theory of ethics among Islamic scholars. According to this doctrine, every virtue or excellence of character lies in the observance of the mean, whereas vices are the excess or deficiency of the soul in his functions. Islamic scholars have been influenced by the doctrine, but they have also developed and re-conceptualized it in innovative ways. Kindi, Miskawayh, Avicenna, Raghib Isfahani, Nasir al-Din Tusi, (...) and others are among the Islamic contributors to the subject. Some of their contributions are as follows: bringing together Aristotle's doctrine of the mean with Plato's psychology, dividing virtues into four higher geniuses, dividing vices into eight higher geniuses, setting various kinds of vices and virtues under these higher geniuses, adding the criteria of quality to Aristotle's quantitative evaluation of excess and deficiency, dividing various conceptualizations of justice, adding religious and mystical virtues into the existing list of virtues, and proposing a comprehensive model for curing diseases of the soul. In this article, we evaluate the capacity of liberal egalitarianism to rebut what we call the libertarian challenge of charity. This challenge states that coercive redistributive taxation is neither needed nor justified, since those who endorse redistribution can give charitably, and those who do not endorse redistribution cannot justifiably be coerced. We argue that contemporary developments in liberal political thought render liberalism more vulnerable to this libertarian challenge. Many liberals have, in recent years, sought to recast liberalism such that it (...) is more hospitable to cultural, religious, and ethnic diversity. This move has resulted in increased support for the claim that liberalism should be understood as a political rather than comprehensive doctrine, and that liberal institutions should draw their legitimacy from agreements made among members of an appropriately conceived deliberative community, rather than from controversial liberal principles like individual autonomy. We argue that, while this move may indeed make liberalism more compatible with cultural diversity, it also makes it more vulnerable to the libertarian challenge of charity. Not all versions of liberalism are troubled by the challenge, but those that are troubled by it are increasingly dominant. We also discuss G.A. Cohen's claim that liberal equality requires an ‘egalitarian ethos’ and argue that, if Cohen is right, it is difficult to see how there can be an adequate response to the libertarian challenge of charity. In general, our argument can be summarised as follows: the more that liberalism is concerned accurately to model the actual democratic wishes and motivations of the people it governs, the less it is able to justify coercively imposing redistributive principles of justice. In this dissertation, I will examine the problem of theological fatalism in St. Augustine and, specifically, whether or not Augustine was philosophically justified in his belief that his views on divine grace and human freedom could be harmonized. As is well-known, beginning with his second response To Simplician (ca. 396) and continuing through his works against the semi-Pelagians (ca. 426-429), Augustine espoused the Pauline doctrine of all-inclusive grace: that the fallen will’s ability to accomplish the good is totally a (...) function of God’s elective grace. What, then, does the fallen will do to work out its own salvation? There is the further issue of how to reconcile Augustine’s rather extreme emphasis on grace in his later works with the more balanced picture we receive in his sermones ad populum, written throughout his forty-year preaching career. In many of these sermons, even those written during the Pelagian controversy, Augustine is careful to leave space for both divine and human initiative in the process of our justification within the totus Christus, or ‘whole Christ.’ How we can understand Augustine in his role as doctor gratiae and as preacher of human freedom will be a major inquiry of this dissertation.The most serious obstacle to moving forward on these problems has been and remains the essentialist interpretation of Augustine’s Trinitarian theology by most commentators. On their interpretation, Augustine thought that there were no real distinctions within the Trinity, with each of the three divine persons and their actions sharing in the absolute unity of the divine essence. Holding this interpretation not only does away with the distinctness of each of the persons, but also requires all of God’s different powers and attributes, including willing and foreknowing, to be coalesced into one another without distinction in the divine essence. God’s foreknowledge is thereby identified with God’s will, which necessarily leads to theological fatalism: God would have to will everything that He foreknows, and God would have to foreknow everything that He wills. Since God is omniscient, He wills everything that will happen, including the future willings of the fallen human will.It cannot be denied that there are texts in the Augustinian corpus that seem to point to a reading of the Trinity as absolutely simple. But this study will endeavor to show that there are also other largely overlooked texts in On the Trinity, the Confessions, and his Commentaries on the Literal Interpretation of Genesis (among others) that argue for various distinctions within the Trinity to make sense of the relation between Creator and creature, and the differences between the divine processions of generation/spiration, and the act of creation. These texts will be shown to parallel very closely the position of the Eastern Orthodox Christian tradition, which consistently uses the real distinction between God’s essential being and energetic activities (also known as the essence-energy distinction) to avoid the problem of theological fatalism. This rich theological and philosophical tradition, from the time of the fourth-century Greek Fathers to the Byzantine tradition that followed, differs less with Augustine concerning the essentials of Trinitarian theology and its practical implications for solving the problem of making human freedom and divine grace compatible than has been hitherto thought. This paper takes Cavarero’s arguments against the Homo erectus seriously and asks: how can we model an alternative to it? It proposes that a notion of the mimetically inclined subject is required, one that thickens Cavarero’s affirmative account of inclination by way of a new philosophical understanding of mimesis that includes habit and disciplinarity. Following Cavarero, the mother is positioned as a key figure to place nurturing and love at the centre of subject-making. However, they are shown to be a (...) necessary but not sufficient step for the process of re-evaluation. An account of disciplinary mimesis which draws on a Nietzschean legacy in Michel Foucault and Judith Butler, together with Simone de Beauvoir’s account of woman as a situation, demonstrate the pitfalls of idealizing the mother. I argue that to challenge the particularized universalism of the European subject with an affirmative account of mimetic inclination, other figures which embrace Cavarero’s notion of relational vulnerability alongside the mother are required. The agonistic friend who practices an open, feminist curiosity is proposed as one such exemplar and, in closing remarks, I gesture to other necessary models in feminist and Indigenous thought that are key to remaking the androcentric subject of European philosophy. The main aim of Jeff McMahan's manuscript on the morality of war is to answer the question: why and accordingly when is it justified or permissible to kill people in war? However, McMahan argues that the same principles apply to individual actions and to war. McMahan rejects all doctrines of collective responsibility and liability. His claim is that every individual is liable for what he has done and not for the actions of others - even if both are part of (...) the same collective. Accordingly, McMahan challenges the common view that it is much easier to justify killing in war compared to killing in other contexts. Therefore, the scope of his project exceeds the context of war and extends to interpersonal conflicts between individuals that do not qualify as war. Many of McMahan's main claims are appealing. Particularly, appealing is his rejection of the collectivist account of war. Indeed, it seems that the simple story according to which people are responsible solely for their actions - rather than (also) to the actions of others - should be held on until a different, more complex, account of collective responsibility is put forward and its plausibility is explained. Therefore, the article focuses on the general principles advocated by McMahan with regard to the resolution of all interpersonal conflicts: Whether these conflicts are small scale or large scale (that is, whether few or a many people are involved in the conflict), and within the latter category of conflicts involving many people, whether these conflicts qualify as war (according to some standard) or not. We are confronted by the clash of contradictory ideologies and a crisis of universal knowledge. Two major causes of this crisis are the erosion of common sense and a relativistic view of doctrinal development. Fr. Réginald Garrigou-Lagrange foresaw today's crisis and wrote keenly in defense of the classical Thomistic synthesis. His critiques of modern philosophy and theology, we are now able to see, were prophetic. This first-time English translation of his Le sens commun: La philosophie de l'être et les formules (...) dogmatiques addresss the relationship between common sense and both philosophy and faith; the proper defense for philosophical realism; the subordination and coordination of philosophical first principles; our natural capacity for knowing God's existence; and, at length, the problem of dogmatic development. Recent re-evaluation of the question of the exact role of experience in the Cartesian philosophy has emerged from many quarters. The metaphysical issue of innate ideas has been raised by such scholars as McRae and Miles, and a close examination of the role of empirical enquiry and methodology in Cartesian science have been undertaken by Clarke, Garber, Buchdahl and Laudan, to mention only a few. These recent reappraisals of the role of experience in Descartes's philosophy have been cast mostly (...) in twentieth-century terms with a specific view to concerns of the present. ;My research centres on an examination of the philosophical works of three Cartesians, Antoine Le Grand, Robert Desgabets, and Pierre-Sylvain Regis. Though they are relatively minor figures in the history of ideas, their defence of Descartes's thesis concerning the free creation of the eternal truths, and their emphasis on the importance of experience, provide a unique opportunity to reevaluate the role of experience in the Cartesian philosophy in terms that are common in the period. ;There was a strongly empirical component in the philosophical doctrines and practices of these seventeenth-century Cartesians. Le Grand's view of truth as created and dependent on the will of God led him to assign experiment and experience the role of "making manifest" the operation of laws in the physical universe. Desgabets rejected innate ideas, and argued that all ideas depend on the operation of the senses. Regis emphasized the immutability and total dependence of truths and essences on the free will of God, and thereby undermined the rationalist foundation for the Cartesian doctrine of essences. ;My goal in this approach to the question of the nature and role of experience in the Cartesian philosophy is to explore the philosophical basis of the empiricist tendencies found in Descartes as developed by three of his disciples. My hope is that my study of Le Grand, Regis, and Desgabets, who are relatively unknown today, will not only serve to place them appropriately within the history of ideas, but will dislodge the common misconception of Cartesianism as having been an inherently rationalist philosophy. Our thought and talk are situated. They do not take place in a vacuum but always in a context, and they always concern an external situation relative to which they are to be evaluated. Since that is so, François Recanati argues, our linguistic and mental representations alike must be assigned two layers of content: the explicit content, or lekton, is relative and perspectival, while the complete content, which is absolute, involves contextual factors in addition to what is explicitly represented. Far (...) from reducing to the context-independent meaning of the sentence-type or, in the psychological realm, to the 'narrow' content of mental representations, the lekton is a level intermediate between context-invariant meaning and full propositional content. Recognition of that intermediate level is the key to a proper understanding of context-dependence in language and thought. Going beyond the usual discussions of indexicality and unarticulated constituents in the philosophy of language, Recanati turns to the philosophy of mind for decisive arguments in favour of his approach. He shows, first, that the lekton is the notion of content we need if we are to properly understand the relations between perception, memory, and the imagination, and second, that the psychological 'mode' is what determines the situation the lekton is relative to. In this framework he provides a detailed account of de se thought and the first person point of view. In the last part of the book, Recanati discusses the special freedom we have, in discourse and thought, to shift the situation of evaluation. He traces that freedom to a special mode - the anaphoric mode - which enables us to go beyond the egocentric stage of pre-human thought. (shrink)

The Resource-Based View (RBV) has been instrumental in shaping strategic management theory by underscoring the significance of a firm's unique, valuable, and hard-to-copy internal resources in securing competitive advantage. However, the conventional RBV framework, with its emphasis on static, possession-oriented resource conceptualization, falls short in addressing the dynamic and relational nature of resources in contemporary business environments. This paper aims to bridge this gap by introducing a processual perspective to the RBV, grounded in process philosophy. In this study, we delve (...) into the philosophical underpinnings of RBV, critiquing its static ontological assumptions and proposing a shift towards a more dynamic and relational ontology. Drawing from the insights of process philosophers such as Whitehead and Bergson, and differentiating between 'strong' and 'weak' process views, we reconceptualize resources not as static entities, but as dynamic elements continually constituted and reconstituted within networks of relationships and ongoing organizational processes. This approach allows for a more nuanced understanding of resources, recognizing their evolutionary and interconnected nature. Our methodology involves a rigorous theoretical analysis and synthesis of existing RBV literature, coupled with philosophical inquiry to construct a novel framework for resource conceptualization. We demonstrate how this reconceptualization offers fresh insights into strategic management, particularly in formulating strategies that leverage the dynamic interplay of resources and in understanding the boundary between internal and external resources. This paper contributes to the RBV literature by offering a process-oriented perspective that aligns more closely with the complexities of modern strategic landscapes. By challenging and extending traditional RBV assumptions, we pave the way for future empirical research and theoretical development in strategic management, highlighting the significance of process philosophy in enriching management theories. This article combines a philosophical critique of the idea that public health nurses are primary technicians who neutrally hand over scientifically established facts on risks to the public and an empirical analysis of the actual work of public health nurses. It is argued that the relationship between facts and values in public health is complex and that, despite the introduction of several scientifically-based standards and guidelines, public health nurses are not technicians. They do moral work and experience ethical dilemmas. To (...) get a grip on the specific character of this moral work, we distance ourselves from the idea that there are ethical dilemmas in public health nursing for which we can provide general ethical rules and principles. Instead we suggest a contextual ethical approach, in which several different kinds of consideration may be important. To illustrate this, we analysed 15 in-depth interviews with nurses involved in the prevention of cot deaths in the Netherlands. It is shown that these nurses do not neutrally pass on the epidemiological facts on the risks of prone sleeping, warm bedclothes and passive smoking, but they are the moral architects of this preventive practice. It is also shown that this moral work and the ethical dilemmas they experience cannot be characterized in terms of general ethical rules and principles. It becomes clear that the moral work of nurses differs according to the three main risks at stake: the balance between virtue, risk taking and responsibility depends on the specific context. According to Aristotle's Doctrine of the Mean, virtue and a good life involve a mean of feeling and action. This chapter focuses on David Pear's claim that the Doctrine is conceptually incoherent. It argues that there are serious difficulties in understanding what it could be for courage and its feelings to be in a mean. Courage involves plural and incommensurable values, victory and danger, and the respective emotions, confidence and fear––it is difficult to see how these can be (...) resolved into a mean. It is argued that this problem can be solved by seeing how incommensurable value and emotions can fuse into complex wholes of disparate and incommensurable values and emotions, and can thus be assessed as lying or not lying in a mean. In several papers, I have argued for a theory of distributive justice and considered its implications. This theory includes a principle of responsibility that was endorsed by others within an account of defensive force (self-defense and defense of others). Whitley Kaufman criticizes this account which he refers to as the "distributive justice theory of self-defense" (DJ theory). In this paper, I respond to this criticism. I argue that Kaufman presents the theory inaccurately, that his standard of evaluation of the (...) theory is inadequate and that his claim that the theory should be rejected is unconvincing. During the past few decades, Quentin Skinner has been one of the most prominent critics of the ideas about negative liberty that have developed out of the writings of Isaiah Berlin. Among Skinner?s principal charges against the contemporary doctrine of negative liberty is the claim that the proponents of that doctrine have overlooked the putative fact that people can be made unfree to refrain from undertaking particular actions. In connection with this matter, Skinner contrasts the present-day theories with (...) the prototypical liberal account of negative freedom propounded by Thomas Hobbes. The present essay challenges Skinner?s position both philosophically and exegetically. Because an agent can always elect to cease his activity as an agent, the ostensible inescapability of certain actions is not the same as the outright inescapability of certain instances of inaction. Once this point is properly recognized, the way is clear for a re-evaluation of Hobbes (and of Skinner on Hobbes). (shrink)

Michel Foucault defines the modern psychiatric hospital as an institution of power that excludes and disciplines those who are deemed immoral, perverse, or abnormal in society. Rather than a facility for healing, as Foucault has taught us, the psychiatric hospital operates more as a punitive method of the body. But what is not considered in Foucault’s historical account of the psychiatric institution are the epistemological preconditions that allowed for its original formation. Drawing on the Kyoto School philosophers’ critique of modernity, (...) this article will discuss how the biomedical model underlying modern psychiatric care is rooted in a prior epistemological duality that was developed even earlier within Western intellectual history—a duality we will call the “epistemology of nihilism.” Foucault’s political technology of the body is therefore a symptom of the epistemology of nihilism, that which leads to consequences beyond mere panoptical surveillance. This article will discuss such consequences, in particular the mechanization of human life derived from the excesses of scientific technology, in the service of introducing a new way of thinking about the limits of psychiatric treatment in today’s world. A group of seven short late Old Babylonian texts, written in Akkadian, found in the early twentieth century in a grave in Susa, form the focus of this paper. The texts, which have attracted much scholarly attention since their publication in 1916 by Jean-Vincent Scheil, have until now not been collated. They are presented here with improved readings, a new translation, and extensive commentary. The mention in two of the texts of an alleged chthonic “weigher” is philologically disproved: psychostasia, the (...) weighing of souls, did not exist in ancient Mesopotamian religion. The suggestion of some scholars that these Old Babylonian Akkadian texts are witnesses to Elamite, or even Iranian, belief in the weighing of souls is methodically refuted. The nature of the seven so-called Susa Funerary Texts is discussed, demonstrating their close contacts to two other well-known Mesopotamian genres—personal prayers and reports of oracular or prophetic visions. Finally, the question of their unusual find spot, viz., in a grave, is discussed and the possibility raised that this peculiar location is a result of the texts’ magical function. (shrink)

The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. The article presents and evaluates the Judgment, particularly the relation between the substantive moral questions involved and the aspect of authorization. (shrink)

For philosophers who would think “with” religion, rather than simply to theorize “about” it, the question of the relationship between religious imagination and philosophical rationality is a matter of constitutive importance. The way we answer this question would have far reaching implications for how we understand the work we do as philosophers who take religion seriously, and how we situate ourselves within broader academic contexts. Indeed, the answer to such a question –insofar as we can give any sort of definitive (...) answer to it –would convey us to the core of what it means for us to “philosophically” appropriate religious and theological materials. We could do worse, I think, than to phrase the question in these terms: do religious imaginaries –representations, narratives, gestures, sacraments, etc. –anticipate a pure, conceptual reflexivity, or do they represent the impossibility of such a standpoint? This question is not only constitutive for philosophical reflection on religion. It is of a more general, formal relevance as well; it effectively raises the additional question as to whether the limits of conceptuality can themselves be conceptually articulated or whether they must be representationally displayed in such a way as to lead thought, obliquely, to an encounter or an experience of its limits. We can distill the question further: does philosophy comprehend religion, or does religion serve to mark the limits of what can be conceptually expressed by philosophy? Is religion the scene of the concept’s satisfaction? Its infinite longing? Or its transcendental frustration? (shrink)

OBJECTIVES: To review the characteristics and performance of research ethics committees in Spain in the evaluation of multicentre clinical trial drug protocols. DESIGN: A prospective study of 100 applications. SETTING: Forty-one committees reviewing clinical trial protocols, involving 50 hospitals in 25 cities. MAIN MEASURES: Protocol-related features, characteristics of research ethics committees and evaluation dynamics. RESULTS: The 100 applications involved 15 protocols (of which 12 were multinational) with 12 drugs. Committees met monthly (except one). They had a mean number (...) of 12 members, requested a mean of six complete dossiers and nine additional copies of the protocol with a mean deadline of 14 days before the meeting. All applications were approved except three (two of the three were open-label long-term safety trials rejected by the same committee), which were approved by the other committees involved. The mean time from submission to approval was 64 days. The mean time from submission to arrival of the approval document at our offices was 85 days. Twenty-five committees raised queries for 38 of the 97 finally approved applications. Impact of evaluation fee, number of members, queries raised and experience of committees on timings were not statistically significant. CONCLUSION: Obtaining ethical approval is time-consuming. There is much diversity in the research ethics committees' performance. A remarkable delay (> 20 days) exists between the decision and the arrival of the written approval, suggesting administrative or organisational problems. (shrink)

The essence of the moral luck question is whether the responsibility of persons is determined only in light of actions that are within their control or also in light of factors, such as the consequences of their actions, which are beyond their control. Most people seem to have contrasting intuitions regarding this question. On the one hand, there is a common intuition that the responsibility of persons should be judged only in light of what is within their control. On the (...) other hand, there is a strong intuition that the consequences of actions sometimes affect the responsibility of agents even when these consequences depend on factors that are beyond their control. A parallel dilemma is present in the law. Legal rules, particularly criminal law rules and tort rules, often differentiate between agents in light of factors that are beyond their control, and in this sense involve legal luck. Of course, factors beyond the control of persons, including the consequences of their actions, can be significant, with respect to the evaluation of the responsibility of persons for instrumental or epistemic reasons. The question is thus only with respect to the independent significance of factors beyond the control of agents, and particularly the consequences of actions, to the evaluation of the (extent of the) responsibility of agents. Benjamin Zipursky offers an interesting argument in order to support the intuition in favor of moral and legal luck, particularly with regard to consequences, especially the rule according to which the punishment of completed offences is more severe than the punishment of attempts and the rule that tort liability applies only to actions that have caused harm. The aim of this Comment is to evaluate this argument. I will try to consider to what extent Zipursky's explanation merely reiterates the familiar intuition that the normative evaluation of the conduct of persons should be influenced by consequential luck, and to what extent it provides new insights that might appeal also to those who are more forcefully drawn to the contrasting intuition that we should judge people only in light of factors that are within their control. I argue that while Zipursky's suggestions might appeal to those who already share the intuition in favor of (consequential) moral and legal luck, they would not convince those who have doubts regarding moral and legal luck. Objectives: To review the performance of research ethics committees in Spain in assessing multicentre clinical trial drug protocols, and to evaluate if they would comply with the requirements of the new EU Directive to be implemented by May 2004.Design and setting: Prospective study of applications of MCT submitted to RECs.Main measurements: Protocol related features and evaluation process dynamics.Results: 187 applications to be performed in 114 centres, were reviewed by 62 RECs. RECs had a median number of 14 members, of (...) which three were lay members. All applications were approved except four which were however approved by the other RECs involved. The median times from submission to approval and from submission to reception at the sponsor’s offices were 48 and 62 days, respectively. In 55% of all applications approved, 41 RECs raised 307 queries, 40% of these were protocol related issues, and 38% related to the patients’ information sheets. RECs charging an evaluation fee in advance and applications with no queries raised were statistically significantly associated with shorter evaluation times. However, there is a gap of at least 1.5 weeks between the date of the meeting and the reception of the approval letter in the sponsor’s office.Conclusions: Evaluating MCT protocols by RECs is a time consuming process. Needing 1.5 weeks for communicating the decision taken by RECs to the sponsor suggests serious administrative shortcomings within most RECs. By significantly reducing the time for communication of their decisions, the majority of RECs would comply with the Directive requirement of a maximum 60 day period for the assessment of MCT. My hypoltheses concerning the United States led War on Terrorism are derived from the German novelist, critic and social theorist Ernst J¸nger’s outstanding 1930 essay on ‘Total Mobilization’. Accordingly, this article explores J¸nger’s ‘Total Mobilization’ and what I label the ‘totally mobilized body’ as the philosophical underpinning of the War on Terrorism from the perspective of my own conceptions of ‘ hypermodern total mobilization’, ‘globalitarian rule’ and the ‘neoconservative body’. From this post-J¸ngerian or hypermodern viewpoint, the examination of the War (...) on Terrorism as offered by social theorists such as Jean Baudrillard and Zygmunt Bauman, Gilles Deleuze, Douglas Kellner and Paul Virilio is analytically evaluated and developed. For their research on the ‘spirit of terrorism’ and the new ‘planetary frontier-land’, control societies, the momentous events of September 11, 2001, and ‘globalitarianism’ can help us to understand the complexities and multiplicities of the neoconservative body. The article concludes by probing the distinction between Jünger’s idea of modern total mobilization and my own hypermodern notions of ‘egalitarian rule’ and the ‘neoegalitarian body’. (shrink)

In all of these definitions the rule or the meta-rule of explosion is abandoned. In this article, I present those definitions and evaluate the role that the negation and the transitivity play in each of them. Finally, I propose a new definition of paraconsistency which I (...) call total paraconsistency and show that the rule of weakening plays a crucial role in all of the characterizations of such a concept. BackgroundChronic airway diseases are prevalent and costly conditions. Interdisciplinary rehabilitation programs that include Acceptance and Commitment-based components could be important to tackle the vicious circle linking progression of the disease, inactivity, and psychopathological symptoms.MethodsA retrospective evaluation of routinely collected data of an interdisciplinary rehabilitation program was performed. The program included group sessions including patient education, breathing exercise, occupational therapy and an ACT-based psychological treatment, and individual sessions of physical therapy. Demographic data, clinical characteristics of the patients and the values (...) of outcome variables before treatment, at discharge, at 3 months, and at 6 months were extracted from medical records. Multiple imputation was employed to address missing data. Linear mixed models were employed to assess changes over time. Multivariable logistic regression was performed to assess predictors of a minimum clinically important change of health status from baseline to the 6-months follow-up.ResultsData from 31 patients with chronic obstructive pulmonary disease and 12 patients with bronchiectasis were extracted. Health status improved from baseline to discharge to the 3 months follow-up, but not to the 6 months follow-up. Anxiety and depression improved across all the time points. Quality of life did not improve over time. Having a worse health status at baseline and fewer depressive symptoms were significantly associated with achieving a minimum clinically important change of health status at 6 months. The effects of the interdisciplinary program were not different for patients with COPD or with bronchiectasis.DiscussionInterdisciplinary programs including ACT-based components are promising treatments for the rehabilitation of patients with chronic airway diseases. Our recent paper reported that 43% of reviewer comment sets shared with authors contained at least one unprofessional comment or an incomplete, inaccurate of unsubstantiated critique. Publication of this work sparked an online conversation surrounding professionalism in peer review. We collected and analyzed these social media comments as they offered real-time responses to our work and provided insight into the views held by commenters and potential peer-reviewers that would be difficult to quantify using existing empirical tools. Overall, 75% of comments (...) were positive, of which 59% were supportive and 16% shared similar personal experiences. However, a subset of negative comments emerged, that provided potential insight into the reasons underlying unprofessional comments were made during the peer-review process. These comments were classified into three main themes: forced niceness will adversely impact the peer-review process and allow for publication of poor-quality science ; dismissing comments as not offensive to another person because they were not deemed personally offensive to the reader ; and authors brought unprofessional comments upon themselves as they submitted substandard work. Here, we argue against these themes as justifications for directing unprofessional comments towards authors during the peer review process. We argue that it is possible to be both critical and professional, and that no author deserves to be the recipient of demeaning ad hominem attacks regardless of supposed provocation. Suggesting otherwise only serves to propagate a toxic culture within peer review. While we previously postulated that establishing a peer-reviewer code of conduct could help improve the peer-review system, we now posit that priority should be given to repairing the negative cultural zeitgeist that exists in peer-review. The article examines the doctrine of thing in the “Metaphysics” created in the early 1330s by an original Franciscan theologian and philosopher Nicholas Bonetus. The article points to the historical-philosophical significance of this work. In the scholastic tradition, Bonetus’s “Metaphysics’ is argued to be one of the first large and independent treatises on metaphysics, i.e. it is not related to the tradition of commenting on Aristotle. It is also the first treatise in the history of philosophy under the title (...) “Metaphysics”, named so by the author himself. First, we present the biography of the author of the treatise and briefly characterize the structure of his four-part “Opus philosophicum”, as well as emphasize the importance of the division between metaphysics and natural theology, for the first time in the history of the scholastic tradition not only declared as a project, but also im­plemented by Bonetus. Secondly, we examine the place that book III of the “Meta­physics” occupies in Bonetus’s entire metaphysical treatise, and determine the two main themes of this book: the doctrine of res and the doctrine on distinctions and identities. Thirdly, through the analysis of the Ist and IIIrd books of “Metaphysics” we demonstrate the connection, opposition and partial coincidence of two fundamental concepts of Bone­tus's metaphysics: the concept of being as being and the concept of thing. Additionally, the leading meaning of the concept of a thing as a simul totum, that is, a single “consti­tuted whole” from metaphysical elements (formalities, quidditative and individual differ­encies, intrinsic modes, properties), is clarified. Finally, we analyze the relationship be­tween the doctrine of res and the doctrine on distinctions in Bonetus and explain how the doctrine of real and formal distinction and identity is subordinated to the goal of ana­lytics of the metaphysical “constitution of res” and is built into the treatise on the thing. This, in turn, allows us to conclude that the main difference between the “formalist trea­tise” on distinctions and identities (and this is exactly how the content of the IIIrd book of Bonetus’s “Metaphysics” was perceived in the subsequent Scotist tradition), in com­parison with the corresponding treatises of Francis of Meyronnes and Peter Thomae, is precisely the role of the ontological concept of a thing as a “metaphysical whole” or in­dividual in Bonetus that determines his understanding of “formalities”. The article deals with the criteria upon which the powers of the Seimas (the Parliament of the Republic of Lithuania) and the Government are delimited in the constitutional jurisprudence of Lithuania. It analyses how the Constitutional Court construes the principle of separation of powers as entrenched in the Constitution and evaluates the meaning of the provision of the Constitution that corresponding ‘relations are regulated by law’. If the Constitution provides that certain relations are regulated by means of a law, such (...) relations may be regulated only by means of a legal act, which takes the form of a law, and it is, therefore, not permissible to regulate such relations by Government resolutions or other acts of the executive. The most important elements of legal relations must be regulated (established) by means of a law, whereas Government resolutions might establish the procedure for the implementation of such laws. Rulings of the Constitutional Court reveal that once the powers of a specific branch of state power have been directly established in the Constitution, an institution of state power may not assume the said powers fr om another state institution. It may not transfer or waive them; and such powers may not be amended or limited by means of a law. The question remains, whether the provision of the Law on the Diplomatic Service wh ereby the candidacy of a diplomatic representative must be reviewed by the Seimas Committee on Foreign Affairs in advance is not in conflict with the Constitution. Despite worldwide efforts to reduce the consumption of tobacco, legislative and educational measures have failed to eradicate the practice of cigarette smoking. Indeed, in many populations, particularly in the developing world, its prevalence is increasing. Consequently were alternative strategies to become available to address the problem, they would deserve serious consideration. One potential strategy which may become a real possibility in the future might be the vaccination of children against the pleasurable effects of nicotine. Were such a vaccine to become (...) available, children who had been inoculated would be less likely to start smoking, and even if they did, would be able to quit more easily. However, as Hasman and Holm discussed, vaccinating against a behavior rather than a disease is not ethically unproblematic, and they concluded that inoculation of infants and young children with a permanently effective nicotine conjugate vaccine should not take place, as it robbed children of the right to a smoking future. In this article, I will re-evaluate some of their arguments, and will conclude that in fact the private and public goods that inoculation with a ‘smoking vaccine’ would produce, outweigh the possible impingements on future autonomy that may result from such vaccination programme. This paper offers an account of Nietzsche's re-evaluation of values that seeks to satisfy two desiderata, both important if Nietzsche's project is to stand a chance of success. The first is that Nietzsche's re-evaluations must be capable of being understood as authoritative by those whose values are subject to re-evaluation. The second is that Nietzsche's project must not falsify the values being re-evaluated, by, for example, misrepresenting intrinsic values as instrumental values. Given this, five possible forms of re- (...) class='Hi'>evaluation are distinguished, and, of these, four are argued both to satisfy the specified desiderata and to feature more or less prominently in Nietzsche's later work. The conclusion of the paper is therefore that Nietzsche's project has at least the right general shape to succeed, and that the reasons for this depend upon acknowledging the importance of the desiderata and of the distinctions to which the paper draws attention.
