Pain, suffering and positive emotions in patients in vegetative state/unresponsive wakefulness syndrome (VS/UWS) and minimally conscious states (MCS) pose clinical and ethical challenges. Clinically, we evaluate behavioural responses after painful stimulation and also emotionally-contingent behaviours (e.g., smiling). Using stimuli with emotional valence, neuroimaging and electrophysiology technologies can detect subclinical remnants of preserved capacities for pain which might influence decisions about treatment limitation. To date, no data exist as to how healthcare providers think about end-of-life options (e.g., withdrawal of artificial nutrition (...) and hydration) in the presence or absence of pain in non-communicative patients. Here, we aimed to better clarify this issue by re-analyzing previously published data on pain perception (Prog Brain Res 2009 177, 329–38) and end-of-life decisions (J Neurol 2010 258, 1058–65) in patients with disorders of consciousness. In a sample of 2259 European healthcare professionals we found that, for VS/UWS more respondents agreed with treatment withdrawal when they considered that VS/UWS patients did not feel pain (77%) as compared to those who thought VS/UWS did feel pain (59%). This interaction was influenced by religiosity and professional background. For MCS, end-of-life attitudes were not influenced by opinions on pain perception. Within a contemporary ethical context we discuss (1) the evolving scientific understandings of pain perception and their relationship to existing clinical and ethical guidelines; (2) the discrepancies of attitudes within (and between) healthcare providers and their consequences for treatment approaches, and (3) the implicit but complex relationship between pain perception and attitudes toward life-sustaining treatments. One central claim is that, in principle, Rawlsians should consider not only generational dissavings, but also generational savings, as unfair. Should the foreign debt of the world’s poorest countries be cancelled? In this essay, I am concerned with whether a generational perspective makes a difference in answering this question. I will show that it does, and that alternative accounts of repayment obligations are possible. I argue that a distributive theory of justice is not only appropriate to address the challenges to justice raised by long-term sovereign indebtedness, but that it is also superior to the solution offered by the odious debt (...) doctrine.Unlike the odious debt doctrine, a distributive view is capable of taking intoaccount the separateness of generations. More specifically, I also argue thatthe need to preserve creditors’ incentives to lend to the poor in order toensure that the latter keep having access to credit for important development purposes requires the adoption of a narrow, problem-specific view, which focuses on the distributive impact of the loan transaction, rather than a broad distributive view, which looks at the general distributive situation of the two descendent communities. Melinda A. Roberts. Lanham, Md.: Rowman & Littlefield, 1998. Pp. 235. ISBN 0-8476-8901-8 (Paperback) This book will provide the reader with a systematic examination of some of the most difficult (...) philosophical issues involved in procreation, and most notably those raised by wrongful life claims and the non-identity problem. Can an action without which a given child would not even exist be simultaneously said to harm this very child? This is the key question addressed in this book. It is relevant not only to bioethicists, but also to those concerned with the possibility of harming members of future generations in general. The author proceeds with remarkable clarity in three steps. First, she unveils the core intuition and unfolds the key implications of what is standardly referred to as the person-affecting view. Second, she focuses on the now famous non-identity problem that is supposed to raise a serious challenge to the plausibility of the person-affecting view. Third, wrongful life and human cloning are taken as illustrations of the problem.The starting point is thus the person-affecting or personalist view. The author argues that what is at stake in such a view is not only a concern for [End Page 114] persons (as opposed to plants or stones), but also for definite persons. The core intuition that "what is bad must be bad for someone" (Derek Parfit) implies a comparison between two states of the same person. As she puts it, "the pairwise comparisons of worlds appealed to within personalism are always in respect of particular people" (6). This does not necessarily imply consequentialism, contrary to what Roberts claims (e.g., 1), at least if we understand the latter, for example, as Philip Pettit does. 1 Moreover, one may very well argue that what is at the heart of the person-affecting intuition is a sense that an action needs to be assessed on the basis of its effect on persons, which would not necessarily imply that such effects require a comparison between two states of the same person. Nevertheless, the extent to which a person-affecting conception--as defined by Roberts--will be in trouble depends on the extent to which comparisons between the same person's states cannot operate. This is precisely where to introduce the idea of a non-identity context, that is, a situation in which not committing an allegedly harmful act would or could also have meant the nonexistence of the allegedly harmed person. For example, had a medical doctor not committed this preconceptional diagnostic mistake (or a father taken a slower or faster means of transportation to come back home), this child would or could not have existed. Can we thus say that the practitioner harmed the child who turned out to be heavily handicapped due, for example, to a genetically transmissible disease (or that the father harmed his child by leaving him with a very polluted environment due to his use of big cars as a means of transportation)?One key feature of Roberts's approach is that she restricts the scope of the non-identity problem to cases where not committing the allegedly harmful action would have made it impossible for this child to have existed ("two-alternative" cases) (26, 319, 325). This entails that whenever this very child could still have come to existence in the allegedly harmful action's absence, whatever the likelihood of such a coming to existence, we would fall outside a non-identity context ("three-alternative" cases) (27; 94-95). What matters to Roberts is whether or not the same child could have been born better than he is, not whether he would, as a matter of fact, have been born at all. Should the current members of a community compensate the victims of their ancestor’s emissions of greenhouse gases? I argue that the previous generation of polluters may not have been morally responsible for the harms they caused.I also accept the view that the polluters’ descendants cannot be morally responsible for their ancestor’s harmful emissions. However, I show that, while granting this, a suitably defined notion of moral free-riding may still account for the moral obligation of the polluters’ descendants to compensate the (...) current victims of their ancestors’ actions. A concept of transgenerational free-riding is defined. Objections to the idea of using free-riding as part of a theory of justice are rejected. Two different views of moral free-riding are contrasted, with consequences for the amount of compensation to be exigible from the polluters’ descendants. Some final considerations are devoted to the possible relevance of this free-riding-based view for other issues of historical injustice. (shrink)

The first debate in this article has to do with the very possibility of intergenerational justice beyond our obligations towards members of other generations while they coexist with us. Here, we ask ourselves whether we owe anything to people who either have died already, or are not yet born. Differences in temporal location mean that people may not exist at the same time — be it only during part of their life — which raises special ethical challenges. It is one (...) thing to decide whether we owe anything to the next generation(s). It is another to define what we owe them. Most standard theories of justice have tried to answer this difficult question. This article focuses on a comparison between a reciprocity-based and an egalitarian account of justice between generations. It then turns, on the one hand, to a brief discussion of alternative theories and, on the other hand, to implementation issues. (shrink)

This chapter explores the specificities, strengths, and weaknesses of the idea of reciprocity as a basis for intergenerational obligations. Three models are presented: descending, ascending, and double reciprocity. Each of these three models is tested against three objections. The first objection asks why having received something from someone would necessarily entail the obligation to give back. The second objection questions the ability of each model to justify the direction of reciprocation. A final objection looks at the extent to which reciprocity-based (...) views adjust the content of our obligation to the fluctuations in population size. (shrink)

Evidence provided by the scientific community strongly suggests that limits should be placed on greenhouse gas emissions. This means that states, firms, and individuals will have to face potentially serious burdens if they are to implement these limits. Which principles of justice should guide a global regime aimed at reducing greenhouse gas emissions originating from human activities, and most notably from CO2emissions? This is both a crucial and difficult question. Admittedly, perhaps this question is too ambitious, given the uncertainties and (...) complexities characterizing the issue of climate change. Yet, rather than listing them all at this stage, let us address the question in a straightforward manner, introducing some of these complexities as the need arises. (shrink)

Understanding loss of consciousness after brain injury poses a practical test for the field of consciousness research, with both clinical and ethical implications. We here discuss three major pathological disorders of consciousness; coma, the unresponsive wakefulness syndrome and the minimally conscious state, which together represent a lesion model for the investigation of human awareness. We review the anatomical and neurophysiological correlates of each condition, and discuss the current findings in context of several theoretical frameworks of consciousness.

La présente contribution vise à offrir au lecteur une présentation de la doctrine suffisantiste de la justice, de ses justifications générales et spécifiques et de son articulation possible avec d’autres théories de la justice. Elle explore certains aspects plus particuliers tels que la place de la responsabilité en son sein, son applicabilité au domaine intergénérationnel ou son positionnement par rapport à la question des « vies-complètes ». In this paper, the author offers a synoptic view of different theories of intergenerational justice, along two dimensions (savings/dissavings) and three modalities (prohibition, authorisation, obligation). After presenting successively the indirect reciprocity, the mutual advantage, the utilitarian and the Lockean approaches, special attention is given to the egalitarian theory of intergenerational justice. Two key differences between the egalitarian view on intergenerational justice and the sufficientarian interpretation of sustainability are highlighted.

What should maximin egalitarians think about seniority privileges? We contrast a good-specific and an all-things-considered perspective. As to the former, inertia and erasing effects of a seniority-based allocation of benefits from employment are identified, allowing us to spot the categories of workers and job-seekers made involuntarily worse off by such a practice. What matters however is to find out whether abolishing seniority privileges will bring about a society in which the all-things-considered worst off people are better off than in the (...) seniority rule's presence. An assessment of the latter's cost-reduction potential is thus needed, enabling us to bridge a practice taking place within a firm with its impact on who the least well off members of society are likely to be. Three accounts of the profitability of seniority privileges are discussed: the “(firm specific) human capital”, the “deferred compensation” and the “knowledge transfer” ones. The respective relevance of “good-specific” and “all-things-considered” analysis is discussed. It turns out that under certain circumstances, a maximin egalitarian case for seniority privileges could be made. Senior: Do you know that they are planning layoffs? Of course, it is only fair that they lay-off the newcomers first! After all, I have been loyal to the company for many years. Junior: Did I choose to be a newcomer? This paper addresses the question “what connection is there between our answer to the question of what we are, and the question, what our actions are?” Suppose that actions are reflexive changes of agents. On that supposition, there would be a direct connection between the answers to those two questions. An action of mine will be a reflexive change of me, and what I am will fix the nature of those changes. I hold that supposition to be true and consider (...) reasons in favor of believing it. However, the paper is not primarily aimed at defense of that thesis. It rather concerned with exploring what consequences accepting it has for the competing notions of what we are, given what we ordinarily think actions are, and bringing to light a tension between thinking of actions as reflexive changes of agents in this way, and a kind of causal understanding of actions that is prevalent. What emerges is that we should shift where we start our theorizing: we cannot assume that action theory primarily involves the task of characterizing the relation between an agent and changes caused, rather than a characterization of a particular kind of relation between the agent and herself. This paper advances the thesis that sensory concepts have as a semantic component the first-person indexical. It is argued that the private nature of our access to our own sensations forces, in our talking about them, an indexical reference to the inner states of the speaker in lieu of publicly accessible properties by which reference is usually fixed. Indexicals, such as ‘here’, can be understood despite ignorance of their referent. Such is the case with sensory terms. Furthermore, the thesis that (...) sensory terms are indexical has considerable explanatory power. I give two examples: firstly, I argue that clashes of intuition over Block's ‘inverted spectrum’ thought experiment can be explained by appeal to semantic properties of indexicals. Secondly, I argue that multiple realisability intuitions can be shown to be consistent with the view that sensations are type-identical with brain states. (shrink)

_Purpose._ This article discusses researching the nature and basic structure of acts of empathy. Such research first requires answering the question: are empathic acts intentional acts of our consciousness? If the answer to this question is affirmative, then there is a need to answer the following questions: what are the features of acts of empathy as intentional ones? And can such acts be qualified as opening a special and complex type of access (epistemic, social, and ethical) to "other minds"? _Theoretical (...) basis._ The research is based on the problems set by the phenomenological tradition and the developed analytical philosophy, which found their continuation in the philosophy of mind. With the tendency to naturalization, representatives of these areas have another common sphere in the research of mental reality. The changes that both traditions are undergoing can be observed in the transformation of fundamental theoretical concepts such as "intentionality". The linguistic turn gives impetus to the development of new theoretical approaches to the understanding of consciousness, which give preference to the research of language rather than the research in the structure of the Self. The change in methodological guidelines is due to a few factors. In particular, this is a noticeable progress in empirical sciences and the dominance of Behaviorism guidelines in psychology, as well as the fact that the Anglo-American tradition inherits several features intrinsic to British empiricism. Today, three main directions of understanding intentionality can be distinguished. Starting from Brentano and Husserl, we have a classical theory – mental intentionality (phenomenological). As part of analytical philosophy and philosophy of language, we can talk about linguistically interpreted intentionality. Sellars’ model of intentionality has a definite linguistic component. Also, a modern version that functions in the philosophy of consciousness: attempts to naturalize intentionality (this is, for example, the research of Galen Strawson and Daniel Dennett). _Originality._ The problem is studied not in the context of the phenomenological or analytical traditions in their isolation, but in a problematic-conceptual way, which allows us to reach a new level of generalization and reveal the theoretical advantages of combining both traditions. _Conclusions._ Empathic Acts can be defined as intentional within the classical phenomenological tradition. As intentional acts, they have their specificity in that they are directed to the "other mind" and can form the basis for the research of intersubjectivity. For the analytic tradition and early philosophy of consciousness, such statements are not obvious. However, discussions about the role of corporality and the problem concerning embodied cognition are becoming increasingly common today. In such discussions, empathy, as an element in the knowledge of others and a possibility for grounding the social sciences, seems more promising than attempts to make epistemic access to other minds possible on the basis of the argument by analogy or on the basis of the inference to the best explanation.
