Are human rights negotiable? Jacques Derrida argued that it is necessary to negotiate the nonnegotiable to save the nonnegotiable. This paper defends this claim while arguing for what Calvin Schrag called an ethics of the fitting response and finding such a response in Amartya Sen’s realization-focused comparative approach to justice. For Derrida, the aporetic character of urgency produces decisions which must be made outside the institutional limits of decision theory. That calls for a deconstruction of the axiomatics of rights in (...) institutional settings. It also makes urgent the need for a deinstitutionalized ethics undeceived by the challenge of making judgments in aporias. Using Ted Honderich’s humanism as counterfoil, the argument moves through Derrida’s concept of "contradictory coherence" to Schrag’s transverse rationality, which thinks with deconstruction in order to think against its negative outcomes. The paper ends by suggesting that Schrag's communicative praxeology forges an ethics compatible with Sen’s threshold conditions to determine rights through freedoms. (shrink)

The twelve essays in this collection promote scholarship on the rich and diverse subject of mysticism by examining the nature of its thought both from Eastern and Western and from philosophical and religious perspectives. These include studies of specific mystics, including Teresa de Avila, Lady Nijo, Hiroshi Motoyama, and Mirabai, and thinkers about mysticism, including Kant, Nietzsche, and Wittgenstein. The book concludes with two essays that look broadly at the supersensible, one from an examination of Kantian aesthetics and the other from quantum mechanical interpretations of reality. Martin Heidegger devotes extensive discussion to medieval philosophers, particularly to their treatment of Truth and Being. On both these topics, Heidegger accuses them of forgetting the question of Being and of being responsible for subjugating truth to the modern crusade for certainty: ‘truth is denied its own mode of being’ and is subordinated ‘to an intellect that judges correctly’. Though there are some studies that discuss Heidegger’s debt to and criticism of medieval thought, particularly that of Thomas Aquinas, there is (...) no constructive reply to his assertions. As a result, Heidegger’s critique had an unprecedented effect on the credibility of medieval philosophy, whereby great portions of the philosophical community dismiss it altogether as an illegitimate Onto‐Theology. It is the aim of this study to offer a constructive reply that will fundamentally grapple with these allegations. By constructive reply we mean not only a reply that avoids the problems Heidegger raises regarding existence, essence and truth, but more importantly, one that uses Heidegger’s criticism in order to present a more insightful account of these notions. The present study is composed of two parts where the second serves as a sort of addendum. The first part, the core of this study, is an attempt to develop an understanding of the distinction between essence and existence that, on the one hand, accords with Heidegger’s criticism while on the other hand advances our understanding of how we think and understand reality. After presenting Heidegger’s depiction of Aquinas’s distinction between essence and existence (esse) as a real distinction, the study will present several views propounded by scholars of Aquinas regarding the status of this distinction. It will be argued that it is not clear whether the distinction is real, formal or conceptual, and that different types of distinction are applied in different places, particularly in regard to the phantasm that Aquinas considers essential to the human act of thinking. The second part diverges from the first part and focuses on Heidegger’s criticism of Aquinas’s conception of truth as adequation, i.e., what it is that grounds the possibility of truth as adequation. This divergence is necessary in order to present a full metaphysical response to Heidegger’s criticism. Since the aim of the present study is to argue that Aquinas’s philosophical system can contend with Heidegger’s criticism, a partial reply would greatly diminish its effectiveness. (shrink)

It is widely thought that chance should be understood in reductionist terms: claims about chance should be understood as claims that certain patterns of events are instantiated. There are many possible reductionist theories of chance, differing as to which possible pattern of events they take to be chance-making. It is also widely taken to be a norm of rationality that credence should defer to chance: special cases aside, rationality requires that one's credence function, when conditionalized on the chance-making facts, should (...) coincide with the objective chance function. It is a shortcoming of a theory of chance if implies that this norm of rationality is unsatisfiable. The primary goal of this paper is to show, on the basis of considerations concerning computability and inductive learning, that this shortcoming is more common than one would have hoped. (shrink)

Genocide in Rwanda, multiple murder at Denver or Dunblane, the gruesome activities of serial killers - what makes these great evils, and why do they occur? In addressing such questions this book, unusually, interconnects contemporary moral philosophy with recent work in New Testament scholarship. The conclusions to emerge are surprising. One of the most basic questions an ontology can address is: How many things, or substances, are there? A monist will say, ‘just one’. But there are different stripes of monism, and where the borders between these different views lie rests on the question, ‘To what does this “oneness” apply?’ Some monists apply ‘oneness’ to existence. Others apply ‘oneness’ to types. Determining whether a philosopher is a monist and deciphering what this is supposed to mean is no easy task, especially (...) when it comes to those writing in the early modern period because many philosophers of the sixteenth, seventeenth, and eighteenth centuries include God in their ontologies. InThe Principles,Anne Finch Conway offers an ontology that is often described as being both ‘vitalist’ and ‘monist’. I take this to mean that, for Conway, all that exists is in some way alive and that if asked ‘How many things, or substances, are there?’ Conway would say, ‘Just one’. But to what does this ‘oneness’ apply? And where does the point of disagreement between Conway and her interlocutors, Hobbes, Spinoza, More, and Descartes lie? In this paper, I argue that determining the answer to this first question turns out to be quite difficult. Nevertheless, we can still make sense of the second. (shrink)

I examine issues in the philosophy of religion at the intersection of what possibilities there are and what a God, as classically conceived in the theistic philosophical tradition, would be able to do. The discussion is centered around arguing for an incompatibility between theism and two principles about possibility and ability, and exploring what theists should say about these incompatibilities. -/- I argue that theism entails that certain kinds and amounts of evil are impossible. This puts theism in conflict with (...) popular principles of modal recombination. However, theists have plausible explanations for the violations of recombination that they posit, and can suitably amend these principles without giving up their usefulness in accounting for what possibilities there are. -/- I also argue that despite the impossibility of these evils, God is able to bring these evils about. This puts theism in conflict with the principle that no one is able to do the impossible. However, theists can give a plausible account of why God is unique in being able to do the impossible, and have distinctive resources to address the arguments in favor of the idea that no one is able to do the impossible. And by denying this principle, theists are able to resolve several otherwise difficult puzzles, including reconciling conflicts between the divine attributes. (shrink)

In order to make sense of Scotus’s claim that rationality is perfected only by the will, a Scotistic doctrine of truth is developed in a speculative way. It is claimed that synthetic a priori truths are truths of the will, which are existential truths. This insight holds profound theological implications and is used on the one hand to criticize Kant's conception of existence, and on the other hand, to offer another explanation of the sense according to which the existence of (...) things is grasped. In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

ABSTRACT This essay is a critical study of Jason Brennan's Against Democracy. We make three main points. First, we argue that Brennan's proposal of a right to competent government only works if one considers the absence of government a viable proposition, something most of his opponents are not prepared to do. Second, we suggest that Brennan's account of competent decision-making is blind to forms of oligarchic power that work against the very ideals of justice and epistemic virtue that competence is (...) meant to safeguard. Third, we muster empirical evidence to argue that, in the real world, democracy is not just about making decisions and selecting policies, in which case Brennan's argument misses its mark. (shrink)

Four years after the Panama Papers scandal, tax avoidance remains an urgent moral-political problem. Moving beyond both the academic and policy mainstream, I advocate the “democratization of tax enforcement,” by which I mean systematic efforts to make tax avoiders accountable to the judgment of ordinary citizens. Both individual oligarchs and multinational corporations have access to sophisticated tax avoidance strategies that impose significant fiscal costs on democracies and exacerbate preexisting distributive and political inequalities. Yet much contemporary tax sheltering occurs within the (...) letter of the law, rendering criminal sanctions ineffective. In response, I argue for the creation of Citizen Tax Juries, deliberative minipublics empowered to scrutinize tax avoiders, demand accountability, and facilitate concrete reforms. This proposal thus responds to the wider aspiration, within contemporary democratic theory, to secure more popular control over essential economic processes. (shrink)

This essay identifies ‘oligarchic harm’ as a dire threat confronting contemporary democracies. I provide a formal standard for classifying oligarchs: those who use personal access to concentrated wealth to pursue harmful forms of discretionary influence. I then use Aristotle to think through both the moral and the epistemic dilemmas of oligarchic harm, highlighting Aristotle’s concerns about the difficulties of using wealth as a ‘proxy’ for virtue. While Aristotle’s thought provides great resources for diagnosing oligarchic threats, it proves less useful as (...) a guide to democratic institutional design. Aristotle raises a deep-seated objection to democratic forms of ‘rule by the poor.’ A successful response to oligarchy must move beyond Aristotle’s objection and affirm the demos’ tripartite status as many, free, and poor. I briefly outline the terms of this ‘new’ mixed regime: one that seeks to tame oligarchy through a mixture of aggregative, deliberative, and plebeian institutions. (shrink)

This article tackles the issue of offshore tax sheltering from the perspective of normative political realism. Tax sheltering is a pressing contemporary policy challenge, with hundreds of billions in private assets protected in offshore trusts and shell companies. Indeed, tax sheltering produces a variety of empirical dilemmas that render it a distinctive challenge for global governance. Therefore, it is crucial for normative political theorists to confront this problem. A realist approach offers three distinct advantages, elaborated in the three subsequent sections (...) of the article. First, it relaxes the theoretical burden by starting from the real practice of tax evasion rather than from an abstract theory of equality or justice. Second, this approach recognizes that sheltering is a political harm: a threat to the very maintenance of order, not just a problem of inequality or injustice. If politicians fail at such polity maintenance, realism's ethic of responsibility provides clear political reasons why they should be held accountable. Third, realism's focus on power and its acceptance of coercion open up new strategies for addressing the problem that would not be allowed by theories with a stronger emphasis on consensus. (shrink)

Under so-called primitive ontology approaches, in fully describing the history of a quantum system, one thereby attributes interesting properties to regions of spacetime. Primitive ontology approaches, which include some varieties of Bohmian mechanics and spontaneous collapse theories, are interesting in part because they hold out the hope that it should not be too difficult to make a connection between models of quantum mechanics and descriptions of histories of ordinary macroscopic bodies. But such approaches are dualistic, positing a quantum state as (...) well as ordinary material degrees of freedom. This paper is concerned with the relation between two notions: that of two solutions or models of a theory being related by a symmetry of the theory and that of solutions or models being physically equivalent. A number of authors have recently discussed this relation, some taking an optimistic view, on which there is a suitable concept of the symmetry of a theory relative to which these two notions coincide, others taking a pessimistic view, on which there is no such (...) concept. An analytic cognitive style denotes a propensity to set aside highly salient intuitions when engaging in problem solving. We assess the hypothesis that an analytic cognitive style is associated with a history of questioning, altering, and rejecting supernatural claims, both religious and paranormal. In two studies, we examined associations of God beliefs, religious engagement, conventional religious beliefs and paranormal beliefs with performance measures of cognitive ability and analytic cognitive style. An analytic cognitive style negatively predicted both religious and paranormal beliefs (...) when controlling for cognitive ability as well as religious engagement, sex, age, political ideology, and education. Participants more willing to engage in analytic reasoning were less likely to endorse supernatural beliefs. Further, an association between analytic cognitive style and religious engagement was mediated by religious beliefs, suggesting that an analytic cognitive style negatively affects religious engagement via lower acceptance of conventional religious beliefs. Results for types of God belief indicate that the association between an analytic cognitive style and God beliefs is more nuanced than mere acceptance and rejection, but also includes adopting less conventional God beliefs, such as Pantheism or Deism. Our data are consistent with the idea that two people who share the same cognitive ability, education, political ideology, sex, age and level of religious engagement can acquire very different sets of beliefs about the world if they differ in their propensity to think analytically. However, since truth is a transcendental, and as transcendentals are convertible, one may claim that the transcendental systems that apply to various beings differ.
