Este artigo propõe uma leitura conjunta de Facticidade e validade, de Jürgen Habermas, e Crítica dos direitos, de Christoph Menke. Mais do que identificar os regimes de continuidade e ruptura que este texto estabelece em relação àquele, trata-se de compreender o modo como Menke pensa poder corrigir a teria do discurso introduzindo, a um só tempo, uma ontologia do direito e dos direitos subjetivos modernos, e uma reflexão materialista sobre o não-direito. Para tanto, é preciso elucidar duas questões centrais. Em (...) primeiro lugar, deve-se evidenciar as diferenças de abordagem entre Habermas e Menke quanto à reconstrução histórica do sistema de direitos. Em segundo lugar, deve-se elucidar as diferentes concepções de autorreflexão do direito com as quais trabalham os dois autores. Of Grammatology's ‘Exergue’ contemplates the closure of an historico-metaphysical epoch, that of logocentrism. The notion of ‘epochality’ cannot be reduced to the idea of a ‘period of time’ or a ‘system of chronology’. Reading Martin Heidegger's ‘epochs of Being’ and Carl Schmitt's ‘nomos of the Earth’, I argue that logocentrism has a fundamental colonial character. Derrida is concerned with a space ordering, a land-appropriation process on the verge of becoming global. Logocentrism is always a logonomocentrism.

A estrutura argumentativa deste artigo pode ser resumida no seguinte raciocínio: 1) Espinosa foi recorrentemente acusado de eleatismo; 2) há ruptura com o eleatismo quando se admite a multivocidade dos operadores lógicos “é” e “não é”; como se vê, por exemplo, 2.1) na discussão que introduz os Grandes Gêneros no So sta de Platão, e 2.2) em certo uso que Aristóteles faz da doutrina das categorias para exibilizar a versão parmenídica do Princípio de Não-Contradição. 3) Espinosa admite a multivocidade do (...) “é” e do “não-é”. Logo, Espinosa não deve ser colocado entre os eleatas mas sim na irmandade dos suspeitos do chamado parricídio contra Parmênides. Este raciocínio, quase um truísmo, permitirá, não obstante, duas apreciações interessantes: uma acerca de como certa tradição interpretativa da loso a de Espinosa colocou mal o problema da relação da ontologia espinosana com os princípios lógicos; outra acerca do tipo de lógica subjacente à teoria dos modos de percepção ou gêneros de conhecimento. The Simple Counterfactual Analysis (SCA) was once considered the most promising analysis of disposition ascriptions. According to SCA, disposition ascriptions are to be analyzed in terms of counterfactual conditionals. In the last few decades, however, SCA has become the target of a battery of counterexamples. In all counterexamples, something seems to be interfering with a certain object’s having or not having a certain disposition thus making the truth-values of the disposition ascription and of its associated counterfactual come apart. Intuitively, however, (...) it would seem that, if all interferences were absent, the disposition ascription and its associated conditional would have the same truth-value. Although this idea may seem obvious, it is far from obvious how to implement it. In fact, it has become widely assumed that the content of qualifying ceteris paribus clauses (such as ‘if all interferences were absent’) cannot be specified in a clear and non-circular manner. In this paper, I will argue that this assumption is wrong. I will develop an analysis of disposition ascriptions, the Interference-Free Counterfactual Analysis, which relies on a clear and non-circular definition of the notion of interference and avoids the standard counterexamples to SCA while vindicating the intuition that disposition ascriptions and counterfactual conditionals are intimately related. The main objective of this article is to analyze the conceptual connection between the Doctrine of Children’s Education, briefly mentioned in Spinoza’s Tractatus de Intellectus Emendatione, and the concept of emendation present at the very center of this Treatise’s title. A close textual exegesis of the opening paragraphs of TIE reveals why such a doctrine cannot be the ascetic renunciation of the content of ordinary life. We shall see instead that a new institution of life shall be possible only through (...) a deep plunge into the understanding of ordinary confused life. A Spinozan Doctrine of Children’s Education shall then be conceived as a pedagogy guided by an error mapping principle, i.e., a pedagogy capable of amending the mistaken beliefs of students through their understanding of the way these are produced as real events in the world. This would be an immanent pedagogy, which could be relevant to any form of contemporary thought that seeks a truly liberating education. (shrink)

This discussion of pride, shame, and guilt centers on the beliefs involved in the experience of any of these emotions. Through a detailed study, the author demonstrates how these beliefs are alike--in that they are all directed towards the self--and how they differ. The experience of these three emotions are illustrated by examples taken from English literature. Seguindo de perto a caracterização que Robert Blanché faz da lógica dos modernos em seu livro História da Lógica de Aristóteles a Bertrand Russell, pretendo mostrar como as Regulae de Descartes instanciam paradigmaticamente algumas das principais características das lógicas reformadas, típicas desse momento histórico. O próprio Blanché oferece vários exemplos do pertencimento de Descartes a esse contexto. De minha parte, pretendo contribuir com a discussão realizando um exame mais detalhado da parte final da Regra X, na qual desponta, já nesta (...) que é uma das primeiras obras de Descartes, certa noção de atividade mental, que está em relação tanto com as críticas cartesianas às matemáticas, no Discurso do Método, quanto com o argumento do cogito, nas Meditações. The argumentative structure of this article can be summarized as follows: 1) Spinoza was repeatedly accused of eleaticism; 2) there is a rupture with the eleaticism when one admits the ‘multivocity’ of the logical operators “is” and “is not”; as can be seen, for example, 2.1) in the discussion introducing the Great Genera in Plato’s Sophist, and 2.2) in a certain use made by Aristotle of the category’s doctrine in order to soften the Parmenidean version of the Principle of Non-Contradiction. (...) 3) Spinoza admits the ‘multivocity’ of “is” and “is not”. Hence, Spinoza should not be placed among the Eleatics but inside the brotherhood of the suspects of the so-called parricide against Parmenides. This reasoning, which almost sounds as a truism, will, however, suggest two interesting further considerations: one on how an important tradition of interpretation of Spinoza has misplaced the problem of the relationship of Spinoza’s ontology with the logical principles; and another on the type of logic that is implied by the theory of modes of perception or kinds of knowledge. However, there are special cases of picture perception, such as trompe l'oeil perception, in which, unlike in usual picture perception, the object looks like a real, present object we can interact with, of the kind we are usually acquainted with in face-to-face perception. While philosophers suggested that usual picture perception and trompe l'oeil perception must differ with respect to the (...) perception of the surface, nobody has ever proposed a final explanatory account for such a difference. Here, I propose such an account. I consider the two possible options as candidates for the explanation of the illusory power of trompe l'oeil perception. The first is that, with trompe l'oeils, we perceive the surface unconsciously. The second is that, with trompe l'oeils, we cannot perceive the surface at all, that is, we cannot perceive it either consciously or unconsciously. I show that the second option is the unique plausible option, as it is in line with vision science, and with our received view about the nature of usual picture perception. (shrink)

I respond to Karin de Boer, Thomas Land, and Claudio La Rocca’s comments on Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023). I first provide a quick outline of some of the main claims I make in the book. I then directly address their criticisms, which I group into three categories. The first group of comments raises doubts concerning my characterization of the central tasks of the critique of pure reason. The second targets the fact that (...) I downplay faculty analysis as an essential characteristic of the critique. The third has to do with my claim that the Critique of Pure Reason aims to show that metaphysics is capable of architectonic unity, where this unity is only achievable when we construe metaphysics according to the worldly concept of philosophy. Public reason liberalism is defined by the idea that laws and policies should be justifiable to each person who is subject to them. But what does it mean for reasons to be public or, in other words, suitable for this process of justification? In response to this question, Kevin Vallier has recently developed the traditional distinction between consensus and convergence public reason into a classification distinguishing three main approaches: shareability, accessibility and intelligibility. The goal of this paper is to defend (...) the accessibility approach by demonstrating its ability to strike an appealing middle course in terms of inclusivity between shareability and intelligibility. We first argue against Vallier that accessibility can exclude religious reasons from public justification. Second, we use scientific reasons as a case study to show that accessibility excludes considerably fewer reasons than shareability. Throughout the paper, we connect our discussion of accessibility to John Rawls’s model of public reason, so as to give substance to the accessibility approach and to further our understanding of Rawls’s influential model. The primary objective of this book is to open space for rethinking the relationship between art and politics. It seeks to combat one of the fundamental assumptions that has plagued many of the previous debates on this issue: that art and politics are distinct entities definable in terms of common properties, and that they have privileged points of intersection, which can be determined once and for all in terms of an established formula. This common sense assumption is rooted in a (...) transcendent illusion according to which there are more or less fixed characteristics that unify our terms, concepts, and practices in such a way as to guarantee their meaning. Against this substantialist approach, Radical History & the Politics of Art argues for a praxeological account that begins the other way around by analyzing specific cultural practices without presupposing a conceptual unity behind them. Such an orientation is radically historicist in the sense that it recognizes that all of our practices—be they linguistic, theoretical, aesthetic or political—are historically constituted and that they are necessarily part of a temporal dynamic. Hence the contingent nature of the labels used to classify various practices or even identify ‘practice’ as such. Radical history thereby proposes a significant departure from the extant debates on art and politics by maintaining that there is no ‘art’ or ‘politics’ in general, nor a singular relation between them. There are only historically constituted practices in various conjunctures, some of which have been labeled, through practical acts of denomination, as ‘artistic’ or ‘political.’ Instead of proposing one more response to the oft-repeated question ‘what is the relationship between Art and Politics?’ this book seeks to overcome the presuppositions that plague such a question. It thereby changes the very nature of the investigation by asking: ‘how do the diverse aspects of practices identified as ‘aesthetic’ and ‘political’ overlap, intertwine and sometimes merge in precise socio-historical force fields of action? Famously, in the essay Inquiry Concerning the Distinctness of the Principles of Natural Theology and Morality (Prize Essay), Kant attempts to distance himself from the Wolffian model of philosophical inquiry. In this respect, Kant scholars have pointed out Kant’s claim that philosophy should not imitate the method of mathematics and his appeal to Newton’s “analytic method.” In this article, I argue that there is an aspect of Kant’s critique of the Wolffian model that has been neglected. Kant presents a powerful (...) attack of the idea that philosophy should proceed through the analysis of concepts and argues that we should give up the aim of arriving at “complete” concepts as one of its fundamental desiderata. Importantly, this attack of philosophy conceived as conceptual analysis is distinctive and original if one compares it with Kant’s critique of analysis in the Critique of Pure Reason, which rests on the idea that analysis is insufficient to ground substantial metaphysical truths. I also make an additional point: Scholars have debated whether the appeal to Newton’s analytic method involves a form of empiricism. I submit that this debate is ill-conceived because Kant uses a notion of “given concepts” that is indeterminate with respect to their a priori or a posteriori status. (shrink)

Interpretations of Kant’s account of the forms of “taking-to-be-true” (Fürwahrhalten) have generally focused on three such forms: opinion (Meinung), belief (Glaube), and knowledge (Wissen). A second distinction that has received comparatively less attention is that between conviction (Überzeugung) and persuasion (Überredung). Kant appears to use the distinction between the subjective and the objective sufficiency of a taking-to-be-true to characterize all of these forms. However, it is impossible to account for the differences between them by relying on this latter distinction alone. (...) In turn, this makes it difficult to fit all of these forms into a single classification of taking-to-be-true. In this chapter, I propose a new approach to conviction and persuasion that dissolves these problems. Conviction and persuasion are not single forms of taking-to-be-true with distinctive characteristics, yet it is not useful to treat them as “classes” of taking-to-be-true either. Rather, they are “operators” that determine whether a taking-to-be-true is apt or inapt, depending on whether it rests on a correct evaluation of the grounds we have. (shrink)

The social virtues are not discussed thematically in the Socratic writings of Plato and Xenophon, but they are on display everywhere. Taking Aristotle's accounts of these virtues as a touchstone, this paper explores the portrait of Socrates as a model of good humour in Xenophon's Symposium. While Xenophon is addressing the same issues as Aristotle, and shares some of his red lines, his conception of the ideal humourist and of virtue in general differs from Aristotle's not only in detail but (...) also in general conception. While he never actually violates the rules Aristotle sets down for eutrapelia, Xenophon's Socrates strives not to avoid opposites but to combine them. It is the careful combining of the spoudaion and the geloion that redeems Xenophon's otherwise outrageous portrait of Socratic humour. This suggests a broader paradigm in which virtuous behaviour is a combination of opposites rather than a middle path. (shrink)

This essay calls attention to a set of linguistic interactions between counterfactual conditionals, on one hand, and possibility modals like could have and might have, on the other. These data present a challenge to the popular variably strict semantics for counterfactual conditionals. Instead, they support a version of the strict conditional semantics in which counterfactuals and possibility modals share a unified quantificational domain. I’ll argue that pragmatic explanations of this evidence are not available to the variable analysis. And putative counterexamples (...) to the unified strict analysis, on careful inspection, in fact support it. Ultimately, the semantics of conditionals and modals must be linked together more closely than has sometimes been recognized, and a unified strict semantics for conditionals and modals is the only way to fully achieve this. This article locates Bourdieu’s sociology within the lasting controversy concerning the nature of causal explanation and interpretative understanding in the social sciences, with a special focus on the classical problem surrounding the alleged compatibility between these procedures. First, it is argued that Bourdieu’s praxeological and relational perspective on the social universe leads him not only to join the ‘compatibility field’ of the debate, but to sustain, more radically, the identity between explanation and understanding. Second, the article defends the view that (...) this methodological proposal is tied to a distinction often ignored among the commentators of Bourdieu’s oeuvre, namely that between objectivism, a mode of knowledge of the social which he intends to integrate and overcome in his structural praxeology, and determinism, adopted by the author as a fundamental scientific principle and, at the same time, a potentially emancipatory ethico-political tool bequeathed by his reflexive sociology. While basically sympathetic to Bourdieu’s perspective, the article concludes in a more critical vein, by defending the need to bridge the gap between the ‘pessimism of the intellect’ that marks his portrayal of the reflexive capabilities of the lay agent, on the one hand, and the ‘optimism of the will’ infused in the critical program of reflexive sociology, on the other. Isso é favorecido pela utilização das plataformas digitais e das mudanças tecnológicas, influenciando no mercado de trabalho. Nesse contexto, discute-se as consequências na identidade profissional e suas perspectivas de carreira. Esse texto tem como objetivo compreender os efeitos da economia gig através de uma revisão de literatura, aplicando a revisão sistemática com metodologia PRISMA como técnica utilizada. As principais conclusões (...) são as mudanças que as empresas devem adotar para manterem seus colaboradores motivados, a busca por ações que evitem a precarização do trabalho e as competências a serem desenvolvidas para manutenção da empregabilidade frente às mudanças citadas. According to Schroeder-Heister 2018, proof-theoretic semantics is ‘an alternative to truth-condition semantics. It is based on the fundamental assumption that the central notion in terms of which meanings are assigned to certain expressions of our language, in particular to logical constants, is that of proof rather than truth. In this sense proof-theoretic semantics is semantics in terms of proof. Proof-theoretic semantics also means the semantics of proofs, i.e. the semantics of entities which describe how we arrive at certain assertions given (...) certain assumptions.' This text advocates that proof-theoretic semantics, as described above, was an approach to semantical issues in logic that appeared in mainstream philosophical literature at least a couple of centuries before the tradition of general proof theory (cf. Prawitz 1971) came into being. This is done by means of an interpretive analysis of Kant’s 1762 essay Die falsche Spitzfindigkeit der vier syllogistischen Figuren, in which two theses are argued: first, that the issue of justifying the logical validity of inferences is approached by Kant in this text, in a strong sense, in terms of proofs; and second, that the purpose of his effort is to establish a point concerning the semantical equivalence between certain distinct valid inferences. O campo da avaliação psicológica para o porte de arma apresenta dificuldades e limitações em sua fundamentação e exercício profissional, com base na legislação brasileira vigente. Para que ela possa se desenvolver, fazse necessário sistematizar o que tem sido desenvolvido sobre o tema. Neste sentido, foi realizada uma revisão assistemática dos estudos nacionais que abordam à avaliação psicológica para porte de arma. Para tanto, foram realizadas buscas por meio da BVS-Psi de pesquisas que trouxessem, em seu título ou corpo, alguma (...) referência à avaliação psicológica para o porte de arma, utilizando como descritores porte de arma, avaliação psicológica, avaliação psicológica para porte de arma. Os resultados apontaram para 2 artigos de natureza empírica, 14 trabalhos de anais, 2 dissertações e 1 livro. Optou-se por não se limitar o período de publicação em razão da pequena quantidade de trabalhos sobre o tema. Concluise que as pesquisas sobre avaliação psicológica para porte de arma de fogo são escassas e trouxeram limitadas contribuições, denotando um campo carente da atenção científica. (shrink)

A presente pesquisa sobre uma abordagem de gênero propõe­se a analisar as trajetórias de Trabalhadores docentes, focalizando os fatores que impulsionam as mulheres a seguir a carreira na educação superior na Universidade Federal de Sergipe. O estudo de caso organizacional desenvolveu­se na Universidade Federal de Sergipe/Campus de Itabaiana­-SE, que integra 84 docentes (58 homens e 26 mulheres). Fontes utilizadas: revisão bibliográfica abordando conceitos orientadores da literatura; documentos da instituição e dados estatísticos sobre o perfil. As estatísticas de imediato descobrem a (...) permanência da segmentação e divisão sexual do trabalho. Verificamos que existem avanços pontuais, mas, no entanto, sem a ruptura de mecanismos que historicamente inviabilizaram a democratização dos espaços acadêmicos, em que as mulheres têm o papel de buscar uma maior efetivação em tais espaços. Considerando que a fundação do Middle Group é uma dissidência teórica do pensamento psicanalítico clássico, destaco as idéias centrais dos teóricos britânicos das relações de objeto, mostrando os pontos de divergência entre eles e Klein, autora que, apesar de pioneira no desenvolvimento do conceito de relações objetais, apresentava-se como principal representante do pensamento tradicional. Em seguida, analiso a noção winnicottiana de constituição de um si-mesmo e de conquista do concernimento como os fundamentos teóricos que marcam a originalidade de Winnicott no (...) que diz respeito ao desenvolvimento da teoria psicanalítica e ao Middle Group. Isso é feito com base na idéia de que, para Winnicott, a constituição de um si-mesmo pessoal é a condição primordial para a conquista da capacidade de relacionar-se com e a conquista do concernimento, a condição para que capacidades como ter confiança em, ter liberdade pessoal e interpessoal, ser responsável por sejam alcançadas.Based on the concept that the foundation of the Middle Group of British is a theoretical dissidence of the classic psychoanalytic propositions, I emphasizes the central ideas of the British theorists of the object relations theory, showing their disagreements with Klein, author who, although was a pioneer in the development of the object relations concept, was the main defender of the traditional thinking. After that, I analyze the winnicottian notions of self constitution and achievement of concern as well as the theoretical pillars which distinguish Winnicott originality with regard to the development of the psychoanalytic theory and in respect to the Middle Group. From mass murder to genocide, slavery to colonial suppression, acts of atrocity have lives that extend far beyond the horrific moment. They engender trauma that echoes for generations, in the experiences of those on both sides of the act. Gabriele Schwab reads these legacies in a number of narratives, primarily through the writing of postwar Germans and the descendents of Holocaust survivors. She connects their work to earlier histories of slavery and colonialism and to more recent events, such as South (...) African Apartheid, the practice of torture after 9/11, and the "disappearances" that occurred during South American dictatorships. Schwab's texts include memoirs, such as Ruth Kluger's _Still Alive_ and Marguerite Duras's _La Douleur_; second-generation accounts by the children of Holocaust survivors, such as Georges Perec's _W_, Art Spiegelman's _Maus_, and Philippe Grimbert's _Secret_; and second-generation recollections by Germans, such as W. G. Sebald's _Austerlitz_, Sabine Reichel's _What Did You Do in the War, Daddy?_, and Ursula Duba's _Tales from a Child of the Enemy_. She also incorporates her own reminiscences of growing up in postwar Germany, mapping interlaced memories and histories as they interact in psychic life and cultural memory. This article aims to offer a fresh analysis of two passages in the extensive necromancy episode in Lucan's Bellum Ciuile: the ritual to reanimate the dead soldier's corpse (6.667–73), and the surgical procedure Erichtho then proceeds to undertake (6.750–7), resembling the practice of a vivisection. The study will focus mostly on the strong connection of magic to medical traditions in antiquity, with a commentary on, and analysis of, these verses through the lenses of medical vocabulary, themes and motifs. It ultimately (...) concludes that Lucan was familiar with the language and characteristics of the medical tradition, enriched his report with them, and was playing with his audience's knowledge of the same. The idea that healthcare should become more person-centred is extremely influential. By using recent English policy developments as a case study, this article aims to critically analyse an important element of person-centred care, namely, the belief that to treat patients as persons is to think that care should be ‘co-produced’ by formal healthcare providers and patients together with unpaid carers and voluntary organizations. I draw on insights from political philosophy to highlight overlooked tensions between co-production and values like equality and (...) liberty. Regarding equality, I argue that co-production compounds both problems of gender inequality in the distribution of care labour and the challenges associated with securing equal access to care. Turning to liberty, I identify important commonalities between co-production and republicanism in political philosophy, given their shared insistence on common citizens’ civic virtue. Then, I use against co-production some liberal arguments against republicanism, to highlight a problem of over-demandingness. In bringing my argument to a close, however, I wish to caution against hastily rejecting co-production as a policy programme. (shrink)

Este artigo objetiva mapear, no interior dos livros A sociedade dos indivíduos, Norbert Elias por ele mesmo e Envolvimento e alienação, bem como na coletânea Escritos e ensaios, a discussão de Norbert Elias sobre a democratização como um processo de transformação global da sociedade. Através de análises de longa duração, ele demonstrou que os processos civilizacionais foram constituídos pelos embates em torno da desconcentração do poder. Assim, a busca por melhores formas de distribuição de recursos e de oportunidades de poder (...) estiveram, ao longo dos últimos cinco séculos, no centro dos conflitos e das tensões que produziram inúmeras mudanças e/ou expectativas de mudanças nas sociedades atuais. Ele demonstrou que não é possível compreender os processos de democratização sem se levarem em conta os diversos jogos configuracionais que vão se estabelecendo entre os muitos grupos que lutam para adentrar a arena política com o intuito de construir novas oportunidades de poder. Intimacy: From Transformation to Transmutation The paper reflects the historical and current dynamism of the concept of intimacy. Besides differences between scientific disciplines in understanding what the substance of intimacy is, the recent discourse on change in intimacy has been dominated by the transformation theme introduced by Anthony Giddens (1992). Led by reflections of Richard Sennett (1986) the author draws attention to the opposite aspect of change in intimacy—the change in content, or the "transmutation" of intimacy. Transmutation of intimacy—the substitution (...) of the satisfaction of intimate needs with identity creation—not only contests the very essence of intimacy, but also constitutes a significant challenge for the project of intimate citizenship (Plummer 2003). Recent epidemiological research on the social determinants of health has been used to attack an important framework, associated with Norman Daniels, that depicts healthcare as special. My aim is to rescue the idea that healthcare has special importance in society, although specialness will turn out to be mainly limited to clinical care. I build upon the link between Daniels's theory and the work of John Rawls to develop a conception of public justification liberalism that is suitable to the field of (...) justice and health. I argue that, from the perspective of public justification liberalism, (clinical) healthcare deserves special status. (shrink)

This essay undertakes an examination that combines a reconstruction of Hegel’s system of needs with a critical analysis of that system. The reconstruction begins by unraveling the philosophical framework Hegel uses in his Philosophy of Right. It presents the evolution of abstract right and morality towards an ethical life and explains why a civil society becomes nec-essary. Furthermore, it explores the interconnectedness of individuals in the system of needs and how freedom may actualize in civil society based on Hegel’s work. (...) Following the recon-struction and the moments of reason in a free-market society, the paper takes a critical point of view upon the system presented by Hegel. It predominantly follows the critique of Marx and demonstrates how, in a free-market society, the freedom provided is only a formal one. In the second part of the critique, the scope of the paper opens up to further points of criticism against a system of needs, especially how sustainability and global inequality may develop on a international scale without any limitations in a globalized market. The essay ties back said points of criticism into Hegel’s philosophy and presents where they were already indicated in Hegel’s philosophy and how they stay relevant all the way up until modern times. In conclusion the paper shows that the exploration of Hegel’s system of needs remains a compelling discourse, regarding freedom and social equality. (shrink)
