Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

According to UNESCO guidelines, one of the four forms of bioethics committees in medicine are the Hospital Ethics Committees. The purpose of this study was to evaluate how the above guidelines are implemented in real practice. There were 111 hospitals selected out of 176 Polish clinical hospitals and hospitals accredited by Center of Monitoring Quality in Health System. The study was conducted by the survey method. There were 56 hospitals that responded to the survey. The number of HECs members fluctuated (...) between 3 and 16 members, where usually 5 members were part of the board committee. The composition of the HECs for professions other than physicians was diverse and non-standardized. Only 55 % of HECs had a professional set of standards. 98 % of HECs had specific tasks. 62 % of HECs were asked for their expertise, and 55 % prepared <6.88 % of the opinions were related to interpersonal relations between hospital personnel, patients and their families with emphasis on the interactions between superiors and their inferiors or hospital staff and patients and their families. Only 12 % of the opinions were reported by the respondents as related to ethical dilemmas. In conclusion, few Polish hospitals have HECs, and the structure, services and workload are not always adequate. To ensure a reliable operation of HECs requires the development of relevant legislation, standard operating procedures and well trained members. (shrink)

The Polish equivalents of Research Ethics Committees are Bioethics Committees (BCs). A questionnaire study has been undertaken to determine their situation. The BC is usually comprised of 13 members. Nine of these are doctors and four are non-doctors. In 2006 BCs assessed an average of 27.3 ± 31.7 (range: 0–131) projects of clinical trials and 71.1 ± 139.8 (range: 0–638) projects of other types of medical research. During one BC meeting an average of 10.3 ± 14.7 (range: 0–71) projects of (...) medical research were assessed (2006). The amendment of Polish laws according with Directive 2001/20/EC caused a percentage increase in BCs which assessed less than 20 projects per year (16% vs. 33% or 42% in 2003 vs. 2005 or 2006 respectively, p < 0,05). The results confirm the usefulness of the current practice of creating BCs by medical universities, medical institutes and regional chambers of physicians and dentists but rationalization of the workload for individual BCs is necessary. Biological research with legitimate scientific purpose that may be misused to pose a biological threat to public health and/or national security is termed dual use. In Poland there are adequate conditions for conducting experiments that could be qualified as dual use research, and therefore, a risk of attack on Poland or other countries exists. Optimal solutions for limiting such threats are required, and the national system of biosecurity should enable early, reliable, and complete identification of this type of research. Scientists (...) should have a fundamental role in this process, their duty being to immediately, upon identification, report research with dual use potential. An important entity in the identification system of dual use research should also be the Central Register of Biological and Biomedical Research, which gathers information about all biological and biomedical research being conducted in a given country. Publishers, editors, and review committees of journals and other scientific publications should be involved in evaluating results of clinical trials. The National Council of Biosecurity should be the governmental institution responsible for developing a system of dual use research threat prevention. Its role would be to develop codes of conduct, form counsel of expertise, and monitor the problem at national level, while the Dual Use Research Committee would be responsible for individual cases. In Poland, current actions aiming to provide biological safety were based on developing and passing an act about genetically modified organisms (GMO’s) and creating a GMO Committee. Considering experiences of other nations, one should view these actions as fragmentary, and thus insufficient protection against dual use research threats. (shrink)

The Helsinki Declaration is a very important document regarding the protection of patients’ rights in clinical trials and one of the fundamental sources of operational principles for every ethics committee. Although they have been updated, the international guidelines for ethics committees continually fail to address certain issues pertaining to the protection of patients’ rights in clinical trials. These issues include, most significantly, the method of electing ethics committees (a free, secret ballot should be preferred to direct appointment), the avoidance of (...) conflict of interest during the election of ethics committee members, and the necessary insurance coverage for the participants of clinical trials. Polish law should, on the other hand, be developed in such way as to not limit the effectiveness of ethics committees in protecting patients’ rights in clinical trials. The ideal solution would be to draft a uniform law concerning not only clinical trials, but all medical experiments. The opinions of experts who have been reviewing medical research projects for several years may prove to be especially valuable in this setting. (shrink)

Although Directive 2001/20/EC of the European Parliament and of Council of 4 April 2001 on the approximation of the laws regulations and administrative provisions of the Member States relating to the implementation of good clinical practice in the conduct of clinical trials on medicinal products for human use does not contain an exception for emergency situations, and requires the informed consent of a legal representative in all cases where research is conducted on legally competent individuals who are unable to give (...) informed consent, in Poland, emergency research can be conducted without consent. Polish regulations on emergency research can hardly be treated as a result of intentional legislative policy. Our provisions arise from multiple and sophisticated interpretations of different regulations that govern medical experiments on human subjects and clinical trials. These interpretations can be summarized as follows: There are two categories of medical experiments: therapeutic and non-therapeutic experiments. Emergency research without consent may be conducted in the category of therapeutic experiment only.. Emergency research may be conducted without consent if there is a situation of great urgency in which the research subject’s life is in danger and there is no possibility of obtaining immediate consent from the research subject him or herself, or from his or her legal representative or guardianship court, and the research subject has not refused to give consent for the participation in an emergency therapeutic experiment. The legal representative or guardianship court shall be provided with all the relevant information concerning subject’s participation in an experiment as soon as possible. All projects of emergency research with intent to be done without the research subject’s consent must be approved by an independent bioethics committee. Because these five requirements seem to provide insufficient protection for a subject’s autonomy and rights it is necessary to add to them two other conditions: the emergency research could not be conducted using other research participants capable of giving informed consent; and informed consent for continued participation in the emergency research shall be obtained from either the participant him or herself or the legally authorized representative as soon as possible. A consolidated single Act that will govern all aspects of medical experiments on human subjects, including emergency research, should be prepared and enacted as soon as possible. (shrink)

The paper reports results of the very first survey-based study on the prevalence, frequency and nature of ethical or other non-medical difficulties faced by Polish physicians in their everyday clinical practice. The study involved 521 physicians of various medical specialties, practicing mainly in inpatient healthcare. The study showed that the majority of Polish physicians encounter ethical and other non-medical difficulties in making clinical decisions. However, they confront such difficulties less frequently than their foreign peers. Moreover, Polish doctors indicate different circumstances (...) as a source of the experienced problems. The difficulties most often reported relate to (i) patients (or their proxies) requests for medically non-indicated interventions; (ii) problems with communication with patients (or their proxies) due to the patients’ negative attitude, unwillingness to cooperate, or aggression; and (iii) various difficulties with obtaining informed consent. Polish physicians report difficulties associated with disagreements among care givers or scarcity of resources less frequently than doctors from other countries. The study’s findings provide support for the thesis that a significant portion of Polish physicians still follow a traditional, paternalistic, and hierarchical model of healthcare practice. Instead of promoting patient’s empowerment, engagement, and rights, they often consider these ideas as a threat to physicians’ professional authority and autonomy. The study leads to the conclusion that due to insufficient training in medical ethics, communication skills, and medical law, many Polish physicians lack the knowledge and competence necessary to adequately respond to challenges posed by modern healthcare practice. In the article I discuss functionalist interpretations of Husserlian phenomenology. The first one was coined in the discussion between Hubert Dreyfus and Ronald McIntyre. They argue that Husserl’s phenomenology shares similarities with computational functionalism, and the key similarity is between the concept of noema and the concept of mental representation. I show the weaknesses of that reading and argue that there is another available functionalist reading of Husserlian phenomenology. I propose to shift perspective and approach the relation between phenomenology and (...) functionalism from a methodological perspective, specifically taking into account the functionalist explanatory strategy called functional analysis. I discuss the notion of function in Husserl’s works and Husserl’s idea of functional phenomenology. The key argument I develop is that in functional phenomenology we can find an explanatory strategy which is analogous to the strategy of functional decomposition used in functional analysis. I conclude that the proposed functionalist reading of phenomenology opens a new approach to the integration of phenomenology with cognitive sciences. (shrink)

The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

The aim of this article is to introduce the work of Leopold Blaustein — philosopher and psychologist, who studied under Kazimierz Twardowski in Lvov and under Husserl in Freiburg im Breisgau. In his short academic career Blaustein developed an original philosophy that drew upon both phenomenology and Twardowski’s analytical approach. One of his main publications concerns Husserl’s early theory of intentional act and object, introduced in Logische Untersuchungen. In the first part of the article I briefly present Blaustein’s biography and (...) some general features of his philosophy. The second part provides an overview of Blaustein’s dissertation concerning Husserl’s early phenomenology. In the third and final part I summarize Blaustein’s research, including the critical remarks of Roman Ingarden. (shrink)

Text porovnává přesvědčovací strategie využité ve velmi podobných politicky angažovaných videoklipech The Great Schlep a Přemluv bábu. Ukazuje, že přestože se klip Přemluv bábu od své americké předlohy zásadně neliší v obecné struktuře, deklarovaném cíli či motivické výbavě, v jiných persvazivně významných ohledech se původnímu klipu vzdaluje. Rozdíly jsou patrné zejména v odlišné konstrukci publika, v jiném situování mluvčích a v topickém výběru vyjádřeném jinými stylistickými prostředky.

Porovnáním významu slovesa vykořisťovat v 19. a 20. století odhalíme jeho dramatickou proměnu: z pojmu neutrálního se stává pojem silně záporný a objevuje se v okolí nových slov jako kapitalista, měšťák, proletář. Tento průnik Marxova idiolektu do češtiny (a do jiných jazyků) s sebou nese několik otázek: proč vnímá Marx tyto pojmy tak vyhraněně? Z jaké pozice, když odmítá morálku jako buržoazní přežitek, odsuzuje vykořisťování? Jeho eschatologicko-dějinný rámec umožňuje čistě negativní polaritu slovesa vykořisťovat a také, bohužel, zakládá jeho autogenocidní potenciál. (...) When comparing the meaning of the verb to exploit between the nineteenth and twentieth century we discover a dramatic transformation: from a neutral term it becomes a purely negative one and collocates with new words such as capitalist, bourgeoisie, proletarian. This penetration of the idiolect of Marx into Czech (as well as other languages) raises several questions: why does Marx use these words in such a categorical way? From what position, having rejected morality as a bourgeois prejudice, does he condemn exploitation? We find that it is his apocalyptic historical frame which enables the purely negative polarity of the verb to exploit as well as its autogenocidal potential. (shrink)

The fact of religious diversity is vital for the philosopher of religion but also, to some extent, for the believer of a given faith. It takes place in such a dimension in which the views of a given believer or the meaning of the practice of a given religion presupposes the truthfulness of specific claims concerning a given religion or the beliefs included in it. If now on the part of the philosopher of religion or the followers of another religion, (...) there is a direct or indirect challenge to such a key proposition, religious disagreement with epistemic dimension is involved. At the same time, it is not the case that any religious diversity is a case of epistemically significant religious dissent. The paper, by distinguishing different aspects of religions and functions performed by religion, tries to show in which situations religious diversification leads to religious disagreement. Both the follower of religion and the philosopher of religion can and should seek the truth in matters of crucial importance to religion. The difference is that the follower of a given religion is more interested in the salvific and practical functions of religion, along with the associated sense of value and meaningfulness of life and, to a lesser degree, the theoretical certainty that her religion is correct at crucial points. On the other hand, the achievement of ‘the soteriological’ purpose of religion based on false belief is impossible, just as the meaningfulness of life 'based on the sand and not on the rock’. It is because the false foundation is devoid of higher value. That is why there is a community of a philosopher of religion and a follower of a given religion to search for the truth of it. (shrink)

According to recent discussion, cross-explanatory integration in cognitive science might proceed by constraints on mechanistic and dynamic-mechanistic models provided by different research fields. However, not much attention has been given to constraints that could be provided by the study of first-person experience, which in the case of multifaceted mental phenomena are of key importance. In this paper, we fill this gap and consider the question whether information about first-person experience can constrain dynamic-mechanistic models and what the character of this relation (...) is. We discuss two cases of such explanatory models in neuroscience, namely that of migraine and of epilepsy. We argue that, in these cases, first-person insights about the target phenomena significantly contributed to explanatory models by shaping explanatory hypotheses and by indicating the dynamical properties that the explanatory models of these phenomena should account for, and thus directly constraining the space of possible explanations. The paper presents some historical (Plato, Aristotle, Plotin, Augustine, Boethius, Aquinas) and main contemporary topics about different accounts of goodness of God understood as ontological goodness, perfection and as ethical goodness - impeccability and benevolence. The arguments for goodness of God are presented, mainly from stance of Thomas Aquinas classical theism as well as arguments against compatibility of essential goodness and omnipotence (N. Pike) and being an moral agent. The article draws perspective of different philosophical issues connected with goodness of (...) God, like a problem of evil, the Euthyphro dilemma, divine command ethics and divine motivation theory. (shrink)

The author of the article deals with the causes of anti-naturalism in culture today from the point view of both a philosophical conception of evolutionary ontology, and the psychology of environmental problems. He highlights the real potential for a biophilic transformation of culture in the context of current knowledge on cognitive psychology, where emphasis is placed on the limits to the phenomena of cognitive dissonance. The author of the article seeks certain options to repress these limits in Gestalt theory, which (...) on some aspects corresponds substantially to the insights and goals of evolutionary psychology. Local hidden-variable model of singlet-state correlations discussed in Czachor (Acta Phys Polon A 139:70, 2021a) is shown to be a particular case of an infinite hierarchy of local hidden-variable models based on an infinite hierarchy of calculi. Violation of Bell-type inequalities can be interpreted as a ‘confusion of languages’ problem, a result of mixing different but neighboring levels of the hierarchy. Mixing of non-neighboring levels results in violations beyond the Tsirelson bounds.

Criticism of ethical review of research continues and research ethics committees (RECs) need to demonstrate that they are “fit for purpose” by meeting acknowledged standards of process, debate and outcome. This paper reports a workshop in Warsaw in April 2008, organised by the European Forum for Good Clinical Practice, on the problems of setting standards for RECs in the European Union. Representatives from 27 countries were invited; 16 were represented. Problems identified were the limited and variable resources, difficulties of setting (...) standards for ethical debate and its outcomes and that REC members, as volunteers, may resent the imposition of standards. Other ways to set standards were discussed, including analysis of current multicentre review, collecting REC member reports for review, learning from appeals and feedback from applicants, and use of other regional and national meetings. The place of a central, national board or ethics committee was debated as was the need for collaborating with partners in other fields. (shrink)

The author recounts the dramatic life of Warsaw’s population during the uprising against the Germans. After miraculously escaping death in a mass execution,Czarkowski teamed up with several other men and lived the hard life of a refugee among the city’s ruins. He and his companions continuously risked death, both from the hands of Nazi execution squads as well as in the buildings, methodically demolished by the occupant as the city was razed to the ground in revenge for the insurgency.

Die Beiträge dieses Bandes aus verschiedenen Disziplinen, Philosophie, Literaturgeschichte und Kunstgeschichte schließen sich zum Bild einer Epoche zusammen, die einen Höhepunkt des deutschen Geisteslebens darstellt. Dabei treten bestimmte Züge heraus, welche die Genese dieser Kultur in relativ eng umgrenzten Kommunikationszentren zeigen: Königsberg - Düsseldorf - Jena - Weimar - freilich mit Ausstrahlung auf das übrige Deutschland. So etwa: die Stilisierung der Geselligkeit über den literarischen Dialog bis zur philosophischen Interpersonalitätslehre Fichtes und einer dem entsprechenden Dialektik des Dialogs; einer Staats- und (...) Gesellschaftsauffassung, die zwar noch in der klassischen Naturrechtslehre der Aufklärung gründete, aber den Rechtsbegriff so in sich zu gliedern wußte, daß er Implikationen verbindlich auch für das politische Handeln hergeben konnte und so aus dem Rechtsbegriff erstmals die Umsetzung des Völkerfriedens politisch fordern konnte. Es zeigt sich hier ein Grundmodell, das aller pragmatisch ausmachbaren Verallgemeinerungsfähigkeit überlegen ist, da die sittliche Person auch schon im Recht eine individuelle Aufforderung erhält, soll politisches Handeln von der öffentlichen Meinung anerkannt werden. Schließlich tritt eine neue Religiosität auf, die ein Naturverständnis einbezog, das ästhetischer Herkunft war, und die vielleicht deswegen ihren überzeugendsten Ausdruck in der Malerei fand. In allen diesen Bereichen aber werden Natur und Kunst im Lichte der neuentdeckten Freiheit des autonomen Individuums wiederbelebt. (shrink)

Článek reaguje na monografii Homo Natura: Nietzsche, Philosophical Anthropology and Biopolitics (2020) současné akademičky Vanessy Lemmové zabývající se Nietzschovým úkolem „přesadit člověka zpět do přírody“, tzn. chápat jej jako bytost veskrze imanentní přírodě. Reakce směřuje především na jednu z hlavních tezí knihy, podle níž tato Nietzschova snaha otevírá možnost nového, postantropocentrického pohledu na člověka a jeho vztahu k přírodě – pohledu, v jehož centru zájmu již nestojí člověk, nýbrž život sám, resp. kontinuum života, jež se ztělesňuje v lidském druhu a (...) jehož je lidský druh rovnocennou součástí po boku ostatních organismů. Nietzschova myšlenka o homo natura podle Lemmové předznamenává myšlení současného posthumanismu vyznačujícího se právě snahou vytvořit takový pohled na člověka a jeho vztah k přírodě, který bybyl vhodným teoretickým rámcem pro sebepojetí člověka v epoše antropocénu. Článek tuto tezi doplňuje o Heideggerovu interpretaci Nietzschovy myšlenky nadčlověka podanou v sérii přednášek Co znamená myslet?, v níž je nadčlověk chápán jako ekologický ideál lidstva schopného zodpovědně převzít moc plynoucí z technického přetváření země. Cílem článku je ukázat, že, v souladu s interpretacemi Lemmové a Heideggera, u Nietzscheho lze nalézt způsob, jak by se lidstvo mohlo produktivně vyrovnat s realitou antropocénu, a to skrze přechod od „posledního člověka“ k „nadčlověku“, kde přechod k „nadčlověku“ je chápán jako idea nastolení nového vztahu mezi lidmi a přírodou, resp. mezi lidmi a zemí. History provides us with instances of various societal and economic changes that with a hindsight are interpreted as either indicating progressive or regressive trends. The present paper attempts to define what represents progress and regress by applying psychological constructs to evaluation of the psychosocial changes. Seven principles of progress are applied as criteria for interpreting various historic events. The primary condition for progress is courage to face adversity or, in the cognitive domain, ambiguity, controversy and “unknown”. An overall model of (...) Challenge-Resilience-Resourcefulness is described as the process through which progress can be achieved. (shrink)

A flurry of recent publications have challenged consensus views on the tempo and mode of plastid (chloroplast) evolution in eukaryotes and, more generally, the impact of endosymbiosis in the evolution of the nuclear genome. Endosymbiont‐to‐nucleus gene transfer is an essential component of the transition from endosymbiont to organelle, but the sheer diversity of algal‐derived genes in photosynthetic organisms such as diatoms, as well as the existence of genes of putative plastid ancestry in the nuclear genomes of plastid‐lacking eukaryotes such as (...) ciliates and choanoflagellates, defy simple explanation. Collectively, these papers underscore the power of comparative genomics and, at the same time, reveal how little we know with certainty about the earliest stages of the evolution of photosynthetic eukaryotes. Bell’s theorem cannot be proved if complementary measurements have to be represented by random variables which cannot be added or multiplied. One such case occurs if their domains are not identical. The case more directly related to the Einstein–Rosen–Podolsky argument occurs if there exists an ‘element of reality’ but nevertheless addition of complementary results is impossible because they are represented by elements from different arithmetics. A naive mixing of arithmetics leads to contradictions at a much more elementary level than the (...) Clauser–Horne–Shimony–Holt inequality. (shrink)

The opposition Diophantine versus non-Diophantine, or Newtonian versus non-Newtonian, is an arithmetic analogue of Euclidean versus non-Euclidean in geometry. We do not yet know if the proposed generalization ultimately removes any need of dark matter, but it will certainly change estimates of its parameters. Artykuł podejmuje polemikę z obiegowym rozumieniem tolerancji. Autor podkreśla znaczenie podziału na tolerancję jako postawę i na dyskursy o tolerancji. Następnie, w nawiązaniu i częściowo w dyskusji z koncepcją tolerancji zaproponowaną przez Iję Lazari Pawłowską, przedstawione jest rozróżnienie trzech odmian tolerancji, a także rozróżnienie odpowiednich trzech odmian nietolerancji. Rozważane są również niektóre paradoksy związane z tolerancją oraz ze zwalczaniem nietolerancji.

Kuala Lumpur is a diverse city representing many different religions and nationalities. Recent government policy has actively promoted unity and cohesion throughout the city; and the country of Malaysia, with the implementation of a programme called 1Malaysia. In this book, the authors investigate the aims of this programme – predominantly to unify the Malaysian society – and how these objectives resonate in the daily spatial practices of the city’s residents. -/- This book argues that elements of urban infrastructure could work (...) as an essential mediator ‘beyond community’, allowing inclusive social structures to be built, despite cultural and religious tensions existing within the city. It builds on the premise of an empirical study which explores the ways in which different communities use the same spaces, supported through the implementation of a theoretical framework which looks at both Western and Islamic conceptualisations of the notion of community. Through the analysis of Kuala Lumpur, this book contributes towards the creation of more inclusive places in multi-ethnic, multi-cultural and multi-religious communities across the world. (shrink)
