En este trabajo nos proponemos analizar los efectos que tienen en la genética y la microbiología la aplicación de las leyes de propiedad intelectual, en su forma de derechos de patentes. A través del estudio de la historia de estas áreas de la biología, argumentamos porque nos parece errónea, desde el punto de vista jurídico y filosófico, la patentabilidad de los genes y genomas que provienen total o parcialmente de la naturaleza. Demostraremos cómo esta práctica legal acarrea una gran cantidad (...) de valores no-epistémicos y concepciones ético-políticas que afectan de lleno a las investigaciones biológicas que forman parte del negocio biotecnológico y generan un desmesurado choque de cosmovisiones con culturas ajenas al sistema liberal-capitalista. Recent studies have shown that Nicola Salvi the architect of the Trevi Fountain intended to present the “potenza non limitata” of water as an existential element of nature, focusing the whole appearance of the fountain on the person in the center, Oceanus. But Salvi’s principal, pope Clement XII., claimed in his other projects such as the restoration of the arch of Constantine or like the new eastern fascade of S. Giovanni in Laterano, which refer especially to Constantine, like (...) this emperor the leader of Christianity. Thus Salvi’s philosophical purpose seems not to be in line with to the intentions of the pope. But how could Salvi convince the pope let him build the prestigious fountain? This paper tries to show that Salvi’s model was influenced by the epiphanies of Neptun or Poseidon in the first book of the Achilleis of Statius and in the 13th book of the Iliad. Transferring these on the epiphany of Oceanus in the Trevi Fountain, Salvi was able to combine his thoughts about the power of water with the metaphorical presentation of a universal ruler, as the pope wanted to present himself. This article argues for a novel approach to the measurement of freedom of choice, on which the availability of an option is a matter of degree, rather than a bivalent matter of being either available or not. This approach is motivated by case studies involving weakness of will, where deficiencies in willpower seem to impair individual freedom by making certain alternatives much harder to pursue. This approach is perfectly general, however: its graded analysis of option availability can be extended to (...) cases where weakness of will is not involved and can be used to generalize numerous existing measures of freedom. The contemporary discussion of modesty has focused on whether or not modest people are accurate about their own good qualities. This essay argues that this way of framing the debate is unhelpful and offers examples to show that neither ignorance nor accuracy about the good qualities related to oneself is necessary for modesty. It then offers an attention-based account, claiming that what is necessary for modesty is to direct one’s attention in certain ways. By analyzing modesty in this way, we (...) can best explain the distinct features of modesty, keep much of what is intuitive in contemporary accounts, and better understand why modesty is a virtue at all. An innovative literary analysis of Freud's "Wolf Man.".

Our discussion of the commentaries begins, at the evolutionary level, with issues raised by our account of the evolution of morality in terms of partner-choice mutualism. We then turn to the cognitive level and the characterization and workings of fairness. In a final section, we discuss the degree to which our fairness-based approach to morality extends to norms that are commonly considered moral even though they are distinct from fairness.

The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. In particular, I focus on single-event virtues, first-time virtuous acts, and morally dangerous situations. (shrink)

Achieving an ambitious goal frequently requires succeeding in a sequence of intermediate tasks, some being critical for the final outcome, and others not. However, individuals are not always able to provide a level of effort sufficient to guarantee success in all such intermediate tasks. The ability to manage effort throughout the sequence of tasks is, therefore, critical when resources are limited. In this paper, we propose a criterion of importance that is person- and context-specific, as it is based on how (...) an individual should optimally allocate a limited stock of exhaustible efforts over tasks. We test this importance criterion in a laboratory experiment that reproduces the main features of a tennis match. We show that our importance criterion is able to predict the individuals’ performance and it outperforms the Morris-importance criterion that defines the importance of a point in terms of its impact on the probability of achieving the final outcome. This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. Uno de los problemas omnipresentes en la teoría política es el de qué tipo de relación debe existir entre el régimen democrático en tanto sistema de toma de decisiones colectivas y las vidas de sus ciudadanos, en tanto seres dotados de fines, metas y deseos. Ya sea desde las concepciones que estipulan que las decisiones mayoritarias pueden poner en riesgo ciertos ideales de buena vida o desde aquellas que creen que el tipo de justificación de las decisiones políticas no puede (...) dar cuenta de los procesos hermenéuticos individuales de búsqueda de significado a la propia existencia hasta aquellas concepciones que consideran que las condiciones para la búsqueda de la buena vida no pueden quedar libradas al desigual poder social o las que consideran que el bienestar individual debe quedar restringido a su compatibilidad con una autocomprensión colectiva de una buena sociedad, la cuestión reaparece incluso cuando se pretende hacerla a un lado. Los textos que componen este Dossier ofrecen diferentes aristas de estos problemas, los cuales vienen siendo tratados extensa y prolíficamente en la obra de Graciela Vidiella. A natural way to think of epistemic virtue is by analogy with an archer. Just as a skilled archer is able to take aim and hit a target, a skilled epistemic agent will aim at truth and, if things go well, get things right. Here we highlight aspects of epistemic virtue that do not fit this model, particularly ways in which epistemic virtues can be non-voluntary and not goal-directed. In doing so, we draw on two important figures in the history (...) of philosophy: the 6th-century Indian Buddhist Buddhaghosa and the 20th-century French philosopher Simone Weil. Despite many differences, both thinkers emphasize the importance of attention in moral and epistemic virtue. Their work highlights ways in which attention that is neither voluntary nor goal-directed can nevertheless play an important role in moral and epistemic life. (shrink)

Most physics theories are deterministic, with the notable exception of quantum mechanics which, however, comes plagued by the so-called measurement problem. This state of affairs might well be due to the inability of standard mathematics to “speak” of indeterminism, its inability to present us a worldview in which new information is created as time passes. In such a case, scientific determinism would only be an illusion due to the timeless mathematical language scientists use. To investigate this possibility it is necessary (...) to develop an alternative mathematical language that is both powerful enough to allow scientists to compute predictions and compatible with indeterminism and the passage of time. We suggest that intuitionistic mathematics provides such a language and we illustrate it in simple terms. (shrink)

The target article attempted to draw connections between broad swaths of evidence by noticing a common thread: Abstract, symbolic, compositional codes, that is, language-of-thoughts (LoTs). Commentators raised concerns about the evidence and offered fascinating extensions to areas we overlooked. Here we respond and highlight the many specific empirical questions to be answered in the next decade and beyond.

The phenomenon of performativity has recently sparked debates about the status of the economic discourse. This paper aims to discuss the subjectivist idea that if economics ‘performs’ social reality, rather than merely reflects it, then every theory can be considered ‘true.’ My main goal is to point out three limits of performativity. First, not all theories can be performative since some do not produce empirical landmarks for agents. Second, social institutions restrict performativity. Third, I emphasize the necessity that a theory (...) to be self-fulfilling. This article is a prelude to a new kind of performative studies based on an original definition: a theory performs the world if it implies a behavioral regularity which leads to a general coordination between agents. It’s natural to think of acts of solidarity as being public acts that aim at good outcomes, particularly at social change. I argue that not all acts of solidarity fit this mold - acts of what I call ‘private solidarity’ are not public and do not aim at producing social change. After describing paradigmatic cases of private solidarity, I defend an account of why such acts are themselves morally virtuous and what role they can have in moral development.

This article compares the ability to track individuals lacking mental states with the ability to track intentional agents. It explains why reference to individuals raises the problem of explaining how cognitive agents track unique individuals and in what sense reference is based on procedures of perceptual-motor and epistemic tracking. We suggest applying the notion of singular-files from theories in perception and semantics to the problem of tracking intentional agents. In order to elucidate the nature of agent-files, three views of the (...) relation between object- and agent-tracking are distinguished: the Independence, Deflationary and Organism-Dependence Views. The correct view is argued to be the latter, which states that perceptual and epistemic tracking of a unique human organism requires tracking both its spatio-temporal object-properties and its agent-properties. It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality. This study investigates the social–psychological mechanisms leading individuals in organizations to engage in environmental citizenship behaviors, which entail keeping abreast of, and participating in, the environmental affairs of a company. Informed by the corporate greening and organizational behavior literature, we suggested that an employee’s level of involvement in the management of a company’s environmental impact was the overt manifestation of his or her discretionary sense of commitment to environmental concerns in the work context, and that such commitment developed through the (...) interplay of individual, organizational, and supervisory factors. Our general findings support the idea that when environmental protection is valued and encouraged by the company and line managers, organization members are more likely to experience a volitional sense of attachment and responsibility to corporate environmental goals and values, which is enacted through citizenship behaviors. We also expected that individual ecological beliefs would strengthen the environmental commitment of employees via identification with, and adherence to, the socially responsible cause embodied by the organization and its managerial staff. But it did not. On the contrary, the data indicated that corporate environmental policy is more likely to influence an employee’s level of environmental commitment when he or she holds weak versus strong personal ecological beliefs. Theoretical and managerial implications of our findings are discussed. (shrink)

Or, à l’opéra, si ces deux dimensions restent importantes et se complexifient du fait des contraintes spécifiques du chant et des attentes du public, c’est la fonction dramaturgique qui passe au premier plan. La nécessité de donner le décor à l’avance pour qu’il soit construit dans les ateliers impose qu’il soit pensé avec la mise en scène, en même (...) temps qu’elle. Grâce à un exemple précis, nous montrerons comment le trio dramaturgie-scénographie et mise en scène fonctionne étroitement pour faire émerger le sens. El presente artículo intenta desarrollar los elementos de una concepción del conocimientoque resulte operativa para una versión epistémica de la democracia deliberativa.Se intenta superar algunas limitaciones de los modelos epistémico-deliberativosactuales y profundizar la relación entre conocimiento, deliberación y legitimidad.

This study examined the effect of the pique technique preceded by a disrupting process. Passersby in the street were asked for money, either for a common amount of change (control) or 37 cents (pique technique). In half of the cases, the requester added a disrupting sentence at the beginning of the request. Results showed that the pique technique alone and the disrupting technique alone increased compliance with the request. Adding a first disrupting sentence to the pique also increased compliance compared (...) with the other three conditions. These results support the theoretical explanation that the initial disrupting sentence associated with the pique could reduce the influence of the refusal script activated by the money request. This paper presents some impossibility results for certain views about what you should do when you are uncertain about which moral theory is true. I show that under reasonable and extremely minimal ways of defining what a moral theory is, it follows that the concept of expected moral choiceworthiness is undefined, and more generally that any theory of decision-making under moral uncertainty must generate pathological results.

Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Nous commençons par inscrire l’ouvrage dans l’argument développé par l’auteur dans ses précédents ouvrages, avant d’en souligner un certain nombre de limites. Nous questionnons d’abord la manière dont Piketty pense le capitalisme, avant d’en venir à sa théorie de l’idéologie. Enfin, nous tenterons de définir les contours et limites du projet de dépassement du capitalisme de Piketty, c’est-à-dire sa vision d’une société juste, d’un « socialisme (...) participatif », développée au dernier chapitre de l’ouvrage. To analyze the relations between art and science, philosophers and historians have developed different lines of inquiry. A first type of inquiry considers how artistic and scientific practices have interacted over human history. Another project aims to determine the contributions that scientific research can make to our understanding of art, including the contributions that cognitive science can make to philosophical questions about the nature of art. We rely on contributions made to these projects in order to demonstrate that art and (...) science are codependent phenomena. Specifically, we explore the codependence of art and science in the context of a historical analysis of their interactions and in the context of contemporary debates on the cognitive science of art. A dilemma put forward by Schein (1993) and Rayo (2002) suggests that, in order to characterize the semantics of plurals, we should not use predicate logic, but non-singular logic, a formal language whose terms may refer to several things at once. We show that a similar dilemma applies to mass nouns. If we use predicate logic and sets, we arrive at a Russellian paradox when characterizing the semantics of mass nouns. Likewise, a semantics of mass nouns based upon predicate logic (...) and mereological sums is too weak, since it cannot characterize the “intermediary” construals that sentences containing mass nouns may receive. We then develop an account where mass nouns are treated as non-singular terms, which may refer to several things at once. This semantics is faithful to the intuition that, if there are eight pieces of silverware on a table, the speaker refers to eight things at once when he says: “The silverware that is on the table comes from Italy”. We show that this account provides a satisfactory semantics for a wide range of sentences, including cases often seen as difficult, like “The gold on the table weighs seven ounces” (Bunt 1985) and “All phosphorus is either red or black” (Roeper 1983). To become more broadly applicable, positions on AI ethics require perspectives from non-Western regions and cultures such as China and Japan. In this paper, we propose that the addition of the concept of harmony to the discussion on ethical AI would be highly beneficial due to its centrality in East Asian cultures and its applicability to the challenge of designing AI for social good. We first present a synopsis of different definitions of harmony in multiple contexts, such as music and (...) society, which reveals that the concept is, at its core, about well-balanced relationships and appropriate actions which give rise to order, balance, and aesthetically pleasing phenomena. The mediator for these well-balanced relationships isTaktwhich is an ability to act thoughtfully and sensibly according to the specific situation and to put things into proportion and order. We propose that the central challenge of building harmonizing AI is to make intelligent systems tactful and also to design and use them tactfully. For an AI system to become tactful, it needs to be able to have an advanced sensitivity to the specific contexts which it is in and their social and ethical implications and have the capability of approximately inferring the emotional and cognitive states of people with whom it is interacting. This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

El presente artículo es la primera traducción española de un artículo del jurista alemán Hermann Heller titulado "¿Liberalismo autoritario?", en el que pretende dar cuenta de una nueva forma de articulación política que se desarrolla al comienzo de los años 30 en Alemania y que combina el autoritarismo político con el liberalismo económico.

Reporting and investigating research misconduct can lead to disciplinary proceedings being initiated, and ultimately to disciplinary sanctions being imposed on convicted scientists. The conversion of research misconduct findings into disciplinary sanctions is poorly understood. This article analyses all the disciplinary decisions handed down on appeal by the Conseil national de l'enseignement supérieur et de la recherche (CNESER) between 1991 and 2023, concerning breaches of research integrity by academics and doctoral students ( n = 333). Three findings are highlighted. Firstly, the (...) article describes how the CNESER sanctioned research misconduct even before the notion of research integrity became part of French law, by monitoring scientists’ compliance with “deontological rules”. Secondly, we show that assessing disciplinary fault involves evaluating a much broader set of circumstances than the mere existence of research misconduct, which can explain why the latter do not result in disciplinary sanctions or lighter sanctions. Thirdly, the research highlights situations where research misconduct is intertwined with other allegations, blurring the relative importance of these motives in the awarding of disciplinary sanctions. The article concludes with a call for greater accessibility to the disciplinary decisions handed down by universities in the first instance, as a key next step in gaining a better understanding of the disciplinary response to research misconduct. First, we concentrate on graphical and gestural communication and show how semantically motivated iconic signs play an important role in creating such communication systems from scratch. We then consider how iconic signs tend to become simplified and symbolic as the communication system matures and argue that this process is driven by repeated interactive use of the signs. We then consider evidence for iconicity at the level (...) of the system in graphical communication and finally draw comparisons between iconicity in graphical and gestural communication systems and in spoken language. In the past decade, experiments on altruistic punishment have played a central role in the study of the evolution of cooperation. By showing that people are ready to incur a cost to punish cheaters and that punishment help to stabilise cooperation, these experiments have greatly contributed to the rise of group selection theory. However, despite its experimental robustness, it is not clear whether altruistic punishment really exists. Here, I review the anthropological literature and show that hunter-gatherers rarely punish cheaters. Instead, (...) they avoid dealing with them and switch to other partners. I suggest that these data are better explained by individual selection, and in particular by partner choice models, in which individuals are in competition to be recruited by cooperative partners. I discuss two apparent problems for partner choice theories: large-scale cooperation and punishments in economic games. I suggest that rather than favouring group selection theory, these two phenomena provide evidence in favour of individual selection: (1) people produce large-scale cooperation through institutions in which punishment is not altruistic but rewarded on an individual basis; (2) punishment in experimental games can be explained without altruism and is indeed often better explained by individual interests. What has become generally known as the Berlin School of Logical Empiricism constitutes a philosophical movement that was erected on foundations laid by Albert Einstein. His revolutionary work in physics had a profound impact on philosophers interested in scientific issues, prominent among them Paul Oppenheim and Hans Reichenbach, the founding fathers of the school, who joined in viewing him as their hero among philosopher-scientists. Overall the membership of this school falls into three groups. The founding generation was linked by the (...) circumstance that both Grelling and Reichenbach were collaborators of Oppenheim; the middle generation by the fact that both Hempel and Helmer were students of Reichenbach's in Berlin; and the younger generation by the fact that all of its members were students and disciples either of Reichenbach's or of Hempel's in the USA. Three stages are at issue: an initial phase in Berlin, a transatlantic migration, and a continuation in the U.S.A.--principally in Pittsburgh. (shrink)

This book features 20 essays that explore how Latin medieval philosophers and theologians from Anselm to Buridan conceived of habitus, as well as detailed studies of the use of the concept by Augustine and of the reception of the medieval doctrines of habitus in Suàrez and Descartes. Habitus are defined as stable dispositions to act or think in a certain way. This definition was passed down to the medieval thinkers from Aristotle and, to a lesser extent, Augustine, and played a (...) key role in many of the philosophical and theological developments of the time. Written by leading experts in medieval and modern philosophy, the book offers a historical overview that examines the topic in light of recent advances in medieval cognitive psychology and medieval moral theory. Coverage includes such topics as the metaphysics of the soul, the definition of virtue and vice, and the epistemology of self-knowledge. The book also contains an introduction that is the first attempt at a comprehensive survey of the nature and function of habitus in medieval thought. The material will appeal to a wide audience of historians of philosophy and contemporary philosophers. It is relevant as much to the historian of ancient philosophy who wants to track the historical reception of Aristotelian ideas as it is to historians of modern philosophy who would like to study the progressive disappearance of the term “habitus” in the early modern period and the concepts that were substituted for it. In addition, the volume will also be of interest to contemporary philosophers open to historical perspectives in order to renew current trends in cognitive psychology, virtue epistemology, and virtue ethics. How do humans manage to keep track of a gradually changing object or person as the same persisting individual despite the fact that the extraction of information about this individual must often rely on heterogeneous information sources and heterogeneous tracking methods? The article introduces the Empirical Tracking of Individuals theory to address this problem. This theory proposes an analysis of the concept of integrated tracking, which refers to the capacity to acquire, store, and update information about the identity and location (...) of individuals in our environment. It hypothesizes that certain functions of attention are a key to explaining how the cognitive flexibility of the human mind overcomes the heterogeneity of sources and methods in integrated tracking. At least two premises lend support to this hypothesis. First, heterogeneity of tracking sources is overcome by the combination of information from multiple perceptual modalities and a phenomenon of multisensory 'transparency'. Second, heterogeneity of tracking sources and methods may also be overcome by inferences that combine information across domains to acquire reasons to believe propositions about the target's location and identity. Artificial intelligence and robots may progressively take a more and more prominent place in our daily environment. Interestingly, in the study of how humans perceive these artificial entities, science has mainly taken an anthropocentric perspective (i.e., how distant from humans are these agents). Considering people’s fears and expectations from robots and artificial intelligence, they tend to be simultaneously afraid and allured to them, much as they would be to the conceptualisations related to the divine entities (e.g., gods). In two experiments, (...) we investigated the proximity of representation between artificial entities (i.e., artificial intelligence and robots), divine entities and natural entities (i.e., humans and other animals) at both an explicit (Study 1) and an implicit level (Study 2). In the first study, participants evaluated these entities explicitly on positive and negative attitudes. Hierarchical clustering analysis showed that participants’ representation of artificial intelligence, robots and divine entities were similar, while the representation of humans tended to be associated with that of animals. In the second study, participants carried out a word/non-word decision task including religious semantic-related words and neutral words after the presentation of a masked prime referring to divine entities, artificial entities and natural entities (or a control prime). Results showed that after divine and artificial entity primes, participants were faster to identify religious words as words compared to neutral words arguing for a semantic activation. We conclude that people make sense of the new entities by relying on already familiar entities and in the case of artificial intelligence and robots, people appear to draw parallels to divine entities.
