The relative input of payoffs and probabilities into risk judgment The study was designed to investigate the relative input of payoffs and probabilities into risk judgment on the basis of the analysis of information search pattern. The modified version of MouselabWeb software was used as an investigative tool. The amount, the kind and the order of information accessed by subjects to evaluate risk was collected from ordinary respondents and respondents trained in mathematics and statistics. In the latter group were 75 (...) students and young researchers working at National Aeronautics and Space Administration. The ordinary subjects were 67 Polish students of social sciences. As expected, the NASA group considered more information than ordinary students and searched for more information about probabilities. However, the ratio of information about payoffs to probabilities was close to 1 in both groups. Moreover, average risk rates were similar in both groups. It was also observed that risk rates were positively related with the amount of information about probabilities considered by subjects. (shrink)

The first goal of this study was to validate the Rational-Experiential Inventory (REI) and the Cognitive Reflection Test (CRT) through checking their relation to the transitivity axiom. The second goal was to test the relation between decision strategies and cognitive style as well as the relation between decision strategies and the transitivity of preferences. The following characteristics of strategies were investigated: requirements for trade-offs, maximization vs. satisficing and option-wise vs. attribute-wise information processing. Respondents were given choices between two multi-attribute options. (...) The options were designed so that the choice indicated which strategy was applied. Both the REI-R and the CRT were found to be good predictors of the transitivity of preferences. Respondents who applied compensatory strategies and the maximization criterion scored highly on the REI-R and in the CRT, whereas those who applied the satisficing rule scored highly on the REI-R but not in the CRT. Attribute-wise information processing was related to low scores in both measurements. Option-wise information processing led to a high transitivity of preferences. (shrink)

Confucian ethics as applied to the study of business ethics often relate to the micro consideration of personal ethics and the character of a virtuous person. Actually, Confucius and his school have much to say about the morals of the public administration and the market institutions in a more macro level. While Weber emphasizes the role of culture on the development of the economy, and Marx the determining influence of the material base on ideology, we see an interaction between culture (...) – specifically Confucian business ethics – and the economy. In this paper, we are going to study this interaction in several crucial stages of development of Confucianism. The paper concludes by postulating the relevance of Confucian business ethics to the global knowledge economy. (shrink)

In this paper I argue that metalinguistic negotiations are not as common as David Plunkett and Timothy Sundell assume. They make two related controversial claims: the claim that speakers don’t know what they say and the claim that they directly communicate metalinguistic contents. These two claims generate two challenges that the metalinguistic-negotiation view should meet. Firstly, it should clarify why speakers are oblivious to what they are saying and communicating, and secondly, it should explain the mechanism that transforms what seems (...) like a typical object-language disagreement into a metalinguistic dispute. I argue that the way in which Plunkett and Sundell meet these challenges is unsatisfactory. Regarding their answer to the first challenge, I’ll argue that the theoretical cost of postulating massive semantic and pragmatic blindness in otherwise competent speakers is too high. Regarding what they say in relation to the second challenge, I’ll claim that metalinguistic contents can only be conveyed when speakers uttering apparently contradicting claims know that they are using terms with different meanings. If my arguments are correct, then metalinguistic negotiations are certainly not ubiquitous. (shrink)

In this article I propose a view which explains how it is possible that the disagreement concerning clear cases of a given vague predicate is genuine, whereas that concerning borderline cases is faultless. I take the possibility of faultless disagreement concerning borderline cases to be an important characteristic of vague predicates and in my view any adequate theory of vagueness should account for it. My proposal might be called “contextual supervaluationism” and it is inspired by Kölbel's relativist view from his (...) paper “Vagueness as Semantic”. Following Kölbel I claim that the range of admissible sharpenings assumed by supervaluationism is context‐dependent, but contrary to him I maintain that we need supertruth as well as truth at a sharpening. Moreover – again unlike Kölbel – I argue that utterances concerning borderline cases are permissible. I claim, however, that such utterances should be assertives rather than assertions, since they express only a weak belief of the speaker. It is the different illocutionary forces of utterances concerning clear cases and borderline cases that make it possible to explain the distinct nature of disagreements over such cases. (shrink)

In recent years, countries have begun to establish ministries of transitional justice as part of political transitions from authoritarianism to democracy or from conflict to peace. This may reflect a broader historical trend in the administration of TJ, which has evolved from isolated offices within a particular ministry to ad hoc cross-ministry coordinating bodies to the establishment of dedicated ministries. The reasons for the establishment of specific ministries to pursue TJ, what we call ministerialization, have not attracted scholarly attention. This (...) article explores the causes and likely consequences of this development. In particular, it applies international relations, comparative politics, and public policy theories to explain the phenomenon. Contrary to some TJ literature that is concerned about hegemonic transnational discourse, international actors have played little to no role in shaping how TJ is bureaucratically managed. Rather, based upon fieldwork in Solomon Islands and Tunisia, the article concludes that ministerialization has been the result of domestic policy entrepreneurship. For TJ ministries to become a norm, however, more transnational actors will need to be convinced of the benefits of such an institutional arrangement. (shrink)

In this response to David Bradnick's and Bradford McCall's defense of Amos Yong's usage of emergence theory, we defend our previous argument regarding the tension between Yong's Pentecostal commitments and the philosophical entailments of emergence theory. We clarify and extend our previous concerns in three ways. First, we explore the difficulties of construing divine action naturalistically. Second, we clarify the problems of employing supervenience in theology. Third, we show why Bradnick's and McCall's advice to Yong to adopt weak emergence is (...) theologically costly. In conclusion, it is suggested that theologians within the science and religion dialogue should not fear, but recover, the language of supernaturalism and dualism. (shrink)

The aim of this research paper is to examine Latin in the context of legal translation between the Polish, English and French languages. Latin ap- pears in contemporary legal discourse in the form of maxims, short phrases and terms. Even though it constitutes an integral element of legal drafting, Latin often attracts little attention from legal translators. It is falsely assumed that Latin elements of the text do not require translation due to several miscon- ceptions related to the Latin language. (...) Firstly, Latin is generally perceived as a global language with no local variations in form. Secondly, Latin is believed to be the universal point of reference in international communication. Thirdly, Latin legal phrases or maxims are thought to originate solely from Roman law, thus they express only Roman legal thought. In the first part of the paper we will address the above issues. To this end, we will briefly discuss the historical presence of Latin in the European lin- guistic context. We will then present the results of our research into the use of Latinisms in the Polish, French and English legal systems. The subject of our research was a set of twenty Latin maxims and phrases that frequently appear in the decisions of the Polish courts. During the first stage of the analysis, the items in question were verified in Legalis. The second stage of the research involved the consultation of monolingual dictionaries of French and English legal language to verify the universal charac- ter of the analyzed Latinisms. During the third stage of the analysis, we looked at the practical use of Latinisms in online databases of legal texts. The paper concludes with some comments on Latinisms in lexicographical publications and online sources. (shrink)

The author analyzes the successful strategy of overcoming financial breakdown in the case study of Iceland. The aim of the article is to verify a hypothesis that the Icelandic model could become a panacea for future crises? A document analysis method is applied to present essential indicators such as GDP and trade balance. With the use of a source analysis method, the collapse of the financial sector is determined as the main cause of the slump. The systematization of crisis events (...) is introduced and deepened by the social and political situation. Changes in the state’s condition after the crash are provided and future forecasts about economic development are discussed. As a summing up, the author disapproves of the hypothesis that the Icelandic model of overcoming the financial breakdown as a panacea for future crises, pointing out that it is only applicable for specific cases and cannot be seen as a magical remedy for every kind of crisis. Filozofów zajmujących się takimi wypowiedziami można podzielić na dwie grupy: tych, którzy uważają, że albo są one zakamuflowanymi wypowiedziami zdaniowymi, albo nie są pełnoprawnymi aktami mowy, oraz tych, którzy uznają, że chociaż nie są to zdania ani w sensie syntaktycznym, ani w sensie semantycznym, to jednak można za ich pomocą dokonać aktu mowy. Opowiadam się za twierdzącą odpowiedzią na tytułowe pytanie (...) i proponuję analizę takich aktów w ramach relatywizmu umiarkowanego Recanatiego. In the first part of my paper I briefly present Jerzy Pelc’s functional approach to logical semiotics of natural language. This approach focuses on the use of natural language expressions and on its dependence on context and conversational situation. One of the important goals of this analysis is to appreciate the role of sentences in natural language and stress that it is by means of sentences that language fulfills its main roles. However, for Pelc almost any expression can be used (...) as a sentence, despite not being a grammatical sentence. In the second part I try to place Pelc’s standpoint within the framework of contemporary semantic minimalism – contextualism debate. I pay special attention to his treatment of subsentential expressions used to express propositions and argue that his view belongs to pragmatics-oriented approaches to subsentential speech acts. This paper is an attempt to show that the subvaluation theory isnot a good theory of vagueness. It begins with a short review of supervaluation and subvaluation theories and procedes to evaluate the subvaluation theory. Subvaluationism shares all the main short-comings of supervaluationism.Moreover, the solution to the sorites paradox proposed by subvaluationists isnot satisfactory. There is another solution which subvaluationists could availthemselves of, but it destroys the whole motivation for using a paraconsistentlogic and is not different from the one offered (...) by supervaluationism. W artykule zwracam uwagę na trudności jakie napotyka ktoś, kto chce wcielać w życie postulaty krytycyzmu dotyczące precyzji językowej. Zgodnie z tymi postulatami powinno się mówić jednoznacznie i precyzyjnie, a zatem unikać wyrażeń wieloznacznych, nieostrych i chwiejnych znaczeniowo. Jednakże postulaty te jest znacznie trudniej spełnić niż mogłoby się wydawać, bowiem istotne wątpliwości dotyczą samych zjawisk niejasności, nieostrości czy wieloznaczności. Wydaje się, że chcąc nauczyć innych unikania na przykład wypowiedzi wieloznacznych, powinniśmy dysponować adekwatną charakterystyką wieloznaczności i potrafić ją właściwie diagnozować. Tymczasem, (...) sytuacja jest niesamowicie zagmatwana i w literaturze czy to filozoficznej, czy językoznawczej, nie ma jednej ustalonej definicji, czy choćby zgody co do tego, które wyrażenia są wieloznaczne. Nie ma także zgody co do tego, w jaki sposób charakteryzować polisemię i jak odróżniać ją np. od zależności kontekstowej. Wątpliwości budzi także charakterystyka nieostrości i właściwego klasyfikowania przypadków granicznych wyrażeń nieostrych. Nie ma natomiast wątpliwości, że większość wyrażeń języka naturalnego jest i nieostra, i zależna od kontekstu, i jednocześnie polisemiczna. Co więcej w wielu wypadkach te cechy wcale nie są defektami naszego języka, a wręcz usprawniają komunikację i umożliwiają nam szybkie przekazanie treści. Postulat unikania tego rodzaju wyrażeń jest po prostu nierealizowalny. Kierowanie się zasadami krytycyzmu pozwala jednak na łatwiejsze dostrzeżenie i unikanie wadliwości i uchybień wobec poprawności językowej w tych sytuacjach, gdy takie wadliwości utrudniają sprawną komunikację. The book presents logical foundations of dual tableaux together with a number of their applications both to logics traditionally dealt with in mathematics and philosophy (such as modal, intuitionistic, relevant, and many-valued logics) and to various applied theories of computational logic (such as temporal reasoning, spatial reasoning, fuzzy-set-based reasoning, rough-set-based reasoning, order-of magnitude reasoning, reasoning about programs, threshold logics, logics of conditional decisions). The distinguishing feature of most of these applications is that the corresponding dual tableaux are built in a (...) relational language which provides useful means of presentation of the theories. In this way modularity of dual tableaux is ensured. We do not need to develop and implement each dual tableau from scratch, we should only extend the relational core common to many theories with the rules specific for a particular theory. (shrink)

In a recent paper Mandy Simons has argued that in a Gricean framework there is room for embedded pragmatic effects. One of her goals has been to demonstrate that an argument put forward by François Recanati to the effect that it is not possible to apply Gricean reasoning to generation of local pragmatic effects is mistaken. In his commentary Recanati maintains that the view suggested by Simons can be called Gricean only in a very broad sense and insists that the (...) process responsible for local effects is essentially different from the one which generates conversational implicatures. In my view their exchange highlights important issues concerning the way in which local pragmatic effects are generated and is worthy of a careful analysis. In what follows I critically examine Simons’s and Recanati’s views and then suggest the view that in the light of this analysis seems to me the most adequate. In particular, I argue—against Recanati—that during the interpretation process interpreters construct literal propositional nuclei, which usually fell short of being truth-evaluable but which play an important role in the interpretation. I claim that the view that assumes that such literal propositions are constructed in the process of interpretation is more universal and may be used to analyse a wider range of examples than the view that does not postulate such constructions. Nevertheless, I maintain—against Simons—that the global and local pragmatic inferences are importantly different. (shrink)

In this case study, I consider Mr. A, a Jehovah’s Witness with chronic vertebral osteomyelitis in need of surgical debridement. Prior to proceeding to the OR, he was unwilling either to explicitly consent to or refuse blood transfusion, while indicating he was open to transfusion intraoperatively, if the team judged it necessary. Ethics was consulted to determine if it would be morally justifiable for the team to proceed with blood transfusion during the course of surgery without Mr. A’s documented consent (...) to being transfused. I argue that in this case, what might be termed indirect consent—namely, delegating decision-making regarding some possible course of action without explicitly consenting to the course of action itself—may be sufficient for discharging the clinician’s ethical obligation to obtain consent. Identifying information has been changed or omitted to protect patient confidentiality. (shrink)

Industry-funded religious liberty legal groups have sought to undermine healthcare policy and law while simultaneously attacking the rights of sexual and gender minorities. Whereas past scholarship has tracked religiously-affiliated healthcare providers’ growing political power and attendant transformations to legal doctrine, our account emphasizes the political donors and visionaries who have leveraged religious providers and the U.S. healthcare system’s delegated structure to transform social policy and bureaucratic agencies more generally.

Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. This paper draws on the philosophy of Karl Popper to present a descriptive evolutionary epistemology that offers philosophical solutions to the following related problems: ‘What happens when learning takes place?’ and ‘What happens in human learning?’ It provides a detailed analysis of how learning takes place without any direct transfer of information from the environment to the learner, and it significantly extends the author's earlier published work on this topic. She proposes that learning should be construed as a special case (...) of ‘problem solving’ and as a fundamentally critical and creative process in which learning organisms develop ‘expectations’ that are not purely an outcome of genetic inheritance or random mutation. Human learning is then characterised with reference to: objectified knowledge; descriptive and argumentative language; theoretical problems; the search for error and specific limitation. If the author's evolutionary analysis of learning is valid, it would suggest that we should, if we wish to promote learning, be wary of corralling children and older students in environments that inhibit autonomous activity, that discourage criticality and creativity and generally limit opportunities for trial and error‐elimination. But education institutions, particularly those for older children and adolescents, are very often environments of this constraining kind. Traditionally, educationists have vastly underestimated the human potential for imaginative criticism—because in general they have not recognised the extent to which it lies at the heart of what humans, including the youngest children, do in order to succeed at even the most basic tasks. This innovative book explores one of the most important concepts in contemporary cultural debates: the sublime. Joanna Zylinska looks at the consequences of feminism and its rethinking of sexual differences, and how it has led to the sublime tradition. She argues that what is generally considered aesthetics can now be more productive thought of in terms of ethics instead. Looking at a range of diverse discourses—Orlan's carnal art, philosophies of the everyday, the French feminism of Cixous and Irigaray, and (...) the gender theory of Judith Butler—Zylinska intertwines the boundaries of cultural theory and textual practice to produce an ethics of the feminine sublime. The aim of this paper is to characterize a non-standard use of the method of market basket analysis in one of the areas of economy, i.e. public transport. Generally, one of the aims of the market basket analysis method is associating the consumer's market basket – in the case of public transport this being the choice of bus stops in the city area made by passengers. Owing to a new, practical use of this method, it was possible to build an (...) efficient model characterizing the movement of flows of public transport passengers, and assess the degree of transferring, thus making it possible to adapt the routes of buses to the needs of people using this particular means of transport, as well as to plot new communication lines. The data analysis was performed using the Statistica statistical package and its SAL application, i.e. the algorithms used in Data Mining. (shrink)

The purpose of the article titled „Spirituality in Management” is to outline the area for a more thorough monograph on the problem of the functioning of the spirituality in the organization. The main research question is focused on the use of the elements of spirituality in the management system and how it will improve the efficiency of human labor in organization. In the article are also provided a conceptual framework issues, some lines of analysis of the problem, which can be (...) used in future studies indicating the major benefits associated with the use of spiritual substance in the management and main threats in this area. The nature of research adopted in the article is presented in a form of exploration, which does not have the obligation to adjudge finally all the issues. The form of exploration seems to be in this particular case the appropriate due to the hard-to-describe and irrational nature of selected thematic area (spirituality) and his reference to the sphere, which has not yet been analyzed very often (organization). In the traditional business analyze, derived from economic and management theory of organizational behavior, attention is paid to the concept of prosperity, as the purpose of organizational human functioning. Interpretations of the concept of welfare proposed in the scientific literature, in many cases, are focused mainly on material prosperity. For this reason, care and activity in terms of spiritual well-being are difficult to observe in the lives of professional individuals. However, the negative effects of the elimination of the spiritual element can significantly affect the efficiency of its operation in both spheres – in professional and in private life. In the words of M. Dziewiecki „The more a person is spiritually poor, much less know how to use the material prosperity”. Man does not take account of the spiritual factor in their functioning in the organization and then the organization exposes itself to lower effects by using of resources, and consequently limit the development – waste is the lack of synergy, added value achievable with appropriate use of resources. Material prosperity without spiritual element may lead the individual to self-restraint, self-destruction. Moreover, mental and spiritual poverty of the unit can cause the poverty of the entire social groups. (shrink)

In this paper, we discuss the processes of racialisation on the example of biomedical research. We argue that applying the concept of racialisation in biomedical research can be much more precise, informative and suitable than currently used categories, such as race and ethnicity. For this purpose, we construct a model of the different processes affecting and co-shaping the racialisation of an individual, and consider these in relation to biomedical research, particularly to studies on hypertension. We finish with a discussion on (...) the potential application of our proposition to institutional guidelines on the use of racial categories in biomedical research. (shrink)

Hannah Arendt began her scholarly career with an exploration of Saint Augustine's concept of _caritas_, or neighborly love, written under the direction of Karl Jaspers and the influence of Martin Heidegger. After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. The disseration became a bridge over which Arendt traveled back and forth between 1929 Heidelberg and 1960s New York, carrying with her Augustine's question about the possibility of social life in an age of rapid political and moral change. In _Love and Saint Augustine_, Joanna Vecchiarelli Scott and Judith Chelius Stark make this important early work accessible for the first time. Here is a completely corrected and revised English translation that incorporates Arendt's own substantial revisions and provides additional notes based on letters, contracts, and other documents as well as the recollections of Arendt's friends and colleagues during her later years.
