This paper examines a number of questions about the degree to which the clinical practice of medicine is affected, if at all, by the legal systems in four countries: Chile, Germany, Japan and the United States. The focus on these four countries in four different regions of the world offers a unique perspective within which to examine medical treatment decisions made by patients and their proxies or surrogates, the potential role for universal written instruments such as advance directives, the cross-professional (...) tensions between clinical and legal concerns in very distinct cultures, and the degree to which legal activities can change or affect clinical realities in the context of these different political and health care systems. We have incorporated, whenever relevant, the insights of many disciplines, including the social sciences, in analyzing the existing interrelations between law and behavior in this specific context. Der Beitrag untersucht, inwieweit die klinische Praxis in vier Ländern mit unterschiedlichen Rechtssystemen und Berufskulturen durch Rechtsnormen oder das Verständnis von Recht beeinflußt wird. Es wird gefragt, welche Funktion rechtliche Interventionen bei der Veränderung von Verhaltensnormen in unterschiedlichen Gesundheitssystemen haben können. Folgende Themenbereiche werden diskutiert: Entscheidungen über die medizinische Behandlung, die von Patienten und ihren Angehörigen oder Stellvertretern getroffen werden; die mögliche Rolle umfassender schriftlicher Verfügungen wie z.B. der Patiententestamente ; die berufsübergreifenden Spannungen zwischen medizinischen und rechtlichen Belangen in sehr unterschiedlichen Kulturen; der Einfluß, den gesetzgeberische Aktivitäten im Kontext der verschiedenen politischen und Gesundheitssysteme auf die medizinische Wirklichkeit haben. Bei ihrer Analyse der in diesem Zusammenhang bestehenden Beziehungen im Verhältnis von Recht und Verhalten haben die Autoren die Erkenntnisse vieler Disziplinen unter Einschluß der Sozialwissenschaften, soweit sie als relevant erscheinen, in ihren Beitrag eingearbeitet. Son but est d’interroger la construction de la définition « naturalisante » des qualités attribuées à l’un et l’autre sexe. A partir de traités physiologiques sur les maladies des femmes, la réflexion porte sur trois points principaux. Pourquoi la lecture et la masturbation sont-ils devenus des problèmes médicaux? Comment un médecin neutralise-t-il le danger, pour une femme, de lire un (...) traité sur un sujet tel que la masturbation? Norbert Elias has notably influenced the historiography of the Early Modern Period since the 1970s. In the course of the borrowing of his concepts by different disciplines, the uniqueness of these concepts was nevertheless altered. This article aims to show that Elias' 'Sociology of configurations' proposed an original point of view on Longue Durée in history. It thus suggests: 1) to re-evaluate the historical dimension of Elias' sociology; 2) to question eventual contributions to present-day research to the history of medicine (...) and health. (shrink)

Dans cet article, nous décrivons un schéma et des modèles de représentation développés pour structurer les corpus de communication médiée par ordinateur (CMC) en suivant les recommandations de la Text Encoding Initiative (TEI). Nous considérons le discours CMC comme un échange dialogique entre humains, organisé de manière séquentielle. Nous insistons d’abord sur le fait que de nombreuses caractéristiques de la CMC ne sont pas traitées de manière adéquate par les schémas et les outils actuels d’encodage de corpus. Nous formulons donc (...) un ensemble de recommandations pour représenter la CMC avec des schémas d’encodage, en insistant sur le fait que la TEI nous semble être un cadre particulièrement approprié pour l’encodage des corpus CMC. Nous proposons une modélisation des unités de base de la CMC (énoncés, messages et actions non verbales) ainsi que des structures de niveaux macro- et micro des interactions dans les environnements de la CMC. À partir de ces modèles, nous introduisons le CMC-core, un noyau TEI pour l’encodage des corpus CMC, qui définit un ensemble de traits d’encodage spécifiques à la CMC sur quatre niveaux: (i) éléments, (ii) classes de modèles, (iii) classes d'attributs et (iv) modules de l'infrastructure TEI. La description du noyau proposé est illustrée au moyen d’exemples extraits des corpus des chercheurs du groupe SIG TEI CMC, représentant une grande variété de genres de la CMC (le chat, le wiki talk, le tweet, le blog, les interactions Second Life…). Le matériel décrit, i.e. les schémas, les exemples d’encodage et la documentation, est disponible sur le Wiki du SIG CMC TEI et accompagnera une demande d’enrichissement de la TEI (TEI feature request) au conseil de la TEI à la fin de l’année 2019. In a context of associational professionalization that is modifying deeply the training offer designed for volunteers in social centers, our contribution (stemming from a doctoral research) proposes to consider the volunteers› accompaniment as an opportunity for employees› professional development in charge of welcoming them. The involved research has mobilized a theoretical framework that articulates work on emerging professionalism and professional ethos (Jorro, 2009; 2011) with communities of practice theory (Wenger, 2005). Our interpretive resources enable us to make sense of, navigate, and communicate about our shared world. These resources not only carve the world up into categories, but also guide how we, individually and collectively, are oriented towards it. In this thesis, I examine how these resources, and the dispositions they guide, may be harmful. A vital kind of interpretive resources are frames, which equip us with unified perspectives on the world. Perspectives are suites of open-ended interpretive (inquisitive, attentional, inferential, evaluative, (...) and affective) dispositions. Frames thereby guide how we interpret, respond to, and navigate the world. I show that these perspectives are epistemically powerful and indispensable. I argue that flawed perspectives, and the distorting frames that produce them, are deeply pernicious and I examine their relationship to oppression. (shrink)

This paper proposes a reconciliation between libertarian freedomand causal indeterminism, without relying on agent-causation asa primitive notion. I closely examine Peter van Inwagen's recentcase for free will mysterianism, which is based in part on thewidespread worry that undetermined acts are too chancy to befree. I distinguish three senses of the term ‘chance’ I thenargue that van Inwagen's case for free will mystrianism fails,since there is no single construal of the term ‘change’ on whichall of the premises of his argument for (...) free will–causalindeterminism incompatibilism are true. Recent policy developments in the area of livestock husbandry have suggested that, from the perspective of optimizing animal welfare, new animal husbandry systems should be developed that provide opportunities for livestock animals to be raised in environments where they are permitted to engage in “natural behavior.” It is not known whether consumers regard animal husbandry issues as important, and whether they differentiate between animal husbandry and other animal welfare issues. The responsibility for the development of such systems is allocated jointly (...) between farmers, regulators, different actors in the food chain, and consumers. This research focuses on understanding consumer attitudes and preferences regarding the development and introduction of such systems, to ensure that they are acceptable to consumers as well as producers, regulators, and scientists. Consumer perceptions of animal welfare and animal husbandry practices were evaluated using quantitative consumer survey, which focused on two animal husbandry issues – farmed pigs and farmed fish. Following pilot work, 1000 representative Dutch consumers were sampled about their attitudes to either pig or fish husbandry. The results indicated that consumers think about animal welfare in terms of two broad categories related to their health and living environment, but do not think about welfare issues at a more detailed level. Greater concern was expressed about the welfare of pigs compared to fish. Consumer trust in labeling also emerged as an important issue, since consumers need to trust different food chain actors with responsibility for promoting animal welfare, and are reluctant to consider the details of animal husbandry systems. As a consequence, a transparent, enforceable, and traceable monitoring system for animal welfare friendly products is likely to be important for consumers. (shrink)

We have arrived at an inflection point, a moment in history when the sentience, conscious- ness, intelligence, agency, and even the moral agency of many nonhuman animals can no longer be questioned without ignoring centuries of accumulated scientific knowledge. Nowhere is this more true than in our understanding of nonhuman primates (NHPs). A neu- roethics committed to probing the ethical implications of brain research must be able to respond to and anticipate the challenges ahead as brain projects globally prepare to (...) increase the use of NHPs in research. This requires adopting a less anthropocentric focus that includes nonhuman animals within its scope. But the Neuroethics Roadmap represents a missed opportunity to critically examine the future direction of research with NHPs in an ethically-responsive neuroscience. (shrink)

Organ donation after the circulatory determination of death requires the permanent cessation of circulation while organ donation after the brain determination of death requires the irreversible cessation of brain functions. The unified brain-based determination of death connects the brain and circulatory death criteria for circulatory death determination in organ donation as follows: permanent cessation of systemic circulation causes permanent cessation of brain circulation which causes permanent cessation of brain perfusion which causes permanent cessation of brain function. The relevant circulation that (...) must cease in circulatory death determination is that to the brain. Eliminating brain circulation from the donor ECMO organ perfusion circuit in thoracoabdominal NRP protocols satisfies the unified brain-based determination of death but only if the complete cessation of brain circulation can be proved. Despite its medical and physiologic rationale, the unified brain-based determination of death remains inconsistent with the Uniform Determination of Death Act. (shrink)
