Definition of the problem: In Germany, clinical ethics is still in the state of development. Ethics consultation is very new and rare in the clinical setting in German university hospitals. Therefore this paper describes the clinical ethics activities at the Medical Center of Philipps University, Marburg, regard to ethics consultation in a case report. Clinical ethics rounds at the Surgical Intensive Care Unit are organized according to the theory and practice of the ethics consultation service at the Medical Center of (...) the University of Virginia, established by J.C. Over the past decade, clinical ethics has received growing attention in Germany as in most European countries. In the mid-1990s, most European countries made efforts to establish healthcare ethics committees and clinical ethics consultation services. The development of clinical ethics discourse and activities in Germany, however, was delayed and, consequently, is still in its natal phase. Until the end of the 1990s, the only institutionalized bodies of ethical reflection were the research ethics committees at university medical centers and at the (...) State Physician Chambers. In March 1997, the Catholic and Protestant hospital association in Germany recommended the implementation of HECs, modeled after the American HECs. Consequently, the establishment of clinical ethics consultation in the form of HECs started in Germany in denominational hospitals, followed by a small but increasing number of community hospitals. In the debate regarding the different possibilities for gene therapy, it is presupposed that the manipulations are limited to the nuclear genome (nDNA). Given recent advances in genetics, mitochondrial genome (mtDNA) and diseases must be considered as well. In this paper, we propose a three dimensional framework for the ethical debate of gene therapy where we add the genomic type (nDNA vs. mtDNA) as a third dimension to be considered beside the paradigmatic dimensions of target cell (somatic vs. germ-line) and (...) purpose (therapeutic vs. enhancement). Somatic gene therapy can be viewed today as generally accepted, and we review t he contemporary arguments surrounding it on the basis of bioethical-pragmatic, socio-political and deontological classifications. Many of the supposed ethical questions of somatic gene therapy today are not new; they are well-known issues of research ethics. We also critically summarize the different international perspectives and the German ethical discussion regarding manipulations of germ-line cells. (shrink)

This article gives an overview about the ethical dispute on preimplantation genetic diagnosis (PGD), its legal status and its practical usage in Europe. We provide a detailed description of the situation in Germany wherein prenatal diagnosis is routinely applied, but PGD is prohibited on the basis of the internationally unique embryo protection act (EPA) that was put into force in 1991. Both PGD and stem cell research were vigorously debated in Germany during the last four years. As regards the PGD (...) debate specifically, the voices of the ones directly affected were not adequately taken into consideration. We describe the predominant lines of argumentation in this debate and some essential results of our "bioethical field study" of opinions on and usage of PGD in Germany and their implications for the German legislation and ethical theory. The current practice of late termination of pregnancy in Germany has been criticized by the German Medical Association as well as several sociopolitical groups. The controversy has especially concerned the time limit for the termination of pregnancies and the counseling process prior to that intervention. The criticism, in part, originates from the reform of the German Abortion Law in 1995, and demands for change led to legislative initiatives in 2008.

Our programmatic article on Homo heuristicus (Gigerenzer & Brighton, 2009) included a methodological section specifying three minimum criteria for testing heuristics: competitive tests, individual-level tests, and tests of adaptive selection of heuristics. Using Richter and Späth’s (2006) study on the recognition heuristic, we illustrated how violations of these criteria can lead to unsupported conclusions. In their comment, Hilbig and Richter conduct a reanalysis, but again without competitive testing. They neither test nor specify the compensatory model of inference they (...) argue for. Instead, they test whether participants use the recognition heuristic in an unrealistic 100% (or 96%) of cases, report that only some people exhibit this level of consistency, and conclude that most people would follow a compensatory strategy. We know of no model of judgment that predicts 96% correctly. The curious methodological practice of adopting an unrealistic measure of success to argue against a competing model, and to interpret such a finding as a triumph for a preferred but unspecified model, can only hinder progress. Marewski, Gaissmaier, Schooler, Goldstein, and Gigerenzer (2010), in contrast, specified five compensatory models, compared them with the recognition heuristic, and found that the recognition heuristic predicted inferences most accurately. We actively invited scrutiny of our IVONT protocol; however, for us to seriously respond to criticisms of our publication, we suggest respectfully that those who critique the article critique the protocol that we proposed. First and foremost, we certainly do not have a regarding mitochondrial genetics.

Although Walter Benjamin's writings are considered to be among the most powerful theoretical enterprises of the twentieth century, his ideas are resistant to cooptation by the doctrines of various critical programs. These essays engage this resistance by examining the ghostly in Benjamin's work. The contributors show that the haunting truths Benjamin offers point towards new forms of responsibility. These truths reside in a figurative elsewhere, a ghostly space that his texts delimit but never fully inhabit, and these essays seek to (...) do justice to the ghosts of Benjamin. Issues explored include: the status of the image in Benjamin's literary reflections and in his meditations on cinema and visual culture; abiding Benjaminian notions of messianism, aura, reproducibility, semblance, and melancholy; Benjamin's relation to Freud; his innovative rethinking of history, virtuality, and translation; and his reflections on tragedy and prophecy, the geometrical dimensions of writing, and the relation between eros and language. The degree of success in creating quality care for people suffering from dementia is limited despite extensive research. This article describes Healthcare providers’ experience with the ethical challenges and possibilities in the relationship with patients suffering from dementia and its impact on quality care. The material is based on qualitative, in-depth individual narrative interviews with 12 professional Healthcare providers from two different nursing homes. The transcribed interview texts were subjected to a phenomenological–hermeneutical interpretation. To provide quality care to patients with (...) dementia, the Healthcare providers emphasized the importance of sensing and understanding the patients’ emotional and bodily expressions through sentient attentiveness and recognition of the patient as a person. They also described reciprocity of expressions in the relationship where the patient recognized them both as persons and Healthcare providers. The analyses of the findings are, inter alia, discussed in light of Løgstrup’s relational philosophy of ethics. (shrink)

Ausgehend von Heinrich Böll und seiner Anfang der 1960er Jahre eingeleiteten Distanzierung von der Institution Kirche, wird am Beispiel von Botho Strauß und Peter Handke, die seit den 1970er und 1980er (...) Jahren eine ins Metaphysische zielende Subjektivität repräsentieren, eine Renaissance des Religiösen konstatiert, die sich in den Werken des jüngeren Autors Ralf Rothmann seit den 1990er Jahren mit selbstbewusster Deutlichkeit fortschreibt. Anhand der geistesgeschichtlichen Trias Gnostizismus, Philosophie und Mystik nimmt die Verfasserin eine Fokussierung vor, die die ästhetischen Konzeptionen der Autoren deutlich werden lässt und sie zueinander in Beziehung setzt. This commentary argues that, in discussing the racial and cultural identities of cinematic representations of humanoid AI robots, nuances and differentiations are beneficial. It suggests that the essay on which the present text comments does not sufficiently acknowledge the range of identities found in AI films, in particular in Alex Garland's Ex Machina.

Gerhard Richter's groundbreaking study argues that the concept of "afterness" is a key figure in the thought and aesthetics of modernity. It pursues questions such as: What does it mean for something to "follow" something else? Does that which follows mark a clear break with what came before it, or does it in fact tacitly perpetuate its predecessor as a consequence of its inevitable indebtedness to the terms and conditions of that from which it claims to have departed? Indeed, (...) is not the very act of breaking with, and then following upon, a way of retroactively constructing and fortifying that from which the break that set the movement of following into motion had occurred? The book explores the concept and movement of afterness as a privileged yet uncanny category through close readings of writers such as Kant, Kafka, Heidegger, Bloch, Benjamin, Brecht, Adorno, Arendt, Lyotard, and Derrida. It shows how the vexed concepts of afterness, following, and coming after shed new light on a constellation of modern preoccupations, including personal and cultural memory, translation, photography, hope, and the historical and conceptual specificity of what has been termed "after Auschwitz." The study's various analyses—across a heterogeneous collection of modern writers and thinkers, diverse historical moments of articulation, and a range of media—conspire to illuminate Lyotard's apodictic statement that "after philosophy comes philosophy. But it has been altered by the 'after.'" As Richter's intricate study demonstrates, much hinges on our interpretation of the "after." After all, our most fundamental assumptions concerning modern aesthetic representation, conceptual discourse, community, subjectivity, and politics are at stake. (shrink)

Mental health professionals who care for asylum seekers in Western European countries increasingly encounter problems for which standard diagnostic and therapeutic protocols and institutional healthcare policies offer no ready answers. In the following case vignettes some of these problems can be identified.

Gegen das Streben der Moderne nach Widerspruchsfreiheit, Ordnung und Einheit aktiviert die Postmoderne die Begriffe Differenz, Widerstreit und Ambivalenz. Dieser Wandel lat auch die Bildungsphilosophie nicht unberuhrt. In diesem Buch wird untersucht, welche Auswirkungen postmoderne Ideen auf Bildungsphilosophie und -praxis haben konnen. Im Zentrum der Auseinandersetzung steht die Kritik an der modernen Identitats- und Subjektkategorie und der Versuch, diese aus postmoderner Sicht neu zu bestimmen und gewinnbringend auf die Erwachsenenbildung zu beziehen.

A response to Lindsay Craig's essay, The So-Called Extended Synthesis and Population Genetics.

The contrast between the two approaches alluded to in the title has gained a certain prominence in our own day. With the knowledge of hindsight it will be of interest therefore to study its incidence in an earlier period, in the writings of Whewell and Mill, Which may thus yield added significance for a later generation. Right at the start there is a difficulty. Not all inductivists agree on their principles, or their interpretation of the logic of scientific reasoning, and (...) the same is true of deductivism, and the differences can therefore be discussed only in connection with individual writers. When this is done, we do find moreover some considerable variations in the treatment of their respective doctrines by the members of each of our two schools. To define these differences, we need a finer structure of elements of classification, indicative of criteria for the acceptance of scientific hypotheses. (shrink)

A demarcation between kant's general metaphysics (transcendental principles) and his special metaphysics is attempted, through a discussion of kant's three accounts of lawlikeness, 'transcendental', 'empirical' and 'metaphysical'. the distinctions are defended via a number of 'indicators' in kant's writings, and the 'looseness of fit' between the different types of lawlikeness is discussed.
