“On Privacy” introduces philosophical arguments bearing on contemporary debates about privacy protection. The book, written for a non-academic audience, focuses on the value of privacy. Lever’s approach is refreshing. First, she sidesteps the controversies over defining privacy, settling for concepts generally associated with privacy: seclusion and solitude, anonymity and confidentiality, intimacy and domesticity. Second, Lever moves beyond the traditional arguments that value privacy because it protects the interests of individuals: what is at stake in protecting privacy is not only individual (...) interests but the democratic nature of modern societies. This article joins in and extends the contemporary debate on the right to privacy. We bring together two strands of the contemporary discourse on privacy. While we endorse the prevailing claim that norms of informational privacy protect the autonomy of individual subjects, we supplement it with an argument demonstrating that privacy is an integral element of the dynamics of all social relationships. This latter claim is developed in terms of the social role theory and substantiated by an analysis of the (...) role of privacy in intimate relationships, in professional relationships and in social interactions between strangers in public. We conclude by arguing that it is not always reasonable to assume a conflict between individual privacy on the one hand and society on the other. Legislators and participants in public debate also have to take into account the consequences of limiting privacy on social interaction and the integration of the society. (shrink)

One of the most influential views in privacy scholarship is that privacy protects individual autonomy. On the early liberal view, the exercise of autonomy requires detachment from social and political life and privacy facilitates it. This view of privacy still informs current legal and political practice. As this view of privacy presupposes a tension between privacy and society, it is responsible for the underrating of privacy in legal and political practice. Over the last decades, liberal reflection on autonomy has shifted (...) from the early liberal understanding of autonomy as calling for detachment from social life to the idea of autonomy as socially embedded. This development has brought about a corresponding adjustment in the liberal concept of privacy: privacy has come to be seen as a social rather than merely an individual interest. The social turn in thinking about privacy has gone a long way to change the problematic image of privacy in legal and political practice. It has not gone far enough, however, to draw conclusions regarding the political relevance of privacy. I argue that we should understand autonomy as politically embedded. Revised along these lines, privacy has a political value: when we claim privacy, we do not make a claim to withdraw from political life, but rather make a claim to protect certain forms of political engagement. The paper discusses the normative grounds for recognizing a watchdog role to the news media as concerns the dissemination of information about an institutional failure menacing a well-ordered society. This is, for example, the case of the news media’s role in the diffusion of whistleblowers’ disclosures. We argue that many popular justifications for the watchdog role of the news media (as a ‘fourth estate’; a trustee of the people’s right to know; expert communicator) fail to ground that role in some (...) unique feature that makes the news media special as concerns the performance of the role. We offer an alternative argument that shows how the watchdog role of the news media shares a justificatory ground with the role that any member of a well-ordered society has in terms of a general duty of answerability in the face of institutional failures. Although this duty does not bear only on the news media, we concede that in some contingent circumstances the news media might be better positioned to discharge it and, therefore, to initiate corrective actions of institutional failures effectively and conscientiously. However, the establishment of the news media’s responsibility in this sense is an empirical, not a conceptual or a normative matter. (shrink)

Much of the debate concerning political obligation deals with the question of which, if any, moral principles could make obedience to the directives of the government a matter of obligation. What makes political obligation political has not received attention in the literature on the topic. In this article I argue that the lack of systematic reflection on what makes political obligation political is responsible for the failure of a number of influential theories of political obligation. I demonstrate this failure using (...) the consent theory of political obligation as my major example. I conclude my analysis by formulating some positive conditions that a successful principle of political obligation should satisfy. (shrink)

The associative argument for political obligation has taken an important place in the debate on political obligation. Proponents of this view argue that an obligation to obey the government arises out of ties of affiliation among individuals who share the same citizenship. According to them, relationships between compatriots constitute basic reasons for action in the same way in which relationships between family members or friends do. As critics point out, this account of the normative force of relationships has counterintuitive implications: (...) if relationships between people sharing the same citizenship make up basic reasons for action, then relationships between people sharing other attributes, for example, relationships between racists or sexists form basic reasons for action too. The author raises the question of whether secret uses of power by democratic states can form a legitimate exercise of democratic authority. On the face of it, the answer seems negative. First, it is commonplace to think that in a democracy, political decisions are legitimate only if they are authorized by citizens. From this perspective, secret uses of power seem to lack democratic authority because, one argues, people cannot authorize what they are denied knowledge about. Second, the exercise of democratic (...) authority requires that citizens be able to hold officials accountable, and to do that citizens must know what officials are doing and why. Yet how can citizens call their representatives to account for secret political decisions and processes if they are denied knowledge of them? The author analyses each of these two dimensions of democratic governance and argues that secrecy, under certain conditions, may be a legitimate form of democratic governance. (shrink)

In 2013, following the leaks by Edward Snowden, The Guardian published a number of classified NSA documents. Both leaking and publishing leaks violate the law prohibiting unauthorized disclosures. Accordingly, there are two potential targets for prosecution: the leakers and the press. In practice, however, only the leakers are prosecuted: Snowden is facing a threat of 30 years’ imprisonment; no charges have been made against The Guardian. If both leaking and publishing leaks violate the law, why prosecute only the leakers and (...) not the press? I consider and reject two arguments. The first claims that the press has special moral claims by virtue of its rights or its role. The second argument states that the leakers commit a greater wrong than the press. I conclude that the current prosecution practice is inconsistent: prosecutors should either prosecute both or neither. (shrink)

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

A record of the words and teachings of Confucius, _The Analects_ is considered the most reliable expression of Confucian thought. However, the original meaning of Confucius's teachings have been filtered and interpreted by the commentaries of Confucianists of later ages, particularly the Neo-Confucianists of the Song dynasty, not altogether without distortion.In this monumental translation by Professor D. C. Lau, an attempt has been made to interpret the sayings as they stand. The corpus of the sayings is taken as an organic (...) whole and the final test of the interpretation rests on the internal consistency it exhibits. Mais comment se peut-il que l'existence d'une croyance (vraie) et l'existence du fait qui est l'objet de cette croyance puisssent constituer la même existence? Je propose ici une réponse à cette question. Parfois, une croyance peut être un désir.

We propose a kernel method for using combinations of features across example pairs in learning pairwise classifiers. Pairwise classifiers, which identify whether two examples belong to the same class or not, are important components in duplicate detection, entity matching, and other clustering applications. Existing methods for learning pairwise classifiers from labeled training data are based on string edit distance or common features between two examples. However, if two examples from the same class have few common features, these methods have difficulties (...) in finding these pairs and achieving high recall. One typical example is to check whether two abbreviated author names in different citations refer to the same person or not. Since similarities between examples from the same class become close to zero, classifiers fail to distinguish positive pairs from negative pairs. One approach to avoiding the problem of zero similarities is using conjunctions of different features across examples, but implementing this idea straightforwardly makes the computational cost prohibitive for practical problems. Using a kernel on pair instances, our method can use feature conjunctions across examples without actually doing feature mappings, which are computationally expensive. The kernel is a tensor product of two inner products on the original feature space. The corresponding feature mapping generates conjunctions of features only across the two different examples while that of the conventional polynomial kernel also generates conjunctions of features from the same example, which are irrelevant to pairwise classification and cause deterioration of accuracy. Our experiments on the author matching problem show that this method can give a precision 4 to 8 times higher than that of previous methods at medium recall levels. (shrink)

This is a study of a crucial and controversial topic in metaphysics and the philosophy of science: the status of the laws of nature. D. M. Armstrong works out clearly and in comprehensive detail a largely original view that laws are relations between properties or universals. The theory is continuous with the views on universals and more generally with the scientific realism that Professor Armstrong has advanced in earlier publications. He begins here by mounting an attack on the orthodox and (...) sceptical view deriving from Hume that laws assert no more than a regularity of coincidence between instances of properties. In doing so he presents what may become the definitive statement of the case against this position. Professor Armstrong then goes on to establish his own theory in a systematic manner defending it against the most likely objections, and extending both it and the related theory of universals to cover functional and statistical laws. The Arabic version of the Enneads is the earliest datable text in which appears the term "anniyya", that features in Avicenna’s metaphysics and lies in the background of the Latin definition of the Causa prima as esse tantum, typical of the Liber de Causis. This paper examines some examples of the use of "to be" in the Arabic translation of the Enneads. Engaging Polanyi’s embeddedness–disembeddedness framework, this study explored the work experiences of Bhil children employed in Indian Bt cottonseed GPNs. The innovative visual technique of drawings followed by interviews was used. Migrant children, working under debt bondage, underwent greater exploitation and perennial and severe depersonalized bullying, indicative of commodification of labour and disembeddedness. In contrast, children working in their home villages were not under debt bondage and underwent less exploitation and occasional and mild depersonalized bullying, indicative of how civil society organizations, (...) along with the state, attempt to re-embed economic activities in the social context. Polanyi’s double movement was evident. ‘Place’ emerged as the pivotal factor determining children’s experiences. A ‘protective alliance’ of community controls and social power, associated with in-group affiliations and cohesive ties, stemming from a common village and tribal identity, aided children working at home for Bhil farmers. ‘Asymmetric intergroup inequality’ due to pronounced social identity and class differences, coupled with locational constraints and developmental disadvantage, made migrant children vulnerable targets. Social embeddedness influences how child workers are treated because it forces employers to be ethical and not engage in bullying. However, by shifting production to children’s home villages, there is an attempt to obscure the difference between child labour and child work. Thus, the seeds of disembeddedness are sown through the very act of re-embeddeding, potentially hampering future interventions. (shrink)

This article is a preliminary presentation of conjunctive paraconsistency, the claim that there might be non-explosive true contradictions, but contradictory propositions cannot be considered separately true. In case of true ‘p and not p’, the conjuncts must be held untrue, Simplification fails. The conjunctive approach is dual to non-adjunctive conceptions of inconsistency, informed by the idea that there might be cases in which a proposition is true and its negation is true too, but the conjunction is untrue, Adjunction fails. While (...) non-adjunctivism is a well-known option, the other view is not so much studied nowadays, but it was not unknown in the tradition, and there are some positive suggestions, in recent literature, that the position is plausible and deserves to be developed. The article compares conjunctivism, non-adjunctivism and dialetheism, then focuses on some possible justifications, costs and benefits of the conjunctive view. (shrink)
