I argue that fitting resentment tracks unacceptable ‘ecological’ imbalances in relative social strength between victims and perpetrators that arise from violations of legitimate moral expectations. It does not respond purely, or even primarily, to offenders’ attitudes, and its proper targets need not be fully developed moral agents. It characteristically involves a wish for the restoration of social equilibrium rather than a demand for moral recognition or good will. To illuminate these contentions, I focus on cases that I believe demonstrate a (...) corollary thesis, namely, that strength, broadly construed, is a necessary condition of resentment-worthiness. I argue that weakness can make resentment unfitting in two ways. First, weakness may prevent a wrongdoer from shifting the balance of social power. Second, a weak wrongdoer may do social damage but be so lowly that resentment, which would represent him as excessively strong, would be inapt. Finally, I consider how accepting the ecological view might affect our theorizing about moral responsibility and the ethics of blame. (shrink)

Abstract: Contemporary analytic philosophers of the “reactive attitudes” tend to share a simple conception of guilt as “self-directed blame”—roughly, an “unpleasant affect” felt in combination with, or in response to, the thought that one has violated a moral requirement, evinced substandard “quality of will,” or is blameworthy. I believe that this simple conception is inadequate. As an alternative, I offer my own theory of guilt’s logic and its connection to morality. In doing so, I attempt to articulate guilt’s defining thought (...) or proposition through an extended investigation and analysis of guilt’s many competing metaphors, which I trace from the Hebrew Bible to the New Testament to Shakespeare to contemporary vernacular. My interpretation of this literary genealogy offers a way to understand guilt’s seemingly disparate metaphors in terms of a single master-image that illuminates our self-conceptions and our relationship to morality. I conclude by making a very brief start toward a moral vindication of guilt against the backdrop of Nietzschean and Freudian analyses that explicitly call guilt’s place in a healthy social and personal life into question. I suggest that once guilt’s logic is made explicit, we can see that it makes sense of, honors, and addresses some of our deepest aspirations and needs. (shrink)

The extended evolutionary synthesis intends to offer a new framework for understanding evolution based mainly on empirical and theoretical findings of current studies, including heredity and evolutionary developmental biology. In this essay, we present and develop the following objections about the terminology associated with the EES literature: despite using the term "extension," EES protagonists claim new evolutionary processes, reformulate conceptual networks, and modify central assumptions of the evolutionary synthesis. Therefore, the difference between ES and EES should not be described in (...) terms of a set-subset relationship ; despite using the term "synthesis," the EES leads, at least in the short term, to a pluralism of approaches in evolutionary biology. Thus, we argue that the EES should not be described as a synthesis, but as a broad and plural interpretative framework encompassing different approaches. These objections are not directed to the proposed changes, but to the interpretation of these changes as a mere expansion of the previous evolutionary framework, as well as to the interpretation of the EES as a synthesis. Based on these objections, we seek to present some explanations for the use of the term "extended synthesis" among its protagonists. (shrink)

Contemporary philosophers of moral responsibility are in widespread agreement that we can only be blamed for actions that express, reflect, or disclose something about us or the quality of our wills. In this paper I reject that thesis and argue that self disclosure is not a necessary condition on moral responsibility and blameworthiness: reactive responses ranging from aretaic appraisals all the way to outbursts of anger and resentment can be morally justified even when the blamed agent’s action expresses or discloses (...) nothing significant about his or her “deep self,” judgments and cares, or the quality of his or her will. I argue that the self-disclosure requirement on responsibility overestimates the extent to which our blaming practices and responsibility judgments are responsive to agents as opposed to actions, and that this mistake has the potential to distort both our reactive responses and our understanding of blamed agents’ characters. In this paper, I argue that the principle of respect for autonomy can serve as the basis for laws that significantly limit conduct, including orders mandating isolation and quarantine. This thesis is fundamentally at odds with an overwhelming consensus in contemporary bioethics that the principle of respect for autonomy, while important in everyday clinical encounters, must be 'curtailed', 'constrained', or 'overridden' by other principles in times of crisis. I contend that bioethicists have embraced an indefensibly 'thin' notion of autonomy that (...) uproots the concept from its foundations in Kantian ethics. According to this thin conception, respect for autonomy, if unconditioned by competing principles (beneficence, justice, non-maleficence) would give competent adults the right to do anything they desired to do so long as they satisfied certain baseline psychological conditions. I argue that the dominant 'principlist' model of bioethical reasoning depends on this thin view of autonomy and show how it deprives us of powerful analytical tools that would help us to think seriously about the foundations of human rights, justice, and law. Then, I offer a brief sketch of a 'thick', historically grounded notion of autonomy and show what we could gain by taking it seriously. (shrink)

Recent years have seen the rise of ‘Just Culture’ as an ideal in the patient safety movement, with numerous hospitals and professional organisations adopting a Just Culture response to incidents ranging from non-culpable human error to intentional misconduct. This paper argues that there is a deep problem with the Just Culture model, resulting from its impoverished understanding of the value of punitive, fundamentally backward-looking, practices of holding people accountable. I show that the kind of ‘accountability’ and ‘punishment’ contemporary Just Culture (...) advocates endorse disrespects both patients and providers. I claim, first, that punishment is good because it respects participants in the healthcare system by restoring an equilibrium of social and moral status that wrongdoing disturbs, and, second, that it only does so when it communicates a backward-looking message of resentful blame. Recent years have seen a surge of interest in implicit bias. Driving this concern is the thesis, apparently established by tests such as the IAT, that people who hold egalitarian explicit attitudes and beliefs, are often influenced by implicit mental processes that operate independently from, and are largely insensitive to, their explicit attitudes. We argue that implicit bias testing in social and empirical psychology does not, and without a fundamental shift in focus could not, establish this startling thesis. We suggest (...) that implicit bias research has been conducted in light of inadequate theories of racism and sexism. As a result, such testing has not sufficiently controlled for subjects’ prejudiced explicit beliefs and emotions, and has not ruled out the possibility that explicit prejudice best explains test subjects’ discriminatory associations and behavior. SummaryThe article considers the development and the diversity of the understandings of the Norman Conquest in Jacobean England. In 1603, James VI of Scotland ascended the throne of England, and one of his first policies to unify the two kingdoms culminated in failure in face of English opposition. Modern historians have demonstrated that at the heart of this quick collapse lay a constitutional struggle—the English fear of the loss of their sovereignty. Taking this as the vantage point, the article examines (...) a number of historical publications composed by English lawyers in the following decade. The Jacobean period witnessed a significant proliferation of historical literature, and modern historians have stressed that English common lawyers staunchly adhered to a belief in the ancient constitution, a belief in the antiquity of English law that was counter to royal policies. The article demonstrates how the Union debate, despite its eventual collapse, produced unparalleled interest in the meaning of conquest in the 1610s. It also considers the works of civil lawyers in comparison. By comparing the differing accounts of the Norman Conquest, the article ultimately demonstrates the contested nature of James's kingship in England. (shrink)

In this paper, we argue that providers who conscientiously refuse to provide legal and professionally accepted medical care are not always morally required to refer their patients to willing providers. Indeed, we will argue that refusing to refer is morally admirable in certain instances. In making the case, we show that belief in a sweeping moral duty to refer depends on an implicit assumption that the procedures sanctioned by legal and professional norms are ethically permissible. Focusing on examples of female (...) genital cutting, clitoridectomy and ‘normalizing’ surgery for children with intersex traits, we argue that this assumption is untenable and that providers are not morally required to refer when refusing to perform genuinely unethical procedures. The fact that acceptance of our thesis would force us to face the challenge of distinguishing between ethical and unethical medical practices is a virtue. This is the central task of medical ethics, and we must confront it rather than evade it. There are no data in this work. (shrink)

Im Zentrum des Buches steht ein kurzer Traktat des Albinos, der sogenannte Prologos. Albinos ist geistesgeschichtlich dem Mittelplatonismus zuzuordnen, der Phase des antiken Platonismus, die dem um 250 n.Chr. einsetzenden Neuplatonismus Plotins vorausging. Der antike Autor fuhrt den Leser seines Prologos mit folgenden Fragen an die Dialoge Platons heran: Was ist ein Dialog? In welche Typen lassen sich die Platonischen Dialoge einteilen? Mit welchem Dialog soll das Studium der Platonischen Dialoge beginnen? Welche Anordnung der Dialoge ist Platons Philosophie angemessen? Der (...) Prologos wurde in der alteren Forschung aus verschiedenen Grunden vernachlassigt: Zum einen glaubte man, die philosophische Position des Albinos besser aus dem umfangreicheren Didaskalikos, der ihm zunachst zugewiesen wurde, rekonstruieren zu konnen; zum anderen sahen die meisten Forscher in dem Prologos nur eine schlecht gearbeitete Zusammenfassung (Epitome). Diese Vorurteile grundeten auf der Monographie "Der Platoniker Albinos und der falsche Alkinoos", die J. Freudenthal 1879 publizierte. Seit einigen Jahren wird der Didaskalikos jedoch wieder Alkinoos, einem nur in den Handschriften auftauchenden und ansonsten unbekannten Autor, zugewiesen. Somit wurde der Weg fur eine unvoreingenommene Neubewertung des Prologos frei.Das Buch beginnt mit einem Uberblick uber die Forschungsgeschichte zum Prologos. Ein Durchgang durch Leben, Werk und Lehren des Albinos mundet in eine Einordnung des Traktats unter die Testimonien zu Albinos und dessen Lehrer Gaios. In einem dritten Abschnitt wird in dem Buch die zentrale Frage diskutiert, worum es sich bei dem Prologos handelt, um ein Exzerpt oder eine Epitome. Aus einer philologischen und philosophiehistorischen Untersuchung der Textstellen, die von Freudenthal in seiner oben erwahnten Monographie als verderbt beanstandet wurden, geht hervor, dass es sich bei dem Prologos um ein Exzerpt und nicht um eine Epitome handelt. In einem vierten Kapitel wird mittels eines formalen und funktionalen Vergleichs des Prologos mit spateren Einfuhrungsschriften dessen spezifischer Charakter herausgearbeitet: Der Prologos gibt sich als unkorrigierte Mitschrift einer Vorlesung zu erkennen und gewahrt als solche Einblick in den Horsaal eines Platonikers der Kaiserzeit. In einem langeren funften Abschnitt wird die handschriftliche Uberlieferung dargelegt und kritisch betrachtet. Reis beschreibt hier ausfuhrlich 21 griechische Handschriften und eine lateinische Ubersetzung unter kodikologischen, historischen und palaographischen Gesichtspunkten. Die Verflechtung der Textgeschichte mit derjenigen Platons und spaterer Platoniker macht diese Untersuchung wunschenswert. Die Abhangigkeit der Handschriften voneinander wird ermittelt, worauf eine kritische Edition des Prologos folgt. Die beigegebene Ubersetzung macht den Text auch interessierten Nicht-Grazisten zuganglich. (shrink)

This chapter argues that adequately facing and responding to medical error requires making space for blame. In vindicating blame as a response to medical error, this essay does not advocate a return to a “bad apple” blame culture in which unlucky practitioners are unfairly scapegoated. It does, however, defend the targeted feeling and expression of angry, and even resentful, blaming attitudes toward health-care providers who make at least certain kinds of mistakes. The chapter makes the case that the angry and (...) resentful feelings associated with blame reflect a conception of oneself as a person worthy of consideration, and that expressing these feelings allows victims and families to fight for their dignity and self-respect. Along the way, it distinguishes between shaming and blaming, explaining that blaming, unlike shaming, characteristically aims to draw offenders into a moral dialogue. As a result, a good blaming practice can provide a logic within which providers who make costly errors may seek forgiveness, reconciliation, and healing. (shrink)

In the first half of the 20 th century, philosophers of science used to sustain that the correct theory acceptance in science derived from their conforming to certain rules. However, from the historicist and practical turn in the philosophy of science, the theory acceptance started to be analyzed based on values rather than on a priori established rules. In this article, I will present four paradigmatic positions on the role of values in science. The first position, articulated by Hugh Lacey, (...) defends a regulative ideal of 'impartiality' in the acceptance of scientific theories as established. The other positions convey arguments that seem to conflict with this ideal. I characterize them as 'blind spot argument', 'inductive risk argument' and 'trust-based acceptance argument'. Based on this analysis, I will defend two main theses. My first thesis is that the ideal of impartiality is compatible with the arguments just mentioned. My second thesis is that the defense of impartiality has the advantage of providing a support for the epistemic authority of properly established scientific knowledge. Following Lacey, I will argue that theories can only be accepted as established under specified domains of phenomena. However, theories are accepted for other purposes, for example, when they are adopted to develop research or when they are endorsed to inform the legitimacy of an action. In such cases of theory acceptance, impartiality is neither possible nor desirable, which requires the support of other ideals. (shrink)

Este texto procura explorar alguns aspectos dessa ligação entre igualitarismo e liberdade como não dominação, a partir da teoria da democracia proposta por Rousseau no Contrato social.

This paper discusses the semiotic dimension of patent interpretation. Patent documents are at the same time disclosure of information and a granting of rights. The claim section expresses the granted rights. In this paper, we view the claims as signs that express the granted rights. The semantics to interpret the signs is given by the all-elements rule, as pragmatics. The description and drawings sections of the patent document provide metapragmatics in the form of lexicon and syntax to help the understanding (...) the claims as signs that express the granted rights. This semiotic approach for patent interpretation has important practical consequences to the correct structuring of a patent document. We highlight this contribution through an instance of a patent application in which a claim includes examples of use. Examples are not allowed in the claim text, as examples do not describe the invention, but consist of metapragmatics to better understand the invention. In this way, examples consist of metapragmatics and belong to the description section of the patent, which has the goal to facilitate the understanding of claims. In the patent application used to highlight our semiotics approach for patent interpretation, the examples initially presented in the claims were rephrased in the final granted patent, significantly reducing the scope of the claim. The most important aspect of the Ernst Bloch`s philosophy is based in the statement: “S is not yet P” - an ontological premise that underlies all ramifications of his thinking. In this sense, Bloch says: “the proletariat is not yet sublated, nature is not yet home, the real is not yet articulated reality”, all this is in process, and the task of philosophy is to considerer the real possibilities of what is not-yet-become and change the world in accordance with what (...) could be. Our intention is to contribute to the investigation of the fundamental premises of Blochian thought, especially his ontology of the not-yet, based on a theory of possibilities that intends to reinterpret the Aristotelian concept of matter. El objetivo de este texto es proponer una reflexión sobre las teorías sobre la cultura o de la literatura originaria en los diferentes países del Caribe y su presencia en los estudios literarios y culturales del continente. Dibujado con amplias pinceladas, tiene el objetivo de poner en claro el ensayo titulado La isla que se repite (1998) del cubano Antonio Benítez Rojo y, a partir de su lectura, nos aproximamos de la canción Haití, de Caetano Veloso y Gilberto Gil, grabada (...) originalmente en el CD Tropicalia II, de 1993.Los planteos de Benítez Rojo traen elementos que se encuentran en la base de nuestra cultura, marcada por la presencia de los negros y de su cultura por toda América. De cada área y de cada región brotó un tipo de música y ritmo que tiene como rasgo común constituirse en una voz contra la tiranía. El negro spiritual, entonado en las iglesias de América del norte, el jazz, el blues, el samba, el son, el tango, la rumba, la salsa, el merengue, la cumbia, prácticamente todas las expresiones musicales de América, están relacionadas con la música y el ritmo producido por los negros desde que, por primera vez, pusieron los pies en nuestro continente. Exploring anxieties raised by Atlantic slavery in radical enlightenment literature concerned about political unfreedom in Europe, Metaracial argues that Hegel's philosophy assuages these anxieties for the left. Interpreting Hegel beside Rousseau, Kant, Mary Shelley, and Marx, Terada traces Hegel's transposition of racial hierarchy into a hierarchy of stances toward reality. By doing so, she argues, Hegel is simultaneously antiracist and antiblack. In dialogue with Black Studies, psychoanalysis, and critical theory, Metaracial offers a genealogy of the limits of antiracism.

In Looking Away, Rei Terada revisits debates about appearance and reality in order to make a startling claim: that the purpose of such debates is to police feelings of dissatisfaction with the given world. Terada proposes that the connection between dissatisfaction and ephemeral phenomenality reveals a hitherto-unknown alternative to aesthetics that expresses our right to desire something other than experience "as is", even those parts of it that really cannot be otherwise.

Neonatal suffering has been the focus of recent debate in pediatric bioethics and suffering theory. How to access and conceptualize the suffering that can be attributed to newborns? How to discern the suffering of newborns who, due to being non-neurotypical, may have a short life and severe neurocognitive disabilities, in addition to being entirely dependent on people or life-sustaining technologies? Phenomenology has provided valuable tools for analysing human experiences of suffering, but its application to the neonatal suffering experience is not (...) without fundamental challenges. In this article, I will consider recent contributions to elucidating the phenomenon of neonatal suffering, especially those in the field of non-experiential theories of suffering. Based on this review, a recent phenomenological approach to suffering will be examined. Explicitly directed toward narrative persons, this approach appears to be inherently limited in elucidating the phenomenon of neonatal pediatric suffering. Nevertheless, a suggestion will be offered to partially elaborate the theoretical foundations of a phenomenological theory of neonatal suffering. This suggestion points to the program of a phenomenology of the existential feelings of newborns. (shrink)

A 35-year-old woman presents to the hospital after a fall at home. A routine medical history and physical examination reveal that the patient identifies as intersex, and an X-ray of the left hip demonstrates profound osteopenia. The patient is admitted to the hospitalist service for further evaluation. What does it mean to identify as intersex? In the medical world, “intersex” is usually referred to as DSD, or “disorders of sex development.” Until the 1990s, physicians referred to this condition as hermaphroditism, (...) but this label is no longer used because it evokes mythical creatures rather than real human beings. This study examined associations between interpersonal competence and achievement motivation. Interpersonal competence is defined as a person’s ability to interpersonally make a relationship to other person. Interpersonal competence have five aspects, which is the ability to inisiat ive , the ability to openness to the other people, the ability to assertiveness, the ability to give support, and the ability to master conflict. Achievement motivation is a drive inside the person to overcome a challenge and to reach some goal. Participants (N (...) = 88) in this study were employees who work at PT X and were chosen using the accidental sampling method and judgmental sampling method.. Using Buhrmester, Furman, Wittenberg, and Reis’s interpersonal competence theory and McClelland’s achievement motivation theory, the results of this correlation is r(88) = 0.742 with significance P < 0.01 showed that there was strong associations between interpersonal competence and achievement motivation. The literature presents a broad approach to Corporate Social Responsibility, which aggregates a diversity of issues, such as the environment, labor conditions, and human rights. We addressed the impact of increasing CSR demands during the internationalization of emerging market multinationals on one particular subject, animal welfare. This subject raises important ethical concerns, especially as we understand that animals are sentient beings. Through content analysis of annual reports, we tracked the evolution of AW-CSR activities throughout the internationalization of two large Brazilian (...) meat-processing multinationals as they accessed markets with complex AW regulations. We also synthetized findings on broiler chicken on-farm AW research in Brazil and conducted interviews to gauge the impact of CSR standards on animals. Our findings show that, although EMNs that enter developed markets engage with various standards, the impacts of standard enforcement on actual welfare are not straightforward and call for broader AW and animal ethics developments. Uneven results among AW criteria indicate that some aspects are prioritized over others. Furthermore, some actions of actors such as EMNs and low-tier suppliers seem to counterbalance the expected impact of normative pressures to change the lives of animals for the better. We conclude that AW standards may improve AW in emerging markets; but these standards do not appear to be sufficiently stringent, and require improvements to have a more significant positive impact. A major signal emerging from this research is the fundamental need to broaden the animal ethics debate regarding the use of animals to produce meat. (shrink)

Literary writing in the digital era is evolving using languages that have a much greater dynamic potential than those known hitherto. The very phrase `text processing' implies the notion of writing `in process', which has very recently been joined by another possibility, the unrestricted circulation of texts on networks on a worldwide scale, without spatial limits and in real time. In the arena of writing that is no longer simply textual but hypertextual, literary writing is becoming highly dynamic, intertextual, fragmentary, (...) interactive and playful. In this article the author discusses the implications of digital publishing and warns of the unexpected consequences of replacing the book, entirely or partly, with new instruments and techniques of communication and information. There's no doubt that reproductive technologies can transform lives for the better. Infertile couples and single, lesbian, gay, intersex, and transgender people have the potential to form families in ways that would have been inconceivable years ago. Yet we are concerned about the widespread commercialization of certain egg‐freezing programs, the messages they propagate about motherhood, the way they blur the line between care and experimentation, and the manipulative and exaggerated marketing that stretches the truth and inspires false hope in women (...) of various ages. We argue that although reproductive technology, and egg freezing in particular, promise to improve women's care by offering more choices to achieve pregnancy and childbearing, they actually have the potential to be disempowering. First, commercial motives in the fertility industry distort women's medical deliberations, thereby restricting their autonomy; second, having the option to freeze their eggs can change the meaning of women's reproductive choices in a way that is limiting rather than liberating. Educational policy and social sciences researchers have been studying dishonest behaviors among students for a long time. In this bibliometric study we examine the extant literature on academic dishonesty until 2017. We also analyze the specific case of the literature on plagiarism since it is arguably one of the most common academic dishonest behavior. We aim at identifying the intellectual structure of the field of academic dishonesty and plagiarism. Results show that Donald L. McCabe and Richard L. Marsh appear as (...) the most productive authors. Furthermore, Whitley, 235–274, 1998) “Factors associated with cheating among college students: A review”, and Pennycook, 201–230, 1996), entitled “Borrowing others’ words: Text, ownership, memory, and plagiarism” are the most cited publications on academic dishonesty and on plagiarism, respectively. Additionally, a strong connection between the McCabe and Treviño articles emerged from the co-citation analysis on academic dishonesty, and also a strong relationship between Pennycook, 201–230, 1996) and Pecorari, 317–345, 2003), suggesting that these articles are strongly connected. Results suggest that these are the most influential authors and articles of the field. (shrink)
