In 1603, James VI of Scotland ascended the throne of England, and one of his first policies to unify the two kingdoms culminated in failure in face of English opposition. Modern historians have demonstrated that at the heart of this quick collapse lay a constitutional struggle—the English fear of the loss of their sovereignty. Taking this as the vantage point, the article examines (...) a number of historical publications composed by English lawyers in the following decade. The Jacobean period witnessed a significant proliferation of historical literature, and modern historians have stressed that English common lawyers staunchly adhered to a belief in the ancient constitution, a belief in the antiquity of English law that was counter to royal policies. The article demonstrates how the Union debate, despite its eventual collapse, produced unparalleled interest in the meaning of conquest in the 1610s. It also considers the works of civil lawyers in comparison. By comparing the differing accounts of the Norman Conquest, the article ultimately demonstrates the contested nature of James's kingship in England. (shrink)

Abstract: Contemporary analytic philosophers of the “reactive attitudes” tend to share a simple conception of guilt as “self-directed blame”—roughly, an “unpleasant affect” felt in combination with, or in response to, the thought that one has violated a moral requirement, evinced substandard “quality of will,” or is blameworthy. I believe that this simple conception is inadequate. As an alternative, I offer my own theory of guilt’s logic and its connection to morality. In doing so, I attempt to articulate guilt’s defining thought (...) or proposition through an extended investigation and analysis of guilt’s many competing metaphors, which I trace from the Hebrew Bible to the New Testament to Shakespeare to contemporary vernacular. My interpretation of this literary genealogy offers a way to understand guilt’s seemingly disparate metaphors in terms of a single master-image that illuminates our self-conceptions and our relationship to morality. I conclude by making a very brief start toward a moral vindication of guilt against the backdrop of Nietzschean and Freudian analyses that explicitly call guilt’s place in a healthy social and personal life into question. I suggest that once guilt’s logic is made explicit, we can see that it makes sense of, honors, and addresses some of our deepest aspirations and needs. (shrink)

In Looking Away, Rei Terada revisits debates about appearance and reality in order to make a startling claim: that the purpose of such debates is to police feelings of dissatisfaction with the given world. Terada proposes that the connection between dissatisfaction and ephemeral phenomenality reveals a hitherto-unknown alternative to aesthetics that expresses our right to desire something other than experience "as is", even those parts of it that really cannot be otherwise.

Este escrito pretende pensar o modo de organização capitalista como gerador de pandemias. Como sistema que age a partir do modus operandi predatório, o capitalismo oferece grandes possibilidades para liberação e circulação de patógenos, bem como sua mutação. A partir das pesquisas do filogeógrafo Rob Wallace, apresentaremos como o atual modo de produção se (...) constitui o principal responsável pela crise pandêmica. Isto nos leva a indagar sobre um outro ethos possível. Que alternativa ética pode se contrapor ao ethos capitalista? Há algum princípio fundamental que possa guiar a ação em contraposição ao modelo atual? Recent years have seen a surge of interest in implicit bias. Driving this concern is the thesis, apparently established by tests such as the IAT, that people who hold egalitarian explicit attitudes and beliefs, are often influenced by implicit mental processes that operate independently from, and are largely insensitive to, their explicit attitudes. We argue that implicit bias testing in social and empirical psychology does not, and without a fundamental shift in focus could not, establish this startling thesis. We suggest (...) that implicit bias research has been conducted in light of inadequate theories of racism and sexism. As a result, such testing has not sufficiently controlled for subjects’ prejudiced explicit beliefs and emotions, and has not ruled out the possibility that explicit prejudice best explains test subjects’ discriminatory associations and behavior. Esse artigo teórico tem como objetivo discutir o problema do suicídio praticado por homens e suas implicações para os serviços de atenção básica à saúde. Utilizou-se o método da revisão narrativa, uma forma de pesquisa que visa contribuir para a reflexão e a discussão sobre um assunto sem pretender reproduzir dados ou responder questões quantitativas específicas. Tendo como base os descritores “suicídio”, “homem” e “saúde”, identificou-se a partir das plataformas Scielo e Pubmed 56 artigos produzidos nos últimos cinco anos em (...) português e inglês, dentre os quais seis foram selecionados. A análise dos resultados indica que no Brasil as ocorrências de suicídio são mais elevadas nas Regiões Sul e Centro Oeste, onde cerca de 70% dos casos são de homens jovens que optam pelo enforcamento. Pode-se identificar como causa aspectos sociais, econômicos, relacionais, psicológicos e aspectos culturais que implicam transformações nas formas como a sociedade vê os homens e na necessidade de que eles reconheçam suas fragilidades. As masculinidades tradicionais precisam ser revistas a fim de que lhes seja possível reconhecer suas limitações diante da vivência de problemas emocionais, buscando-se superar sua recusa a buscar ajuda nos momentos de fragilidade e intenso sofrimento. Conclui-se que os serviços básicos precisam dinamizar suas ações e promover campanhas preventivas, participação da comunidade, facilitação do acesso a profissionais da saúde mental e diversificação de abordagens, compreendendo o suicídio praticado por homens em suas especificidades. Enquanto problema de saúde pública, o suicídio precisa ser abordado de forma preventiva com ações voltadas para o público em geral, sendo importante compreender sua complexidade no que se refere às questões das masculinidades. Several countries maintain universal health coverage, which implies responsibility to organize delivery formats of healthcare services and products for citizens. In Brazil, the health system has a principle of universal access for more than 30 years, but many deficiencies remain and the country observes a day practice for those seeking judicial decisions to determine provision of healthcare.

No Brasil, a vida nas cidades, o habitar e as diversas formas de se relacionar e de produzir o espaço entre os citadinos vêm adquirindo novas configurações nas últimas décadas. A partir disso, a cidade na contemporaneidade apresenta-se como um importante elemento analítico pela dinâmica histórica, econômica, política, cultural e espacial que lhe é inerente. Como efeito dos processos espaciais, novas paisagens, formas, estruturas e conteúdos eclodem no tecido urbano, transformando e impactando a vida social em suas diversas escalas. Partindo (...) disso, este artigo analisa o processo de fragmentação espacial na cidade de Montes Claros/MG sob a perspectiva da mobilidade urbana. Para essa finalidade, realizou-se o levantamento, e, posterior análise das recentes obras de mobilidade realizadas pelo poder público na cidade após o ano de 2018, com registro iconográfico. Todavia, esta ação do poder público deve ser compreendida de forma ampla e crítica, pois, evidenciou-se, a partir de aspectos da mobilidade urbana, características gerais de fragmentação espacial nesta cidade média. Tal processo se materializa, entre outros condicionantes, pela segmentação do tecido urbano, em razão, especialmente, dos usos sociais distintos do espaço. A metodologia adotada foi quali-quantitativa, com análise teórica, pesquisa documental e pesquisa de campo. (shrink)

Neste texto, discutimos disposições teórico-metodológicas do Grupo de Estudos sobre Numeramento (GEN), na busca de compreender os modos como pessoas, em suas singularidades, mas como sujeitos sociais, se apropriam de práticas matemáticas, tomadas como práticas discursivas. A pesquisa, a formação docente e a atuação do GEN em contextos educativos diversos inserem-se nos campos da Educação Matemática e do Letramento, pois buscam conhecer sujeitos da Educação (crianças, adolescentes, jovens, pessoas adultas e idosas), que, vivendo em sociedades ‘grafocêntricas’ e ‘quanticratas’, movidos por (...) intenções pragmáticas e parametrizados por referências culturais, forjam usos dos sistemas linguísticos relacionados à quantificação, mensuração, ordenação, classificação e organização de formas e espaços. A esses usos chamamos práticas de numeramento. As situações em que as identificamos – os eventos de numeramento –, em seu caráter histórico, são tomadas como unidades da análise das intenções dos usos, dos efeitos de sentido que logram produzir e, principalmente, de como sujeitos se constituem nas interações por eles mediadas, ao produzirem e tensionarem significados. Na seção ‘Compreendendo práticas matemáticas como práticas discursivas: foco, perspectiva e referenciais teórico-metodológicos do Grupo de Estudos sobre Numeramento (GEN)’: explicitamos o propósito do Programa de Pesquisa do Grupo (conhecer sujeitos e grupos sociais que protagonizam práticas de numeramento); justificamos sua base teórica (os Estudos do Letramento como Prática Social; a Pedagogia da Liberdade e da Autonomia; a compreensão da cognição como processo social; e a abordagem sociológica da Linguagem); assumimos a etnografia como lógica de investigação; e propomos a análise de interações como principal tratamento do material empírico. Apontamos também, dadas as especificidades dos sujeitos, a necessidade do diálogo com diversos campos: Educação de Pessoas Jovens, Adultas e Idosas (EJA), Sociologia da/s Infância/s; Estudos da/s Juventude/s; Educação do Campo; Educação Indígena; Educação de Pessoas Surdas; Formação Docente, entre outros. Na seção ‘Compreendendo práticas de numeramento como práticas de letramento: fertilidade analítica e pedagógica das escolhas teóricas’, esclarecemos como nossos estudos se inserem numa perspectiva Etnomatemática, porque contribuem para conhecermos os sujeitos que vemos protagonizar práticas matemáticas ao assumirem posições discursivas – portanto, sociais, culturais e políticas. Na seção ‘Compreendendo a aprendizagem matemática como apropriação de práticas de numeramento: desdobramentos da concepção de práticas matemáticas como práticas discursivas’, apresentamos como o conceito de apropriação de práticas de numeramento, de inspiração vigostskiana, usado para contemplar múltiplos sentidos das ações dos sujeitos em eventos de numeramento, disponibiliza uma ferramenta teórica para compreender a aprendizagem matemática não como experiência cognitiva individual, mas como ação social. Na seção ‘Interlocuções teóricas e disposições analíticas dos estudos mais recentes do GEN’, indicamos como uma análise tridimensional do discurso (do texto, da situação discursiva e da prática social), adotada para conhecer melhor os sujeitos e reconhecê-los como sujeitos sociais, tem-nos conduzido às considerações de Paulo Freire sobre sujeito de cultura, sujeito de conhecimento, sujeito dialógico e sujeito do processo, que compõem o sujeito histórico, protagonista de eventos de numeramento. Na ‘coda’ (‘Reiterando’), reafirmamos o foco de nossa linha de investigação no campo da Educação Matemática: pessoas constituindo-se como sujeitos sociais, enquanto se apropriam de práticas de numeramento. This study examined associations between interpersonal competence and achievement motivation. Interpersonal competence is defined as a person’s ability to interpersonally make a relationship to other person. Interpersonal competence have five aspects, which is the ability to inisiat ive , the ability to openness to the other people, the ability to assertiveness, the ability to give support, and the ability to master conflict. Achievement motivation is a drive inside the person to overcome a challenge and to reach some goal. Participants (N (...) = 88) in this study were employees who work at PT X and were chosen using the accidental sampling method and judgmental sampling method.. Using Buhrmester, Furman, Wittenberg, and Reis’s interpersonal competence theory and McClelland’s achievement motivation theory, the results of this correlation is r(88) = 0.742 with significance P < 0.01 showed that there was strong associations between interpersonal competence and achievement motivation. O principal objetivo de Micheal Sandel, no livro Liberalismo e os limites da justiça, foi atacar o conceito de deontologia de John Rawls. Nesse artigo, pretende-se argumentar que Sandel interpretou o conceito de deontologia de um modo equivocado. Há uma diferença entre a forma como Rawls definiu este conceito e a maneira como foi interpretado por Sandel. Dado isso, na primeira parte desse artigo, será analisado o modo como Sandel interpretou o conceito de deontologia na filosofia de Rawls. A segunda (...) parte apresenta uma avaliação do confronto entre os dois autores à luz da diferença no modo como ambos compreendem o significado da deontologia no liberalismo político. (shrink)

Exploring anxieties raised by Atlantic slavery in radical enlightenment literature concerned about political unfreedom in Europe, Metaracial argues that Hegel's philosophy assuages these anxieties for the left. Interpreting Hegel beside Rousseau, Kant, Mary Shelley, and Marx, Terada traces Hegel's transposition of racial hierarchy into a hierarchy of stances toward reality. By doing so, she argues, Hegel is simultaneously antiracist and antiblack. In dialogue with Black Studies, psychoanalysis, and critical theory, Metaracial offers a genealogy of the limits of antiracism.

The main purpose of this paper is the formulation of a hypothesis about the internal link between the laughing and the thinking of Being, offering some guidelines for a systematic treatment of the issue of the comical in Heidegger's work. I conclude the paper with a remark on the relation between the comical, the tragic and the thinking, having Heidegger's interpretation of Heraclitus as a starting point.

The main objective of Micheal Sandel’s Liberalism and the Limits of Justice was to attack the concept of deontology, as formulated by John Rawls. In this article, I argue that Sandel interpreted the concept of deontology in a misleading way. There is a difference between how Rawls defined this concept and how it was interpreted by Sandel. Given this, the first part of this article will analyze the way Sandel interpreted the Rawlsian concept of deontology. The second part presents an (...) assessment of the clash between the two authors in light of the differences in the way both of them understood the meaning of deontology in political liberalism. Zaratustra, aquel mítico profeta persa, es para Nietzsche la autosuperación de la moral, de aquella moral escindida entre el bien y el mal que él mismo profesó y que por medio de Nietzsche ha de superar con su figura del superhombre. Las características propias de la superación son esbozadas desde Así habló Zaratustra hasta La voluntad de poder , en donde se señalan los rasgos de la crítica; una crítica contundente hacia las dimensiones epistemológicas y ontológicas de la metafísica abstracta (...) del ser, y un ataque contundente a la ciencia positivista y su pretensión de universalidad que niega la posibilidad de la acción de la subjetividad. Por eso el Vitalismo de Nietzsche señala el tránsito de la superación: el nihilismo como motor de la historia, que va desde un estado negativo a uno positivo que debe conllevar a una gran transvalorización de la moral. En el Vitalismo de Nietzsche, la transvalorización de la moral debe de producir un tipo de hombre dotado de una nueva metafísica, la metafísica de los valores, guiada por la voluntad de poder y su fuerza activa. La voluntad de poder es uno de los tópicos propios de su filosofía, mostrando el largo y tedioso camino hacia una nueva civilización superior, profecía del cual salió de la boca del mayor inmoralista de la historia: Zaratustra. A new approach to the metaphysics of the will to power in Thus Spoke Zarathustra Zarathustra, that mythical Persian prophet is for Nietzsche the self-overcoming of morality, that morality split between good and evil that he himself practiced, which for Nietzsche, will be overcome with his figure of the Overman. The intrinsic characteristics of overcoming are outlined from Thus spoke Zarathustra up to The Will to Power , where features of the critique are pointed, a forceful critique of the epistemological and ontological dimensions of the abstract metaphysics of being, and a forceful assault on the positivist science and its pretensions of universality that denies subjectivity of all possibility for action. That is why Nietzsche's Vitalism indicates the transit of the overcoming: nihilism as the engine of history, which goes from a negative to a positive condition, thus leading to a great transvaluation of morality. On Nietzsche's Vitalism the transvaluation of morality must produce a type of man possessed of a new metaphysics –the metaphysics of values, guided by the will to power and its active force. “The will to power” is one of the topics characteristic of his philosophy, showing the long and tedious way towards a new, higher civilization, prophecy of which it came out of the mouth of the greatest immoralist in history: Zarathustra. . Democracy can be regarded, following Alexis de Tocquevilles thoughts, from two complementary standpoints: the equality standpoint – where equality is understood as a social condition; and the liberty standpoint – understood as a political condition. However, he observes, democracy is not a priori what it should be, denunciating, in this way, the imbalance between equality and liberty, the greater the imbalance as poor are the public virtues. We intend to enroll in a debate involving ethics and politics, by considering vices (...) and virtues inherent to democracy, analyzing Tocqueville´s ideas. I argue that fitting resentment tracks unacceptable ‘ecological’ imbalances in relative social strength between victims and perpetrators that arise from violations of legitimate moral expectations. It does not respond purely, or even primarily, to offenders’ attitudes, and its proper targets need not be fully developed moral agents. It characteristically involves a wish for the restoration of social equilibrium rather than a demand for moral recognition or good will. To illuminate these contentions, I focus on cases that I believe demonstrate a (...) corollary thesis, namely, that strength, broadly construed, is a necessary condition of resentment-worthiness. I argue that weakness can make resentment unfitting in two ways. First, weakness may prevent a wrongdoer from shifting the balance of social power. Second, a weak wrongdoer may do social damage but be so lowly that resentment, which would represent him as excessively strong, would be inapt. Finally, I consider how accepting the ecological view might affect our theorizing about moral responsibility and the ethics of blame. (shrink)
