Indeed, antiocularcentrism provides the unifying thread of Jay’s work, which reviews the theory of vision from Plato to Bergson in the first three chapters and concentrates on “the culture of modernity” in chapters four through eight; the ninth chapter interestingly and curiously places Derrida and feminist criticism side by side under the aegis of “phallogocularcentrism” and presents Derrida and Irigaray if not as the high points of modernism, then at least as the center of the poststructuralist discourse, which argues for the elevation of the word over the eye and so offers downcast eyes as the new logo for what is now identified as postmodernism. Jay’s last chapter addresses postmodernism as a foreclosure on visual practice or the ocularcentric. The short seven-page conclusion attempts to place a positive note on the author’s admitted denigration of the notion of visuality in modern French intellectual thought and culture by calling for a plural or multiple—“polyscopic”—visual experience. Hence, Jay concludes that his notion of downcast eyes or disillusionment is “no solution” (p. 592) to the problem. Certainly, Broodthaer’s “L’Oeil” on the jacket cover does not present [End Page 162] downcast eyes but rather the very feminine alluring eye of a seductress. In this sense, the real message of Jay’s work is reader, beware! His provocative title and even more provocative subtitle initiate from the outset a critique of one of the long-held and cherished myths about the dominance and prominence of the visual sense in Western culture, especially in modern French thought. It is the unsettling of the comfortableness of this notion which Jay’s work successfully undertakes.The study is well-organized and lucidly written. It forcefully argues the author’s case. Unfortunately, there is no bibliography. The omission of a bibliography undercuts the project and casts scholarly suspicion on the entire venture. In all truth, the inclusion of a bibliography would dramatically call attention to serious lacunae in the scholarship. The French thinkers presented and analyzed, such as Bataille, Barthes, Sartre, Foucault, Derrida, Irigaray, and Lyotard, have been studied in depth—at times brilliantly—but Jay ignores this rich corpus of critical material. In particular, his treatment of important French poets such as Rimbaud, the surrealists, Ponge, and others is so skewed in order to reinforce his denigration of the dominant role of vision in twentieth-century French writing that the reader in the field of French studies questions the quality of the basic research undertaken for the project and the author’s skill at reading with understanding and sensitivity hermetic material in the original French. Once these questions are raised, the very nature of Jay’s study itself becomes suspect.As the reader progresses through the volume, it seems that most of Jay’s analyses of the primary texts are based on English translations and are in fact limited to those works available in translation. While this may not be the actual case, the lack of a bibliography reinforces such a suspicion and contributes to the steady erosion of the credibility of the study. Even worse, it poses a troubling if not invidious question: who is the audience for Downcast Eyes? Surely, the audience is not humanists who specialize in twentieth-century French studies. If the intended audience is one of scholars and their students in cultural history and the social sciences with little grounding in contemporary French intellectual thought as manifested in its literature and literary criticism, this audience needs to begin its reading with Jay’s conclusion which is a masterfully subtle denigration of his own work on... The successful global diffusion of formal democracy has gone hand in hand with the hollowing out of its substance. Ever more realms of domestic public policy are removed from the purview of national legislative deliberation and insulated from popular scrutiny. Rhetoric of accountability has accompanied the increasing unaccountability of international financial and trade organizations, transnational corporations as well as of states and NGOs. The new architecture of global governance characterized by legal plurality and overlapping sovereignties has facilitated a game of (...) ‘passing the blame’ among these four actors. There is a curious ambivalence in current debates on globalization about the role of the state, which is conceived of as both central and marginal. Globalization is seen to be marked by the decline of both the external and the internal sovereignty of the state. Contrary to such a view, it will be argued here that the state is both an agent and an object of globalization. Although inadequate, the state remains indispensable as its laws and policies play a key role in transposing neo-liberal agendas to the national and local levels. If in the age of globalization and of economic Empire, political violence has been replaced by legal violence, resistance to it is also articulated in the language of law. This paper focuses on the dynamic of legal politics against impoverishment and dispossession caused by the new global designs of intellectual property protection, biodiversity conservation and privatization of the commons in India. The case studies in this paper point to the emergence of intertwined structures of rule, overlapping sovereignties and complex processes of legal transnationalization that have reconfigured the relations between law, state, and territoriality. If welfare states were concerned with the redistribution of risk and resources, cunning states seek to redistribute responsibility. Sensitivity to the history of colonialism would be an important corrective to the presentism and Westerncentrism of analyses of (legal) globalization. (shrink)

In this article, I consider a curious blind spot in constitutional scholarship concerning the resurging rural/urban divide—a readily evident phenomenon closely associated with political resentment and anti-establishment sentiments—and how we may begin to address that challenge through creative constitutional designs. Specifically, I draw upon insights from comparative constitutionalism to discuss four main areas of constitutional law and theory that appear to hold some intellectual promise in this context: formal constitutional commitment at the national level to recognizing the urban/rural divide (...) and commitment to addressing it; creative electoral system designs that take into account the spatial dimension of politics; spatial pluralization based on concepts such as “mixed constitutions,” “community standards,” and “margin of appreciation”; and rethinking elements of equalization and fiscal federalism more generally. Taken together, the four directions I discuss here offer a repertoire of constitutional design possibilities that hold promise in mitigating the resurging rural/urban gulf. More generally, they serve as an invitation to constitutional thinkers to shake up the rather stagnant constitutional thought of spatial governance, and to think creatively about the ever-expanding urban/rural divide and its consequences for the theory and practice of 21st century constitutional democracy. Olympiodorus' Commentary on Plato's Phaedo I.3-6 has been the linchpin of the reconstructions of the supposed Orphic doctrine of original sin. While Olympiodorus links the Titans' dismemberment of Dionysus and anthropogony, he does not include any element of inherited guilt, either in his narration of the myth or in his interpretation. Moreover, his telling of the myth, which makes the anthropogony the sequel to the dismemberment of Dionysus, is an innovation made for the purposes of his own argument. Rather than (...) preserving in fossilized form a sacred myth more than a millennium old, Olympiodorus concocts an innovative tale of his own. (shrink)

Despret's philosophical approach builds from the virtue of politeness, which allows animals – concrete, individual animals – to be interesting. Part appraisal, part speculative narrative, this preface looks at the curious practices of Despret as she works with, and thinks from, animals.

Mass media images offer audiences models for how to perform the social roles they depict. Opinions and other attributes of credible media models may likewise be embraced by audience members seeking to identify with those models. Thus farm magazine narratives about “successful” farmers may encourage readers to model or aspire to featured farmers' production and management techniques and ascribe legitimacy to models' responses to current agricultural issues. However, production of agrarian images in the mass media — including images of farms, (...) farmers, and farmers' values — are inevitably biased such that media representations of successful farmers selectively present objective characteristics in terms of the media's own ideological frameworks, which in turn reflect the dominant ideology of the social relations in which the media are engaged. As a first step in identifying farm magazines' role in creating social models for farmers, this study analyzes articles featuring “successful,” “leading,” or “innovative” farmers in leading agricultural magazines. The featured farmers are categorized according to enterprise characteristics and characterizations of them and their management philosophies. Findings show that farmers in farm magazines have larger than average operations and are portrayed in a way that blends a “farming as business” orientation with more conventional agrarian values but that generally omits non-business aspects of farm life. Dialogue semantics for logic are two-player logic games between a Proponent who puts forward a logical formula φ as valid or true and an Opponent who disputes this. An advantage of the dialogical approach is that it is a uniform framework from which different logics can be obtained through only small variations of the basic rules. We introduce the composition problem for dialogue games as the problem of resolving, for a set S of rules for dialogue games, whether the set (...) of S-dialogically valid formulas is closed under modus ponens. Solving the composition problem is fundamental for the dialogical approach to logic; despite its simplicity, it often requires an indirect solution with the help of significant logical machinery such as cut-elimination. Direct solutions to the composition problem can, however, sometimes be had. As an example, we give a set N of dialogue rules which is well-justified from the dialogical point of view, but whose set N of dialogically valid formulas is both non-trivial and non-standard. We prove that the composition problem for N can be solved directly, and introduce a tableaux system for N. (shrink)

Book Gamma of Aristotle’s Metaphysics contains a vigorous defense of the principle of non-contradiction (PNC). A chief part of Aristotle’s strategy is to attack those, such as Heraclitus and Protagoras, who are said to deny the principle. Commentators have found a number of logical and historical problems with Aristotle’s arguments, but none are more troubling than those he deploys against Protagoras. Midway through Gamma 4, and throughout Gamma 5, he represents Protagoras not as simply denying PNC but rather as asserting (...) the contrary of the principle. The latter, the proposition that every thing has every property and its negation, I call the strong denial of PNC. In particular, Aristotle argues that Protagoras is committed to strong denial because of ‘Protagorean’ relativism – the doctrine that if something appears to be the case, then it is the case. This paper provides a reconstruction of Aristotle’s arguments in Gamma 4 and 5, and suggests that the second argument may infact hold against the Protagorean. (shrink)

The frame/content theory justifiably makes tinkering an important explanatory principle. However, tinkering is linked to the accidental and, if completely decoupled from functional constraints, it could potentially play the role of an “idiosyncracy generator,” thus offering a sort of “evolutionary” alibi for the Chomskyan paradigm – the approach to language that MacNeilage most emphatically rejects. To block that line of reasoning, it should be made clear that evolutionary opportunism always operates within the constraints of selection.

This chapter illustrates the power of thought experiments by assembling influential thought experiments from the history of science. It lays out the book's plan to understand philosophical thought experiments by concentrating on their resemblance to scientific relatives. Points of difference between philosophical and scientific thought experiments give a preview of obstacles that must be overcome in the course of the campaign. Naive and sophisticated reservations about the philosophical cases are registered for the same purpose.

The North American wolf became extinct east of the Appalachians by 1800. To colonial legislators, uniform, colony-wide wolf bounties, as incentives to wolf-extermination, seemed the simplest solution to a perceived threat to livestock and European settlements. To local taxpayers, considerations of parsimony and fraud loomed just as large. This tension led to wolf extermination policies that were costly and often counterproductive. The bounty laws, as enacted, amounted to a fight against the abstract wolf, instead of against individual predators. Its eventual (...) 'success' brought about new troubles. Absent wolves, the eastern seaboard's ecosystem re-adjusted, allowing new predators and pests to flourish. (shrink)

In this response, doubts are expressed relating to the treatment by Hoyningen-Huene and Oberheim of the relation between incommensurability and content comparison. A realist response is presented to their treatment of ontological replacement. Further questions are raised about the coherence of the neo-Kantian idea of the world-in-itself as well as the phenomenal worlds hypothesis. The notion of common sense is clarified. Meta-incommensurability is dismissed as a rhetorical device which obstructs productive discussion.

In this paper, Mou Zongsan’s (牟宗三, 1909–1995 CE) Kantian interpretation of Confucianism will be surveyed with a focus on Mou’s ideas of moral metaphysics and autonomy. After a brief account of the development of Confucianism up to the Song dynasty (960–1279 CE) and Ming dynasty (1368–1644 CE) (§1) and some initial attempts to articulate Confucian ideas in terms of Western philosophy (§2), Mou’s Kantian interpretation of Confucianism will be presented in §3 and criticized in §4. It is argued that Mou (...) uses the Kantian dichotomy of autonomy and heteronomy to describe the traditional rivalry between two primary schools of Neo-Confucianism. While Mou neglects Kant’s claim that the autonomy of the will gives the principle by means of which it is to determine the content of the moral law, he appeals to Kant’s idea that human beings as free agents are members of the intelligible world to propose a Confucian moral metaphysics. In §5, Mou’s Confucianism’s metaphysical and religious characteristics are further criticized. (shrink)

University education is full of promise. Indeed universities have the capacity to create and shape, through staff and students, all kinds of enthralling ‘worlds’ and ‘new possibilities of life’. Yet students are encouraged increasingly to view universities as simply a means to an end, where neoliberal education delivers flexible skills to directly serve a certain type of capitalism. Additionally, the universal challenge of technological unemployment, alongside numerous other social issues, has become educationalised and portrayed in HE policy, as an issue (...) to be solved by universities. The idea that more education can resolve the problem of technological unemployment is a political construction which has largely failed to deliver its promise. In this article, we look at educationalisation in hand with technologisation and we draw on a Critical Discourse Analysis of HE policies, to demonstrate the problems arising from taken for granted visions of neoliberal social development related to education,... The first observation concerns the fundamental nature of ecological diversity measures, while the second one specifically addresses some interesting mathematical connections between α- and β-diversity.

This essay offers a critical analysis of Hannah Arendt's notion of natality through the lens of Adriana Cavarero's feminist philosophy of birth. First, I argue that the strength of Arendtian natality is its rootedness in an ontology of uniqueness, and a commitment to human plurality and relationality. Next, I trace with Cavarero three critical concerns regarding Arendtian natality, namely that it is curiously abstract; problematically disembodied and sexually neutral; and dependent on a model of vulnerability that assumes equality rather than (...) asymmetry. This last issue is further developed in the final section of the essay, where I examine the idea that birth, for Cavarero, becomes the very concept by which we can distinguish and normatively differentiate acts of care and love from acts of wounding and violence. Upholding the normative distinction here depends on a conceptual distinction between vulnerability and helplessness. To maintain the ethical potential of the scene of birth, I argue that we have to insist on the very characteristics Cavarero attributes to it—ones, as this essay aims to show, that are ultimately missing in the Arendtian account thereof. This essay proposes an alternative reading of David Lewis’s On the Plurality of Worlds (OpW) by drawing parallels between this book and a performance by Andy Kaufman, Andy Wrestles the Ladies (AwL). The proposed reading is ultimately grounded by a joke: that it is more credible to believe that similarly to Kaufman in AwL, Lewis impersonated a character in OpW by performing a reductio ad absurdum than to believe that he seriously defended modal realism. After all, to support this thesis (...) is to face countless objections while showing varied lacks of awareness and justifying the attribution to oneself of Ostrichist. The latter abbreviates the predicate, “to act like an ostrich,” attributable to that which lacks varied kinds of awareness in acting in a way comparable to that of a bizarre ostrich that buries its head in the sand for no good reason. In this paper I draw some distinctions between the terms “cultural diversity” and “plurality” and argue that a radical conception of plurality is needed in order both to re-imagine the boundaries of democratic education and to address more fully the political aspects of conflict that plurality gives rise to. This paper begins with a brief exploration of the usages of the term diversity in European documents that promote intercultural education as a democratic vehicle for overcoming social conflict between different cultural (...) groups. In contradistinction to these usages, this paper calls for a more robust conception of plurality, one that does not simply denote membership in different cultural groupings but is rooted in the human condition and based on a conception of uniqueness. Following the work of Hannah Arendt and feminist philosopher Adriana Cavarero, I explore how the appearance of unique beings in specific contexts can be understood as an eminently political act and I contend that such a view leads to a better educational understanding of conflict and contestation. The paper sketches the contours of democratic plurality along this line of thought and discusses how these new boundaries have implications for education’s relation to democracy. (shrink)

In the last two decades, an ever-increasing number of scholars have challenged the conceptual borders of political philosophy and the supposed universalism of its normative pre-commitments. Surprisingly enough, the normative underpinnings of this debate have had very little impact on contemporary disputes about pluralism. This article asks how contemporary disputes about the conceptual borders of political theory can help in constructing a more plural theory of pluralism. It shows that such contributions inspire three ways of constructing a more (...) class='Hi'>plural political theory of pluralism: a self-transformative approach, a dialogical approach and a pre-relational approach. While all three approaches progress towards less exclusionary theories of pluralism, I argue that a pre-relational approach can lead to a normative theory that is more plural than the alternatives. ABSTRACTSince its origin bioethics has been a specialized, academic discipline, focussing on moral issues, using a vast set of globalized principles and rational techniques to evaluate and guide healthcare practices. With the emergence of a plural society, the loss of faith in experts and authorities and the decline of overarching grand narratives and shared moralities, a new approach to bioethics is needed. This approach implies a shift from an external critique of practices towards embedded ethics and interactive practice improvement, (...) and from a legal defence of rights towards fostering interdependent practices of responsibility. This article describes these transitions within bioethics in relation to the broader societal and cultural dynamics within Western societies, and traces the implications for the methodologies and changing roles of the bioethicist. The bioethicist we foresee is not just a clever expert but also a relationally sensitive person who engages stakeholders in reciprocal dialogues about their practice of responsibility and helps to integrate various sorts of knowledge . In order to illustrate this new approach, we present a case study. It concerns a project focusing on an innovation in elderly care, based on the participation of various stakeholders, especially older people themselves. (shrink)

The illustrator is Marco Koren, a young Californian artist with a passion for drawing.

In the course of his chemical investigation of crude platina ore, William Hyde Wollaston in 1802 isolated and characterized the metal palladium. In early 1803, he chose to make known his discovery by offering small samples of the metal for sale through a small shop in London. In the notice advertising the properties of the new metal, no information was given as to its source nor to its discoverer. The unique properties of the metal, and the secrecy surrounding its discovery, (...) led the Irish chemist Richard Chenevix to question the elemental nature of the new metal. His hasty but extensive investigation of the chemical properties of palladium convinced him that it was no more than an alloy of platinum and mercury, and he denounced the discovery as fraudulent. The president of the Royal Society, Joseph Banks, was drawn into the resulting furore, and correspondence between him and Chenevix reveals involved plans to obtain the identity of the palladium discoverer. The controversy is viewed as a significant episode in the continuing debate in the chemical community over the operational definition of a chemical element, and although Chenevix's concern over the growth in the number of new elements was justified, his choice of palladium as a test case was an unfortunate one, for his claim that the metal was an alloy was found to be erroneous. Motives for the actions of both Chenevix and Wollaston are sought, and the judgement that their careers were damaged by the incident is questioned. (shrink)

Tocqueville's observation in the Rubish for the second volume of Democracy in America is not only startling, but theoretically important: it ratifies the liberal (and nowadays oft-assumed) separation between musical life and political constitution. This, however, should give us cause to wonder. While in America, Tocqueville and Beaumont had multiple occasions to hear music in public festivals and (...) private spaces. Though other European and highbrow observers also declared American music to be ‘in its infancy’, music nonetheless played a significant part in antebellum social and political life. Nor was Tocqueville insensitive to sound in his relation to others. Indeed, Tocqueville perhaps saw in the demise of music as the art of ‘making harmony’ a symptom of the democratic era. However, like Montesquieu, Tocqueville refused to consider music a constitutive principle of democratic regimes—including in the context of Ancient Greek political theory. In doing so, Tocqueville sharply dissociated himself from republican political theory, but failed to raise the question of music's contribution to the culture and exercise of freedom in the modern era.
