Wittgenstein’s private language argument claims that language and meaning generally are public. It also contends with our appreciation of artworks and reveals the deep connection in our minds between originality and the temptation to think of original meaning as private. This problematic connection of ideas is found in Kant’s theory of fine art. For Kant conceives of the capacity of artistic genius for imaginatively envisioning original content as prior to and independent of finding the artistic means of communicating this content (...) to others. This raises the question of whether we can conceive of art as both original and meaningful without succumbing to privacy. (shrink)

The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. The Analytic of the Beautiful in Kant's Critique of Aesthetic Judgment is a text of unparalleled importance in the history of philosophical aesthetics. Its main claims are adopted by some and rejected by others. A significant number of responses, of both kinds, take the Analytic to apply to all experiences of beauty—most notably, to the beauty of both nature and fine art. Our principal claim is that this assumption is mistaken. The analysis in the misleadingly titled Analytic of the Beautiful (...) applies paradigmatically to judgments of natural beauty. The experience of the beauty of most artworks is different and requires a separate analysis. We detail the modifications required in all four moments of the Analytic and thereby explicate the experience of artistic beauty. This reveals that Kant holds an interesting and historically consequential account of the experience of artistic beauty, which is significantly different from the experience of natural beauty. The analysis further reveals that despite these significant differences, the experiences are both species of a single genus. (shrink)

The distinction between access consciousness and phenomenal consciousness is a subject of intensive debate. According to one view, visual experience overflows the capacity of the attentional and working memory system: We see more than we can report. According to the opposed view, this perceived richness is an illusion—we are aware only of information that we can subsequently report. This debate remains unresolved because of the inevitable reliance on report, which is limited in capacity. To bypass this limitation, this study utilized (...) color diversity—a unique summary statistic—which is sensitive to detailed visual information. Participants were shown a Sperling-like array of colored letters, one row of which was precued. After reporting a letter from the cued row, participants estimated the color diversity of the noncued rows. Results showed that people could estimate the color diversity of the noncued array without a cost to letter report, which suggests that color diversity is registered automatically, outside focal attention, and without consuming additional working memory resources. For Kant the definitive end of art is the expression of aesthetic ideas that are sensible counterparts of rational ideas. But there is another type of aesthetic idea: ‘Beauty can in general be called the _expression_ of aesthetic ideas: only in beautiful nature the mere reflection on a given intuition, without a concept of what the object ought to be, is sufficient for arousing and communicating the idea of which that object is considered as the _expression_.’ What are these aesthetic (...) ideas? I argue that Kant is drawing on the idealist conception of art, associated with Vasari, Bellori and Winckelmann, as presenting idealized spatial forms characteristic of natural kinds. He incorporates this conception into his analysis of the beauty of nature and adds that we have non-conceptual access to it. These idealized forms he names aesthetic normal ideas of natural species. §51 of Kant’s Critique of the Aesthetic Power of Judgment opens with an unexpected claim, described by readers as ‘puzzling’, ‘perplexing’ and even as a ‘notorious mystery’.1 1 Beauty can in general be called the _expression_ of aesthetic ideas: only in beautiful art this idea must be occasioned by a concept of the object, but in beautiful nature the mere reflection on a given intuition, without a concept of what the object ought to be, is sufficient for arousing and communicating the idea of which that object is considered as the _expression_. 2 2 I will argue that, in this passage, Kant states that there are two types of aesthetic ideas—namely, aesthetic ideas expressed in beautiful art and aesthetic ideas expressed by beautiful nature. This distinction is surprising for, before this juncture, there is no explicit claim that there are different types of aesthetic ideas. In fact, although Kant offers several seemingly general characterizations of aesthetic ideas, in none of them does he indicate that there is a subdivision of the genus. Noteworthy, too, is the claim that the distinct pleasure we take in beautiful nature is independent of concepts; for strikingly, it can be considered as the expression of what the passage above expressly calls ideas. In his analysis of fine art, Kant draws the distinction between natural and artistic beauty—a distinction that is succinctly repeated in the passage above.3 3 But when he goes on to explicate the notion of an aesthetic idea, he refers only to aesthetic ideas expressed in art. This fact is taken to support the assumption that aesthetic ideas are connected solely to art. This is the heart of the mystery of the passage, for in it, Kant explicitly talks about aesthetic ideas expressed by beautiful nature. This raises a crucial question: Does the explication of aesthetic ideas in the sections on art apply to aesthetic ideas of beautiful nature?I maintain that the answer is negative. Although, in the passage above, Kant uses the same term in relation to both kinds of beauty, he has a clear distinction in mind: Beauty in art is an aesthetically or sensuously unified expression of the conceptual richness of an idea of reason; beauty in nature is an expression of a purely aesthetically or sensuously unified richness. Obviously, this distinction is connected to other significant differences between the two kinds of beauty. But it is important to point out at the outset that the two types of aesthetic ideas have in common only the quality of being a sensuously unified richness. It is in this sense that they are both species of a single genus. But what more precisely does Kant mean by aesthetic ideas expressed by beautiful nature, and what unified richness do they express and how precisely do they express it? It is to the historical genealogy of this notion of aesthetic ideas of beautiful nature and its implications for Kant’s theory of beauty that this paper is devoted. This historical genealogy will reveal a sense of the notion of aesthetic ideas that we easily overlook but would have been familiar to Kant and his contemporaries. (shrink)

§49 of the Critique of the Power of Judgment concludes with a striking claim regarding the freedom required for artistic expression. Kant classifies Mannerism as aping, but considers manner the only valid means of artistic expression. These opposed uses of maniera echo a historical controversy, which finds reconciliation in Kant in what I call artistic autonomy. For Kant, artistic expression of genuine originality requires autonomous action, the individual manner in which an artist selects, transforms and applies given academic rules, in (...) a way that renders an aesthetic vision meaningful. His grave concern is that artists, in their aspiration to innovate, might make the freedom to modify and transform rules into the very aim of their artistic endeavor. In order to grasp the full significance of Kant’s view, I examine the contradictory attitudes towards maniera articulated by Vasari and Bellori. Kant’s account of artistic autonomy offers an understanding of artistic succession, different from that of his predecessors. (shrink)

In 2015, the Israeli Knesset passed the force-feeding act that permits the director of the Israeli prison authority to appeal to the district court with a request to force-feed a prisoner against his expressed will. A recent position paper by top Israeli clinicians and bioethicists, published in Hebrew, advocates for force-feeding by medical professionals and presents several arguments that this would be appropriate. Here, we first posit three interrelated questions: 1. Do prisoners have a right to hunger-strike? 2. Should governing (...) institutions force-feed prisoners and/or is it ethical to force-feed prisoners? 3. Should healthcare professionals force-feed prisoners? We then focus on the first and third questions. We first briefly provide several arguments to support the right of prisoners to refuse treatment. Next, we critically review the arguments presented in the Israeli position paper, demonstrating that they are all misguided at best. Lastly, we briefly present arguments against force-feeding by medical professionals. We conclude that healthcare providers should not participate in the force-feeding of prisoners. (shrink)

The body of research on civic education points to the importance of teachers creating open democratic environments, leading to what has been termed the political classroom. This yearlong study of an Israeli multicultural and bilingual high school civics course, in which students from different citizenship status participated, presents a case in which teachers were unsuccessful in achieving this goal, raising the question of what limited this class's potential to create an educational environment where democratic discourses could have taken place? The (...) main argument points to Israel's current disputative political environment that led to the enactment of four educational mechanisms that resulted in such a futile reality. These included: conflicting objectives, avoiding discussion of controversial issues, implementing traditional teaching practices, and overlooking language issues. The neo-liberal educational environment and a culture of fear and self-censorship were both identified as a common explanation to these, leading to an educational reality in which there was a detach between the lessons and the students’ transcultural lived political experiences. From a methodological perspective, the study illuminates the importance of focusing on such unsuccessful cases, examining their elements, and understanding what influences them. (shrink)

One Health is a novel paradigm that recognizes that human and non-human animal health is interlinked through our shared environment. Increasingly prominent in public health responses to zoonoses, OH differs from traditional approaches to animal-borne infectious risks, because it also aims to promote the health of animals and ecological systems. Despite the widespread adoption of OH, culling remains a key component of institutional responses to the risks of zoonoses. Using the threats posed by highly pathogenic avian influenza viruses to human (...) and animal health, economic activity and food security as a case exemplar, we explore whether culling and other standard control measures for animal-borne infectious disease might be justified as part of OH approaches. Our central premise is that OH requires us to reformulate ‘health’ as universal good that is best shared across species boundaries such that human health and well-being are contingent upon identifying and meeting the relevant sets of human and non-human interests and shared dependencies. Our purpose is to further nascent discussions about the ethical dimensions of OH and begin to describe the principles around which a public health agenda that truly seeks to co-promote human and non-human health could potentially begin to be implemented. Several bioethicists have recently advocated the force-feeding of prisoners, based on the assumption that prisoners have reduced or no autonomy. This assumed lack of autonomy follows from a decrease in cognitive competence, which, in turn, supposedly derives from imprisonment and/or being on hunger strike. In brief, causal links are made between imprisonment or voluntary total fasting and mental disorders and between mental disorders and lack of cognitive competence. I engage the bioethicists that support force-feeding by severing both of these causal (...) links. Specifically, I refute the claims that VTF automatically and necessarily causes mental disorders such as depression, and that these mental disorders necessarily or commonly entail cognitive impairment. Instead, I critically review more nuanced approaches to assessing mental competence in hunger strikes, urging that a diagnosis of incompetence be made on a case-by-case basis—a position that is widely shared by the medical community. It seems that every singular proposition implies that the object it is singular with respect to exists. It also seems that some propositions are true with respect to possible worlds in which they do not exist. The puzzle is that it can be argued that there is contradiction between these two principles. In this paper, I explain the puzzle and consider some of the ways one might attempt to resolve it. Loneliness is a major public health concern, particularly during pandemics such as Covid. It is extremely common, and it poses a major risk to human health. Technological solutions including social media, robots, and virtual reality have been advocated and implemented to relieve loneliness, and their use will undoubtedly increase in the near future. This paper explores the use of technological solutions from a normative perspective, asking whether and to what extent such measures should indeed be relied upon. The conclusion is (...) that technological solutions are unquestionably part of the solution to loneliness, but that they cannot and should not constitute the whole solution. It is important to note that this is not a straw‐man argument, as several organizations and scholars have strictly focused on such technological solutions for loneliness. (shrink)

Intergroup competition over resources is attested since the dawn of history. Written and archaeological evidence go back to at least the fourth millennium BC. According to accepted views, evolution has favored humans because of their ability to have cumulative cultures, which has made flexible adaptation possible. One major aspect of this adaptation has been the ability to handle power contests without engaging physical force. Instead, increasing prestige dynamics has allowed contest management by displaying symbolic assets. These have growingly been instrumental (...) in deterring external assaults, thus guaranteeing the possession – or expansion – of a group’s resources. However, while material assets are believed to create status by the evidence of their tangible usefulness (such as foods, husbandry and tools), symbolic assets are by definition subject to ongoing negotiation, entirely dependent on being socio-semiotically recognized as types of capital. Symbolic stock exchanges thus appear to have been determinative since antiquity in hierarchizing ethnic and political groups fighting over resources, prioritizing ones over the others. They have culminated in repertoires of more solid tangible and intangible assets, from impressive buildings, city gates, gardens and temples, to ideas such as freedom, quality of life and wealth, justice, personal security, or whatever values that have gained universal recognition. The article discusses the creation and expansion of such symbolic repertoires and their uncertain position in recent times. (shrink)

A growing body of literature focuses on practice as a central aspect of teacher education. Whereas this approach emerged mainly from teacher preparation programs in specific content areas such as math, science, and literacy studies, socially related educational fields have served as a peripheral player alone. Recently, however, scholars have suggested incorporating a practice-based approach to teacher education into the social studies. In this article, we draw on complexity theory to reexamine this proposal, evaluating the connections between teaching practices and (...) democratic citizenship. First, we introduce complexity theory. Second, we offer a critical examination of key publications discussing practice-based teacher education, using the components of complexity theory as an organizing scheme. We then highlight practice-based teacher education’s reductive aspects, leading to an argument that promoting democratic citizenship through civics teacher education should be seen as a complex endeavor where borders are blurred, interactions are nonlinear, and reality changes frequently. Finally, we offer to supplement the practice approach with aspects of teacher education that stem from complexity theory. (shrink)

This paper applies the argumentative perspective to the concept of scientific fact by combining the rhetorical and the sociological perspectives. The scientific fact is presented as an entity having both an epistemic and a social meaning, and the scientific paper is presented as a discourse that has both an epistemic value and role related to knowledge and to the description of the ‘world,’ and a social value, fulfilling social roles within its relevant discourse community. The discussion leads to some insights (...) into the connection between scientific language and facts. Scientific language reflects the degree of facticity of the utterance at every stage: various linguistic and discursive elements reflect the current factual status of the utterance. This conception of fact is dynamic and open to discussion, and it is presented from the author’s point of view. On the other hand, language, or the choice of language usage, creates facticity in the sense of social acceptance: by using language, the researcher reports on his belief that what he is describing is indeed a fact. The essence of the scientific paper as an argumentative text is that its point of departure is the faith of the speaker in the facticity of the new information, and its rhetorical aim is to convince the audience, based on its disciplinary rationality, to accept that same faith and thereby usher the new claim into the shared disciplinary body of knowledge. Using this classification, we classify the cofinal structure of local bases in the groups C(X, R) of continuous real-valued functions on complete metric spaces X, with respect to the compact-open topology.

Conflicts of interest in corporate law can be addressed by two main alternatives: a requirement of a majority of the minority vote or the imposition of duties of loyalty and fairness. A comparison of Delaware, the UK, Canada, and Israel reveals that while the conflicts of interest problem within publicly-traded corporations receives different treatment in the different jurisdictions — either a fairness rule or a majority of the minority rule — closely-held corporations receive the same treatment of an imposition of (...) duties of loyalty and fairness. This article explains this finding, demonstrating that determining which of these rules is adopted is, in fact, a choice between liability rule protection and property rule protection. This choice depends on the total and relative transaction costs. These costs include both the negotiation costs attendant upon a property rule, as well as the adjudication costs associated with a liability rule. The sum of these costs is influenced by the efficacy of the judicial system and of extralegal mechanisms such as the market for corporate control, the capital market, and the types of investors active in the market. Because the different jurisdictions have different relative costs, due to differences in the economy and the legal systems, publicly-traded corporations are treated differently in each system. However, sometimes conflict of interest situations share the same main characteristics — as with closely-held corporations—leading to the domination of one solution, and thus the same solution is applied for closely-held corporations in the different jurisdictions.
