In _Caring_, Peta Bowden extends and challenges recent debates on feminist ethics. She takes issue with accounts of the ethics of care that focus on alleged principles of caring rather than analysing caring in practice. Caring, Bowden argues, must be understood by 'working through examples'. Following this approach, Bowden explores four main caring practices: mothering, friendship, nursing and citizenship. Her analysis of the differences and similarities in these practices - their varying degrees of intimacy and reciprocity, formality (...) and informality, vulnerability and choice - reveals the practical complexity of the ethics of care. _Caring_ recognizes that ethical practices constantly outrun the theories that attempt to explain them, and Bowden's unique approach provides major new insights into the nature of care without resorting to indiscriminate unitary models. What are the implications of living in a gender system that recognizes “two and only two” genders? For those individuals whose “gender displays” are inappropriate, there can be a variety of consequences, many of them negative. In this article, the author provides an analysis of her experiences as a woman whose appearance often leads to gender misattribution. She discusses the consequences of the gender system for her identity and her interactions. The author also examines Lorber's assertion that “gender bending” actually (...) serves to perpetuate gender categories rather than to break them down, and she suggests how her experiences might contradict Lorber's argument. Amid absorbing large amounts of new information and interpreting the parameters and implications of what they are learning about their child's condition, families are forced by circumstances to assess—and to act on—their most critical, and perhaps previously unexamined, values. This work examines the rise of postmodernism in management scholarship and argues that the prevalence of postmodernist thought reflects a lack of understanding by management researchers of the core principles upon which Western business endeavour is based. The author highlights postmodernism’s methodological and conceptual failings, such as disbelief in material progress and economic advancement, and its denial of generalizable laws to direct management research. In its place, the author proposes a return to traditional modernist principles in management research, based on (...) scientific evidence. This ground breaking, timely work will spark debate and challenge previously accepted claims of postmodernism, a nice retort to the anti-business/anti-capitalist literature now prevalent in academia. Not much has been written about how the ethics of U.S. business executives are perceived by the American public, yet the perception of integrity is important to both businesses and their investors. This study examines the U.S. public’s perceptions of the ethics of American business executives using Gallup Poll data for the past thirty years. Organizations with unethical executives have trouble attracting investors, customers, and new managerial talent. They suffer lawsuits, market share deterioration, and often prison time for the once-revered (...) leaders. This study also looked at the U.S.’s relative standing on the Corruption Perceptions Index and the Edelman Trust Barometer. Confidence in the ethics of the U.S. business executive remains fairly low on the Gallup Poll surveys and the U.S. has declined on the CPI and Edelman Trust Barometer. (shrink)

The editors of the JRE collected short essays from scholars of religion in response to a recent incident at Hamline University that made national headlines. Last fall, Hamline University administrators refused to extend a contract to an adjunct professor of art history after a Muslim student accused her of Islamophobia for showing a 14th‐century image of Mohammad in an online class. The event provoked intense conversations about issues of academic freedom, religious diversity, the status of contingent faculty, and race. ABSTRACT This article synthesizes several different studies of Hegel's and Nietzsche's expressive conceptions of action and agency and identifies a related account in Deleuze's Logic of Sense. It argues that such conceptions not only challenge familiar voluntarist accounts of action and agency; they also demand a reassessment of standard approaches to the relation between norms and action. For the voluntarist, an agent's action is caused by the separate, prior intention of the agent. For expressivists, an agent's intention is inseparable from (...) the action expressing it and nonisolatable from the expression of this intention-action in interpretative activity. For the voluntarist, the norms governing action can be thought of as more or less freestanding, entering into the prior formation of the agent's intention. For the expressivist, the norm or principle on which an agent acts will be produced over time, through the unfolding of the action expressing it, as well as through interpretative struggle over the meaning of that action, all of which takes place in a social space governed by more basic norms concerning the offering of act-descriptions, recognition, and social and hermeneutical struggle. A number of important differences among Hegel's, Nietzsche's, and Deleuze's accounts are identified, and their significance is explored. (shrink)

This essay argues that the best starting point for discussions of the Principle of Discrimination (PD) is its most basic formulation: In wartime, certain enemy subjects should receive better treatment than others. Other formulations of the PD ? in particular, those centered on the concept of noncombatant immunity ? have sought to identify a single criterion that can be used as the basis for sorting enemy subjects into two (and only two) classes. However, a historical and legal analysis of the (...) principle indicates that three distinct criteria ? the conduct of individuals, their status, and their guilt or innocence ? have all been seen as relevant for determining the appropriate treatment of the enemy. In this essay, I formulate an expanded version of the PD, which calls for the proportionate treatment of enemy subjects based on evaluations of all three of these criteria. (shrink)

A major problem threatens Deleuze’s project in The Logic of Sense. He makes an ontological distinction between events and substances, but he then collapses a crucial distinction between two kinds of events, namely, actions and mere occurrences. Indeed, whereas actions are commonly differentiated from mere occurrences with reference to their causal dependence on the intentions of their agents, Deleuze asserts a strict ontological distinction between the realm of causes and the realm of events, and holds that events of all types (...) are incorporeal happenings which are inseparable from expressed sense. For Deleuze, what counts as one’s action thus does not depend on one’s intention, but rather on a process of “making sense” of that action. Nevertheless, Deleuze continues to speak of the need to “will” the event. In order to resolve this apparent contradiction, I will read a conception of “expressive agency” into The Logic of Sense. The dramatic increase in the number of corporate ethical codes over the past 20 years has been attributed to the Watergate scandal and the Foreign Corrupt Practices Act. Ethical codes differ somewhat from profesional codes and mission statements; yet the terms are frequently interchanged and often confused in the literature. Ethical code studies are reviewed in terms of how codes are communicated to employees and whether implications for violating codes are discussed. Most studies use content analysis to determine subjects in (...) codes. Little information is available about how codes are communicated, whether they are accepted and used by employees, and whether they affect employee/corporate behavior. More research on ethical codes is needed to answer some of these questions. (shrink)

Greta Garbo named herself. It was she who invented the name “Garbo” and officially registered the change from Greta Gustafsson to Greta Garbo at the Ministry of Justice in Sweden on 4 December 1923. The name had the metonymic virtue of suggesting the nature of her screen presence. The Swedish meaning of garbo, “wood nymph,” suggests the association with otherworldly forces that became part of her image; while the Spanish meaning of the word, “animal grace sublimated,” combines the animal passion (...) and spiritual grace that were part of her power.1 And yet in most accounts of Garbo’s life and work the legend still persists that it was Swedish director Mauritz Stiller who named her after a seventeenth-century Hungarian king. The extent to which the legend has obscured Garbo’s initial act of self-naming is symptomatic of the larger tendency in film theory and criticism to mask the creative power of the actress by treating her as the blank sheet upon which the director inscribes his own signature.What is particularly misleading about the Svengali metaphor as it has figured in studies of Garbo is that it so deliberately masks the evidence. In her article “Gish and Garbo: The Executive War on the Stars,” Louise Brooks suggests that the popular image of Garbo—the “dumb Swede” transformed by Stiller’s art—was perpetuated by Hollywood executives eager to play down the very real power that Garbo already exhibited in the rushes for her first American film, The Torrent . “The whole MGM studio, including Monta Bell, the director, watched the daily rushes with amazement as Garbo created out of the stales, thinnest material the complex, enchanting shadow of a soul upon the screen.” Although recent accounts of Garbo’s life and work have advanced beyond the “dumb Swede” publicity of Photoplay magazine, critics still reveal a similar, almost vampish determination to deprive Garbo of her creative power. “Her contribution,” states Kenneth Tynan, “is calm and receptiveness, an absorbent repose which normally, in women, coexists only with the utmost vanity. Tranced by the ecstasy of existing, she gives to each onlooker what he needs” . Comparing Garbo to a “watermark in a blank sheet of paper,” David Thomson says in an essay in honor of her seventy-fifth birthday: “She must be no one in herself if she is to signify so much to so many others…. All the moods and moments of love are encompassed because the appearance is hollow. We are to inhabit it, to flesh it out.” In these accounts, Garbo is presented not as an active shaping power but as a passive female vessel, ready to receive the impress of male voyeuristic fantasy. On that day, around 10 million people—some estimates are much higher—demonstrated on the streets of the world's cities in opposition to the US war on Iraq, then being merely threatened. Sartre's study of the elements of history in Critique of Dialectical Reason and its unpublished ethical sequel, Morality and History, illuminate, and are illuminated by, the movements that contest today's global system. From the Critique, we'll (...) engage his notions of negative universality as threat of death and the "fusing" of "series" into "groups" as response. From Morality and History, we'll take "integral humanity" as a goal and standard; it seems to us built into the global act of February 15 and into the wider movement of which that day was a moment. After comparing a Sartrean take on February 15 with the famous Habermas-Derrida appeal inspired by that day, we'll close with some reciprocal illuminations between Sartre's theories and Zapatista practice. The corporate meltdowns of this and the previous decade in the US - WorldCom, Enron, Tyco, and in Australia - FAI, HIH and AWB being among the many examples - have resulted in the governments of those two countries introducing legislation and policy guidelines aimed at minimising future corporate misbehaviour. -/- The US has introduced the Sarbanes Oxley Act, with requirements on corporate accountants and auditors, as well as its whistleblowing provisions. It has revised the Federal Sentencing Guidelines for Organizations. (...) New rules for the NYSE and NASDAQ have also been introduced. In addition, the U.S. Securities and Exchange Commission and U.S. Department of Justice have further strengthened the Foreign Corrupt Practices Act 1977, last revised in 1997. -/- Australia has revised the Corporations Act to include whistleblower protection clauses as well as adopted the ASX Corporate Governance guidelines. Standards Australia has issued its handbook on corporate governance. Although not a business issue, the Australian government has also announced that it will introduce whistleblower protection legislation for the public sector by the end of its first term in office. This legislation will likely influence whatever the private sector does in this respect. The inclusion of whistleblower protection in both Sarbanes–Oxley and the Corporations Act reflects a growing body of research that finds that people internal to an organisation are the most effective way to identify corporate wrongs. The Commonwealth Treasury has recently issued an options paper, stating that the Corporations Act has been ineffectual. It has sought submissions on revisions to the legislation that the Australian Government could take. This paper examines the policies advocated by over 20 organisations and academics concerned with whistleblowing issues. It draws the conclusion that on current indications, even after further reform, Australian legislation and policies are still likely to be less effectual than overseas practices. -/- --------------------------------- . The claim is made in the book, Applied Ethics, published under the auspices of the Australian Association for Professional and Applied Ethics (AAPAE), that it can strengthen ethical behaviour. That claim, embodied in the subtitle, is based on more than a half dozen practices set out in the book. In total, they are drawn from an examination of ethical practices across fourteen different disciplines. The purpose of this paper is to outline and support that claim, drawing primarily on chapters of (...) the book, but also drawing on a small amount of additional information. The research on the ethical issues in each of these disciplines, and the writing of the chapters, were undertaken by members and associates of AAPAE. The fourteen disciplines were Marketing, Business, Accounting, Pharmacy, Nursing, Medicine, Veterinary & Animal Ethics, Engineering, Information and Communications Technology (ICT), Journalism, Policing, Politics, the Law and the Sciences. The findings have significance for the teaching of ethics by moral philosophers, for not all ethics classes follow the practices suggested by these findings. A few of the practices are even rejected by some moral philosophers. That the practices will improve ethical behaviour is the principal position taken by this paper. -/- . (shrink)
