This target article focuses on dynamics that arise in three typical ethically complex cases in which psychiatric consultations are requested by physicians: a dying patient refuses life-prolonging treatment, an uncooperative patient demands to be allowed to go outside and smoke, and an angry patient demands to be admitted to the hospital. The discussion canvasses what is at stake morally and clinically in each of these cases and explores clinician–patient interactions, dynamics in relationships between consulting physicians and consultant psychiatrists, patient transference, (...) and physician countertransference. The article defines legalism and countertransference and argues that an ethically and clinically important consequence of these phenomena for patients is distortion of clinicians' perceptions of patients' decisions and vulnerabilities. The discussion also describes how legalism and countertransference adversely affect how clinicians treat their psychiatrist colleagues. Finally, the article suggests how the effects of legalism and countertransference can be mitigated. (shrink)

On the premise that the good knowing is the originary reality, this article provides a synopsis of Wang Yangming’s exposition of the fundamental essence of liangzhi. The self-existent resemblances of the originary reality are outlined and summarized as the eight virtues of liangzhi: voidness, intelligence, luminousness, awareness, constancy, happiness, true I, and purity. These eight virtues are, however, ultimately subsumed by the middle, which governs them in common. The middle is the original state and true form of the fundamental essence (...) of liangzhi, which Wang Yangming describes as a transparent mirror and level balance. (shrink)

This paper presents an Anscombian alternative to the traditional deontic conception of ought. According to the Anscombian conception of ought developed here, ought is general as opposed to ‘peculiarly moral’, norm-referring instead of law- or obligation-referring, and ‘heroic’ in the sense that it does not presuppose that individuals can do or be as they ought. Its connection to matters of fact can, moreover, be clearly stated. In the first part of the paper, I describe some significant logical characteristics of this (...) conception, and argue that it provides a more suitable account of the oughts of ethics as compared to the deontic conception. One particular strength of the Anscombian conception of ought is that it does justice to the possibility of tragedy in human life, where tragedy is understood as the possibility that a thoroughly well-intentioned individual might sometimes ensure her own moral imperfection, precisely by doing what is morally right or best at every step along the way. To motivate this feature of the view, I sketch a corresponding picture of responsibility for actions in terms of ownership of one’s deeds. This conception of responsibility allows that what one ought to do is not always constrained by what one can do, while saving the intuitions about fairness and the practical scope of moral norms that principally motivate ‘ought implies can’. To illustrate and motivate the overall account I discuss a number of cases, including the character Winston from George Orwell’s 1984. (shrink)

Kateb asserts that the defense of universal human rights requires two indispensable components: morality and human dignity. For Kateb, morality and justice have sound theoretical underpinnings; human dignity, by virtue of its “existential” quality, lacks its own theoretical framework. This he proceeds to establish with a critique of the writings of canonical Western political philosophers and contemporary thinkers like Peter Singer and Thomas Nagel. The author argues that while morality compels just governments to prevent, reduce, or eliminate human suffering inasmuch (...) as it is possible, people possess and are entitled to dignity by mere virtue of their “status” as human beings. Homo sapiens, he maintains, have a “stature,” manifest in the species's “great achievements,” that exceeds that of other creatures, even in the secular cosmos. (shrink)

First published in 1713, this work was designed as a vivid and persuasive presentation of the remarkable picture of reality that Berkeley had first presented two years earlier in his Principles of Human Knowledge. His central claim there, as here, was that physical things consist of nothing but ideas in minds--that the world is not material but mental. Action is a means of acquiring perceptual information about the environment. Turning around, for example, alters your spatial relations to surrounding objects and, hence, which of their properties you visually perceive. Moving your hand over an object’s surface enables you to feel its shape, temperature, and texture. Sniffing and walking around a room enables you to track down the source of an unpleasant smell. Active or passive movements of the body can also generate useful sources of perceptual information (Gibson 1966, (...) 1979). The pattern of optic flow in the retinal image produced by forward locomotion, for example, contains information about the direction in which you are heading, while motion parallax is a “cue” used by the visual system to estimate the relative distances of objects in your field of view. In these uncontroversial ways and others, perception is instrumentally dependent on action. According to an explanatory framework that Susan Hurley (1998) dubs the “Input-Output Picture”, the dependence of perception on action is purely instrumental: "Movement can alter sensory inputs and so result in different perceptions… changes in output are merely a means to changes in input, on which perception depends directly" (1998: 342). -/- The action-based theories of perception, reviewed in this entry, challenge the Input-Output Picture. They maintain that perception can also depend in a noninstrumental or constitutive way on action (or, more generally, on capacities for object-directed motor control). This position has taken many different forms in the history of philosophy and psychology. Most action-based theories of perception in the last 300 years, however, have looked to action in order to explain how vision, in particular, acquires either all or some of its spatial representational content. Accordingly, these are the theories on which we shall focus here. -/- We begin in Section 1 by discussing George Berkeley’s Towards a New Theory of Vision (1709), the historical locus classicus of action-based theories of perception, and one of the most influential texts on vision ever written. Berkeley argues that the basic or “proper” deliverance of vision is not an arrangement of voluminous objects in three-dimensional space, but rather a two-dimensional manifold of light and color. We then turn to a discussion of Lotze, Helmholtz, and the local sign doctrine. The “local signs” were felt cues for the mind to know what sort of spatial content to imbue visual experience with. For Lotze, these cues were “inflowing” kinaesthetic feelings that result from actually moving the eyes, while, for Helmholtz, they were “outflowing” motor commands sent to move the eyes. -/- In Section 2, we discuss sensorimotor contingency theories, which became prominent in the 20thcentury. These views maintain that an ability to predict the sensory consequences of self-initiated actions is necessary for perception. Among the motivations for this family of theories is the problem of visual direction constancy—why do objects appear to be stationary even though the locations on the retina to which they reflect light change with every eye movement?—as well as experiments on adaptation to optical rearrangement devices (ORDs) and sensory substitution. -/- Section 3 examines two other important 20th century theories. According to what we shall call the motor component theory, efference copies generated in the oculomotor system and/or proprioceptive feedback from eye-movements are used together with incoming sensory inputs to determine the spatial attributes of perceived objects. Efferent readiness theories, by contrast, look to the particular ways in which perceptual states prepare the observer to move and act in relation to the environment. The modest readiness theory, as we shall call it, claims that the way an object’s spatial attributes are represented in visual experience can be modulated by one or another form of covert action planning. The bold readiness theory argues for the stronger claim that perception just is covert readiness for action. -/- In Section 4, we move to the disposition theory, most influentially articulated by Gareth Evans (1982, 1985), but more recently defended by Rick Grush (2000, 2007). Evans’ theory is, at its core, very similar to the bold efferent readiness theory. There are some notable differences, though. Evans’ account is more finely articulated in some philosophical respects. It also does not posit a reduction of perception to behavioral dispositions, but rather posits that certain complicated relations between perceptual input and behavioral provide spatial content. Grush proposes a very specific theory that is like Evans’ in that it does not posit a reduction, but unlike Evans’ view, does not put behavioral dispositions and sensory input on an undifferentiated footing. Webb's scheme for classifying behavioral models is applicable to a wide range of theories and simulations, nonrobotic as well as robotic. It is suggested that a meta-analysis of existing models, characterized according to the proposed scheme, could identify regions of the seven-dimensional modelling space that are particularly likely to lead to new insights in understanding behavior.

The law has therefore had two conflicting impacts on medical ethics: the positive effect of eroding paternalism and replacing it with a patient-centered ethic; and the negative effect of encouraging physicians to be more concerned with avoiding litigation than doing the "right" thing.

Several philosophers have developed theological perspectives out of Heidegger's ontology. Yet the question of God in Heidegger's thought itself has never received full elucidation. In this revealing new study, George Kovacs poses the problem of analyzing the idea of God as a process of questioning and thus subjects Heidegger's phenomenological existentialism to a process of exposition Heidegger himself employed.

This study shows how Kierkegaard's mature theological writings reflect his engagement with the wide range of theological positions which he encountered as a student, including German and Danish Romanticism, Hegelianism and the writings of Fichte and Schleiermacher. George Pattison draws on both major and lesser-known works to show the complexity and nuances of Kierkegaard's theological position, which remained closer to Schleiermacher's affirmation of religion as a 'feeling of absolute dependence' than to the Barthian denial of any 'point of contact', (...) with which he is often associated. The role of metaphysics in critique stands as a defining issue for the Frankfurt School theorists. Max Horkheimer himself claims that metaphysics serves as an instrument of domination, leading him to develop an interdisciplinary mate- rialism as a postmetaphysical alternative. Critics such as Georg Lohmann con- tend, however, that Horkheimer’s critique of instrumental reason is aporetic insofar as it undermines all metaphysical claims while implicitly making them. Since Horkheimer narrowly equates metaphysics with identity thinking, this article argues that his appeal (...) to nonidentity thinking as the foundation for critique is better understood as a form of antimetaphysics. This, however, leaves Horkheimer no better situated, since antimetaphysics remains a variant of metaphysics. While Horkheimer reproduces the techniques of domination he sought to avoid, this lapse into metaphysics warns of the difficult path that postmetaphysical thinking must navigate between the antipodes of metaphys- ical and antimetaphysical positions. Whatever else one might say concerning the legality, morality, and prudence of his actions, Edward Snowden, the former U.S. National Security Agency contractor, is right about the notion of publicity and informed consent, which together constitute the hallmark of democratic public policy. In order to be morally justifiable, any strategy or policy involving the body politic must be one to which it would voluntarily assent when fully informed about it. This, in essence, was Snowden's argument for leaking, in June 2013, (...) the documents that revealed the massive NSA surveillance program: So long as there's broad support amongst a people, it can be argued there's a level of legitimacy even to the most invasive and morally wrong program, as it was an informed and willing decision.... However, programs that are implemented in secret, out of public oversight, lack that legitimacy, and that's a problem. It also represents a dangerous normalization of “governing in the dark,” where decisions with enormous public impact occur without any public input. (shrink)

Digital computers carry out algorithms coded in high level programs. These abstract entities determine what happens at the physical level: they control whether electrons flow through specific transistors at specific times or not, entailing downward causation in both the logical and implementation hierarchies. This paper explores how this is possible in the light of the alleged causal completeness of physics at the bottom level, and highlights the mechanism that enables strong emergence (the manifest causal effectiveness of application programs) to occur. Although synchronic emergence of higher levels from lower levels is manifestly true, diachronic emergence is generically not the case; indeed we give specific examples where it cannot occur because of the causal effectiveness of higher level variables. I have only begun to sketch out some of the differences between the work of Harold Garfinkel and Alfred Schutz. As the work of ethnomethodology accumulates and as other commentators begin to explore their similarities and differences, a clearer picture will, I am certain, emerge. For now, I shall only conclude with the following brief summary.As Natanson (1966, p. 152) has noted, “for Schutz, mundane existence is structured by the typifications of man in the natural standpoint. Common sense is then (...) an achievement rather than something simply given.” The main issues with which Schutz was concerned were how to investigate social reality and comprehend it (Natanson, 1966): …in terms which do not violate its character. How is warranted knowledge possible of the experiential world defined by the natural standpoint? The answer Schutz offers is by way of a reconstruction of the typifications of mundane life, but the underlying theme he is exploring is the intentional nature of consciousness in its abstractive and ideational modalities. Typification as such, rather than types and constructs, is the underlying concern. By tracing out the phenomenological genesis of typification from its prepredicative grounds to its self-conscious activity in generalization, he has provided an approach to an epistemology of the social world. [p. 154]Garfinkel, on the other hand, seeks to trace out the genesis of the perception, interpretation, and accomplishment of social occasions and their settings by members of society as they live and operate within the natural attitude in the world of everyday life. Their activities are taken without question as whatever social reality is for them. The processes whereby they accomplish these activities so as to make them recognizable become his main concern and it is the discovery and reconstruction of these processes, under the ethnomethodological reduction, of which his findings consist. By describing the methods used by members, he provides an approach to the methodology of the social world, that is, an ethno or members' methodology, for the construction, interpretation, and recognition of the social world. Genetics and ethics are employed to assess the claims of the transhumanist program of human enhancement. A succinct description of central concepts in genetics and an explanation of current techniques to edit the (...) human genome serve to assess the capabilities and limitations of editing techniques. Potential benefits and liabilities of human enhancement through genome editing are discussed to appraise its feasibility. Ethical considerations of genome editing inform a reflection on the implications of introducing heritable changes in the genome of individuals. It is concluded that the transhumanist program is underpinned by a large number of hypotheses rather than by sufficient evidence. (shrink)

Amidst the constantly augmenting gastronomic capital of celebrity chefs, this study scrutinizes from a critical discourse analytic angle how Jamie Oliver has managed to carve a global brand identity through a process that is termed (dis)placed branding. A roadmap is furnished as to how Italy as place brand and Italianness are discursively articulated, (dis)placed and appropriated in Jamie Oliver’s travelogues which are reflected in his global brand identity. By enriching the CDA methodological toolbox with a deconstructive reading strategy, it is (...) shown that Oliver’s celebrity equity ultimately boils down to supplementing the localized meaning of place of origin with a simulacral, hyperreal place of origin. In this manner, the celebrity’s recipes become more original than the original or doubly original. The (dis)placed branding process that is outlined in the face of Oliver’s global branding strategy is critically discussed with reference to the employed discursive strategies, lexicogrammatical and multimodal choices.
