This paper examines the ‘deep-end’ of the international justice process—the incarceration of persons convicted in specially constituted international criminal tribunals and courts for gross violations of human rights, genocide, crimes against humanity and war crimes with a focus on language rights of such prisoners who are commonly serving sentences in foreign prisons. The punishment phase of the international justice process and its effects are not easily quantifiable and have been largely hidden from view. Although international criminal law asserts that equal (...) treatment before the law requires that there be no significant disparity in punishment regimes from one sentence-enforcing country to another, comparative penology shows that there are considerable differences in the conditions of confinement and the nature of correctional services in the prison systems of different countries. This has a direct impact on post-sentence procedural and rehabilitation rights of which language rights from a key part. In this specific context, and drawing from existing literature, the paper therefore examines the extent to which enforcement practice conforms to the ideal of equal treatment espoused by the tribunals. In this paper we prove that from large cardinals it is consistent that there is a singular strong limit cardinal $\nu $ such that the singular cardinal hypothesis fails at $\nu $ and every collection of fewer than $\operatorname {\mathrm {cf}}(\nu )$ stationary subsets of $\nu ^{+}$ reflects simultaneously. For $\operatorname {\mathrm {cf}}(\nu )> \omega $, this situation was not previously known to be consistent. Using different methods, we reduce the upper bound on the consistency strength of this situation for (...) $\operatorname {\mathrm {cf}}(\nu ) = \omega $ to below a single partially supercompact cardinal. This paper examines the legal and ethical aspects of traceback testing, a process in which patients who have been previously diagnosed with ovarian cancer are identified and offered genetic testing so that their family members can be informed of their genetic risk and can also choose to undergo testing. Specifically, this analysis examines the ethical and legal limits in implementing traceback testing in cases when the patient is deceased and can no longer consent to genetic testing.

In this paper certain parameters of ethical values and attitudes of students in economics from different countries are analysed (attitudes toward work and organisation; goals of work; readiness to work for common benefit, etc.). The basic question was whether, and to what extent, such attitudes differ in countries in transition (former communist countries of Central and Eastern Europe) compared with western countries with a developed market economy and Latin‐American countries. On the basis of empirical research we conclude that there are (...) significant differences, i.e., that students from countries in transition show more self‐oriented attitudes, less readiness to help others and tend to consider work in an organisation primarily as a means to achieve one's own goals (always compared with students from the other two groups of countries). The main explanation for this is found in the transition itself, i.e., conditions and processes in those countries in the 1990s, and less in the heritage of the previous (communist) system. Categorization and decision making are combined in a task with photorealistic faces. Two different types of face stimuli were assigned probabilistically into one of two fictitious groups; based on the category, faces were further probabilistically assigned to be hostile or friendly. In Part I, participants are asked to categorize a face into one of two categories, and to make a decision concerning interaction. A Markov model of categorization followed by decision making provides reasonable fits to Part I data. A Markov (...) model predicting decision making followed by categorization is rejected. In Part II, a no-parameter model predicts decisions using categorization and decision responses collected in separate trials, suggesting that Part 1 results are not an artifact of the presentation of categorization and decision questions within a single trial. Decisions concerning interaction (defensive/friendly) appear to be based on information from the category decision, and not from the face stimuli alone. (shrink)

This thesis concerns alternative concatenating operations in extensive measurements and the degree to which concatenating operations are matter of convention. My arguments are directed against Ellis' claim that what prevents us from choosing alternative ways of combining extensive quantities is only convenience and simplicity and that the choice is not based on empirical reasons. ;My first argument is that, given certain relational theories of measurement, there can be no more than one concatenating operation per quantity; because combining operations are the (...) only conclusive distinguishing characteristic among distinct extensive measurements and thus the only thing that can serve as an indicator for the identity of a quantity. Rectangular and collinear concatenation, for example, cannot both be used as a way of combining lengths. However, rectangular concatenation could be used to measure some other extensive quantity since it fulfills the necessary conditions for adequate numerical assignment. ;For those that adopt theories of measurement which can support the claim that dinches measure length, I demonstrate, in the second argument, that rectangular concatenation would be a bad alternative and thus no alternative at all. Implementation of rectangular concatenation requires a new science; a science compatible with dinches violates present invariance principles and a new set must be provided, if possible. It is not clear that there is a set of invariance principles compatible with dinches which also gives basis for a science that explains the phenomena as well as the old one. Moreover, new invariance principles would be unintuitive and would require that certain fundamental concepts change their meaning. For these reasons the choice between them is guided by a number of empirical reasons and is not only a matter of convention. (shrink)

The prevalence of dementia is increasing worldwide but there is still no hope of a cure. Huge resources go into biomedical research, whose reductive ‘enactment’ has severe consequences for women, who are predominantly affected by dementia. To challenge such tragic enactment, this article considers ‘multiple ontologies’ of the most common type of dementia – Alzheimer’s disease – in the popular fictional film adaptations Still Alice and A Song for Martin. Using a post-humanist account of feminist visual studies of technoscience, this (...) comparative film analysis reveals how gender supersedes AD oversteering the hierarchical dualisms between health and pathology, human and nonhuman, and biomedical and artistic modes of knowing about Alzheimer’s. The author argues that these films stress the potential of the arts, as a multisensorial post-humanist embodied state of becoming with AD, to challenge hierarchical dualisms and innovatively contribute to dementia care. The issue of Holocaust tourism might be a quite sensitive, but nevertheless very important topic in the domain of the Holocaust remembrance. As tourism is often associated with leisure activities, it is quite challenging to put tourism into darker contexts of history and death. Also, different people coming to the Holocaust-related places with different motives make the issue of designing educational tours even more complex. This paper will try to expose questions related to dark tourism, Holocaust tourism, auratic memorial places, (...) and to discuss ethical approaches to the Holocaust memory in the beginning of the 21st century. The text argues for the tourist experience as a memorable and educational tool with an active transformational potential, which will turn the visitor into a witness who further contributes to survival of the legacy of the Holocaust in the future. This paper concerns the ways in which one can/cannot combine extensive quantities. Given a particular theory of extensive measurement, there can be no alternative ways of combining extensive quantities, where 'alternative' means that one combining operation can be used instead of another causing only a change in the number assigned to the quantity. As a consequence, rectangular concatenation cannot be an alternative combining operation for length as was suggested by Ellis and agreed by Krantz, Luce, Suppes, and Tversky. In this paper, I will present a problem for reductive accounts of knowledge-undermining epistemic luck. By “reductive” I mean accounts that try to analyze epistemic luck in non-epistemic terms. I will begin by briefly considering Jennifer Lackey's (2006) criticism of Duncan Pritchard's (2005) safety-based account of epistemic luck. I will further develop her objection to Pritchard by drawing on the defeasible-reasoning tradition. I will then show that her objection to safety-based accounts is an instance of a more general problem with (...) reductive accounts of epistemic luck. In short, they face a dilemma: they can either fail to vindicate the intuitive verdicts about cases or they can illicitly appeal to the epistemic vocabulary they are trying to reduce. The upshot is that we can only understand epistemic luck in terms of the assessment of the subject's reasons and we can't give a reductive account of that. (shrink)

I will discuss a variety of cases such that the subject's believing truly is somewhat of an accident, but less so than in a Gettier case. In each case, this is because her reasons are not ultimately undefeated full stop, but they are ultimately undefeated with certain qualifications. For example, the subject's reasons might be ultimately defeated considered in themselves but ultimately undefeated considered as a proper part of an inference to the best explanation that is undefeated without qualification. In (...) each section of the paper, I consider different qualifications and show how in each case we get an epistemic standing I call “coach-class knowledge”. First-class knowledge requires justifying reasons that are undefeated without qualification. Coach-class knowledge only requires qualified lack of defeat. I will use this distinction to bring debates over knowledge from falsehood and fake barns to an ecumenical resolution. In both cases, the subject enjoys coach-class rather than first-class knowledge. I will also show that the defeasible reasoning tradition can better account for graded accidental truth than safety theories. (shrink)

The Study of Sociology, by English philosopher, biologist, anthropologist, and sociologist, Herbert Spencer, was originally published in 1873. Spencer was known for his contributions to evolutionary theory and for applying it outside of biology, to the fields of philosophy, psychology, and within sociology. In particular, this work is a survey of the foundations of sociology, by one of its founders. Within which he applies the idea of natural selection to the group survival and institutional structures.

Many philosophers have noted that normative error theorists appear to be committed to saying ‘Error theory is true, but I have no reason to believe it’, which seems paradoxical. In defence of error...

Reasons rationalize beliefs. Reasons, when all goes well, turn true beliefs into knowledge. I am interested in the relationship between these aspects of reasons. Without a proper understanding of their relationship, the theory of knowledge will be less illuminating than it ought to be. I hope to show that previous accounts have failed to account for this relationship. This has resulted in a tendency to focus on justification rather than knowledge. It has also resulted in many becoming skeptical about the (...) prospects for an analysis of knowledge. The skepticism is misplaced and the tendency can be fixed without sacrificing any insights. The solution is to see how good reasons (in a sense to be articulated) are apparent (in a sense to be articulated) to the knowing subject. Once this claim is unpacked, we see that it is an illuminating analysis of knowledge in terms of distinct but intimately related aspects of epistemic assessment. It helps us see the value of knowledge (over and above true belief) and it affords us a unified, “reasons-first” metaepistemology. The resulting picture is neither a familiar kind of internalism or externalism. (shrink)

In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations (...) as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. It has become customary among philosophers and biologists to claim that folk racial classification has no biological basis. This paper attempts to debunk that view. In this paper, I show that ‘race’, as used in current U.S. race talk, picks out a biologically real entity. I do this by, first, showing that ‘race’, in this use, is not a kind term, but a proper name for a set of human population groups. Next, using recent human genetic clustering results, I show (...) that this set of human population groups is a partition of human populations that I call ‘the Blumenbach partition’. (shrink)

“It's almost like putting salt in a wound, for this person who's already made a very difficult decision,” suggested Meghan Patterson, a licensed obstetrician-gynecologist whom we interviewed in our qualitative study of the experiences of North Carolina abortion providers practicing under the state's Woman's Right to Know Act. The act requires that women receive counseling with state-mandated information at least twenty-four hours prior to obtaining an abortion. After the law was passed, Patterson worked with clinic administrators, in consultation with a (...) lawyer, to write a script to be used in the state-mandated counseling procedure. She and her colleagues took particular steps to mitigate the effects of what she described as HB 854's “forced language”—such as referring to the “father of the child.” While HB 854 stipulated that patients must be informed of the medical risks associated with the particular abortion procedure as well as those of carrying the child to term, Patterson's script made explicit the magnitude of comparative risks, emphasizing that the risks of carrying a pregnancy to term are substantially greater than the risks of an early-term abortion. She felt that these contextualization strategies helped to facilitate trust and rapport in a clinical care situation that proved relationally and morally challenging. In this article, we take up and expand on this point by elucidating an empirically grounded approach to ethically justified care when health care providers face legal or institutional policy mandates that raise possible moral conflicts. Our approach builds on recent bioethics discourse addressing conscience in the practice of medicine. While the concept of conscience has broad philosophical underpinnings relating to moral judgment, agency, and discernments of right and wrong, debates in bioethics have tended to engage the concept primarily vis-à-vis rights of conscientious objection or refusal. Here, we suggest a broader frame for thinking about claims of conscience in health care. Our approach draws on the feminist bioethics and the ethics of care literatures to highlight how providers may be motivated by matters of conscience, including relational concerns, in the active provision of certain forms of care. What emerges are two possibilities: not only conscientious refusal to comply with a policy mandate but also conscientious compliance—working conscientiously within a mandate's confines. (shrink)

Though almost forgotten today, Herbert Spencer ranks as one of the foremost individualist philosophers. His influence in the latter half of the nineteenth century was immense. Spencer's name is usually linked with Darwin's, for it was he who penned the phrase: survival of the fittest. Today in America he is most often admired for his trenchant essays in 'The Man Versus the State'. But Spencer himself considered THE PRINCIPLES OF ETHICS to be his finest work. In the (...) second volume, under 'Justice', is his final statement on the role of the state. His formula for justice is summed up in these words: "Every man is free to do that which he wills, provided he infringes not the equal freedom of any other man.". (shrink)

I am interested in the “rational irrationality hypothesis” about voter behavior. According to this hypothesis, voters regularly vote for policies that are contrary to their interests because the act of voting for them isn’t. Gathering political information is time-consuming and inconvenient. Doing so is unlikely to lead to positive results since one's vote is unlikely to be decisive. However, we have preferences over our political beliefs. We like to see ourselves as members of certain groups (e.g. “rugged individualists”) and being (...) part of those groups depends on having certain beliefs (e.g. about welfare spending). Even if a decrease in welfare spending would be bad for me, I might still benefit by believing in and, consequently, voting for a decrease since my vote is unlikely to make a difference but getting to see myself as a rugged individualist will make a noticeable difference to my wellbeing. It is sometimes argued that this hypothesis fails for empirical reasons. I will argue that things are worse: it is conceptually incoherent. I will do so by first showing that it is a rationalizing explanation and then argue that rationalizing explanations must be reflectively stable from the agent's perspective.
