It is no accident that the book Benjamin wrote as a reader of himself, A Berlin Childhood, also begins with the description of a park, that of the Tiergarten zoo. However great the difference may seem between this collection of short prose pieces and Proust's three-thousand-page novel when viewed from the outside, Benjamin's book illustrates [his] fascination... A sentence in his book points to the central experience of Proust's work: that almost everything childhood was can be withheld from a person (...) for years, suddenly to be offered him anew as if by chance. "Like a mother who holds the new-born infant to her breast without waking it, life proceeds for a long time with the still tender memory of childhood" . Also reminiscent of Proust is the description of the mother who, on evenings when guests are in the house, comes in to see her child only fleetingly to say good night; so, too, is that of the boy attentively listening to the noises which penetrate into his room from the courtyard below and thus from a foreign world. The studied elevation of the newly invented telephone to the level of a mythical object is anticipated in Proust as well. And the relationship to and influence of the earlier work can be demonstrated even in the use of metaphor. But little is gained by this approach, and it would not be easy to refute the objection that such similarities lie in the authors' common raw material: childhood, the fin de siècle epoch, and the attempt to bring them both into the present. Peter Szondi was professor of comparative literature at the Free University of Berlin at the time of his death in 1971. His many influential works include Theorie des modernen Dramas , Versuch über das Tragische , and a five-volume collection of his lectures. In 1991, Jones developed an issue-contingent model of ethical decision making in which moral intensity is posited to affect the four stages of Rest's 1986 model. Jones claimed that moral intensity, which is "the extent of issue-related moral imperative in a situation", consists of six characteristics: magnitude of consequences, social consensus, probability of effect, temporal immediacy, proximity, and concentration of effect. This article reports the findings of two studies that analyzed the factor structure of moral intensity, operationalized by a 12-item (...) Perceived Moral Intensity Scale adapted from the work of Sing-hapakdi et al. [1996, Journal of Business Research, 36, 245-255] and Frey [2000, Journal of Business Ethics, 26, 181-195]. The two items that were purported to measure CE were dropped due to their inability to effectively tap into the characteristic proposed by Jones. Factor analyses of the remaining 10 items supported a 3-factor structure, with the MC, PE, and TI items loading on the first factor, the PX items loading on the second factor, and the SC items loading on the third factor. These factors were labeled: Probable Magnitude of Consequences, Proximity, and Social Consensus. The authors conclude that moral intensity consists of three characteristics, rather than the six posited by Jones. (shrink)

The factor structure of the Multidimensional Ethics Scale (MES; Reidenbach and Robin: 1988, Journal of Business Ethics 7, 871–879; 1990, Journal of Business Ethics 9, 639–653) was examined for the 8-item short form (N = 328) and the original 30-item pool (N = 260). The objectives of the study were: to verify the dimensionality of the MES; to increase the amount of true cross-scenario variance through the use of 18 scenarios varying in moral intensity (Jones: 1991, Academy of Management Review (...) 16, 366–395); and, to examine the items for measurement precision using item-response theory (IRT) methods. Results of confirmatory and exploratory factor analysis failed to conclusively support the hypothesized 3- (short form) or 5-factor (long form) structure; both instruments were instead dominated by a general factor. Item response theory analyses using Samejima’s (1969, Psychometrika Monograph Supplement 34, (4, Pt. 2)) graded response model revealed that many items in the 30-item pool performed very well, and suggested that a different collection of items be used to form a short-form version of the MES. Our proposed 10-item instrument includes more discriminating items than the 8-item version, and has the added advantage of including two items from each of the five ethical philosophies represented in the original 30-item pool. Should advance directives (ADs) such as living wills be employed to direct the care of the severely demented? In considering this question, I focus primarily on the claims of Rebecca Dresser who objects in principle to the use of ADs in this context. Dresser has persuasively argued that ADs are both theoretically incoherent and ethically dangerous. She proceeds to advocate a Best Interest Standard as the best way for deciding when and how the demented ought to be treated. PrécisThe administration of Pre-Mortem Interventions (PMIs) to preserve the opportunity to donate, to assess the eligibility to donate, or to optimize the outcomes of donation and transplantation are controversial as they offer no direct medical benefit and include at least the possibility of harm to the still-living patient. In this article, we describe the legal analysis surrounding consent to PMIs, drawing on existing legal commentary and identifying key legal problems. We provide an overview of the approaches in several jurisdictions that (...) have chosen to explicitly address PMIs within codified law. We then provide, as an example, a detailed exploration of how PMIs are likely to be addressed in one jurisdiction where general medical consent law applies because there is no specific legislation addressing PMIs — the province of Ontario in Canada. Teaching economics has been shown to encourage students to defect in a prisoner's dilemma game. However, can ethics training reverse that effect and promote cooperation? We conducted an experiment to answer this question. We found that students who had the ethics module had higher rates of cooperation than students without the ethics module, even after controlling for communication and other factors expected to affect cooperation. We conclude that the teaching of ethics can mitigate the possible adverse incentives of the prisoner's (...) dilemma, and, by implication, the adverse effects of economics and business training. It is proposed in this paper that enzymes, by virtue of a number of correctly positioned sites of interaction with substrates, can force the compression of hydrogen bonds, increasing the probability of proton transfer by quantum mechanical tunneling. By such a catalytic mechanism a rate enhancement of many orders of magnitude may be obtained with a very low energy input requirement. Is genuinely just behavior possible for Hobbesian agents? More perspicuously, does Hobbes allow that at least some individuals conceive of justice as not simply a means to self-preservation, but furthermore, as a worthwhile end in its own right? In a recent issue of Hobbes Studies I answered both of these questions in the affirmative.1 Therein, however, for reasons of space I neglected to explore and defend adequately Hobbes's conception of the "Just Man" as someone for whom genuinely just behavior is, (...) in the Jamesian sense, a "live option." I intend to correct this scholarly deficit forthwith by proffering what I consider to be a thorough defense thereof. Those who advocate the Standard Reading of Hobbes as an egoist will, of course, α priori dismiss such claims as "astonishing" to say the least.2 Nonetheless, if my exegesis and defense is successful then SR will have to undergo a transformation; succinctly, proponents of SR will be forced to acknowledge the Just Man's presence and to weaken their presuppositions and conclusions accordingly . I begin by cataloging and critically commenting upon the numerous references Hobbes makes to the "Just Man" throughout the major works that constitute his moral and political corpus: The Elements of Law , De Cive and both the English and Latin versions of Leviathan .3 I then turn in the next section to a defense of the possibility of genuinely just behavior on the part of Hobbesian individuals by responding to four powerful objections proffered by the proponents of SR. I make three points. First, processors and depletable resources should not be regarded as alternative means of processing information: they are both necessary. Second, comparing a processor account with a rational allocation mechanism to a depletable-resources account without one is not a fair comparison. Third, depletable resources can act as signals as well as fuels.

In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Unfortunately, the World Trade Center attacks have exacerbated the problem by labeling asylees and refugees as potential terrorists and subject to deportation. (shrink)

Philosophical clarity is not simply a matter of style; it affects the quality of the thinking and writing and so the level of intellectual rigor. Achieving maximum clarity requires both intellectual and perceptual skills. The intellectual grasp of what philosophical clarity involves motivates writing with greater clarity. The perceptual skill of seeing exactly what we have written enables such improvement to occur. This paper explains a technique used in graduate-level courses to move both sets of skills, which in turn typically (...) changes the students’ approach to writing and moves their written presentation skills quite dramatically.
