This study identified and compared the attitudes of visitors toward zoo-housed little penguins, their enclosure and visitor experience that may influence the way visitors behave toward little penguins at two Australian zoos. Visitor attitudes were assessed using an anonymous questionnaire, targeting visitor beliefs, and experiences, where visitors were randomly approached at the penguin exhibit after they had finished viewing the penguins. Visitors were given two options to complete the questionnaire, on an iPad during their zoo visit or online (URL sent (...) via email) after their zoo visit. A total of 638 participants (495 at Melbourne Zoo and 143 at Taronga Zoo) completed the questionnaire, 42% were completed onsite during their zoo visit and 58% were completed online after their zoo visit. Most participants were living in Australia, non-zoo members, female, previously or currently owned a pet, aged between 26 and 35 years and had a University degree. Results showed that the attitude dimensions of visitors were consistent between the two zoos which indicates that these measures of attitudes were stable over time and location. Overall, visitors at both zoos had positive attitudes toward little penguins, penguin welfare, the enclosure, and visitor experience. However, whether these positive attitudes and positive visitor experience influenced the way visitors behaved toward the penguins remains unclear. There were some differences in visitor attitudes toward the perceived “aggressiveness” and “timidness” of little penguins, “negative penguin welfare”, “experience with the penguins”, “learning”, “visual barriers” and the way visitors rated their overall experience at the penguin enclosure. While the reasons for the differences in visitor attitudes and visitor experience between the zoos were not clear, some factors such as penguin behavior and enclosure design, may have been attributable to these differences. Also, a relationship was found between visitor attitudes and how visitors rated the welfare of penguins, the enclosure and visitor experience at the enclosure; more positive visitor attitudes were associated with higher ratings of penguin welfare, the enclosure and visitor experience. The practical implications of these results for zoos is unclear because the differences in visitor attitudes were numerically small. This requires further comparisons between zoos or enclosures that are more markedly different than the penguin enclosures in the present study and further research on how visitors assess zoo animals, enclosures and visitor experience. Cohen, has credited Hume for being the first to explicitly recognize that there is an important kind of probability which does not fit into the framework afforded by the calculus of chance, a recognition that is evident in Hume's distinction between analogical probability and probabilities arising from chance or cause. Part I considers "The Moral and Metaphysical Sources of the Criminal Law," with contributions by Michael S. Moore, Lawrence Rosen, and Martin Shapiro. The four chapters in Part II all relate, more or less directly, to the issue of retribution, with papers by Hugo Adam Bedau, Michael Davis, Jeffrie G. (...) Murphy, and R. B. Brandt. In the following part, Dennis F. Thompson, Christopher D. Stone, and Susan Wolf deal with the special problem of criminal responsibility in government-one of great importance in modern society. The fourth and final part, echoing the topic of NOMOS XXIV, Ethics, Economics, and the Law , addresses the economic theory of crime. The section includes contributions by Alvin K. A much-cited definition of placebo is from Shapiro and Shapiro :"any therapy that is intentionally or knowingly used for its nonspecific, psychological, or psychophysiological, therapeutic effect, or that is used for a presumed specific therapeutic effect on a patient, symptom, or illness but is without specific activity for the condition being treated". What nonspecific means and how it relates to the psyche has been written about extensively yet inconclusively. In the end, the term nonspecific doesn't say anything about the crux (...) of the matter.Talking about placebo, one first has to distinguish between " placebo effect proper" and "perceived placebo effect." Throughout the history of philosophy there has been a sustained interest in the concepts of knowledge, truth and meaning; interest in the concepts of error, falsity and nonsense, on the other hand, has been intermittent and spasmodic. Error, for example, has suffered at the expense of knowledge to such an extent that sometimes its very existence has been denied, or it has been explained away as being merely the absence of or privation of knowledge; many theories of truth are so (...) constructed that no place can be found for falsity, and theories about what constitutes making sense pay, on the whole, little heed to what constitutes nonsense. In this paper I hope to do something to redress the balance so far as error is concerned. My remarks are prompted by the hope that, just as we may best understand health through the study of disease, so a consideration of error or failure may throw light on knowledge or success. It is clearly not very informative to say of error, falsity and nonsense that they are merely the absence of knowledge, truth and sense; indeed it is just as laconic as a proposed medical definition of disease as the absence of health. On 6 September 1966, the prime minister of South Africa, Dr HF Verwoerd was killed by Mr Tsafendas, a Portuguese national of Greek descent, in parliament by stabbing him in the chest. Mr Tsafendas was a messenger in parliament. At the enquiry trial of Mr Tsafendas, he was found unfit to stand trial on the ground that he suffered from schizophrenia. The psychiatric evidence during the enquiry trial was reviewed and discussed under the following headings: Diagnosis of schizophrenia; Consideration of (...) cultural factors in forensic psychiatric settings; Delusional infestation v. extreme overvalued beliefs; Simulation of psychosis; Ethical considerations in criminal capacity and trial competency assessments. Lessons from the Mr Tsafendas enquiry trial for forensic psychiatrists where a defendant previously diagnosed with schizophrenia commits a prominent political murder, are summarised. It is emphasised that the personhood of an accused referred for forensic observation should be respected and protected, instead of focusing exclusively on a specific diagnosis. (shrink)

In order to understand the rise of runaway solutions in the radiation reaction problem a mechanical model is used. An alternative demonstration of Daboul’s theorem, through Hurwitz’s criterion, is given. The origin of runaway solutions in electrodynamics is discussed. They arise when the particle has a negative mechanical mass or when approximations are used in the equation of motion. In the 1-dimensional mechanical model an exact and linear equation of motion for the particle is obtained, the corresponding exact solution is (...) again runaway when the mechanical mass is negative. The exact solution is not runaway when the mechanical mass is positive. However, the use of approximations leads to an equation of motion which has runaway solutions. It is exhibited that the use of approximations in the 3-dimensional mechanical model is completely necessary because the general equation of motion for the particle is non-linear. The analysis of this case proceeds in a very similar way to the one carried out in electrodynamics. This means that the number of dimensions also plays an important role in the analysis. (shrink)

'Ideologies of Discrimination' considers the implications of the new genetics for understandings of personhood and for understandings of the relationship between people in groups. In particular, the essay delineates and examines the emerging notion of a 'genetic group' and considers the social implications of redefining families, racial groups and ethnic groups through express, and often exclusive, reference to a shared genome. One consequence of such redefinition has been the justification and elaboration of stigmatizing images of and discrimination against such groups-especially (...) those, such as Jews and African-Americans, that have long been identified with specific somatic characteristics. A few worrisome trends begin to emerge in the response of the American legal system to the notion of genetic groups. Among these is a shift in the locus of privacy and identity from the autonomous individual to the genetic group. This shift challenges (and threatens) long-standing Western values (including equality and liberty) that depend upon the ideological centrality of autonomous individuality. (shrink)

This article responds to logical and social theses proposed by Professor José Medina in discussing the relativity of identity. In exploring the metaphor of family resemblance, the author argues that its causal mechanism is biological, not social; particular features of being a woman, or of belonging to a racial or ethnic group, cannot be reduced to social constructions. The article skeptically discusses the supposed importance of sex, race, and ethnicity to a person’s individual identity, and suggests that moral significance finds (...) its origin and grounding elsewhere. It concludes that no liberation can be ‘complete, or even adequate’ until it liberates the mind from ‘“scripts” rooted in the delusion of “collective identities”’. (shrink)
