There is a deep cultural anxiety around public expressions of maternalism and the application of maternal values to society as a whole. Julie Stephens examines why postmaternal thinking has become so influential in recent decades and why there has been a growing unease with maternal forms of subjectivity and maternalist perspectives. In moving beyond policy definitions, which emphasize the priority given to women's claims as employees over their political claims as mothers, Stephens details an elaborate process of (...) cultural forgetting that has accompanied this repudiation of the maternal. Reclaiming an alternative feminist position through an investigation of oral history, life narratives, Web blogs, and other rich and varied sources, Stephens confronts the core claims of postmaternal thought and challenges dominant representations of feminism as having forgotten motherhood. Deploying the interpretive framework of memory studies, she examines the political structures of forgetting surrounding the maternal and the weakening of nurture and care in the public domain. She views the promotion of an illusory, self-sufficient individualism as a form of social unmothering that is profoundly connected to this ethos. In rejecting both traditional maternalism and the new postmaternalism, Stephens challenges prevailing paradigms and makes way for an alternative feminist maternalism centering on a politics of care. We discuss how the Arab Spring is a reflection of the resiliency of the human rights regime. In order to accomplish this, we explore the extent to which the Arab Spring represents norm diffusion among Middle East and North Africa states. Specifically, we examine the cases of Tunisia, Egypt, and Bahrain and consider how economic and demographic changes created space for human rights discourse in these countries. We find that, in the case of MENA states, the Arab Spring represents significant (...) pressure from below. Access to new forms of social media allowed civil society to organize, publicize, and protest relatively efficiently. Social media expanded the potential role of individuals and created newly empowered latent human rights activists who emerged as leaders of the norm diffusion process. The resulting diffusion of human rights norms in the Arab region represents one of the most significant expansions of the human rights regime since the regime’s inception. (shrink)

We argue that the post-9/11 environment has amounted to a substantive change in the longstanding United States relationship with the international human rights regime. We identify three distinct phases of that relationship, noting that in the most recent phase, since 9/11, the US has moved from passive support of the international human rights regime to a direct attack of that regime. Realist and liberal regime theories suggest that the human rights regime is relatively weak, and is unlikely to withstand such (...) an attack. We find that the regime has not only continued to persist, but has flourished even as US support has faltered. The human rights regime is surprisingly strong. We argue it is the ideological nature of the regime that explains its resilience, which suggests that constructivist theory is necessary to fully understand the human rights regime. (shrink)

ABSTRACT:In 1740, Joanna Stephens (fl. 1720–1741) produced a recipe for a tonic that she claimed cured bladder stones. Although she had the support of some notable and powerful men in the medical community and empirical evidence that her tonic worked, it took two years of petitioning, discussing, and even (unsuccessfully) crowd-sourcing before Parliament relented and awarded her the sum she requested to take her tonic public. Stephens’s interaction with the scientific community serves as a case study for how (...) epistemic credibility shapes how communities hear, interpret, and react to testimonies of knowledge claims from marginalized community members. Stephens’s position as an outsider, both qua woman and qua experimentalist, meant that she was effectively and almost immediately written out of her own story by learned and powerful men with who had both vested interests in the cure for the stone and epistemic prejudices that made it impossible for them to hear Stephens’s claim that she had made a discovery. The development of AAC technologies is of critical importance to the many people who are unable to speak intelligibly due to a communication disorder, and to their many everyday interlocutors. Advances in digital technologies have revolutionized AAC, leading to devices that can “speak for” such individuals as aptly as it is illustrated in the case of the world famous physicist, Stephen Hawking. However, given their dependence on prefabricated language, current AAC devices are very limited in their ability to mediate everyday (...) interactions. We argue here that the limits of AAC are firstly theoretical — grounded in prosthetic models that imagine AAC devices as replacements for damaged body parts and in transmission models of language production as communication. In contrast, our multidisciplinary team aims to design pseudo-intelligent mediators of communication by blending strengths of human mediators with features of current AAC technologies. To inform the design process, we report here our initial situated studies focusing on the distributed nature of everyday communicative activities conducted with potential AAC/PIM users. Our analysis focuses on the discursive alignments of these participants and their interlocutors, attending especially to the various ways their personal aides function as human mediators. Specifically, we focus on mapping the communicative activity around each of these differently-abled individuals as they navigated a university campus. We profile the everyday interactional patterns within functional systems and across settings, and present close discourse analysis of one interaction to highlight the diverse roles personal aides adopted in mediating communication. Finally, we argue that attending to differently “abled” bodies as they move through everyday communicative environments pushes CHAT to more fully theorize physicality, individual mobilities, and the roles of bodies in the laminated assemblage of functional systems. This is the tenth volume of the Correspondence produced in the new edition of The Collected Works of Jeremy Bentham. The great majority of the letters have never before been published. They illustrate the composition, editing, publication, and reception of several of his works. The volume reveals Bentham's attempts to influence developments in France, the USA, Greece, Spain, Portugal, and South America. Despite Bentham's importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition (...) of his works was a poorly edited and incomplete one brought out within a decade or so of his death. The problem of holism in social science has, as Zahle and Collin, the editors of this volume note, a long history. It has revived, however, in a peculiar way, inspired by such things as the literature on corporate responsibility in ethics, the idea of supervenience, “Critical Realism” in sociology, ideas about emergence, the use of game-theoretic models to account for collective outcomes, and various notions of collective actors with collective intentions. These new inspirations interact with older problematics, such as the (...) micro–macro relation problem in sociology, the traditional argument that sentences such as “the crowd stormed the Bastille” have explanatory import apart from the import of sentences about the individual, and claims about reducibility of various kinds.This volume collects original papers by many of the main commentators on this set of topics and is an indispensable starting point for future discussion. The aim of this paper is to provide a characterization of ability theories of practice and, in this process, to defend Pierre Bourdieu’s ability theory against Stephen Turner’s objections. In part I, I outline ability theorists’ conception of practices together with their objections to claims about rule following and rule explanations. In part II, I turn to the question of what ability theorists take to be the alternative to rule following and rule explanations. Ability theorists have offered, and been ascribed, (...) somewhat different answers to this question, just as their replies, or positive accounts, have been heavily criticized by Turner. Due to this state of the debate, I focus on the positive account advanced by a single—and highly famous—ability theorist of practice, Pierre Bourdieu. Moreover, I show that despite Turner’s claims to the contrary, his arguments do not refute Bourdieu’s positive account. (shrink)

This essay offers constructive criticism of the book “In Defense of Kant’s Religion” (2008), by Chris L. Firestone and Nathan Jacobs. Follow the link given here to see the published version of this article. In the same journal issue where that version appeared (Faith & Philosophy 29.2), Jacobs and Firestone each published essays that claimed to respond to my criticisms of their book; but for the most part they merely skirted around the points my article makes, often avoiding the key (...) issues (e.g., by imputing alleged "fallacies" to my paper and using these as excuses to avoid discussing the genuine issues), sometimes making claims that were simply false in the process. In Faith and Philosophy 29.3 (July 2012):340-346, I published a general response to the whole debate over their book, without going into the sad details of the tactics they employed. But in a footnote (p.342n) I referred the reader to a detailed, point-by-point rebuttal to their (non-)arguments, as an addendum to that article, that would be uploaded here on my academia. edu site. This version of my original paper uploaded here contains the identical text for the paper itself (i.e., the first 15 pages of the original typescript have not been changed); but I have added an Appendix (starting on p.16) that responds, point-by-point to the Firestone and Jacobs essays. Warning to the faint-hearted: this discussion should not be read by anyone who is considering giving up their study of philosophy on the grounds that philosophers typically waste their time merely talking past each other, because for such a person, reading the Appendix to the version of the paper uploaded here could be the straw that breaks the camel's back! As I wrote it, I found myself sometimes wishing I had not published a promise to provide such material, because it is an embarrassment to philosophy that philosophers sometimes treat each other in the way illustrated by the two essays I am responding to. I only hope that taking the trouble to publish such a detailed response will help some readers recognize how important it is to give one's interlocuter the benefit of the doubt wherever possible (as I have tried to do here, for Firestone and Jacobs--and I would welcome their detailed explanations, if they think I have not done so). In any case, I hope the (unpublished) Appendix, uploaded here, will illustrate the fact that there are more important values to consider, when conducting a philosophical argument, than merely persuading others that "I’m right!". _ Source: _Volume 46, Issue 1, pp 35 - 53 In a letter written at the end of July 1930, Jean Cavaillès singled out two of his successful students at the _Ecole Normale_, Merleau-Ponty and Lautman, “full of interest in the philosophy of mathematics”. While both would play an important role in French philosophy in the coming decades, one almost never thinks of their names together. Indeed, only rarely do we think of Merleau-Ponty and Cavaillès together. This paper will argue (...) against this rarity. Cavaillès would write a treatise on logic that in retrospect is often viewed to advance French philosophy—but precisely at the expense phenomenology. I will argue that this evaluation is overblown. Merleau-Ponty’s philosophy, on the other hand, is often viewed in opposition to this as defending a Husserlian account of perception, a view equally too narrow. Between them, instead, I argue, we can see both transforming the Husserlian account of a transcendental logic and a transcendental aesthetic. Both provide resources for understanding phenomenology as a dialectical and historically emergent theory. Notwithstanding Cavaillès initial characterization of Husserl’s “exhorbitant use of the Cogito”, or his “aggressive” description of acts, to use Merleau-Ponty’s term, the result, in both cases, focuses on phenomenology as an emergent experience of philosophy as an “architecture” of signs. This article considers the concept of the utopia from the point of view of garden design. It begins with an evocation of the `Jardin de Julie', the literary garden described in Rousseau and acutely analysed by Louis Marin. It then passes to a series of actual gardens created by the French contemporary designer Bernard Lassus, in which the use of landscape effects is seen as achieving similar dislocations of space and incitements to the imagination.

This corpus analysis of linguistic and semantic features in French parliamentary debates concerning online hate speech regulation, highlights tensions between state powers and private rights. Two key themes are identified: first, the _problem of definition_: how such online content is defined in the debates, and second, the _problem of regulation_: how the debates negotiate the supra-jurisdictional and individual jurisdiction issues involved, in regulating both the global online content and the responsibilities of the owners of the platforms who manage the content. For this analysis, the authors created a corpus of French National Assembly Examination Committee discussions and public sessions between July 2019 to January 2020 discussing the _Loi Avia _(Avia Law). The corpus was analysed using quali-quantitative methods. Overall, the study combines a top-down (global) and a bottom-up (local) analysis of the data, applying corpus semantic approaches (Lecolle et al. in Langages 210(2):35–54, 2018; Rastier in The Routledge handbook of semantics, Routledge, pp 507–522, 2015) to contextualize the analysis of the meta-discourse (Hyland in Meta-discourse: exploring interaction in writing, 1st ed. We wish to describe and acknowledge the exceptional contributions to medical ethics, both in the UK and internationally, made by Edward Shotter1 who died at home on 3 July 2019. He was founder of the London Medical Group2 3 and instigator of similar student-led medical ethics groups throughout the UK; founder of the Institute of Medical Ethics4 and founder of the Journal of Medical Ethics. Ted Shotter transformed the study of medical ethics in the UK in the interests of patients (...) and professionals alike. In 1963, he established the pioneering ‘Medical Group’ model, an innovative bottom-up method whereby students in the health professions could gain a grounding in ethics that had previously been denied to the profession.5 It was with these Medical Groups that many of the leading figures in contemporary UK medical ethics and law began their careers in the subject including Sir Kenneth Calman, Sir Ian Kennedy, Professor Margaret Brazier OBE, Professor John Harris and Professor Sir Jonathan Montgomery to name but …. BackgroundFew studies have examined factors associated with willingness of people living with HIV to participate in HIV treatment clinical trials in Sub-Saharan Africa. We assessed the factors associated with participation of PLHIV in HIV treatment clinical trials research at a large urban clinical and research facility in Uganda.MethodsA mixed methods study was conducted at the Infectious Diseases Institute, adult HIV clinic between July 2016 and January 2017. Data were collected using structured questionnaires, focused group discussions with respondents categorised as either (...) participated or never participated in clinical trials and key informant interviews with IDI staff. A generalized linear model with a logit link function was used for multivariate analyses while the qualitative data were summarized using a thematic approach.ResultsWe enrolled a total of 202 and analysed 151 participants, 77 of whom were male with mean age of 41 years. The majority 127 expressed willingness to participate in treatment clinical trials if given an opportunity. At bivariate analysis, willingness to participate was significantly associated with respondents’ perception of a satisfactory compensation package, special status accorded and belief that their health status would improve while on the clinical trial. At multivariate analysis, a satisfactory compensation package and special status accorded in clinical trials remained significant. The qualitative data analysis confirmed these findings as participants valued the privilege of jumping the clinic waiting queues and spending less time in clinic, the wide range of free tests offered to trial participants, unrestricted access to senior physicians and regular communication from study team. Additionally, free meals offered during clinic visits meant that participants were not in a hurry to go back home. Barriers to participation included the perception that new drugs were being tested on them, fear of side effects like treatment failure and the uncertainty about privacy of their data.ConclusionWe found overwhelming willingness to participate in HIV treatment clinical trials. This was largely extrinsically influenced by the perceived material and health-related benefits. Investigators should pay attention to participants’ concerns for benefits which may override the need to understand study procedures and risks. (shrink)

In his essay “Rand, Paterson, and the Problem of Anarchism,” which appeared in The Journal of Ayn Rand Studies (July 2013), Stephen Cox argues that the principles of consent and non-initiation of force on which anarchists rely are too strong, and would require undue violation of the principle of non-sacrifice unless modified. But properly interpreted, these principles do not generate the conflicts that Cox describes, and such modifications as are defensible still do not rule out anarchism; hence Cox's case against (...) anarchism fails. In the December 2015 Issue of the Police Journal Sam Poyser and Rebecca Milne addressed the subject of miscarriages of justice. Cold case investigations can address some of these wrongs. The salient points for attention are those just before his sudden death: Milligan was appointed Private Secretary to Jonathan Aitken, the then Minister of Arms in the Conservative government in 1994. The known facts are as follows: 1. Stephen David Wyatt Milligan was found deceased on Tuesday 8th February 1994 at (...) his Chiswick, West London house where he lived alone. His body was found by his secretary Vera Taggart who was told by Julie Kirkbride where a spare key to his London house was kept and who decided to go to his house that day because he was not answering his telephone. Police said he had made one last telephone call on Saturday evening at 9.00pm. 2. Stephen David Wyatt Milligan had been the elected Member of Parliament (‘MP’) for Eastleigh in Hampshire since 1992. 3. The important topics this MP was addressing in 1994 at the time of his death included: (i) rail privatization plans and the impact through job losses on communities, especially his own constituency of Eastleigh; (ii) arms dealings with Saudi Arabia, especially with his previous intelligence gathered as an economics journalist for esteemed publications; (iii) the UK military industry; (iv) homosexuality among senior government Ministers, as revealed by British footballer Fasanu; (v) personal relationship and planned marriage to his fiancée (Julie Kirkbride) who at the time was a political journalist. 4. Stephen Milligan was also appointed as Parliamentary Private Secretary to Jonathan Aitken, Arms Minister and this position must have required that he came ‘up to speed’ on international arms trade and indeed its relation to bribery and corruption across jurisdictions. Milligan’s experience and knowledge as a former high-level political and economics journalist must have been of huge benefit to government minister Jonathan Aitken who was later imprisoned for perjury. 5. Regarding Stephen Milligan’s death in 1994, the Guardian newspaper in their immediate obituary said that ‘The death of one of the government's most outspoken and loyal supporters will pose a stiff electoral test for the Tories to surmount. He was on the left of the Tory party - he had even had a brief flirtation with the SDP when it was formed - and was a noted Euro-enthusiast… the death of one of the government's most outspoken and loyal supporters will pose a stiff electoral test for the Tories to surmount. Regarding Stephen Milligan’s sudden and unexpected death in 1994, MP David Willetts (Conservative, Havant) said in March 2015, in his address in the House of Commons. ‘…The inevitable ups and downs and triumphs and disasters of politics are among the great features of this place. There are colleagues in all parts of the House who are tolerant and understanding. There are friendships that keep the downs as well as the ups of politics in perspective. Having entered the House in 1992, I think particularly of two good friends, Judith Chaplin and Stephen Milligan, who both died within two years of being elected; that loss stayed with me for a long time...’ 6. On 28 February 2000, in the House of Commons, at Column 106, Mr Mike Hancock (Portsmouth) said, on the deaths of Michael Colvin and of Stephen Milligan MP: ‘I knew Michael Colvin for nearly 30 years, from when he was first elected to Hampshire county council. During my time as leader of that council, he and the late former Member of Parliament for Eastleigh, Stephen Milligan, were usually the only Members of Parliament who readily supported the council when necessary. Michael Colvin supported many ventures in the county of Hampshire. He will be missed here, in his constituency, and in Europe, and I stress that Hampshire has lost a staunch supporter. I am sure that the county will at some stage want to record its regret at his death and its deepest appreciation of the part that he played in its life....’ -/- Mike Hancock had, like Stephen Milligan, served on the Select Committee on Defence. It is interesting that he mentioned Stephen Milligan’s support as MP for Eastleigh when Milligan had only been so appointed a couple of years before his sudden death, as compared to 30 years of support from Mike Colvin. 7. Mr Andrew Robathan (for Blaby) said in the House of Commons Hansard Debates on 27 January1997, (Column 62) (on the registering of sex offenders): ‘I remember the death of my honourable friend Stephen Milligan, who represented Eastleigh. The press reports of the time stated that each Metropolitan police station had a police officer in the pay of newspapers. I do not know whether that is true, but I am aware that the police are not renowned for being entirely secure with their information…’ This statement is mischievous and it has been demonstrated time and time again, as being untrue, especially during the recent press inquiry leading to the four-volume Leveson Report, published in November 2012, into phone hacking and the ethics and culture of the UK media, pursuant to section 26 of the Inquiries Act 2005, and ordered by the House of Commons to be printed on 29 November 2012, ISBN: 9780102981063, by the Stationery Office Limited on behalf of the Controller of Her Majesty’s Stationery Office. In Volume 4 of the 2012 Leveson Report, chapter 4 concluded on the Press Complaints Commission (‘PCC’) and its effectiveness and revealed that the PCC does not initiate its own investigations other than those ‘needed to head off criticism of the press or self-regulation- or to accept complaints from third parties across the board and on a transparent basis… and the report states that ‘the resources of the police are limited’ in terms of being able to fully inspect the Press and media reports. For deliberations on the ethical and meta-ethical implications of Alfred North Whitehead's process philosophy, here are abstracts and papers from the Ethics Section of the 6th International Whitehead Conference held at the University of Salzburg in Salzburg, Austria in July 2006.
