Despite the end of the Cold War and the ascendancy of liberal democracy celebrated by Francis Fukuyama as “the end of history”, a growing number of scholars and political activists point to its inherent shortcomings. However, they have tended to dismiss it on the basis of one or two of its salient weaknesses. While this is a justifiable way to proceed, it denies the searching reader an opportunity to see the broad basis for the growing rejection of liberal democracy among (...) African political theorists. Consequently, in this article, I argue that from an African perspective, the almost hegemonic status of liberal democracy can be challenged on at least five grounds, namely, logical inconsistency, impracticability due to the largely communalistic outlook of many africans, inconsistency between affirmation and action, violation of the right to ethnic identity, and the moral imperative to assert the right to cultural emancipation. -/- I conclude by calling upon African and Africanist political theorists to utilise indigenous African political thought, coupled with emancipatory aspects of political thought from other parts of the world, to design practicable models of democracy for contemporary African states. I further conclude that in order to promote genuine inter-cultural dialogue on democratisation, people from Western cultures ought to acknowledge the equality of all cultures, and to recognise that systems of governance are part and parcel of those cultures. Expressions in a language, whether words, phrases, or sentences, have meanings. So it seems reasonable to suppose that there are meanings that expressions have. Of course, it is fashionable in some philosophical circles to deny this.

In The Philosophy of Logical Atomism Russell held the view that facts in the world are formally structured complexes, the structure of which matches the logical structure of correspondent propositions. Russell also seems to have denied that there are facts of identity and of diversity. This paper argues that Identity and Diversity can be understood as purely formal structures in Russellian facts. It considers Russell’s possible reasons for denying the existence of facts of identity and diversity and shows how problematic (...) these reasons are. In particular, I argue that identity statements are not tautologies, and their denial does not result into a contradiction. An important consequence of this thesis is that Metaphysics and Logic are not as tied up as Russell took them to be, but nevertheless these are good news for the old formal program for Metaphysics that lies at the very heart of what he called philosophical logic. While not taking St. Anselm’s ontological argument in the Proslogion to be valid, this paper shows that the dismissal of the thesis by both St. Thomas Aquinas and Kant does less than justice to St. Anselm’s text. In Chapter II of the Proslogion Anselm defines God as ‘something than which nothing greater can be thought’, claiming that this notion ‘exists in the mind’. The question is does its subject, God, exist ‘in re’. Can one proceed from the mental existence to (...) real existence given that to exist in re is greater than to exist notionally? This paper sets out several of Anselm’s premises from which he concludes that the notional existence of God defined by Anselm entails God’s actual existence, Aquinas dismissed Anselm’s arguments – possibly not having Anselm’s full text at hand. Anselm maintains that if ‘something than which nothing greater can be thought’ can be conceived, then to deny its existence in re constitutes a self-contradiction. The present paper examines in detail the elements of which Anselm’s elegant arguments are composed: q.v. Reference is made to Anselm’s Reply to Gaunilo, and to Anselm’s ontology set out in Monologion. Much, for the modern reader, turns on the topical logic of ‘perfection’ and of ‘greatness’. Again: much turns on the Kantian question ‘Is existence a predicate?’ And on the question: what kinds of things can be the subject of predicates? The comparison which Anselm is making between real and conceptual existence is not like any other comparison. This may be the flaw in his arguments. (shrink)

In Kidney for Sale by Owner: Human Organs, Transplantation, and the Market, I argued that the market is the most efficient and effective—and morally justified—means of procuring and allocating human organs for transplantation. This special issue of The Journal of Medicine and Philosophy publishes several articles critical of this position and of my arguments mustered in its support. In this essay, I explore the core criticisms these authors raise against my conclusions. I argue that clinging to comfortable, but unfounded, notions (...) that human body parts are not commodities, that the physician-patient relationship transcends commercial practices, and that medicine rises above market-place morality (where “market-place morality” is presented rhetorically as a criticism) leads to a real failure adequately to appreciate the complex reality of modern medicine. Denying the illicit moral intuitions that commodification of body parts is immoral or that it necessarily violates human dignity would benefit donors and recipients alike, while also reinforcing virtuous transplantation practice and policy. Honestly acknowledging the medical marketplace would shed light on what is often a hazy and shrouded policy setting. At stake is not solely the efficiency of procuring human organs for transplantation but also the recognition of the moral authority of persons over themselves. (shrink)

The theory of mental models and its computer implementations have led to crucial experiments showing that no standard logic—the sentential calculus and all logics that include it—can underlie human reasoning. The theory replaces the logical concept of validity (the conclusion is true in all cases in which the premises are true) with necessity (conclusions describe no more than possibilities to which the premises refer). Many inferences are both necessary and valid. But experiments show that individuals make necessary inferences that are (...) invalid, e.g., Few people ate steak or sole; therefore, few people ate steak. Other crucial experiments show that individuals reject inferences that are not necessary but valid, e.g., He had the anesthetic or felt pain, but not both; therefore, he had the anesthetic or felt pain, or both. Nothing in logic can justify the rejection of a valid inference: a denial of its conclusion is inconsistent with its premises, and inconsistencies yield valid inferences of any conclusions whatsoever including the one denied. So inconsistencies are catastrophic in logic. In contrast, the model theory treats all inferences as defeasible (nonmonotonic), and inconsistencies have the null model, which yields only the null model in conjunction with any other premises. So inconsistences are local. Which allows truth values in natural languages to be much richer than those that occur in the semantics of standard logics; and individuals verify assertions on the basis of both facts and possibilities that did not occur. Körner begins with a “logical”—as opposed to epistemological or psychological—discussion of the different kinds of concepts, “ostensive” and “non-ostensive”, and defines a concept as a sign used in accordance with rules. These rules, he emphasises, are not purely conventional, derived either from artificial formal languages or from “ordinary language” as the Linguistic Analysts claim. Thus he says that the claim of the (...) Analysts that a proposition is meaningless unless it has a role in ordinary language,” presupposes a criterion to decide whether, if a proposition cannot be expressed in some language, it is the proposition which is defective and not merely the language”. Körner’s position, therefore, differs in this respect from that of the Analysts, although his method is similar to theirs in that he claims that his enquiry is a purely neutral “logical” one involving no metaphysical or epistemological presuppositions or commitments and, in a sense, having no direct metaphysical or epistemological repercussions one way or the other. This study examines the socioeconomic and familial background of Irish Catholic priests born between 1867 and 1911. Previous research has hypothesized that lack of marriage opportunities may influence adoption of celibacy as part of a religious institution. The present study traced data from Irish seminary registries for 46 Catholic priests born in County Limerick, Ireland, using 1901 Irish Census returns and Land Valuation records. Priests were more likely to originate from landholding backgrounds, and with landholdings greater in size and wealth (...) than the local average. Priests were found to originate from families with more sons than the national average, but with similar numbers of daughters. These findings are discussed in relation to competition for resources and lineage survival strategies. (shrink)

Pp. viii+ 445. Writing ostensibly a history of the philosophical origins of 18th century atheism in 17th century theism, Michael Buckley, S.J., has contributed a learned, subtle, and provocative hook whose length is significantly increased and whose focus is considerably enlarged by a running commentary about the metatheory (...) (Richard McKeon's philosophical semantics) that structures his reading of the chosen theists and atheists. Buckley provides the best summary of his own historical conclusion: "... theology generated apologetic philosophy and philosophy generated Universal Mechanics, and these in turn co-opted theology to become the foundations of theistic assertions... [But] when the contradictions between Cartesian and Newtonian mechanics were further negated... god became a deus otiosus" [pp. 358-359]. This conclusion rests on a philosophical principle whose elements are taken from Plato's Seventh Epistle: " The name, the definition, and the instance for the atheistic negations are all set by the current theism " [p. 15]. In turn, this principle is justified by a cluster of meta-theses that are not easily summarized, although one stands above the rest: " Much more may he involved in such a process of ideas [from 17th century theism to 18th century atheism] than their· own internal necessity, hut internal necessity remains and governs inherently " [p. 334]. The latter meta-thesis asserts that there is a dialectic of ideas and it is from this point of view that Buckley reads the conceptual history of modern atheism. Dialectical necessity is a bugbear for many contemporary philosophers, hut Buckley argues, convincingly I think, that some kind of conceptual necessity links theism and atheism. Atheism is, essentially, the negation of a particular form of theism. In Hegelian terms, atheism is a determinate negation which draws all of its conceptual content from what it negates. Buckley, however, puts an even greater Hegelian spin on the same point. If the theism carries within itself a contradiction, it negates itself and, thereby, dialectically generates its contradiction-atheism [cf. p. 17]. " Modern atheism took not only its meaning hut its existence from the self-alienation of religion " [p. 359]. A theism that believes in the existence of an intelligent, personal God, Who creates and orders the universe, but that attempts a rational 144 BOOK REVIEWS 145 justification of this belief apart from the religious experience that alone can embody such a faith contains exactly the kind of inner contradiction that generates the negation of itself. Buckley focuses on the poignant contradiction of a Christian theology abandoning " the religious figure of Jesus as the principal evidence for the reality of God" [p. 41] in favor of some philosophy (whether that of Descartes, Malebranche, or Newton) which provides a different and allegedly more certain kind of evidence for God's existence. This theology, or more precisely the theistic philosophies it spawned, are the sources of modern atheism because, if Descartes and Newton are consistently combined, philosophy can do quite well without God. Laplace's famous reply to Napoleon, although it was not originally an atheistic slogan, captures what Diderot and d'Holbach thought: God is an unnecessary hypothesis in a truly universal mechanics which needs to presuppose only matter and motion. The historical story, of course, is more complicated than this skeleton dialectic can suggest. Buckley richly details the story but I shall rehearse only its opening chapter. Buckley begins with the Jesuit theologian, Leonard Lays (1554-1623), usually known under his Latin name, Lessius, whose De providentia numinis et anima immortalitate (1613) set the pattern for subsequent Catholic theology. Lessius, who was convinced that atheism by eliminating the eternal judge destroys morals and sound politics, revived Stoic arguments, numerous variations on a theme, which show that the universe is everywhere imprinted with a divine design. Lessius's intent, although he referred only to ancient philosophers, was not to replay the classical battle between the Stoics and the Epicureans but to combat the atheism, silent and disguised in contemporary Europe, that Lessius thought to be the inevitable outcome of the wars of religion and theological fights. The western religious tradition survives because, from the beginning, it has internalized a radical critique: the theological via negativa which, by strenuously qualifying religion’s factual, logical, and ontological (...) claims, brings about religion’s death but simultaneously and perpetually assures its resurrection whether “in its present guise or in another”. While there seems to be much evidence that perceptual states can occur without being conscious, some theorists recently express scepticism about unconscious perception. We explore here two kinds of such scepticism: Megan Peters and Hakwan Lau's experimental work regarding the well-known problem of the criterion -- which seems to show that many purported instances of unconscious perception go unreported but are weakly conscious -- and Ian Phillips' theoretical consideration, which he calls the 'problem of attribution' -- the worry that many (...) purported examples of unconscious perception are not perceptual, but rather merely informational and subpersonal. We argue that these concerns do not undermine the evidence for unconscious perception and that this sceptical approach results in a dilemma for the sceptic, who must either deny that there is unconscious mentality generally or explain why perceptual states are unique in the mind such that they cannot occur unconsciously. Minimally, metaphysical realists hold that there exist some mind-independent entities. Metaphysical realists also hold that we can speak meaningfully or truthfully about mind-independent entities. Those who reject metaphysical realism deny one or more of these commitments. This Element aims to introduce the reader to the core commitments of metaphysical realism and to illustrate how these commitments have changed over time by surveying some of the main families of views that realism has been contrasted with: such as scepticism, idealism, and anti-realism.

Curbside ethics consultations occur when an ethics consultant provides guidance to a party who seeks assistance over ethical concerns in a case, without the consultant involving other stakeholders, conducting his or her own comprehensive review of the case, or writing a chart note. Some have argued that curbside consultation is problematic because the consultant, in focusing on a single narrative offered by the party seeking advice, necessarily fails to account for the full range of moral perspectives. Their concern is that (...) any guidance offered by the ethics consultant will privilege and empower one party’s viewpoint over—and to the exclusion of—other stakeholders. This could lead to serious harms, such as the ethicist being reduced to a means to an end for a clinician seeking to achieve his or her own preferred outcome, the ethicist denying the broader array of stakeholders input in the process, or the ethicist providing wrongheaded or biased advice, posing dangers to the ethical quality of decision-making. Although these concerns are important and must be addressed, we suggest that they are manageable. This paper proposes using conflict coaching, a practice developed within the discipline of conflict management, to mitigate the risks posed by curbside consultation, and thereby create new “spaces” for moral discourse in the care of patients. Thinking of curbside consultations as an opportunity for “clinical ethics conflict coaching” can more fully integrate ethics committee members into the daily ethics of patient care and reduce the frequency of ethically harmful outcomes. The opinion of Mr. Justice Francis of the English High Court which denied the parents of Charlie Gard, who had been born with an extremely rare mutation of a genetic disease, the right to take their child to the United States for a proposed experimental treatment occasioned world wide attention including that of the Pope, President Trump, and the US Congress. The case raise anew a debate as old as the foundation of Western medicine on who should decide and on (...) what standard when there is a conflict between a family and the treating physicians over a possible treatment. This paper will explore the different approaches of the British and American courts on the issue and the various proposals from that of John Rawls in his A Theory of Justice to a processed-based approach for resolving such disputes. As carefully crafted as the opinion of Mr Justice Nicholas Francis in the Gard case proved to be, it left commentators unsatisfied. A widespread criticism, captured in an article by Michael Dougherty in The National Review was for the state to ‘get out of the way of the parents trying to act in the best interests of the child’.1 Although he conceded the parents could be adding to the suffering of the child by taking Charlie to America for an experimental therapy and agreed that such a choice ‘may be the wrong decision,’ in Dougherty’s view, it should still be ‘their decision’. Dougherty’s stand was the popular response to the question of ‘Who should decide?’ It fails, however, to propose any rationale for the decision. It provided no norms, no standards and no guidelines for the parents. Their motive could equally well be indifference to the suffering of the child as concern for his well-being. Hegel criticizes Spinoza's philosophy at various places in his writings.1 Spinozists have made several major challenges to Hegel's criticisms.2 Although there have been explications of Hegel's criticisms, there has been no effective response to the Spinozists' challenges.3 Until now. This article defends Hegel's criticisms of Spinoza's philosophy and shows that the challenges to his criticisms fail.This article presents a précis of Spinoza's system and shows the senses in which Hegel is not wholly enamored with it. It defends Hegel's criticism of Spinoza's system as an acosmism from Parkinson's challenges to it. It considers both Myers's view that Hegel's system begins where Spinoza's system ends and McMinn's charge that the systems of Spinoza and Hegel are fundamentally identical. Myers and McMinn misunderstand Hegel's dialectical method, and so they incorrectly believe that the methods of Spinoza and Hegel are complementary. Hegel's dialectics can sublate the systematic pluralism that Myers and Armour propose as its alternative. The penultimate section discusses the modifications that must be made to Spinoza's system to advance from his substance to Hegel's subject.Clinton successfully appropriated what was worthwhile in the "Contract with America," but he also effectively argued that the "Contract" would be a disaster for America. Similarly, Hegel assimilates the truth in his predecessors' philosophies while demonstrating how those philosophies remain [End Page 76] one-sided and partial. That is, he thinks that there is only one basic substance. Although there is only one substance, it necessarily expresses itself through an infinite number of attributes, and an attribute is the essence of substance as experienced by the intellect.4 Humans are capable of knowing only two of these attributes: thought and extension. Objects, ideas, and relations—Spinoza refers to all of these as "modes"—are presented through some attribute or other. Spinoza denies that a thing presented through one attribute can cause or be affected by anything presented through another attribute. Rather, each thing which is presented through an attribute has an infinite number of counterparts presented through the infinite number of attributes. Indeed, those infinite counterparts are that thing, presented through the other attributes. Substance necessarily expresses itself through the attributes and modes, according to Spinoza, and everything that is possible is also actual.5Spinoza's substance expresses itself through its attributes and modes, but what occurs at the level of the attributes and modes has no reciprocal effect on substance. Like unrequited love, expression is a one-way street. Not e pluribus unum (out of many, one), but e unibus plurum (out of one, many). Unlike the relation of the states to the federal government, the attributes and modes do not possess a relative or circumscribed autonomy vis-à-vis substance.6 Substance expressing itself through its attributes and modes is nature, according to Spinoza, and nature in turn is God. Hence, Spinoza's God is wholly immanent within the world—for him, God is the world—and so he rejects that traditional God of theism, who transcends and is wholly independent from the world. The subtitle of this essay can be misleading; the author devotes only one preliminary chapter and a brief part of another chapter to discussing issues of scientific language and method. The book is primarily an essay in the philosophy of mind. Rosenblueth is a well-known neurophysiologist who has considerable background in the philosophy of science. His purpose is to articulate a general philosophical position that is consistent with the results of science as well as with the attitudes and activities of (...) experimental scientists; and to develop from this basis an answer to the question of how mind and brain are related. He spends four chapters summarizing the biological and neurophysiological research that shows the nature of the correlation between mental and neurophysiological events. He concludes from this that our knowledge of the material world is limited to those structures that can be coded by the afferent fibers. He then articulates four unprovable "postulates" which scientists must assume. One of these is a probabilistic statement of causal determinism. This postulate is the basis for his rejecting the idea that the mind can causally influence the brain through volitions. Moreover, he argues for the converse statement as well; the brain cannot cause conscious events since the latter are mental and not material. But this denial of causal interaction does not lead Rosenblueth to conclude that mind/body dualism must be rejected. He considers and rejects the monist views of Feigl, Russell and Eddington, and thus comes up with a dualist view that denies causal interaction. This book's purpose is the exposition of the inability of natural science to disprove the existence of God. Clark argues that the acceptance of a mechanistic world view based on Newtonian science makes, unjustifiably, a philosophy of science in which science forgets the many idealizations built into its laws' mathematical formulations. The philosophy of science Mr. Clark espouses is Percy Bridgman's operationalism, i.e., the reduction of the meaning of a concept to the operations used to measure it. The separation of (...) the physical world from what the scientist says about it leads Clark to deny that science is cognitive. It is, rather, a way of increasing nature's utility. Background The allocation of scarce deceased donor kidneys is a complex process. Transplant providers are increasingly relying on constructs such as frailty and cognitive function to guide kidney transplant (KT) candidate selection. Patient views of the ethical issues surrounding the use of such constructs are unclear. We sought to assess KT candidates’ attitudes and beliefs about the use of frailty and cognitive function to guide waitlist selection.Methods KT candidates were randomly recruited from an ongoing single-center cohort study of frailty and (...) cognitive function. Semi-structured interviews were conducted, and thematic analysis was performed. Inductively derived themes were mapped onto bioethics principles.Results Twenty interviews were conducted (65% contact rate, 100% participation rate) (60% male; 70% White). With respect to the use of frailty and cognitive function in waitlisting decisions, four themes emerged in which participants: (1) valued maximizing a scarce resource (utility); (2) prioritized equal access to all patients (equity); (3) appreciated a proportional approach to the use of equity and utility (precautionary utility); and (4) sought to weigh utility- and equity-based concerns regarding social support. While some participants believed frailty and cognitive function were useful constructs to maximize utility, others believed their use would jeopardize equity. Patients were uncomfortable with using single factors such as frailty or cognitive impairment to deny someone access to transplantation; participants instead encouraged using the constructs to identify opportunities for intervention to improve frailty and cognitive function prior to KT.Conclusions KT candidates’ values mirrored the current allocation strategy, seeking to balance equity and utility in a just manner, albeit with conflicting viewpoints on the appropriate use of frailty and cognitive impairment in waitlisting decisions. The consent and community engagement process for research with Indigenous communities is rarely evaluated. Research protocols are not always collaborative, inclusive or culturally respectful. If participants do not trust or understand the research, selection bias may occur in recruitment, affecting study results potentially denying participants the opportunity to provide more knowledge and greater understanding about their community. Poorly informed consent can also harm the individual participant and the community as a whole. Invited by local Aboriginal community leaders of the Fitzroy (...) Valley, the Kimberley, Western Australia, The Picture Talk project explores the consent process for research. Focus groups of Aboriginal community members were conducted to establish preferences for methods of seeking individual consent. Transcripts were analysed through NVivo10 Qualitative software using grounded theory with inductive and deductive coding. Themes were synthesised with quotes highlighted. Focus groups with Aboriginal community members were facilitated by a Community Navigator as a cultural guide and interpreter and a researcher. Participants were recruited from all main language groups of the Fitzroy Valley – Gooniyandi, Walmajarri, Wangkatjungka, Bunuba and Nikinya. Participants were aged ≥18 years, with 5 female groups and one male group. Themes identified include: Reputation and trust is essential; The Community Navigator is key; Pictures give the words meaning – milli milli versus Pictures; Achieving consensus in circles; Signing for consent; and Research is needed in the Valley. Aboriginal communities of the Fitzroy Valley recommend that researchers collaborate with local leaders, develop trust and foster a good reputation in the community prior to research. Local Aboriginal researchers should be employed to provide cultural guidance throughout the research process and interpret local languages especially for elders. Pictures are preferred to written text to explain research information and most prefer to sign for consent. The Fitzroy Valley welcomes research when collaborative and for the benefit of the community. Future research could include exploring how to support young people, promote health screening and improve understanding of medical knowledge. (shrink)

This paper analyzes the influence of J. Derrida’s philosophy on the early thought of French phenomenologist M. Richir. Main texts for the analysis are Derrida’s report « La Différance » and the article « Le Rien Enroulé » by Richir. The author stresses their deep figurative and substantive interconnectedness. Thus, Richir borrows from Derrida a number of key philosophical figures, including the figure of différance itself, and applies them to phenomenological landscape through the “first-person” narrative. Having examined the correlation between (...) Derrida’s figures of différance and Richir’s phenomenalization, the author concludes that Richir, influenced by the impersonal figure of différance, leads his “first-person” narrative in an attempt to take it beyond the limits of classical phenomenological discourse. Moreover, the author finds preconditions for Richir’s introduction of one of his early key concepts “nothing” (rien) in the text of Derrida’s « La Différance ». The main thesis of this research is: Richir borrows Derrida’s understanding of consciousness and performs phenomenological description from its perspective. The paper considers Derrida’s text as a key to understanding Richir’s article « Le Rien Enroulé » and, as a result, the key to his early philosophy in general. (shrink)
