According to a captivating picture, epistemic justification is essentially a matter of epistemic or evidential likelihood. While certain problems for this view are well known, it is motivated by a very natural thought—if justification can fall short of epistemic certainty, then what else could it possibly be? In this paper I shall develop an alternative way of thinking about epistemic justification. On this conception, the difference between justification and likelihood turns out to be akin to the more widely recognised difference (...) between ceteris paribus laws and brute statistical generalisations. I go on to discuss, in light of this suggestion, issues such as classical and lottery-driven scepticism as well as the lottery and preface paradoxes. (shrink)

In this analytically oriented work, Peterson articulates and defends five moral principles for addressing ethical issues related to new and existing technologies: the cost-benefit principle, the precautionary principle, the sustainability principle, the autonomy principle, and the fairness principle.

Our understanding of subjunctive conditionals has been greatly enhanced through the use of possible world semantics and, more precisely, by the idea that they involve variably strict quantification over possible worlds. I propose to extend this treatment to ceteris paribus conditionals – that is, conditionals that incorporate a ceteris paribus or ‘other things being equal’ clause. Although such conditionals are commonly invoked in scientific theorising, they traditionally arouse suspicion and apprehensiveness amongst philosophers. Many epistemologists have responded to the lottery paradox by proposing formal rules according to which high probability defeasibly warrants acceptance. Douven and Williamson present an ingenious argument purporting to show that such rules invariably trivialise, in that they reduce to the claim that a probability of 1 warrants acceptance. Douven and Williamson’s argument does, however, rest upon significant assumptions – amongst them a relatively strong structural assumption to the effect that the underlying probability space is both finite and uniform. In (...) this paper, I will show that something very like Douven and Williamson’s argument can in fact survive with much weaker structural assumptions – and, in particular, can apply to infinite probability spaces. . Science at the interface with society is regarded with mistrust among parts of the public. Scientific judgments on matters of practical concern are not infrequently suspected of being incompetent and biased. I discuss two proposals for remedying this deficiency. The first aims at strengthening the independence of science and suggests increasing the distance to political and economic powers. The drawback is that this runs the risk of locking science in an academic ivory tower. The second proposal favors “counter-politicization” in (...) that research is strongly focused on projects “in the public interest,” that is, on projects whose expected results will benefit all those concerned by these results. The disadvantage is that the future use of research findings cannot be delineated reliably in advance. I argue that the underlying problem is the perceived lack of relevance and reliability and that pluralism is an important step toward its solution. Pluralism serves to stimulate a more inclusive research agenda and strengthens the well-testedness of scientific approaches. However, pluralism also prevents the emergence of clear-cut practical suggestions. Accordingly, pluralism is part of the solution to the credibility crisis of science, but also part of the problem. In order for science to be suitable as a guide for practice, the leeway of scientific options needs to be narrowed – in spite of uncertainty in epistemic respect. This reduction can be achieved by appeal to criteria that do not focus on the epistemic credentials of the suggestions but on their appropriateness in practical respect. (shrink)

Public surveys conducted in many countries report widespread willingness of individuals to donate a kidney while alive to a family member or close friend, yet thousands suffer and many die each year while waiting for a kidney transplant. Advocates of financial incentive programs or “regulated markets” in kidneys present the problem of the kidney shortage as one of insufficient public motivation to donate, arguing that incentives will increase the number of donors. Others believe the solutions lie—at least in part—in facilitating (...) so-called “altruistic donation;” harnessing the willingness of relatives and friends to donate by addressing the many barriers which serve as disincentives to living donation. Strategies designed to minimize financial barriers to donation and the use of paired kidney exchange programs are increasingly enabling donation, and now, an innovative program designed to address what has been termed “chronologically incompatible donation” is being piloted at the University of California, Los Angeles, and elsewhere in the United States. In this program, a person whose kidney is not currently required for transplantation in a specific recipient may instead donate to the paired exchange program; in return, a commitment is made to the specified recipient that priority access for a living-donor transplant in a paired exchange program will be offered when or if the need arises in the future. We address here potential ethical concerns related to this form of organ “banking” from living donors, and argue that it offers significant benefits without undermining the well-established ethical principles and values currently underpinning living donation programs. The phenomenon of altruism extends from the biological realm to the human sociocultural realm. This article sketches a coherent outline of multiple types of altruism of progressively increasing scope that span these two realms and are grounded in an ever-expanding sense of “self.” Discussion of this framework notes difficulties associated with altruism at different levels. It links scientific ideas about the evolution of cooperation and about hierarchical order to perennial philosophical and religious concerns. The International Bill of Human Rights (IBHR) enjoys universal acclaim as the source of the best standards and definition of human rights. This paper argues that the IBHR is inspired by liberalism and harbours ambiguities that open the door to a neoliberal seizure of the rights agenda; and that this effectively destabilises the focus on the IBHR on socio-economic and community rights, and therefore its stated ideal of the equal value of all human rights. I argue that Kwame Gyekye's moderate (...) communitarian political philosophy affords a viable philosophical basis for justification of a more balanced conception of human rights than the theoretical basis of the IBHR does. A political challenge facing constitutional democracies in Africa is the lack of adequate representation and participation of citizens in democratic processes and institutions. This challenge is manifest in the vesting of power solely in, and the exercise of this power by, a sectional group – the majority party – to the exclusion of others; as evinced in the liberal democratic systems extensively practised on the continent. Wiredu proposes as a solution to these challenges the adoption of consensual democracy; an indigenous, (...) non-party democratic system rooted in the traditional African humanist and communitarian conceptions of the individual and the community, in which political decisions are characteristically reached by consensus. In this article, I present a critical exposition of Wiredu’s consensual democracy and defend it against liberal democracy on the one hand, and criticisms levelled against it on the other hand. I also offer some modifications to Wiredu’s theory in a bid to render it more suitable for practice in Africa. (shrink)

Rawls’s notion of civil disobedience, which still dominates the literature on this subject, comprises at least these three characteristics: it involves breaking the law, is non-violent and public. But implicit in this notion is a certain tension: it shows pessisimism about the proper functioning of the public sphere as earlier normal appeals have failed, but it also displays a certain optimism about its proper functioning as it assumes that civil disobedience may be effective. In my paper I argue that Rawls (...) cannot explain how civil disobedience may be effective as a public appeal for social justice because he does not fully understand what it means for civil disobedience to be public in relation to the public sphere. His analysis would require an additional notion of publicity which, as I argue, is the notion of hermeneutical publicity. From a Bourdieusian perspective I then make a case for the claim that public spheres always suffer from hermeneutic invisibility. This may explain why non-violent appeals for social justice fail as dialogical practices. Finally I suggest how we nevertheless could understand that civil disobedience can be effective as a dialogical practice. (shrink)

This paper examines the question of whether human rights are related to ontology. It examines perspectives on this question from human rights theories in the Western and African traditions of philosophy and defends the thesis that a good account of human rights requires an explicit ontology of the human, and that taking this seriously engenders divergent conclusions about what rights are. It then proceeds to claim that the African Charter on Human and Peoples’ Rights adds substantive features to the International (...) Bill of Human Rights, and that the Charter expresses Kwame Gyekye’s ontology of the human being. (shrink)

Lighting upon Weber as a history student in the late 1950s led to all round engagement with his work to the present day, beginning with rationality and bureaucracy, passing through appreciation of his synoptic vision of modernity, and arguing for the continuing relevance of his rationalization thesis. This emphasis on Weber’s contribution to understanding the course of modernity led in the 1990s to pointing out that his approach to epochal shift provides the basis for understanding the global age. Volume 18 of Martin Heidegger's collected works presents his important 1924 Marburg lectures which anticipate much of the revolutionary thinking that he subsequently articulated in Being and Time. Here are the seeds of the ideas that would become Heidegger's unique phenomenology. Heidegger interprets Aristotle's Rhetoric and looks closely at the Greek notion of pathos. These lectures offer special insight into the development of his concepts of care and concern, being-at-hand, being-in-the-world, and attunement, which were later elaborated in Being and (...) Time. Martin Heidegger’s 1934–1935 lectures on Friedrich Hölderlin’s hymns "Germania" and "The Rhine" are considered the most significant among Heidegger’s lectures on Hölderlin. Coming at a crucial time in his career, the text illustrates Heidegger’s turn toward language, art, and poetry while reflecting his despair at his failure to revolutionize the German university and his hope for a more profound revolution through the German language, guided by Hölderlin’s poetry. The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. The first case of COVID-19 infection in Africa was recorded in Egypt on 14 February 2020. Following this, several projections of the possible devastating effect that the virus can have on the population of African countries were made in the Western media. This paper presents evidence for Africa’s successful responses to the COVID-19 pandemic and under-reporting or misrepresentation of these successes in Western media. It proceeds to argue for accounting for these successes in terms of Africa’s communitarian way of life (...) and conceptions of self, duty, and rights; and that a particular orientation in theorizing on global justice can highlight the injustices inherent in the misrepresentation of these successes and contribute shared perspectives to formulating a framework of values and concepts that would facilitate the implementation of global policy goals for justice. The paper is thus grounded in a rejection of the insular tenets of theorizing prevalent in the global justice debate and to persistent inclinations in Western scholarship to the thinking that theorizing in the African context that draws inspiration from the cultural past has little to contribute to the quest for justice globally. On the contrary, it argues that reflexive critique of cultural history is a necessary source of normative ideals that can foster tolerant coexistence and a cooperative endeavour toward shared conceptions of justice in the contemporary world. Cette étude s'intéresse aux passages sur la définition de l'âme, où Aristote use de deux procédés, la division et la démonstration. Elle met en évidence le caractère méthodique de l'argumentation et propose des solutions aux difficultés du texte.

The Principle of Reason, the text of an important and influential lecture course that Martin Heidegger gave in 1955–56, takes as its focal point Leibniz’s principle: nothing is without reason.

In this paper, we present the results of two surveys that investigate subjects’ judgments about what can be known or justifiably believed about lottery outcomes on the basis of statistical evidence, testimonial evidence, and “mixed” evidence, while considering possible anchoring and priming effects. We discuss these results in light of seven distinct hypotheses that capture various claims made by philosophers about lay people’s lottery judgments. We conclude by summarizing the main findings, pointing to future research, and comparing our findings to (...) recent studies by Turri and Friedman. (shrink)

I propose a novel way to understand the stringency of Kant’s conception of beneficence. This novel understanding can ground our intuition that we do not have to forego (almost) all pursuit of our personal ends. I argue that we should understand the application of imperfect duties to specific cases according to the framework set by the adoption and promotion of ends. Agents have other ends than obligatory ones and they must weigh obligatory ends against these other ends. Obligatory ends are (...) special among ends only insofar as their adoption is not optional. My reading of the normative status of imperfect duties affords a way of thinking about beneficence modelled on the everyday ways in which agents pursue their personal projects and weigh different ends against each other. This establishes a middle-ground between an extremely demanding conception of beneficence and an overly latitudinarian one. Furthermore, it helps us understand why we do not have to be maximally beneficent and why there is a bias towards the near in our thinking about rescue cases. (shrink)

Opposition to inducement payments for research subjects is an international orthodoxy amongst writers of ethics committee guidelines. We offer an argument in favour of these payments. We also critically evaluate the best arguments we can find or devise against such payments, and except in one very limited range of circumstances, we find these unconvincing.

This chapter examines the traditional understanding of Horkheimer and Adorno's dialectic of enlightenment (exemplified by Jürgen Habermas and others), arguing that the traditional reading – with its stress on instrumental rationalization and a regressive or self‐destructive history – misses Horkheimer and Adorno's deepest aspirations, which are to offer an argument against a particular conceptualization of human agency (as apperceptive). Stressing instead, that Kant is the central interlocutor, the chapter shows how understanding this Kantian inheritance allows us to bring into focus (...) the radical nature of Horkheimer and Adorno's argument: that it is meant to bring into focus the problematic nature of conceiving human agency as dependent on apperception. In presenting this problem, the chapter shows how the ontogenetic origin of self‐consciousness becomes a crucial issue, and the thought of Sigmund Freud is marshaled both to make this clear and to show how Horkheimer and Adorno's account can benefit from making explicit its potential debt to Freud. El artículo analiza el problema de la expulsión de extranjeros sospechosos de ser delincuentes o anarquistas, tomando como marco temporal la acción de la policía de Buenos Aires durante la jefatura de Francisco Beazley (1896-1904). A partir del cruce de dos tradiciones historiográficas diferentes —aquella que toma como objeto a la institución policial y el mundo del delito y la que se ha preocupado por el surgimiento del anarquismo—, busca reflexionar sobre los mecanismos de deportación de inmigrantes antes y después (...) de la aprobación de la Ley de Residencia en 1902. Si bien el foco está puesto en el accionar de la policía de Buenos Aires, una de las ideasvertebradoras del análisis es que la comprensiónde la acción policial frente a la expulsión de extranjeros requiere un estudio detenido en los enlaces entre las ciudades portuarias del litoral atlántico sudamericano y europeo. De esta manera, el artículo se propone reconstruir una cartografía de la actuación transnacional de la policía,conectando a Buenos Aires con Rio de Janeiro, Montevideo y la costa española. Para ello, se ha consultado un heterogéneo conjunto de fuentes que van desde informes consulares y prensa policial, hasta periódicos de Brasil y Argentina, pasando por escritos anarquistas y socialistas.
