This paper presents a four layer model for working with legal knowledge in expert systems. It distinguishes five sources of knowledge. Four contain basic legal knowledge found in published and unpublished sources. The fifth consists of legal metaknowledge. In the model the four basic legal knowledge sources are placed at the lowest level. The metaknowledge is placed at levels above the other four knowledge sources. The assumption is that the knowledge is represented only once. The use of metaknowledge at various (...) levels should make it possible to use the appropriate knowledge for the problem presented to the system. The knowledge has to be represented as closely to the original format as possible for this purpose. Suitable representation formalisms for the various types of knowledge in the five knowledge sources are discussed. The introduction of results of AI and Law research in actual legal practice advances disturbingly slow. One of the problems is that most research can be classified as either theoretical or pragmatic, while combinations of these two are scarce. This interferes with the need for feedback as well as with the need of getting support, both financially and from actual legal practice. Automated decision systems are often used to enforce legislation.As such, they have considerable regulating effects. These systemsregulate the behaviour of users and addressees mainly throughstandardization. This research classifies these systems intocategories according to which the regulating effects can bedescribed more clearly. Furthermore, this categorization resultsin a better understanding how problems encountered with atpresent can be avoided in the future. Many problems result fromthe way the development process has been organized. It turns outthe development process can be divided according to the (...) time thesystems are developed with regard to the legislation they aim toenforce. Present procedures lack good monitoring of thedevelopment process. To this end, legal procedures are needed toensure that a legally correct product will be made, partiesinvolved should change their tune, system developers should bemore concerned with the legal status of the system and thelegislator should be actively involved in the development of thesystem. Moreover, an ex ante-evaluation should notice thepossible regulating effects caused by the system to ensure acorrect balance of the pros and cons. Software agents that play a role in E-commerce and E-government applications involving the Internet often contain information about the identity of their human user such as credit cards and bank accounts. This paper discusses whether this is necessary: whether human users and software agents are allowed to be anonymous under the relevant legal regimes and whether an adequate interaction and balance between law and anonymity can be realised from both the perspective of Computer Systems and the perspective of Law.

Software agents extend the current, information-based Internet to include autonomous mobile processing. In most countries such processes, i.e., software agents are, however, without an explicit legal status. Many of the legal implications of their actions (e.g., gathering information, negotiating terms, performing transactions) are not well understood. One important characteristic of mobile software agents is that they roam the Internet: they often run on agent platforms of others. There often is no pre-existing relation between the owner of a running agents process (...) and the owner of the agent platform on which an agent process runs. When conflicts arise, the position of the agent platform administrator is not clear: is he or she allowed to slow down the process or possibly remove it from the system? Can the interests of the user of the agent be protected? This article explores legal and technical perspectives in protecting the integrity and availability of software agents and agent platforms. New forms of artificial intelligence on the one hand and the ubiquitous networking of “everything with everything” on the other hand characterize the fourth industrial revolution. This results in a changed understanding of human–machine interaction, in new models for production, in which man and machine together with virtual agents form hybrid teams. The empirical study “Socializing with robots” aims to gain insight especially into conditions of development and processes of hybrid human–machine teams. In the experiment, human–robot actions and interactions were (...) closely observed in a virtual environment. Robots as partners differed in shape and behavior. Participants were instructed to achieve an objective that could only be achieved via close teamwork. This paper unites different aspects from core disciplines of social robotics and psychology contributing to anthropomorphization with the empirical insights of the experiment. It focuses on the psychological effects on anthropomorphization and mechanization, taking the inter- and transdisciplinary field of social robotics as a starting point. (shrink)

Ethical thought experiments such as the trolley dilemma have been investigated extensively in the past, showing that humans act in utilitarian ways, trying to cause as little overall damage as possible. These trolley dilemmas have gained renewed attention over the past few years, especially due to the necessity of implementing moral decisions in autonomous driving vehicles. We conducted a set of experiments in which participants experienced modified trolley dilemmas as drivers in virtual reality environments. Participants had to make decisions between (...) driving in one of two lanes where different obstacles came into view. Eventually, the participants had to decide which of the objects they would crash into. Obstacles included a variety of human-like avatars of different ages and group sizes. Furthermore, the influence of sidewalks as potential safe harbors and a condition implicating self-sacrifice were tested. Results showed that participants, in general, decided in a utilitarian manner, sparing the highest number of avatars possible with a limited influence by the other variables. Derived from these findings, which are in line with the utilitarian approach in moral decision making, it will be argued for an obligatory ethics setting implemented in ADVs. (shrink)

Kant attacks the Leibnizians on various fronts but the objection that occurs most frequently in his writings is that they are committed to an untenable conception of the relation between sensible and intellectual representations. They regard the difference between intellectual and sensible representations as a merely ‘logical’ difference that concerns their form, namely, their different degrees of distinctness, while in truth it is a difference in kind that concerns their nature, origin, and content. In the first part of this essay, (...) I provide a detailed reconstruction of what exactly this objection amounts to, and show why Kant takes this misconception to be so significant that he keeps coming back to it over and over again. The misconception is so significant because virtually all of the other mistaken doctrines of the Leibnizians can be traced back to it. Several commentators have argued that Leibniz is not guilty of the confusion of sensible and intellectual representations that Kant accuses him of. But this does not automatically clear him from all the other errors that Kant takes to be closely connected with this confusion. In the second part of this essay, I take a look at Leibniz's theory of confused perceptions and examine whether he is committed to one of these errors, namely, the view that we could learn something about things in themselves by experience if our senses were acute enough or our powers of 'disfusing' perceptions were strong enough. In light of new biomedical technologies, such as artificial reproduction, stem cell research, genetic selection and design, the question of what we owe to future persons-and unborn life more generally-is as contested as ever. In A Theory of Unborn Life: From Abortion to Genetic Manipulation, author Anja J. Karnein provides a novel theory that shows how our commitments to persons can help us make sense of our obligations to unborn life. We should treat embryos that will develop into persons (...) in anticipation of these persons. But how viable is this theory? Moreover, what does it mean to treat embryos in anticipation of the future persons they will develop into? Exploring the attractiveness of this approach for Germany and the U.S. - two countries with very different legal approaches to valuing unborn life-Karnein comes to startling conclusions to some of today's greatest ethical and legal debates. Die gängigen Prognosen, nach denen die Religionen im Kontext der Moderne oder im Zuge der Globalisierung an Bedeutung verlieren würden, haben sich nicht bestätigt. Das Gegenteil ist der Fall: Jenseits von nihilistischen Entwürfen und virtuellen Konstruktionen öffneten sich auch und gerade in der Literatur Räume für die Belebung religiöser Weltsicht. Ausgehend von Heinrich Böll und seiner Anfang der 1960er Jahre eingeleiteten Distanzierung von der Institution Kirche, wird am Beispiel von Botho Strauß und Peter Handke, die seit den 1970er und 1980er (...) Jahren eine ins Metaphysische zielende Subjektivität repräsentieren, eine Renaissance des Religiösen konstatiert, die sich in den Werken des jüngeren Autors Ralf Rothmann seit den 1990er Jahren mit selbstbewusster Deutlichkeit fortschreibt. Anhand der geistesgeschichtlichen Trias Gnostizismus, Philosophie und Mystik nimmt die Verfasserin eine Fokussierung vor, die die ästhetischen Konzeptionen der Autoren deutlich werden lässt und sie zueinander in Beziehung setzt. The influence of background music on cognitive functions is still a matter of debate. In this study, we investigated the influence of background music on executive functions (particularly on inhibitory functions). Participants completed a standardized cued Go/NoGo task during three different conditions while an EEG was recorded (1: with no background music, 2: with relaxing or 3: with exciting background music). In addition, we collected reaction times, omissions, and commissions in response to the Go and NoGo stimuli. From the EEG (...) data, event-related potentials (ERPs) were calculated for the Go and NoGo trials. From these ERPs, the N2 and P3 components were specifically analyzed since previous studies have shown that these components (and particularly the Go-NoGo difference waves) are strongly associated with inhibitory functions. The N2 and P3 components of the difference waves (N2d and P3d) were used for statistical analyses. The statistical analyses revealed no differences between the three conditions in terms of amplitudes and latencies of the N2d and P3d components. In addition, reaction times, omissions, and commissions were comparable across all conditions. Our results suggest that in the context of this paradigm, music as background acoustic stimulation has no detrimental effects on the performance of a Go/NoGo task and neural underpinnings. (shrink)

In this article, I discuss the commemoration of public figures such as Nelson Mandela and Yitzhak Rabin. In many cases, our commemoration of such figures is based on the admiration we feel for them. However, closer inspection reveals that most (if not all) of those we currently honour do not qualify as fitting objects of admiration. Yet, we may still have the strong intuition that we ought to continue commemorating them in this way. I highlight two problems that arise here: (...) the problem that the expressed admiration does not seem appropriate with respect to the object and the problem that continued commemorative practices lead to rationality issues. In response to these issues, I suggest taking a fictionalist position with respect to commemoration. This crucially involves sharply distinguishing between commemorative and other discourses, as well as understanding the objects of our commemorative practices as fictional objects. (shrink)

The view that agents are not obliged to do more than their initial fair shares when their fellow duty bearers fail to comply has prominent defenders, including Liam Murphy and David Miller. While Murphy thinks that asking agents to take up other agents’ slack would be unfair, Miller claims that slack-taking cannot be required because primary responsibility does not migrate from noncompliers to compliers. This paper argues, by contrast, that there are a number of circumstances in which there is a (...) duty to take up the slack even though it is unfair and even though responsibility stays where it is. The central claim is that what agents owe to third parties is a separate issue from how they relate to fellow duty bearers. This proposal also runs counter to familiar defenses of slack-taking that weigh its unfairness against the moral importance of the interests at stake for third parties. (shrink)

The World According to Kant offers an interpretation of Immanuel Kant’s critical idealism, as developed in the Critique of Pure Reason and associated texts. Critical idealism is understood as an ontological position, which comprises transcendental idealism, empirical realism, and a number of other basic ontological theses. According to Kant, the world, understood as the sum total of everything that has reality, comprises several levels of reality, most importantly, the transcendental level and the empirical level. The transcendental level is a mind-independent (...) level at which things in themselves exist. The empirical level is a fully mind-dependent level at which appearances exist, which are intentional objects of experience. Empirical objects and empirical minds are appearances, and empirical space and time are constituted by the spatial and temporal determinations of appearances. On the proposed interpretation, Kant is thus a genuine idealist about empirical objects, empirical minds, and space and time. But in contrast to other intentional objects, appearances genuinely exist, which is due both to the special character of experience compared to other kinds of representations such as illusions or dreams, and to the grounding of appearances in things themselves. This is why, on the proposed interpretation, Kant is also a genuine realist about empirical objects, empirical minds, and empirical space and time. There has been some debate recently about whether we can come to know what an experience is like that we have not been through ourselves. Mostly, this debate focuses on general phenomenal knowledge. It is asked, for instance, whether we can come to know what it is like to be a refugee generally speaking (as opposed to being some specific refugee). In this paper, I want to add to this debate by trying to come to know how and to what (...) extent someone who has been through the experience in question acquires this sort of general knowledge. I suggest that this form of general phenomenal knowledge is only acquired if the experience one has undergone is typical for the group in question. (shrink)

Feministische Aktivist*innen haben sich schon immer verschiedener Medien bedient, um zu kommunizieren, sich zu artikulieren und zu vernetzen. Durch die Digitalisierung und die damit verbundenen Möglichkeiten erweitern sich feministische Aktionsräume und verlagern sich zunehmend ins Social Web. So lässt sich feststellen, dass Plattformen wie twitter, instagram oder auch facebook vielfach genutzt werden, um feministische Anliegen in die Öffentlichkeit zu tragen. Der gegenwärtige mediale Diskurs um feministische Ideen und Forderungen wird dabei maßgeblich durch antifeministische Akteur*innen beeinflusst, deren Anliegen es ist, feministische (...) Stimmen aus dem medialen Raum zu verbannen. Die vorliegende Arbeit greift diese Thematik auf und geht der Frage nach, wie feministische Aktivist*innen antifeministische, digitale Gewalt wahrnehmen und damit umgehen. Die Ergebnisse verweisen darauf, dass insbesondere Aspekte der Sexuellen Identität und der Mehrfachdiskriminierung entscheidend sind für das Ausmaß der digitalen Gewalt, die erfahren wird. Weiterhin wird deutlich, welche Rolle Solidarität, Vernetzung und Empowerment im Kampf gegen den Antifeminismus spielen. Die Autorin Anja Roß studierte Pädagogik und Soziologie an der Universität Bielefeld. Sie arbeitet als wissenschaftliche Mitarbeiterin am Institut für Pädagogik an der Universität Oldenburg. The author argues that normative questions in social law are in need of a more philosophical approach. This is particularly true for the evaluation of Work-first arrangements. She proposes to evaluate workfare policies from the perspective of the reciprocity principle as it is deployed in the work of the liberal egalitarians John Rawls and Stuart White. While Rawls’ interpretation of the reciprocity principle seems to be at odds with Dutch jurisprudence on workfare policies, which allows for Work-first arrangements within the (...) boundaries that are set by article 4 of the European Convention on Human Rights , White’s approach rather encourages work obligations for welfare recipients, on the condition that citizens acquire individual drawing rights on collective participation funds. Conrad Gessner was town physician and lecturer at the Zwinglian reformed lectorium in Zurich. His approach towards the world and mankind was centred on his preoccupation with the human soul, an object of study that had challenged classical writers such as Aristotle and Galen, and which remained as important in post-Reformation debate. Writing commentaries on Aristotles De Anima was part of early-modern natural philosophy education at university and formed the preparatory step for studying medicine. This article uses the case study (...) of Gessners commentary on De Anima to explore how Gessners readers prioritised De Animas information. Gessners intention was to provide the students of philosophy and medicine with the most current and comprehensive thinking. His readers responses raise questions about evolving discussions in natural philosophy and medicine that concerned the foundations of preventive healthcare on the one hand, and of anatomically specified pathological medicine on the other, and Gessners part in helping these develop. One of the most fascinating but also one of the most criticised legal theories in the USA for the last years have been the Critical Legal Studies which emerged some thirty years ago and queried the hegemonic views on the law and the law system in the US. This essay especially tries to analyse the position of one of the leading representatives of this so called “movement” - Duncan Kennedy - towards the role of judges in the US-American legal system. As the American legislation and adjudication have intensified their ambitions to extend their power of jurisdiction - all thus going hand in hand with a restriction of the human rights - a view on a critical and progressive US-American theory of jurisdiction is of great importance. Die gerade stattfindende Digitalisierung von vielen Tausend Filmen des ehemaligen Instituts für den Wissenschaftlichen Film (IWF) gibt Anlass, über die Provenienz und Wiederverwendung von Filmbildern nachzudenken als auch über die Art und Weise, in der sie behaupten, wissenschaftliche (oder in diesem Fall historische) Evidenz zu produzieren. In den Jahren von 1956 bis etwa 1960 initiierte der deutsche Sozialdemokrat, Historiker und Filmemacher Friedrich „Fritz“ Terveen Filmreihen, die mit vorgefundenem (...) Filmmaterial Hochschulstudent*innen über Zeitgeschichte aufklären sollten. Die erste kleine Filmreihe darunter warLuftschifffahrt in Deutschland, die vier kleine Filme mit gefundenem Filmmaterial über Zeppelinflüge umfasste, von denen die frühesten Bilder aus der Zeit um 1904 und die letzten aus dem Jahr 1937 stammen und die „Hindenburg-Katastrophe“ zeigen. In diesem Artikel soll gezeigt werden, wie Terveen die politische Landschaft des Geschichtsunterrichts in der neu gegründeten Bundesrepublik Deutschland zu gestalten suchte, indem er erstens danach strebte, ein bundesweites Bildarchiv mit historischen Filmdokumenten einzurichten und zweitens die politische Bildung einer neuen Generation junger Deutscher mithilfe des bewegten Bildes verbessern wollte. Die in französischer und russischer Sprache verfaßten Memoirenfragmente, an denen Katharina IL ab 1754 über dreißig Jahre lang schrieb, die jedoch erst 1859 von A. Gercen veröffentlicht wurden, zählen zu den bedeutendsten Dokumenten weiblichen autobiographischen Schreibens im 18. Jahrhundert. Die Selbsterforschung und -Stilisierung Katharinas als Politikerin und Frau folgt einer Logik wissender Unschuld. Ihre Selbstbiographie verbindet auf symptomatische Weise literarische Empfindsamkeit mit politischem Kalkül.

The development of action and perception, and their relation in infancy is a central research area in socio-cognitive sciences. In this Perspective Article, we focus on the developmental variability and continuity of action and perception. At group level, these skills have been shown to consistently improve with age. We would like to raise awareness for the issue that, at individual level, development might be subject to more variable changes. We present data from a longitudinal study on the perception and production (...) of contralateral reaching skills of infants aged 7, 8, 9, and 12 months. Our findings suggest that individual development does not increase linearly for action or for perception, but instead changes dynamically. These non-continuous changes substantially affect the relation between action and perception at each measuring point and the respective direction of causality. This suggests that research on the development of action and perception and their interrelations needs to take into account individual variability and continuity more progressively. (shrink)

The focus of this article is on elderly patients’ and nursing staff perceptions of privacy in the care of elderly patients/residents in five European countries. Privacy includes physical, social and informational elements. The results show that perceptions of privacy were strongest in the UK (Scotland) and weakest in Greece. Country comparisons revealed statistically significant differences between the perceptions of elderly patients and also between those of nurses working in the same ward or long-term care facility. Perceptions of privacy by patients (...) and their nursing staff were quite similar in Finland, Germany and the UK. In contrast, in Greece and Spain these perceptions were different: nurses believed that they took account of their patients’ privacy needs more often than the patients themselves felt this was the case. Among Spanish and UK patients, an association was found between lower levels of independence and comparatively less positive perceptions of privacy. No associations were established between nurses’ perceptions and their demographic factors. This is the third of a set of five articles published together in this issue of Nursing Ethics in which the results of this comparative research project are presented. (shrink)

Contrary to popular belief, I argue that Leibniz is not hopelessly confused about motion: Leibniz is indeed both a relativist and an absolutist about motion, as suggested by the textual evidence, but, appearances to the contrary, this is not a problem; Leibniz’s infamous doctrine of the equivalence of hypotheses is well-supported and well-integrated within Leibniz’s physical theory; Leibniz’s assertion that the simplest hypothesis of several equivalent hypotheses can be held to be true can be explicated in such a way that (...) it makes good sense; the mere Galilean invariance of Leibniz’s conservation law does not compromise Leibniz’s relativism about motion; and Leibniz has a straightforward response to Newton’s challenge that the observable effects of the inertial forces of rotational motions empirically distinguish absolute from relative motions. The problem at the center of this essay is how one can reconcile the continuity of space with a monadological theory of matter, according to which matter is ultimately composed of simple elements, a problem that greatly exercised Leibniz, the Wolffians, and Kant. The underlying purpose of this essay is to illustrate my reading of Kant’s philosophical development, and of his relation to the Wolffians and Leibniz, according to which, (a), this development was fueled by ‘home-grown’ problems that arose within (...) the framework of the Wolffian philosophy from which Kant started out, and, (b), on his journey to critical idealism, Kant gradually moved away from Wolffianism, but closer to Leibniz, which, however, he came to realize only some years after the publication of the Critique of Pure Reason. This reading is illustrated by showing that the problem of how to reconcile the continuity of space with a monadological theory of matter is a problem that Kant inherits from Leibniz and the Wolffians, in whose thinking it already plays an important role, that Leibniz’s mature solution to the problem differs markedly from the Wolffian solution, and that Kant’s early, pre-critical solution is largely Wolffian, while his later critical solution is largely Leibnizian, as he himself notes with gleeful satisfaction. The discussion also reveals that this problem is one of the key problems that fueled Kant’s philosophical development and, eventually, led him to the discovery of transcendental idealism. (shrink)

Toward concordia: Dialogue and Poetry. – The question whether the governance and autonomy of medieval and early modern cities and the participation of their citizens in communal affairs may gesture toward a form of communal self-governance or it is yet another form of the rule of the privileged has re-emerged with new answers in recent scholarship. It was also one of the topics of the lecture series, Urban Governance and Civic Participation in Words and Stone, as part of which Prof. (...) Ferenc Hörcher also gave a talk. Although the following interview is based primarily on Prof. Hörcher’s lecture, the discussion joyfully meandered through a number of other, fascinating topics, like the value of philosophical dialogue vis-a-vis debate, the literary figure of the flaneur, the political ideas of Dante and the philosophical potential of poetry. Naneslo je namreč, da sem po opoldanskem odhodu iz Padove vrata tvojega mesta dosegel, ko se je sonce že nagibalo k zahodu. Preudarjal sem, ali naj prenočim tam ali naj nadaljujem pot – kajti mudilo se mi je, hkrati pa mi je zaradi dolžine dneva ostal še dobršen del svetlih ur – in ko sem se tako obotavljal, – glej – kdo bi se mogel skriti pred prijatelji? (...) – si mi s svojim predragim prihodom v družbi imenitnih mož, kakršnih je to drobno mestece rodilo na pretek, odgnal vsak dvom. Kot bi mi z nitjo prijetno pestrega pogovora pričvrstil omahujočega duha, sem kljub misli na odhod ostal in šele ko se je spustila noč, sem zapazil, da je dan spolzel mimo. Kot že mnogokrat poprej sem tudi tistega dne spoznal, da nam nič drugega ne izmika časa tako neopazno kot prav pogovori s prijatelji. Prijatelji so spretni tatovi časa, čeprav nobenega časa – razen tistega, ki ga posvetimo Bogu – ne bi smeli šteti za manj ukradenega, za manj izgubljenega, kot tistega, ki ga preživimo s prijatelji. Članek obravnava literarno ustvarjanje dr. Joža Lovrenčiča (1890–1952), slovenskega pesnika, pisatelja, prevajalca in klasičnega filologa. Prinaša nekatere življenjepisne informacije in na njihovi podlagi obravnava zlasti njegovo afiniteto do rimske in grške antike. This essay examines some of the ways in which the assumption of the essential finitude of the human mind, in contrast to the infinitude of God’s mind, bears on Leibniz’s and Kant’s accounts of our representational capacities. This examination reveals several underappreciated similarities between their views, but also some notable differences that help us pinpoint where and in what ways Kant departs from his celebrated predecessor. The fruits of this examination are a better understanding of Kant’s conception of the discursivity (...) of our understanding, his account of the difference between concepts and intuitions, and the particular flavor of his idealism. -/- . Drawing on interviews with women and men who serve on the supervisory boards of German stock-listed companies, this qualitative study examines why some female directors seek to augment gender equality in their organizations while others do not. Those who take action do so both in formal board processes and in informal settings. A sense of belonging to women as a social group and a sense of responsibility for women in the organization are key factors in explaining why some female directors (...) contribute to gender equality. In addition, the study highlights the relevance of a board culture supportive of gender equality and positive expectations by other organizational members about female directors’ role in advancing gender equality. Board chairs influence how supportive female directors perceive the organizational context to be. Where the organizational context is not seen as supportive, those who take equality-related action anyway are experienced directors. Surprisingly, the presence of other women on the board does not appear to be related to whether or not female directors take action. Examining female directors’ actions and paying close attention to both their identities and their specific organizational settings shows how the interplay between social identity and situational opportunities and constraints affects board behavior.
