Background Informed consent procedures for large population-based cohort studies should be comprehensive and easy-to-use. This is particularly challenging when participants from different socio-economic groups and multicultural ethnic backgrounds are involved. Recently, more and more studies have tried to use multimedia in informed consent procedures. We describe the development and testing of a digital informed consent app and elaborate on whether this may contribute to a comprehensive and practical procedure to obtain informed consent for public health research. Methods In a sample (...) of parents with young children, we used a mixed method approach to study the user experience of an informed consent app and evaluate whether it can be used to adequately inform people and register their consent. Through semi-structured interviews we investigated participants’ experiences with and opinions about the app, with a special focus on comprehensibility of the content and the usability of the app. Information retention questions were asked to evaluate to what extent participants could recall key aspects of the provided study information. Results The 30 participants in this study used the app between 4 and 15 min to give their consent. Overall, they found the app well-designed, informative and easy to use. To learn more about the study for which informed consent is asked, most of the participants chose to watch the animated film, which was generally found to convey information in a clear manner. The identification process was met with mixed reactions, with some feeling it as a secure way to give consent, while for others it contradicted their view of using data anonymously. Information retention questions showed that while all participants remembered various aspects of the study, fewer than half answered all four questions satisfactorily. Conclusion Our study shows that a well-designed informed consent app can be an effective tool to inform eligible participants and to record consents. Still, some issues remain, including trust barriers towards the identification procedure and lack of information retention in some participants. When implementing consent procedures that incorporate digital formats, it may be beneficial to also invest in a complementary face-to-face recruitment approach. (shrink)

Because of the COVID-19 pandemic, procrastination has become commonplace due to changes in teaching and learning, which trigger students' academic burnout. As a result, it has increased the intensity of procrastination among students who are enrolled in online learning programs. As a result, students have difficulty as a result of the rapid change from in-person learning to online learning. The study investigates the relationship between academic burnout and procrastination among 150 grade 12 senior high school students. Hence, this study employed (...) a correlational design. Based on the inferential analysis, the r coefficient of 0.71 indicates a high positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Boyer (bio)Organizers of the Human Genome Project (HGP) understood from the beginning that the scientific activities of mapping and sequencing the human genome would raise ethical, legal, and social issues that would require careful attention by scientists, health care professionals, government officials, and the (...) public. The establishment of the ELSI (ethical, legal, and social implications) programs at the National Human Genome Research Institute (NHGRI) and the Department of Energy (DOE) was thought to be vital to the success of the HGP in the United States. It also provided a novel approach to the simultaneous study of ethical, legal, and social issues and basic scientific issues. Eric Juengst, the first director of the ELSI program, described its origins in a previous issue of the Kennedy Institute of Ethics Journal (Juengst 1991). Now in its seventh year, the ELSI program has accomplished much. This article summarizes the evolution and goals of the ELSI program at NHGRI, outlines the program’s current research priorities with examples of activities within each priority area, and provides a look to the future, including the initiation of a strategic planning process.Evolution and Goals of the ELSI Research ProgramThe HGP’s “genomic” goals are unique: to map and sequence the entire human genome—some 3 billion base pairs that make up approximately 80–100,000 genes—and the genomes of related model organisms by the year 2005. This goal was particularly ambitious since, when it was proposed, the technologies for mapping and sequencing had yet to be developed. When the HGP was first established, its organizers also elaborated a set of ELSI goals, which they saw as vital to the success of the genome project. The original ELSI goals were: (1) to anticipate and address the implications of the HGP for individuals and society and (2) to examine the ELSI consequences of mapping and sequencing the human genome in order to stimulate public discussion. To meet these goals, the NHGRI created its ELSI research program in 1990. Along with mapping, sequencing, [End Page 291] and mammalian genetics, ELSI was one of four original branches in the NHGRI Division of Extramural Research that funded research in those areas. Although the individual “branches” no longer exist, the mechanisms for funding research remain much the same. While the overall goals of the program have not changed, the specific ways of achieving the goals have continued to evolve. The importance of the ELSI program lies not in the collection of a full set of data that will be valuable in and of itself, but in the value of using and interpreting this new set of information.Early on, the NHGRI described a set of somewhat more specific goals: (1) to develop a program to help understand the ethical, legal, and social implications of the human genome project and (2) to identify and define the major issues of concern and develop policy options to address them. These more specific goals have been largely met. As the most recent biennial NHGRI Progress Report notes, “a robust ELSI research and education program has been established, many of the most urgent ELSI issues have been identified, and many policy options to address these issues have been proposed” (NCHGR 1995, p. 21). Between 1990 and 1996, ELSI provided more than $32.5 million in funding through 128 research and education grants in more than 30 states and in Canada (Table 1). The ELSI research budget is unique in that when originally created, it was specifically tied to the amount of money provided for the overall NHGRI budget. The NHGRI originally devoted 3 percent of its extramural budget to fund ELSI projects, but in FY 1991, it increased the ELSI budget to 5 percent, a figure that remains today. Edited by Karma Lekshe Tsomo. Albany: State University of New York Press, 1999. Pp. viii + 326. This collection of essays on women in Buddhism largely succeeds in fulfilling Tsomo's goal of documenting "Buddhist women's actual involvement" in the Buddhist tradition (p. 1). Her introduction provides a very (...) informative and well-supported description of the history and current status of Buddhist women around the world, focusing on Asia but including the West as well. In the introduction and in her essays on women in the Tibetan and Himalayan region and in Buddhist and Christian traditions, she provides a feminist critique of gender discrimination in the Buddhist tradition as well as prescriptions for transforming the existing tradition in ways that would make it more egalitarian. These include "consciously validating women's accomplishments," reinterpreting religious texts with gender sensitive lenses, and the ordination of women (pp. 256-257). The essays in the volume as a whole carry forward Tsomo's examination of both sides of the equation of women and Buddhism--that is, how the Buddhist tradition has treated women overall as well as how women have responded to and are working to alter Buddhism, what Tsomo characterizes as "the ongoing process of women transforming and being transformed by, the tradition" (p. 1). The essays highlight a number of dichotomies in the experiences of Buddhist women, the primary one being that of gender disparities in the status and experience of women. Several essays in the collection detail the hardships that Buddhist women encounter because of gender inequalities that persist to the present day, even in Western cultures. Tsomo's essay comparing the experiences of Buddhist and Christian women in particular illustrates that in most areas, gender-based inequalities are more pronounced in Buddhist contexts than in Christian ones. Tsomo observes that [End Page 278] both traditions have fallen short of their egalitarian ideals, expressed within Christianity as the imago dei (creation in the image of God) and in Buddhism as tathagathagarbha (the seed or essence of Enlightenment present in all sentient beings). While noting that both traditions in general permit women to participate in religious practices on an equal basis with men, that neither legally mandates an inferior status for women, and that the highest stage of religious attainment is the same for both genders, Tsomo finds gender discrimination still functioning in both religions: both Buddhism and Christianity traditionally have assigned subordinate roles to women (especially with respect to monastic life), depict females negatively in scriptures, and generally ignore women's contributions to religious life.Despite these similarities, Tsomo thinks that in most respects Christian women have made more progress in securing equal rights to participate in the religious life of their faith than have Buddhist women. The only reason she provides for the greater extent of change in Christianity is that "Christian women have been far more active than Buddhists" (p. 253). Yet she fails to probe the possible reasons for this disparity in respect to the broader cultural, social, and economic differences in Christian and Buddhist contexts that have fostered a more activist and socially acceptable feminism in the former. The greater gender discrimination in Buddhist cultures has less to do with differences between Christianity and Buddhism per se than it does with other aspects of culture. Unfortunately, Tsomo does not develop the thesis she presents in the introduction to this essay that "Christian women have much to learn from the Buddhist tradition with respect to meditation and that Buddhist women have much to learn from Christian women with respect to service to society" (p. 241). Indeed, it is difficult to understand the basis for the latter claim, given Buddhist women's primary roles as service providers in most Buddhist cultures, unless she is speaking of the so-called socially engaged religious movement. A leading character in a play, at any rate in a major speech, is normally doing several things: he is saying what the development of the plot requires, and sometimes also expressing the dramatist's own tragic vision; he is also expressing his own thoughts and emotions, or saying what from his point of view the rhetoric of the situation requires. There are thus at least two questions to ask about the Trugrede: What is its function in the economy of the (...) plot? Why does Sophocles give this speech to Ajax, and what light does it throw on his character as presented by Sophocles? The first question is easy enough to answer. There can be no doubt that this is a deception speech in the sense that Tecmessa and the Chorus are misled about what is going to happen, and at any rate part of Sophocles' purpose was evidently to achieve an effect of relaxation of tension or ‘retardation’. At first all is gloom and despair; then when the suicide of Ajax seems to be imminent, this speech leads Tecmessa and the sailors to think that he means to live on after all, and they express their relief in a joyful hyporchema. Then follows a messenger speech with warnings that dispel their joy but still offer a gleam of hope, until that hope is extinguished when they find the dead body of Ajax. Sophocles has thus contrived an arresting dramatic sequence to fill the interval between the opening scene and the discovery of Ajax' death. The main effect could have been produced by direct, unambiguous falsehood in the speech we are considering, but Sophocles presumably wished the spectators to be aware that the joy and relief were illusory, so that they could at once appreciate the tragic irony of the sailors' rejoicing. There was probably no way of informing the audience directly that the speech was meant to be deceptive, and Sophocles therefore included in it numerous ambiguous expressions which the Chorus and Tecmessa, eager to believe good news, interpret as indicating a change of purpose, whereas for the spectators, who are more detached and probably aware of the traditional version of the story according to which Ajax killed himself, they have ominous overtones and arouse suspicion, in the last lines verging on certainty, that in this play too he still means to take his own life. Happiness has been at the centre of philosophical reflection ever since Plato and Aristotle. Epicureans thought of happiness as the satisfaction of one's minimal needs and the absence of further desires. True happiness may be the love of another, or successful and virtuous public service recognized by society, or successful engagement in a favoured activity. Youthful happiness involves intensity of feeling, engagement with the passing moment, the discovery of first love and of sexuality, and the joys of dedication to a (...) beloved. The different forms of human engagement involve different kinds of happiness. Physical normality and good health are patently preconditions of happiness inasmuch as physical abnormalities and persistent diseases are barriers to leading a healthy and normal human life. A person's social conditions are highly relevant to the possibility of happiness. In this essay I reply to Richard Rorty's and Judith Shklar's influential accounts of liberalism, preferring what I call "strong agapism" to Rorty's ironism and Shklar's emphasis on avoidance of cruelty. Strong agapism treats love as a "metavalue," an indispensable source of moral insight and power, yet it admits the genuineness and fragility of goods other than love (for example, health, happiness). The detaching of charity from moral self-sufficiency-as well as from certainty about personal immortality-amounts to a disconsoling doctrine in (...) many respects. I conclude, however, that accent on agape betokens a profound philosophical and theological optimism. This optimism stems from the conviction that putting charity first is its own reward, a joyful affirmation of life (and its Creator) that is the basis of all other virtues. (shrink)

The physical environment leads to a thermal sensation that is perceived and appraised by occupants. The present study focuses on the relationship between sensation and evaluation. We asked 166 people to recall a thermal event from their recent past. They were then asked how they evaluated this experience in terms of 10 different emotions (frustrated, resigned, dislike, indifferent, angry, anxious, liking, joyful, regretful, proud). We tested whether four psychological factors (appraisal dimensions) could be used to predict the ensuing emotions, as (...) well as comfort, acceptability, and sensation. The four dimensions were: the Conduciveness of the event, who/what caused the event (Causality), who had control (Agency), and whether the event was expected (Expectations). These dimensions, except for Expectations, were good predictors of the reported emotions. Expectations, however, predicted the reported thermal sensation, its acceptability, and ensuing comfort. The more expected an event was, the more uncomfortable a person felt, and the less likely they reported a neutral thermal sensation. Together, these results support an embodied view of how subjective appraisals affect thermal experience. Overall, we show that appraisal dimensions mediate occupants' evaluation of their thermal sensation, which suggests an additional method for understanding psychological adaption. (shrink)

KimberThe Eighth Annual Building Bridges: East and West Graduate Student Philosophy Conference at Southern Illinois University Carbondale (SIUC) was held on November 4 and 5, 2005. Nine students representing nine different universities presented papers over the two days of the conference. Since its inception in (...) 1998, the Building Bridges conference has provided an annual opportunity for graduate students to present their research on several different comparative themes in philosophy. The context of comparison for the 2005 conference, as indicated in its title, was East and West.Professor Philip J. Ivanhoe was the keynote speaker, and his presentation, titled "The Values of Spontaneity," was a highlight of the first day of the conference. Professor Ivanhoe began by making a distinction between two senses of spontaneity generally present in Western writings, which he referred to as "untutored" and "cultivated" spontaneity. He aligned these two senses of the term with Daoism and Confucianism, respectively, and sought to demonstrate the ethical value of spontaneity within these traditions. "Untutored" spontaneity, which characterizes the notions of wuwei and ziran in Daoism is not something that is acquired. It is rooted in one's inherent nature and is more effectively enhanced by the removal of impediments to its realization than by learning. "Cultured" spontaneity, on the other hand, presupposes a disposition that is acquired through appropriate enculturation. It is exemplified in the rituals and rites of Confucianism. In both cases, spontaneous activity consists of participation within a greater scheme, whether nature or culture, and it is in such spontaneous participation that one may experience greater significance in one's actions, "metaphysical comfort," and joy.Through his comparative approach, Professor Ivanhoe contributed to an enriched understanding of the value of spontaneity while illuminating significant aspects of Daoism and Confucianism. The student presentations that spanned the two days of the conference were characterized by a similar use of comparison. A variety of topics were addressed from property ownership to the locus of moral responsibility, and in each case the topic of investigation was developed by way of an appeal to Eastern and Western philosophical perspectives. Facets of Chinese, Indian, Japanese, and Russian thought were brought into dialogue with philosophers of the West from Aristotle to Sartre. [End Page 707]One theme that became evident in the different presentations and discussions that followed was the role and importance of composure. Each of the presentations exposed valuable, yet distinct ways of understanding how one may relate to history, others, the world, or, more generally, one's greater context. There was a common interest in clarifying what kind of composure is called for in these different approaches to relationality. In the separate papers and in the ensuing questions, there was an attempt to understand better how these diverse perspectives can inform one's actions and contribute to the realization of greater benefit, value, and significance in one's life. These considerations contributed not only to the building of several comparative philosophy "bridges" but also to an appreciation of the value that traversing such bridges may offer.On a more aesthetic note, Carbondale and the surrounding area offered a spectacular sense of the season marked by beautiful fall foliage and large, calm lakes. The SIUC campus was blanketed with colorful leaves and swept with cool breezes. This autumn environment contributed a sense of seasonal charm and aesthetic character that further enhanced the overall experience of the conference.Even more inviting than the environment were the many people who made the conference a success. The 2005 conference coordinator, Travis Smith, and the other SIUC graduate students who shared their homes, culinary skills, and conversation effectively conveyed a genuine sense of hospitality that made the many people who traveled to Illinois from around the country feel welcome and comfortable.Several of the practices that contributed to the success of the Building Bridges Conference have since contributed to the structure of the CrossCurrents Graduate Student Conference that will be held at the University of Hawai'i at Mānoa on March 16 and 17, 2006. In addition to probabilities of monetary gains and losses, personality traits, socio-economic factors, and specific contexts such as emotions and framing influence financial risk taking. Here, we investigated the effects of joyful, neutral, and sad mood states on participants’ risk-taking behaviour in a simple task with safe and risky options. We also analysed the effect of framing on risk taking. In different trials, a safe option was framed in terms of either financial gains or losses. Moreover, we investigated the effects (...) of emotional contagion and sensation-seeking personality traits on risk taking in this task. We did not observe a significant effect of induced moods on risk taking. Sad mood resulted in a slight non-significant trend of risk aversion compared to a neutral mood. Our results partially replicate previous findings regarding the presence of the framing effect. As a novel finding, we observed that participants with a low emotional contagion score demonstrated increased risk aversion during a sad mood and a similar trend at the edge of significance was present in high sensation seekers. Overall, our results highlight the importance of taking into account personality traits of experimental participants in financial risk-taking studies. (shrink)

Resumen El artículo dirige su atención a la dimensión pastoral del Vaticano II, comprendida como una relación de ida y vuelta entre Iglesia y sociedad. Corroborando esta perspectiva el texto construye una memoria del Concilio, partiendo de algunas charlas de los Papas Juan XXIII y Pablo VI, así como de diversos pasajes de la Constitución Pastoral Gaudium et Spes . El foco insiste en la reciprocidad implicativa del orden secular y del orden de la gracia; rompe con las dicotomías; afirma (...) el ministerio teológico como lectura creyente del devenir histórico. También destaca las exigencias de la Iglesia para acatar valores “modernos”, como la libertad de consciencia de los fieles, la pluralidad de opiniones y la autonomía de la investigación científica incluso en el ámbito religioso. En un segundo momento, contraponiéndose a una crítica ingenua de la modernidad, dirige su reflexión a la perspectiva profética de la Gaudium et Spes que preconizó la urgencia –para la Iglesia y para la sociedad- de romper con las normativas totalizadoras y hegemónicas para abrirse a las relaciones plurales. In support of this view, the text builds a memory of the council from the understanding of some speeches of Pope John XXIII and Paul VI and also analyzes some passages of the Pastoral Constitution ´Gaudium et Spes`. The reflection emphasizes the reciprocity of the secular order and the order of grace, breaking with all dichotomies and thus reaffirming the theological task as an understanding of historical events. The article also emphasizes the requirements of the Church to accept "modern" values such as freedom of conscience of their followers, the plurality of opinions, the autonomy of scientific research, even in the religious sphere. Secondly, in contrast to the temptation of a naive critique of modernity, this discussion refers to the prophetic vision of Gaudium et Spes, which drew attention to the urgent need to break with the hegemony of normalization and to make efforts to open itself to the plurality of interpretations. The apparent consensus among Nietzsche interpreters is that Nietzsche accepts Schopenhauer’s “description of the ubiquity of suffering” (Gemes 2008, p. 463). In this paper, I argue against this consensus. Specifically, Nietzsche holds that life is not as painful as Schopenhauer makes it out to be, for Nietzsche recognizes two kinds of pleasures that Schopenhauer fails to acknowledge. The only kind of pleasure that Schopenhauer acknowledges is the experience of the cessation of pain that occurs upon the satisfaction of a desire. (...) Nietzsche explicitly rejects Schopenhauer’s view of pleasure; instead, he recognizes pleasurable feelings of power that one can experience when one is trying to satisfy desires, and pleasurable feelings of value that one can experience when one satisfies a desire for something one takes to be valuable. Andrew Hofer has written a cleverly conceived treatise on Gregory Nazianzen, one whose main focus is Gregory’s vision of his own life (and the life of Christians (...) more generally) as both imitatio Christi and participatio Christi. Hofer grounds his account of this imitatio and participatio in Gregory’s core dogmatic account of the person of Christ. The book thus offers us a study, focusing on one central author, of the ways in which a Nicene Christology could shape and stimulate (as well as be shaped and stimulated by) an account of the Christian life.The first chapter is an extended meditation on the nature of the “word” in Gregory. Here, Hofer begins by exploring how Gregory situates himself in the ancient battle—or at least the ancient literary topos of such a battle—between philosophy and rhetoric. Not surprisingly, Hofer emphasizes that Gregory sees himself as a philosopher, but one for whom the Christian life offers the true form of a philosophical life. The discussion then turns toward ways in which Gregory sees the Scriptures as providing a basis for discussing and modeling virtually all aspects of the Christian life. Hofer offers a little discussion of the manner in which Gregory adapts ancient rhetorical traditions of, for example, the paradeigma (see 44), but these debts are acknowledged mostly en passant.The second chapter takes us to the heart of the book and does an excellent job of setting up the author’s theme. Considering Gregory’s poetic auto-biographical [End Page 314] writing, Hofer argues that Gregory not only “blends Christ into the troubles, fears, and joys of his own life” but that he also “makes present the baptismal mysteries of one’s life immersed in Christ’s life” (56). In chapter 5, this extra dimension will receive a foundation in an account of the ways in which Gregory sees Christians drawn into the very events of Christ’s life (156-60, commenting particularly on Gregory’s Or. 40). There, Hofer emphasizes that Christ’s life is itself “a mimesis of ours” (160), creating realities that may be models for ours, models into which we are then drawn. But, in chapter 2 itself, Hofer’s main concern is to show the sheer variety of ways in which Gregory interweaves the scriptural account of Christ’s life and ministry with his own. This complex set of reference styles is termed Gregory’s “autobiographical Christology.”Chapter 3 pursues this agenda by turning to the ways in which Gregory uses the terminology of “mixture” to describe Christ—and to describe Christ’s relationship to Christians. It is this chapter that Stanley Hauerwas, were he endorsing the book, would say is “worth the price of the book alone.” Two things are particularly noteworthy. The first is the helpful discussion of the philosophical traditions that lie behind the terms Gregory uses. Hofer wishes us to take seriously traditions of thought on this theme that run between Aristotle and Alexander of Aphrodisias, rather than to place most weight on the Stoic tradition. Hofer advocates for his thesis in a sensitive fashion, emphasizing the difficulty in distinguishing distinct traditions in late antiquity. Second, there is much to be learned from the manner in which Hofer stretches discussion of Christ himself as “mixture” so that it provides insight into Gregory’s account of the Christian’s relationship with Christ.Chapter 4 follows a similar pattern, showing that a discussion of Christ’s person in Gregory’s writings (in this case, the famous sequence epp. 101, 102, and 202) has repercussions for wider themes. Caillois, G. Dumezil e (...) R. Otto. O objetivo pretende não somente viver a festa como analisar e estudar a festa. Desta festa concreta e particular, pode-se passar ao universal. De fato, a festa supõe um momento muito especial na historia dos grupos humanos, permitindo dimensionar sua vida desde um passado vivencial e um futuro de esperança. A festa permite quebrar a monotonia do cotidiano reorganizando a vida do grupo, possibilitando a alegria e o dinamismo da existência humana. Trata-se de uma necessidade humana, tão humana como o trabalho, onde o sagrado e o profano entram como formas integradoras da convivência. Convivência que necessita do riso, da alegria, da irreverência e da felicidade, além do trabalho, do compromisso e da ordem estabelecida. The festival allows us to break the monotony of our daily lives and help us in the reorganization of our group life. It also makes the joy and the dynamism of human existence ever possible. Esse trabalho tem como objetivo analisar a ocorrência de Teresas na literatura brasileira, como heroínas divididas entre o sacro e o profano. Propomos o estudo do romance Tereza Batista: (...) cansada de guerra, de Jorge Amado, a partir da intertextualidade com a tradição literária baiana, de Gregório de Matos e Castro Alves, e em contraponto ao pensamento religioso da obra lírica de Santa Teresa de Ávila, em diálogo com a escultura extática da santa, criada por Gian Lorenzo Bernini.Palavras-chaves: Santa Teresa de Ávila. This article aims to analyze the occurrence of Teresas in Brazilian literature, as heroines divided between the sacred and the profane. We propose to study of the novel Tereza Batista: cansada de guerra, by Jorge Amado, from the intertextuality with the literary tradition of Bahia, of Gregorio de Mattos and Castro Alves, and in opposition to the religious thought of the lyrical work of St. Teresa de Ávila, in dialogue with the ecstatic sculpture of St. Tereza, by Gian Lorenzo Bernini.Keywords: St. Teresa of Ávila. In Matthew 24, Jesus prophesied to his disciples about ‘wars and rumours of wars’ and other eschatological birth-pangs to prepare them in advance on how they are to be responding to eschatological events as they would be unfolding in the interim of his ascension and his promised Parousia. What then does Jesus mean by enlisting ‘wars and rumours of wars’ in this eschatological era to be functioning as ‘the beginning of birth-pangs’ and how should Christians be responding to wars and (...) rumours of wars as eschatological birth-pangs? Employing the redaction exegetical method, this study focuses on interpreting Matthew 24:6−8 to explain what Jesus most probably meant as he enlisted ‘wars and rumours of wars’ as eschatological birth-pangs; and with special reference to the Russia–Ukraine war that broke out on 24 February 2022, recommends from the Olivet prophecy how Christians are to be righteously responding to ‘wars and rumours of wars’ as eschatological birth-pangs. Contribution: This study explored Matthew 24:6−8 to unveil what Jesus means by enlisting wars and rumours of wars as eschatological birth-pangs. With special reference to the Russian military invasion of Ukraine, theological highlights were recommended on how Christians are to be responding to war and war rumours as end-time birth-pains. Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day.
