Within Germany, Carl Schmitt's status as a political thinker is on a par with Machiavelli and Hobbes. With the rise in neo-conservatism and authoritarian liberalism in less developed countries such as Chile and Singapore, Renato Christi believes Schmitt's theories will become of considerable importance. While Hegel’s political philosophy has been attacked on the left by republican democrats and on the right by feudalist reactionaries, his apologists see him as a liberal reformer, a moderate who theorized about the development of a free-market society within the bounds of a stabilizing constitutional state. This centrist view has gained ascendancy since the end of the Second World War, enshrining Hegel within the liberal tradition. In this book, Renato Cristi argues that, like the Prussian liberal reformers (...) of his time, Hegel was committed to expand the scope of a free economy and concurrently to ensure that the social practice of subjective freedom did not endanger political stability and order. Aware that a system of mutual advantage failed to integrate the members of civil society and that profound social disharmonies were ineradicable, Hegel adopted the views of the French liberal _doctrinaires_, who sought to realize the principles of the French Revolution by supporting Louis XVIII’s sovereign assertion of the monarchical principle. Not surprisingly, Hegel hailed the French _Charte_ of June 1814 as a beacon of freedom. Endorsement of the monarchical principle was meant to prevent the atomized individuals of civil society from gaining control of the state through appeals to popular sovereignty. This challenges most conventional interpretations of Hegel’s theory of the state and draws it closer to the conservative-authoritarian end of the political spectrum than is usual. (shrink)

Nedelsky and Kelsen criticize the notion of subjective rights. While Nedelsky does so on the basis of a relational theory of rights founded on the Hegelian intersubjective recognition, Kelsen rejects Hegel’s theory of rights because property, the paradigmatic subjective right, appears to be constituted prior to intersubjectve recognition. This paper probes into Hegel’s conception of property to elucidate the root of the divergence between Nedelsky and Kelsen. Pierson v. Post is examined as an illustration of that divergence.

This essay analyzes the conjunction freedom/authority defended by classical republicanism. As a modern thinker, Machiavelli retrieves this classical synthesis and defines the authority of law as the condition of possibility for freedom. But, as Eric Neson shows, Machiavelli's republicanism is more Athenian than Roman. Michael Sandel's democratic republicanism has a similar orientation. Besed on the social ontology developed by Arendt and Taylor, Sandel postulates the intrinsic value of the notions of participation and popular sovereignty. In this way he can refute Rorty's objections and his idiosyncratic interpretation of Dewey. According to Sandel, Dewey criticizes liberalism's rejection of authority and is able organically to articulate democratic authority and freedom. (shrink)

A critical examination of Kymlicka's conception of republicanism as a mediation between liberalism and communitarianism. The difficulties encountered by Kymlicka's view are traced to the holistic ontology republicanism shares with communitarianism. Mediation with liberalism is better attained by expanding the range of participation beyond the political sphere and a recognition of the value of representation.

[Wilfrid Hodges] During the last forty or so years it has become popular to offer explanations of logical notions in terms of games. There is no doubt that many people find games helpful for understanding various logical phenomena. But we ask whether anything is really 'explained' by these accounts, and we analyse Paul Lorenzen's dialogue foundations for constructive logic as an example. The conclusion is that the value of games lies in their ability to provide helpful metaphors and representations, (...) rather than in any true conceptual analysis. In fact some of the standard explanations of logical notions in terms of competitive games simply don't work. /// [Erik C. W. Krabbe] In an attempt to redeem the Lorenzen-type dialogues from their detractors, it is perhaps best first to provide a survey of the various benefits these dialogues have been supposed to yield. This will be done in Section I. It will not be possible, within the confines of this paper, to scrutinize them all, but in Section II we shall delve deeper into the capacity of this type of dialogue to yield a model for the immanent criticism of philosophical positions. Section III will extend the concept of a dialogue in such a way as to conform better with our intuitive conceptions of what a rational discussion of a position should contain. This will be followed up by a concept of 'winning a dialogue' that takes position midway between the old conception of 'winning one play' and that of the full-fledged presentation of a winning strategy. Concepts of 'rational discussion' are thus shown to be, plausibly, more fundamental than those of proof. Recuperamos, na esteira de trabalhos apresentados e publicados nos anais das edições 38, 39 e 40 das Reuniões Anuais da Anped, textos que abordam a escola, a educação popular, seus cenários e personagens, na periferia e no campo. Textos que observam a escola que temos e que enunciam pesquisas e propostas para a aquisição e partilha de conhecimentos de forma mais horizontalizada e dialógica. São olhos e olhares para o passado com vistas ao futuro, que na presente proposta de texto (...) somos levados a pensá-los em paralelo às figuras mitológicas de Jano e Sankofa. Partindo do diálogo, passando pela compreensão da não-neutralidade das práticas, pela formação docente permanente, pelo trabalho constante com a diferença, e chegando à reflexão decolonial e contra-hegemônica, os debates presentes nos textos em questão pensam e abordam os limites e possibilidades atravessados pela escola, na tentativa de erigir uma escola mais democrática, humana e afeita à vida. O presente artigo partiu da revisão bibliográfica das publicações do GT6 nos três últimos encontros anuais (2017, 2019 e 2021), aplicando-se sobre eles filtros relativos à escola pública e à educação popular. Buscaram-se confluências, similaridades ou mesmo divergências que apontassem a emergência de um novo paradigma de educação, destoante do modelo hegemônico, afeito às virtudes de uma civilização orientada para o neoliberalismo, para a competitividade e para as necessidades do mercado. Indícios sugestivos nos levam a crer que assuntos caros à educação popular, como questões de gênero e localidade ganharam mais protagonismo, em momentos de forte ataque à escola pública e à educação progressista. Uterine transplantation could give women who suffer from uterine factor infertility the possibility of experiencing gestation. Much of the ethical discussion about uterine transplantation has focused on whether research on it should even be pursued, but researchers are nevertheless moving forward with several uterine transplant research protocols. Scholars should therefore already be identifying and engaging in an intimate examination of the ethical realities of offering uterine transplantation in a clinical setting. Given the potential for the procedure to expand reproductive options (...) for women, reproductive autonomy has been a primary principle underlying much of the ethical discourse about the hypothetical impact of uterine transplantation. Yet the factors that will affect whether uterine transplants promote or undermine a patients’ reproductive autonomy if the procedure is integrated into clinical practice have yet to be rigorously explored. Focusing on the clinical realities of patient autonomy, I argue that empirical data exploring prospective recipients’ motivations and their perceptions of the benefits of the procedure in the context of their lived experiences are critical to a robust analysis of the ethical dimensions of uterine transplantation. ABSTRACT The presence of truth and honesty is a permanent demand, and becomes vital the more committed and intimate a relationship is. Medical practice is relevant to this discussion when one questions whether or not a physician should always tell their patient the truth in the face of a progressive or potentially fatal disease, regarding the diagnosis, outcome, therapy and evolution of the specific disease. From this discussion we aim, with the present report, to look at the truth applicable to (...) the patient‐physician relationship, and its ethical and moral implications; and also to look at where the Brazilian Code of Medical Ethics (BCME) and the medical literature stand regarding this issue. One concludes that there are only two moments not to tell a patient the truth: when the patient does not want to be informed, and when the truth could be iatrogenic. The question now is, when would the truth be iatrogenic? Physicians, in our opinion, would not be able to judge solitarily when the truth might be deleterious to their patient. Alternatively, we propose the appointment of a multidisciplinary commission to help the doctor with such a decision. (shrink)

This co-edited volume compares Chinese and Western experiences of engineering, technology, and development. In doing so, it builds a bridge between the East and West and advances a dialogue in the philosophy of engineering. Divided into three parts, the book starts with studies on epistemological and ontological issues, with a special focus on engineering design, creativity, management, feasibility, and sustainability. Part II considers relationships between the history and philosophy of engineering, and includes a general argument for the necessity of dialogue (...) between history and philosophy. It continues with a general introduction to traditional Chinese attitudes toward engineering and technology, and philosophical case studies of the Chinese steel industry, railroads, and cybernetics in the Soviet Union. Part III focuses on engineering, ethics, and society, with chapters on engineering education and practice in China and the West. The book’s analyses of the interactions of science, engineering, ethics, politics, and policy in different societal contexts are of special interest. The volume as a whole marks a new stage in the emergence of the philosophy of engineering as a new regionalization of philosophy. This carefully edited interdisciplinary volume grew out of an international conference on the philosophy of engineering hosted by the University of the Chinese Academy of Sciences in Beijing. Background Prison creates philosophical needs due to the exceptionality of the situation. This study explores how philosophy can meet these needs by focusing on three aspects: critical thinking, personal relationships and the government of passions. It builds on similar interventions in several countries and is proposed as a research that bypasses some limitations of previous projects in prisons.Method Following the participation of 81 inmates in 22 philosophical sessions over six months, the results of both interventions were analyzed using mixed methods, (...) as well as a pretest posttest design with a control group. Specifically, Webster’s Self Assessed Wisdom Scale, a questionnaire and an interview with four participants were used. These methods were triangulated in order to obtain data from the various methodologies and to improve the validity and reliability of the results.Results It was demonstrated that the experimental group showed significant progress in relation to the categories “openness”, “humor” and “emotion regulation”. Participants also showed a progression in categories related to the project’s goals. These results allow for a description of the categories that explain in what sense philosophy can act in the context of imprisonment.Conclusions This study demonstrates, on the one hand, how philosophy workshops involve outcomes linked to cognitive, affective and relational aspects. Furthermore, it provides evidence to confirm previous studies and interventions that are more modest in their results and use less rigorous scientific methodologies. (shrink)

An experiment aimed at detecting a DC voltage across a conductor induced by the steady magnetic field of a coil, carried out in 1998, provided a positive (although preliminary) evidence for such an effect, which might be interpreted as a breakdown of local Lorentz invariance. We repeated in 1999 the same experiment with a different experimental apparatus and a sensitivity improved by two orders of magnitude. The results obtained are discussed here in detail. They confirm the findings of the previous (...) experiment, and show, among the others, that the effect is independent of the direction of the current. A possible interpretation of the results is given in terms of a geometric description of the gravitational and the electromagnetic interactions by means of phenomenological, energy-dependent metrics.
