In this article, I provide a new account of the basis of medical researchers' ancillary care obligations. Ancillary care in medical research, or medical care that research participants need but that is not required for the validity or safety of a study or to redress research injuries, is a topic that has drawn increasing attention in research ethics over the last ten years. My view, the relationship‐based approach, improves on the main existing theory, Richardson and Belsky's ‘partial‐entrustment model’, by avoiding (...) its problematic restriction on the scope of health needs for which researchers could be obligated to provide ancillary care. Instead, it grounds ancillary care obligations in a wide range of morally relevant features of the researcher‐participant relationship, including the level of engagement between researchers and participants, and weighs these factors against each other. I argue that the level of engagement, that is, the duration and intensity of interactions, between researchers and participants matters for ancillary care because of its connection to the meaningfulness of a relationship, and I suggest that other morally relevant features can be grounded in researchers' role obligations. The movement toward PFCC is especially pronounced in pediatrics, where the American Academy of Pediatrics has a long-held, explicit commitment to PFCC. Organized into three broad sections entitled "Race, Gender, and Community," "War and Community," and "Artistic and Scientific Community," the book contributes to ongoing conversations about the roles of language, symbolism, differences, metaphors, myths, hegemony, economic class, pluralism, and multiple consciousness in unifying the United States. A preface and a conclusion by J. Michael Hogan, who edited the collection, provides an orientation and summary for this new volume in the University of South Carolina Press series devoted to Studies in Rhetoric/Communication.The preface frames the book's contribution as a response to a belief that "a growing number of social and political commentators fear that the United States has lost all sense of 'community'--that repository of shared purpose, values, and traditions which historically has defined the American character" (xii). Hogan amplifies, "The signs of stress and fragmentation appear everywhere, not just in our national political and cultural dialogue but in all of the various communities that define our social lives--our families, our neighborhoods, our towns and cities, our professions, and our social and cultural associations" (xii). The preface situates the book in this concern about a "lost" unity that once upon a time typified the United States. But this "lost" community is a mythic representation of a past that has never existed in the United States, except possibly in the imaginations of people habituated to dominant roles. Stephen H. Browne's comments about restoration projects in general are germane: "The work of restoration has [End Page 182] never come easy for Americans, not least of all because it presumes a state that never existed and the appeal to which is almost always self-interested" (75).Describing the fourteen contributors as sharing "a common bond," Hogan asserts, "recognizing that communities are largely defined, and rendered healthy or dysfunctional, by the language they use to characterize both themselves and others, all share an abiding concern with how communities are constituted and sustained--or, in some cases, threatened and disrupted--by the words their leaders choose to characterize both themselves and others" (xv). Hogan emphasizes a question that he reiterates with slight changes in the conclusion: "Can feminist or ethnic and racial communities successfully sustain and celebrate their own identities without alienating themselves from the larger community?" (295; similarly, xxiii). But if all members of a community are responsible for unity and fragmentation, if we are unwilling to assign responsibility for fragmentation to subordinated community members, it may be necessary, consciously, to reverse the dynamics of power implicit in Hogan's question, by asking: "Can groups that have had a history of dominating others--both beyond and within the borders--sustain their own identities and still relate productively to the community?" In addition, because the English language is a communal inheritance, it may be revealing to ask, in a reversal of the book's focus on "community," how are notions of individualism sustained in the United States?Roderick P. Hart's introduction, "Community by Negation--An Agenda for Rhetorical Inquiry," focuses on a rhetoric of hate as practiced by both the political right and the political left. Hart inquires "whether it is possible to have community without hate" (xxv). This question is necessary in any serious discussion of rhetoric, fragmentation, and community; yet calculated opportunism and economic exploitation may be misnamed and obfuscated in language depicting a rhetoric of "hate." Stress is one of the most powerful experiences to influence health and disease. Through epigenetic mechanisms, stress may generate a footprint that propagates to subsequent generations. Programming by prenatal stress or adverse experience in parents, grandparents, or earlier generations may thus be a critical determinant of lifetime health trajectories. Changes in regulation of microRNAs (miRNAs) by stress may enhance the vulnerability to certain pathogenic factors. This review explores the hypothesis that miRNAs represent stress‐responsive elements in epigenetic regulation that are (...) potentially heritable. Recent findings suggest that miRNAs are key players linking adverse early environments or ancestral stress with disease risk, thus they represent useful predictive disease biomarkers. Since miRNA signatures of disease are potentially heritable, big data management platforms will be vital to harness multi‐generational information and capture succinct yet potent biomarkers capable of directing preventative treatments. This feature would offer a unique window of opportunity to advance personalized medicine. (shrink)

A collection of Head’s previously published papers are reprinted here, often without significant change. Nevertheless, the book has a great unity of purpose. It analyzes different problems related to an important new concept in economic theory: that of public goods. Head’s merit is to review, compare, and analyze the different approaches or definitions of a public good found in the literature. Further, he relates this problem to the whole field of welfare economics and finally, compares and differentiates it from (...) the concept of merit good. Head attempts to clarify the concept of a public good by integrating it into two streams of economic thought that try to construct analytical tools for mastering the problem of market failure. He, therefore, takes up and interrelates such individualistic concepts as Pareto-optimum, consumer sovereignty, jointness of supply, indivisibility of a good, and externality; but he also pointedly refers—through his concept of merit good—to the little discussed authoritarian stream of the liberal economic tradition. To support this claim Head cites a text even from J. S. Mill. The authors that Head refers to the most are Samuelson, Musgrave, Buchanan, and Pareto. But he also incorporates Baumol, Thiebout, Olson, and Downs, among the contemporary authors, and Sidgwick, Pigou, Wicksell, and Lindahl, among the historical figures. (shrink)

By demonstrating how Sartre’s account of nothingness comports with a Rahnerian understanding of God as absolute mystery and how Sartre’s account of bad faith further opens up an understanding of ontological self-identity as a turn away from God, we can establish a phenomenology of Christian vocation as one’s owning each finite situation in terms of its divinely available possibilities rather than simply (...) its given conditions. Divine call thus occurs where one’s possibilities for boundless becoming are freely recognized in any situation and are further apprehended in light of the character of God to become the possibilities for the freedom and calling of others. Some years ago, in the course of a general critique of what has sometimes been referred to as the covering law theory of explanation, I made the claim that perfectly satisfactory explanations can often be provided by indicating only one or a few necessary conditions, where we remain ignorant of the sufficient conditions, of what we nevertheless claim to understand. What seemed to me one identifiable type of such explanations I called “explaining how-possibly,” because it was a type more naturally (...) given in response to the question how it could be that a certain thing happened than to the more familiar question why it did so. In the present paper I propose to review certain objections to this thesis which have come to my attention in the interval, and to make such concessions as these seem to require. In fact, the concessions will be minor, since the general thesis still seems to me quite defensible. (shrink)

Here I review the science of prokaryotic LGT, the philosophy of the TOL as it figured in Darwin’s formulation of the Theory of Evolution, and the politics of the current debate within the discipline over how threats to the TOL should be represented outside it. ABSTRACT After initially pitting partisans against purists, the literature on the ethics of fandom has coalesced around a pluralist position: purists and partisans each have their own merits, and there is no ideal form of fandom. In this literature, however, the fair-weather fan continues to be viewed with dismissal and derision. While some fair-weather fans may earn this contempt, many fair-weather fans, we argue, are not only acceptable, they have important advantages over partisans and purists, and as such are in (...) a better position to navigate some of the moral complexities inherent in modern sports. We develop this argument first by clarifying the nature of the fair-weather fan. We then examine challenges that fans face in many modern sports, first owing to their economic nature and, second, due to the morally tainted status of many of them. We argue that the fair-weather fan meets these challenges in ways that the partisan and purist cannot replicate. (shrink)

The responsible corporate officer doctrine is, as a formal matter, an instance of strict criminal liability: the government need not prove the defendant’s mens rea in order to obtain a conviction, and the defendant may not escape conviction by proving lack of mens rea. Formal strict liability is sometimes consistent with retributive principles, especially when the strict liability pertains to the grading of an offense. But is strict liability consistent with retributive principles when it pertains, not to grading, but to (...) whether the defendant has crossed the threshold from noncriminal to criminal conduct? In this essay, I review the two most plausible arguments supporting an affirmative answer in the context of the RCO doctrine. First, perhaps this doctrine reflects a rule-like form of negligence, akin to a rule that prohibits selling alcohol to a minor. Second, perhaps this doctrine expresses a duty to use extraordinary care to prevent a harm. Neither argument is persuasive. The first argument, although valid in some circumstances, fails to explain and justify the RCO doctrine. The second argument, a duty to use extraordinary care, is also inadequate. If “extraordinary care” simply means a flexibly applied negligence standard that considers the burdens and benefits of taking a precaution, it is problematic in premising criminal liability on ordinary negligence. If instead it refers to a higher duty or standard of care, it has many possible forms, such as requiring only a very slight deviation from a permissible or justifiable standard of conduct, placing a “thumb” on the scale of the Learned Hand test, identifying an epistemic standard more demanding than a reasonable person test, or recognizing a standard that is insensitive to individual capacities. However, some of these variations present a gratuitous or incoherent understanding of “negligence,” and none of them sufficiently explain and justify the RCO doctrine. (shrink)

This volume makes good on a promise that the author made in his Ancient Menippean Satire , namely, to use that tradition to offer an interpretation of Boethius's Consolation of Philosophy. Building on a trend in recent scholarship to reclaim the Consolation as a Christian work, on his own well-received translation of the Consolation , and on the literary criticism associated with Northrop Frye and Mikhail Bakhtin, Relihan argues that attentiveness to the ironies typical of Menippean satire can help to (...) resolve the problem that is presented by the lack of any explicit testimony to Boethius's Christian faith within the Consolation. Had Boethius somehow found his religion insufficient for coping with his prison experience and reverted to philosophy for comfort in the face of imminent death? Going beyond the stance that the Consolation has merely some latent religious convictions, Relihan argues that Boethius is using the resources of Menippean satire to show the limits of pagan philosophy and the need to turn to prayer instead. Patient safety has only recently been subjected to wide-spread systematic study. Healthcare differs from other high risk industries in being more diverse and multi-contextual, and less certain and regulated. Also many patient safety problems are low-frequency events associated with many, varied contributing factors. The subject of this paper is the epistemology of patient safety (the science of the method of finding out about patient safety). Patient safety research is considered here on the background of a risk management framework which requires (...) researchers to: • Understand the context - as a subset of healthcare quality, services and systems research, with technical and human behavioural (cultural) components and a range of external and internal organisational influences, a wide range of research disciplines is necessary • Identify the risks - identify the things that go wrong and the frequency and nature of different types of incidents from sources such as medical record review, observational studies, audit, incident and medico-legal reports • Analyse the risks - deconstruct the things that go wrong, identifying contributing factors and trying to detect trends and patterns in contributing factors, detection, mitigation factors, ameliorating factors and actions taken to reduce risk • Evaluate the risks - decide on priorities, identifying preventive and corrective strategies and judging the risk- and cost-benefit of potential corrective strategies such as standardisation or simplification of a process or device • Manage the risk - evaluate and scope preventive and/or corrective strategies and then implement these, or place the problem on a risk register pending solution, or accept that what is needed is unaffordable • Communicate and consult - use interactive sessions, audit, on-going feedback, reminders and patient mediated prompts • Monitor and review the state of the problem - get baseline trends and patterns so that changes can be tracked and properly attributed to an intervention A hierarchy of levels of evidence has been proposed for clinical research and we argue that insufficient weighting has been given to lower ranked levels of research and to qualitative research, although critical interpretive synthesis is now gaining acceptance in mainstream thinking (e.g. by the Cochrane Collaboration). Fundamental challenges remain including how to grasp the elusive concept of patient safety, how to quantify, characterise and cost the problems, how to judge the extent to which harm can be attributed to errors, violations or system failures, how to identify contributing factors and the extent to which they can be implicated, how to judge whether incidents or their precursors are preventable, how to generate strong evidence to make healthcare safer and how to translate research into practice. Future directions include addressing the mundane as well as rare, dramatic events, and developing further research in non-hospital settings and in developing countries. In summary, a mixture of qualitative and quantitative methods, using information from all available data sources and combining retrospective, real time and prospective study designs, is necessary to address some of the more difficult patient safety problems. W. H. Auden, the sometimes Greta Garbo of twentieth-century poetry, once told Stephen Spender that he liked America better than England because in America one could be alone. Further, in his introduction to The Criterion Book of Modern American Verse Auden remarked that while in England poets are considered members of a “clerkly caste,” in America they are an “aristocracy of one.” Certainly it does seem to be the individual poet—Whitman, Williams, Olson, Plath, O’Hara, Ginsberg—who has altered the landscape (...) of American poetry and prosody, not the group. And most American literary “movements,” as Robert Creeley has pointed out, are simply comprised of a few people who on occasion drink together, and who are as likely as not to end the evening in violent argument over an aesthetic or political point. Yet the notion of schools or movements remains, in mainstream historical criticism at least, a vital one. How many introductions to anthologies of American poetry, for example, continue to use such rubrics as the Transcendentals, the Populists, the Black Mountain poets, the Beats, the New York group? And while established poets often rebel from any sense that they are part of a larger community, which by definition is self-limiting, they are often complicit in their initial categorization. For poets as well as critics the idea of a school is often a useful fiction serving as both a kind of protective hothouse and a platform for getting a hearing.The most recent “group” of American poets—the first since the anthology wars of the early sixties really to be of more than passing interest and perhaps to be actually capable of bringing about a major shift of attention in American poetry and poetics—is the so-called “Language” school. Individual volumes by poets often considered part of this group number well into three figures now and there have been important journals and anthologies produced in a serious and sustained fashion by these writers. Yet in part because of what seems the essentially hermetic character of the project , there has been little notice of this activity by academic critics or reviewers.1 What I’d like to do here is briefly map a few major aspects of the territory, describing some of the practical and theoretical questions which seem to occupy many of these writers in their ongoing critique of the “workshop poem.” 1. Two important exceptions are discussions of some of this work in Stephen Fredman, Poet’s Prose: The Crisis in American Verse and Marjorie Perloff’s review “The Word as Such: L=A=N=G=U=A=G=E Poetry in the Eighties,” American Poetry Review 13 : 15-22. Efforts to reform medical education have emphasized the need to formalize instruction in medical ethics. However, the discipline of medical ethics education is still searching for an acceptable identity among North American medical schools; in these schools, no real consensus exists on its definition. Medical educators are grappling with not only what to teach (content) in this regard, but also with how to teach (process) ethics to the physicians of tomorrow. A literature review focused on medical ethics education among (...) North American medical schools reveals that instruction in ethics is considered to be vitally important for medical students. Agreement by medical educators on a possible core curriculum in ethics should be explored. To develop such a curriculum, deliberative curriculum inquiry by means of a targeted Delphi technique may be a useful methodology. However, the literature reveals that medical curricular change is notoriously slow. General implications for medical ethics education as a discipline are discussed. (shrink)

MitchellPurdue UniversityThe three papers presented by this panel have given me a much greater knowledge about, and appreciation for, the relationship between ritual practice and ethical action in Tibetan, Zen, and Nichiren Buddhism. I would like to respond to each of the papers one at a (...) time from a Christian point of view by making certain comparisons with the connection between Christian ethics and ritual practice. Let me begin by raising a comparative five points concerning Stephanie Kaza's wonderful description [End Page 84] and insightful analysis of the function of ritual in nurturing authentic personhood in Zen.First, it seems that the practice of ritual in Zen demands a degree of self-sacrifice which in turn aids in the cultivation of the virtue of selflessness. For example, Kaza says that through the participation in ritual practice, "the student is freed from his or her own individual designs and preferences... not asking any questions but just trying to do it better and more fully each time." Or elsewhere Kaza concludes, "Zen ritual is a training ground for intensive practice in giving up the small ego-bound self." In a similar way for the Christian, the self-sacrifice demanded in ritual performance can be seen as nurturing selflessness in the context of community--as aiding one in giving up one's ego in order to participate more fully in the communal life of agape. But more than this, the value of selfless participation in the Christian community that is reinforced by the ritual is connected to a call for future action: It calls one to contribute selflessly together with others to building the reign of God. In Christianity, the performing of ritual with others sensitizes one to the fact that he or she is part of the church working for a collective love and unity that manifests in human community the very holiness of the unity and love of the Trinity. One is thus called within the sacred ritual environment to bring this love and unity into one's everyday environment through ethical behavior.Second, besides selflessness, another positive quality that is cultivated through ritual practice is mindful awareness. As Kaza states in regard to the meal ritual, this practice "cultivates mindful awareness... if one merges wholeheartedly with the process, the meal itself becomes a lesson in co-dependent arising." In other words, the ritual performance brings to mind an awareness of fundamental reality according to Buddhism, namely, dependent arising. Being aware of mutual interdependence brings a deeper sense of compassion for all beings, and a more focused inspiration to act morally on their behalf. So, too, in Christianity, ritual is seen to be a "social drama" that brings to awareness the reality of the mystical body of Christ, the church, being the social form of Jesus Christ in the world. Ritual, as a sacred and dramatic social manifestation of the church, brings this communal reality of Christ to the Christian's mindful awareness by breaking into the secular structures of ordinary consciousness. Furthermore, the ritual also guides, forms, inspires, strengthens, and encourages the participants to re-enter that ordinary life committed to living the values and ideals expressed in the ritual. The formative power of the ritual performance lies, in part, in the fact that ritual ties ideas, values, and ideals to sensual and emotional stimuli in a way that, in the words of Victor Turner, "connects the obligatory into the desirable" (The Forest of Symbols, 1967).Third, Kaza shows how ritual in Zen helps to convey the tradition and promote solidarity within the community. She says that ritual in Zen: "promotes healthy sangha through sharing the stability and continuity of traditional practice forms... which generate a culture of the larger body--familiar and supportive." In Christianity, too, the multidimensional expressions of the ritual performance--the physical movements, sounds, music, smells, verbal articulations, etc.--all blend together in ways that pass on certain ideas, ideals, and values... Burnyeat's map is an ambitious attempt to establish two claims about Zeta: that Aristotle employs an unusual, non-linear form of argument in Zeta, and that the discussion in Zeta is on two levels, one abstract and "logical" and (...) another specific and "metaphysical." In addition to looking at Zeta, chapter by chapter, Burnyeat examines the other works that provide the context for Zeta—the Organon for the logical level of explanation and the rest of the Metaphysics for the metaphysical level. Burnyeat argues that Aristotle's metaphysical project culminates in the theology of'Lambda, for which the metaphysics of Zeta has prepared us. The goal is to "map" or sketch the evidence for these claims rather than provide definitive arguments for them.A brief introductory chapter presents the main themes of the book. This is followed by an even briefer chapter that sets out the four routes (or independent sections of Zeta), viz. Z 3; Z 4-6, 10-11 with Z 7-9, 12; Z 13-6; and Z 17 with H 1. On all four routes, a logical discussion moves to a metaphysical discussion of form and matter.The third chapter on "signposts" is the lengthiest of all and takes the reader through the chapters of Zeta in order. It is also the most map-like of the chapters, as it requires that the reader have a copy of the Metaphysics ready to hand. Burnyeat follows other commentators in treating Zeta 7-9 and Zeta 12 as later insertions; he does, however, argue that the former and probably the latter were added by Aristotle. Chapters 7-9 are integral to the argument of Zeta, as they provide a diachronic view of artifacts and substantial beings (37). [End Page 267] Rejecting the prominence assigned Z 13 by several recent commentators, Burnyeat reads Z 13 in context with chapters 14-6. "The task of Z 13-6 is to show how the idea that substantial being is a universal such as human leads eventually, after suitable refinements and restrictions, to the conclusion that substantial being is form" (54). Wrapping up the discussion of Zeta, Burnyeat concludes that the goal of Zeta's two-level approach has been to show how logical concepts should be used to search for form.This leads directly to a chapter on the Organon. Burnyeat argues that none of the treatises making up the Organon are metaphysical; all employ an abstract (logical) mode of analysis. Even if written at different times, these treatises belong together because they are all methodological. Since form and matter belong to the metaphysical level, in the Analytics Aristotle "follows a deliberate policy of excluding form and matter" (97).In the final chapter, Burnyeat returns to the Metaphysics and considers Zeta in the context of the other books. Three "chunks," viz. books ABGE, ZHQ, and MN are briefly surveyed. The topics of Zeta are then considered in relation to Lambda. Several chapters, viz. D1 and Z1; D3 and Z 7-9, are found to have the same concerns. Burnyeat concludes with a fanciful muqo~ (story) about a dying Aristotle hastily writing a culminating metaphysical treatise.Burnyeat gives us a map—a map to prompt questions; he does not attempt to delve into many of the interpretative puzzles that have exercised other interpreters of Zeta. Thus, this book stands as a helpful counterbalance to a certain kind of scholarship on Zeta. The two interpretative claims, however, that are at the heart of Burnyeat's enterprise stand in need of further justification. One of these, the non-linearity of Zeta, seems to be too weak to support substantive claims. Burnyeat defines non-linearity as holding when "it is not the case that the successive chapters build continuously upon the results of their predecessors" (4). I want to take issue with these views both by attempting to answer the arguments which have been given against regarding explanations in terms of the agent's reasons as causal and by giving some positive reasons for supposing that such explanations are a kind of causal explanation.

Integrins are ubiquitous trans‐membrane adhesion molecules that mediate the interaction of cells with the extracellular matrix (ECM). Integrins link cells to the ECM by interacting with the cell cytoskeleton. In cases such as leukocyte binding, integrins mediate cell‐cell interactions and cell‐ECM interactions. Recent research indicates that integrins also function as signal transduction receptors, triggering a number of intracellular signaling pathways that regulate cell behavior and development. A number of integrins are known to stimulate changes in intracellular calcium levels, resulting in (...) integrin activation. Although changes in intracellular calcium regulate a vast number of cellular functions, this review will discuss the stimulation of calcium signaling by integrins and the role of intracellular calcium in the regulation of integrin‐mediated adhesion.
