Is argumentation essentially adversarial? The concept of a devil's advocate—a cooperative arguer who assumes the role of an opponent for the sake of the argument—serves as a lens to bring into clearer focus the ways that adversarial arguers can be virtuous and adversariality itself can contribute to argumentation's goals. It also shows the different ways arguments can be adversarial and the different ways that argumentation can be said to be "essentially" adversarial.

Short food supply chains have become the focus of considerable research in the last two decades. However, studies so far remain highly localized, and claims about the economic and social advantages of such channels for farmers are not backed by large-scale empirical evidence. Using a web survey of 613 direct-market farmers across Canada, this article explores the potential economic and social benefits that farmers derive from participating in short food supply chains. We used multivariate analysis to test whether a farmer’s (...) degree of involvement in direct food channels is positively correlated with levels of work enjoyment, social satisfaction, and economic satisfaction. The results indicate that, overall, direct-market farmers report high levels of occupational satisfaction, although work-related challenges persist, such as stress, excessive workloads, and competition. Farmer participation in short food chains was also a positive predictor of work enjoyment and economic satisfaction, but not of social satisfaction, as measured by the share of total farm sales attributable to direct selling. Net annual farm revenue, the share of direct food sales involving a middleman, age, and gender also correlated with one or more dimensions of occupational satisfaction. (shrink)

This book presents the thought of the Kyoto School in comparison with continental philosophers better known in the West and addresses the affiliation of some of its members with the militarism of the 1930s and 1940s.

David Kaplan's semantic theory for indexicals yields a distinct logic for indexical languages that generates contingent a priori truths. These special truths of the logic of indexicals include examples like "I am here now", an utterance of which expresses a contingent state of affairs and yet which, according to Kaplan, cannot fail to be true when it is uttered. This claim is threatened by the problem of displaced communications: answerphone messages, for example, seem to facilitate true instances of the negation (...) of this supposed logical truth as they allow the agent of the message to no longer be at the location of the message when it is encountered by an audience. Many such displaced communications can be identified in everyday natural language uses of indexicals. Recent discussion has suggested that Kaplan's error is to be overly restrictive in the possible contexts of utterance his semantic theory recognizes, as he fails to acknowledge the possibility of utterances that occur at a context distinct from that in which they are constructed. I reject this diagnosis and defend Kaplan's semantic theory. Displaced communications, I argue, are best understood as resulting from a pragmatically introduced metalinguistic context-shifting operation and hence do not demand revision of Kaplan's semantic theory. I provide an analysis of the pragmatic process underlying this operation and make the case for its merits over those of rival accounts of displaced communications. (shrink)

Martin Heidegger’s existential account of care in _Being and Time_ (2010) provides us with an opportunity to reimagine what the proper theoretical grounding of an ethic of care might be. Heidegger’s account of care serves to deconstruct the two primary foundations that an ethic of care is often based upon. Namely, that we are inevitably interdependent upon one another and/or possess an innate disposition to care for fellow humans in need. Heidegger’s account reveals that both positions are founded upon an (...) ontic (meaning factual existence), as opposed to an ontological (which refers to the nature of being), understanding of care. The distinctions between an ontic and ontological understanding of care are significant. Yet, I maintain that they are not completely incompatible. Both Heidegger and care ethicists contend that our existence with others is understood through a relational ontology. Furthermore, there are certain ontological structures from Heidegger which resonate with an ethic of care. Two key existential structures are leaping-ahead and being-guilty. These existential structures are latent in care ethics, and by explicitly revealing them I reinforce the connection between Heidegger’s account and care theory. Lastly, I develop the theoretical foundations of care ethics by proposing an existential ethic of care. (shrink)

It is widely assumed that Russell's problems with the unity of the proposition were recurring and insoluble within the framework of the logical theory of his Principles of Mathematics. By contrast, Frege's functional analysis of thoughts (grounded in a type-theoretic distinction between concepts and objects) is commonly assumed to provide a solution to the problem or, at least, a means of avoiding the difficulty altogether. The Fregean solution is unavailable to Russell because of his commitment to the thesis that there (...) is only one ultimate ontological category. This, combined with Russell's reification of propositions, ensures that he must hold concepts and objects to be of the same logical and ontological type. In this paper I argue that, while Frege's treatment of the unity of the proposition has immediate advantages over Russell's, a deeper consideration of the philosophical underpinnings and metaphysical consequences of the two approaches reveals that Frege's supposed solution is, in fact, far from satisfactory. Russell's repudiation of the Fregean position in the Principles is, I contend, convincing and Russell's own position, despite its problems, conforms to a greater extent than Frege's with common sense and, furthermore, with certain ideas which are central to our understanding of the origins of the analytical tradition. THE TITLE OF THIS PAPER calls for clarification. Not only are there several senses in which something may be said to "be," there are also many nuances to the terms "categorial" and "intuition." Taking Aristotle as a guide, let us focus upon the primary sense of "being," that is, substance considered both as first substance and second substance. We may then take "categorial" as referring to what Aristotle calls the "figures of predication," the ways in which predicates characterize subjects, indicating (...) "what" the subject is, its quality, quantity, relation, its "where," its "when," and so forth. The term "intuition" expresses something too primitive to be defined, but Edmund Husserl's metaphorical contrast between the "emptiness" of thought and speech and the "fullness" of intuition successfully highlights its essential characteristic. A couple of examples should suffice to grasp the import of Husserl's distinction. Consider the difference, for instance, between first entertaining vague plans of visiting a foreign city and then experiencing the fulfillment of actually strolling through its streets, or the difference between first reading a manual of instructions for performing some task and then actually executing the task skillfully. Taking Husserl as a guide, let us therefore characterize intuition broadly as the presentation of something in its fullness, as opposed to thinking or talking about it in an empty way. Finally, combining Husserlian and Aristotelian terminologies, we may describe categorial intuition as the presentation of figures of predication. Rather than presenting some particular thing, say a red chair, categorial intuition presents the chair's being red, the red quality's belonging to the chair. In short, categorial intuition makes present the modes of presentation of things. (shrink)

Patient consent has been formulated in terms of radical individualism rather than shared benefits. Medical education relies on the provision of patient consent to provide medical students with the training and experience to become competent doctors. Pelvic examination represents an extreme case in which patients may legitimately seek to avoid contact with inexperienced medical students particularly where these are male. However, using this extreme case, this paper will examine practices of framing and obtaining consent as perceived by medical students. This (...) paper reports findings of an exploratory qualitative study of medical students and junior doctors. Participants described a number of barriers to obtaining informed consent. These related to misunderstandings concerning student roles and experiences and insufficient information on the nature of the examination. Participants reported perceptions of the negative framing of decisions on consent by nursing staff where the student was male. Potentially coercive practices of framing of the decision by senior doctors were also reported. Participants outlined strategies they adopted to circumvent patients’ reasons for refusal. Practices of framing the information used by students, nurses and senior doctors to enable patients to decide about consent are discussed in the context of good ethical practice. In the absence of a clear ethical model, coercion appears likely. We argue for an expanded model of autonomy in which the potential tension between respecting patients’ autonomy and ensuring the societal benefit of well-trained doctors is recognised. Practical recommendations are made concerning information provision and clear delineations of student and patient roles and expectations. (shrink)

The literature on affective determinants of physical activity is growing rapidly. The present paper aims to provide greater clarity regarding the definition and distinctions among the various affect-related constructs that have been examined in relation to PA. Affective constructs are organized according to the Affect and Health Behavior Framework, including: affective response to PA; incidental affect; affect processing; and affectively charged motivational states. After defining each category of affective construct, we provide examples of relevant research showing how each construct may (...) relate to PA behavior. Humility holds a modest but important place among the judicial virtues. But in spite of its growing popularity, it does not yet have a place on the ‘central judicial virtues’ lists. This paper provides an argument that judicial humility, especially institutional judicial humility, should be considered a necessary judicial virtue at least in common-law jurisdictions. This is because it is a necessary ingredient in precedent-based decisions that are fully justified from the point of view of the law and of political (...) morality. Further, while it is sufficient that individual judges make decisions that a humble judge would have made, the judicial community must in fact be humble in order to produce fully justified common-law decisions – humility is therefore necessary as a community-virtue. In this article, I critique Jonathan Floyd’s method of normative behaviourism (NB): that we should measure political preference for a political system from levels of crime and insurrection. First, I distinguish between problems with the data and problems with the theory. I proceed to examine 6 groups who present a difficulty for NB and identify the common thread: NB abstracts the capacity of groups to commit crime and insurrection, and therefore, misreads them in the data as normative approval of a (...) political system. Next, I argue that this a problem, especially as that capacity is often caused by the conditions of the political structure such groups live within. This lack of capacity often means they are amongst the most vulnerable. Consequently, NB needs to be careful of overlooking corrective justice. Indeed, we might say that the category of film now only exists in theory. Whereas film-theoretical discussion at the turn of the 21st century was preoccupied, understandably, by digital technology's permeation of virtually all aspects of the film object, this volume moves the conversation away from a focus on film's materiality towards timely questions concerning (...) the ethics, politics, and even aesthetics of thinking about the medium of cinema. To put it another way, this collection narrows in on the subject of film, not with a nostalgic sensibility, but with the recognition that what constitutes a film is historically contingent, in dialogue with the vicissitudes of entertainment, art, and empire. In his article The Nature, Importance, and Difficulty of Machine Ethics, James H. Moor distinguishes two lines of argument for those who wish to draw a “bright line” between full ethical agents, such as human beings, and “weaker” ethical agents, such as machines whose actions have significant moral ramifications. The first line of argument is that only full ethical agents are agents at all. The second is that no machine could have the presumed features necessary for ethical agency. This paper (...) shows why Moor is mistaken in his refutation of the first line of argument; it also makes a positive case that “weaker” ethical agents are not agents at all. This positive case, however, allows Moor’s rejection of the second line of argument to stand: allowing that there could be moral machines, but that these machines would have to be full moral agents and not merely something that models moral behavior or can be used in morally charged ways. There are scientists that have speculated that, since science involves abstraction, generalizations across facts, and the generalization of causes and theories across empirical phenomena, the direction of science is to increasingly unify forces and causes until there is a single general theory unifying all of the forces of nature. The most prominent contemporary example of this attempt to unify all of the forces of nature in a single theory is string theory or superstring theory. String theorists have attempted to emulate (...) Albert Einstein’s call for physicists to attempt to unify all of the forces of physics in a single theory, sometimes called a “theory of everything.” String Theory has been called “untestable,” empirically unverifiable, and “post-empiricist,” and I use another standard by which String Theory might be evaluated, a _Standard of Instrument Design and Technological Productivity. _Moreover, I seek to show that, instead of attempting to unify all of the forces of nature in a single theory or “theory of everything,” it is possible to identify and separate the forces of nature in relation to each other, and order and rank the forces of nature by their capacity to generate branching patterns in the biological sciences or the physical sciences. Ranking forces by their capacity to generate branching patterns (or other shapes or patterns), in the biological sciences or in the physical sciences, is more positivist and testable than attempts to unify all of the forces of nature in a single theory. When evaluating the arguer instead of the argument, we soon find ourselves confronted with a puzzling situation: what seems to be a virtue in one argumentative situation could very well be called a vice in another. This paper will present the idea that there are in fact two sets of virtues an arguer has to master—and with them four sometimes very different roles.

If circumstances were always simple and all arguers were always exclusively concerned with cognitive improvement, arguments would probably always be cooperative. However, we have other goals and there are other arguers, so in practice the default seems to be adversarial argumentation. We naturally inhabit the heuristically helpful but cooperation-inhibiting roles of proponents and opponents. We can, however, opt for more cooperative roles. The resources of virtue argumentation theory are used to explain when proactive cooperation is permissible, advisable, and even mandatory (...) – and also when it is not. (shrink)

Who gets to practice and participate in science? Research teams in Puerto Rico and New Zealand have each sequenced the genomes of parrot populations native to these locales: the iguaca and kākāpō, respectively. In both cases, crowdfunding and social media were instrumental in garnering public interest and funding. These forms of Internet-mediated participation impacted how conservation science was practiced in these cases and shaped emergent social roles and relations. As citizens “follow,” fund, and “like” the labor of conservation, they create (...) new relational possibilities for and with science. For example, the researchers became newly engaged and engaging by narrating and displaying the parrots via an Internet-inflected aesthetic. The visibility of online modalities shifted accountabilities as researchers considered whom this crowdfunded work answered to and how to communicate their progress and results. The affordances of the Internet allowed researchers from the peripheries of the scientific establishment to produce genomic knowledge for globally dispersed audiences. The convergence of genomic and Internet technology here shaped scientific practice by facilitating new modes of participation—for laypeople in science but also for scientists in society. (shrink)

Team members co-regulate their activities and move together at the collective level of behavior while coordinating their actions toward shared goals. In parallel with team processes, team members need to resolve uncertainties arising from the changing task and environment. In this exploratory study we have measured the differential neurodynamics of seven two-person healthcare teams across time and brain regions during autonomous and collaborative segments of simulation training. The questions posed were: whether these abstract and mostly integrated constructs could be separated (...) neurodynamically; and, what could be learned about taskwork and teamwork by trying to do so? The taskwork and teamwork frameworks used were Neurodynamic Information, an electroencephalography derived measure shown to be a neurodynamic proxy for the pauses and hesitations associated with individual uncertainty, and inter-brain EEG coherence which is a required component of social interactions. No interdependency was observed between NI and IBC, and second-by-second dynamic comparisons suggested mutual exclusivity. These studies show that proxies for fundamental properties of teamwork and taskwork can be separated neurodynamically during team performances of ecologically valid tasks. The persistent expression of NI and IBC were not simultaneous suggesting that it may be difficult for team members to maintain inter-brain coherence while simultaneously reducing their individual uncertainties. Lastly, these separate dynamics occur over time frames of 15–30 s providing time for real-time detection and mitigation of individual and collaborative complications during training or live patient encounters. The United States juvenile justice system has primary oversight of youth who come into contact with legal authorities. This system is purposefully distinct from the adult system given the presumption of youths’ reduced culpability for delinquent behavior and increased potential for rehabilitation. Some juvenile court policies and practices are supportive of youth while others may drive youth further into the juvenile justice system. Today, we are at a point in which we can—and should—use information technology to accrue data to unpack (...) the impact of these policies and practices on and across youth. Moreover, technology-driven policies and practices such as electronic monitoring may be detrimental to the well-being of youth, whereas others such as video conferencing could be more widely used to benefit youth. While juvenile courts hold youth accountable for their behavior, courts also need to be accountable to youth by employing data-informed policies and practices that advance the health and well-being of youth.
