Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. In analyzing the socio-psychic nature and operations of intuitive legal rules, Petrazycki formulates a theory of law around five conceptual themes: anti-formalism, imperative-attributive legal relationships, law's functional control, law's subjective reality and morality. Petrazycki presents the two ways by which law coordinates and regulates social conduct as through its distributive and organizing functions. "Law and Morality" has a basic objective: to analyze interrelations between positive and intuitive law. Petrazycki's socio-psychic orientation toward law is behavioral as well as thoughtful. He finds (...) the most suitable methods for obtaining knowledge about legal experiences to be internal and external observation. His technique of introspection is similar to Max Weber's conceptual method." "Petrazycki distinguishes between two kinds of interpretive understanding. External observation involves deriving the meaning of an act or symbolic expression from immediate observation without reference to any broader context, and internal observation involves placing the particular act in a broader context of meaning involving facts that cannot be derived from a particular act or expression. Petrazycki's socio-legal ideas remain relevant in today's society. His arguments concerning the global expansion of human love have an attraction for those working towards a better world. In the context of positive psychology and the growing happiness industry, Petrazycki's ideas will compel legal scholars to consider his arguments. Petrazycki's work stands out for the scientific ambitions and systematic nature of his thought as well as the influence of his work on later scholars in the sociology of law. (shrink)

The book is a critical analysis of the work of Max Weber, Emile Durkheim and Karl Marx. It focuses on their separate analyses of the role of law in society, pointing out their faults and errors, and the resultant impact on modern social science. The author takes issue with Weber's work on rationality, with Durkheim's work on repressive and restitutive law, and with Marx's work on social justice and law as part of the super-structure. In each section of (...) the book he shows the implications that flow from a re-assessment and re-interpretation of their work for an understanding of society. The book is multi-disciplinary, making ample reference to law, sociology, anthropology, history, religion, ecology, criminology, philosophy and economics. Este artigo discute algumas variantes de relevo na língua alemã na crítica à modernidade. Em rigor, discute-as na sua pertinência actual, tal como se deixa ver em dois trabalhos recentes de autores portugueses, Rafael Gomes Filipe e Alexandre Franco de Sá. O nó-górdio da questão encontra-se na caracterização da modernidade através da elaboração de uma filosofia da His­tória, problema que sobressai na análise de Nietzsche e Weber por Gomes Filipe e no ensaio schmittiano de Franco de Sá.

This paper makes the case for the relevance of C. G. Hempel’s 1942 proposal of the usage of «covering laws» in History. To do so, it argues that such a proposal reflects how 18 and 19th centuries «philosophy of History» became methods or epistemology of History. This carried a change in meaning of «History»: no longer a succession of past events but the study of documented human action (including of scientific kind in general), its distinction vis-à-vis philosophy, sociology etc., becomes (...) a minor matter as far as logic of research is concerned. Also present in this paper is the conception of theory as a conceptual mode of narrative, and the defense of a development of theories alongside their practice, not apart from them. Raymond Aron was a student of Léon Brunschvicg, a representative of French historical epistemology. This article explores Aron’s relation to this tradition through three claims. First of all, it contests that Raymond Aron’s philosophy of history constituted a complete break with this tradition. Secondly, resituating Aron in this tradition is valuable, because it highlights how Aron’s own philosophy of history is to be understood as a normative project, seen as an alternative to that of Brunschvicg. What does woman mean? According to two competing views, it can be seen as a sex term or as a gender term. Recently, Jennifer Saul has put forward a contextualist view, according to which woman can have different meanings in different contexts. The main motivation for this view seems to involve moral and political considerations, namely, that this view can do justice to the claims of trans women. Unfortunately, Saul argues, on further reflection the contextualist view fails to do justice (...) to those moral and political claims that motivated the view in the first place. In this article I argue that there is a version of the contextualist view that can indeed capture those moral and political aims, and in addition, I use this case to illustrate an important and more general claim, namely, that moral and political considerations can be relevant to the descriptive project of finding out what certain politically significant terms actually mean. This study examines the influence of mood on corporate philanthropic giving. Drawing on group emotions theory and affect-infused decision theory, we advance the argument that firms allocate greater resources to philanthropy when headquarters-based employees are in a more positive affective state. We also describe three boundary conditions in this relationship—executives’ embeddedness in the firm, executives’ latitude to engage in philanthropic giving, and the firm’s track record of corporate social irresponsibility. We test our arguments using a longitudinal dataset of philanthropic giving (...) by U.S. firms. Our study contributes to the literature by shedding light on the role of affect in shaping the decision to allocate resources to corporate philanthropy. (shrink)

Self-locating attitudes and assertions provide a challenge to the received view of mental and linguistic intentionality. In this paper I try to show that the best way to meet this challenge is to adopt relativistic, centred possible worlds accounts for both belief and communication. First, I argue that self-locating beliefs support a centred account of belief. Second, I argue that self-locating utterances support a complementary centred account of communication. Growing powers to manipulate human bodies and minds, not merely to heal disease but to satisfy desires, control deviant behavior, and to change human nature, make urgent questions of whether and how to regulate their use, not merely to assure safety and efficacy but also to safeguard our humanity. Oversight in democratic societies rightly belongs to the polity, not merely to self-appointed experts, scientific or ethical. Volume I provides a detailed analysis of cylindric algebras, starting with a formulation of their axioms and a development of their elementary properties, and proceeding to a deeper study of their interrelationships by means of general algebraic notions such as subalgebras, homomorphisms, direct products, free algebras, reducts and relativized algebras.

Modifying a contrast introduced by Dixon, Stephen Mumford distinguishes between ‘partisan’ and ‘purist’ ways of watching sport. Recognising that the extreme partisan and extreme purist positions do not explain the nature of sports spectatorship, Mumford follows Dixon in adopting the idea of moderate partisanship. He outlines three theories of spectatorship designed to address the issue of the relationship between the partisan and the purist ways of viewing sport. The true perception theory regards the moderate fan as able to see the (...) event as it really is, rather than concentrating on an aspect. The mixture theory is the view that ‘the moderate partisan has both partisan and purist perceptions of sport in some mixed way’. Wilson and Kass talked about their book, The ethics of human cloning, which is about the ethical debate over human cloning.

This paper explores the view that, on Mumford’s account of the purist, to the degree that the purist adopts an aesthetic perspective, he or she doesn’t watch the sport in question, and to the degree that he or she does watch the sport, there is a loss of aesthetic appreciation. The idea that spectators oscillate between partisanship and purism means that the purist is unable to avoid either the Scylla of not actually watching the sport, or the Charybdis of loss (...) of aesthetic appreciation at any given point. Ultimately there seems to be both a sport-shaped hole and an aesthetic-shaped hole in Mumford’s account of the purist. It is argued that oscillation is incapable of dealing with the problem precisely because it is disjunctive in nature and entails the spectator either watching sport from an aesthetic perspective or from a partisan perspective at any given time. An alternative conception of the aesthetic is considered that offers one way of dissolving the purist’s dilemma. (shrink)

Most American young people, like their ancestors, harbor desires for a worthy life: a life of meaning, a life that makes sense. But they are increasingly confused about what such a life might look like, and how they might, in the present age, be able to live one. With a once confident culture no longer offering authoritative guidance, the young are now at sea--regarding work, family, religion, and civic identity. The true, the good, and the beautiful have few defenders, and (...) the higher cynicism mocks any innocent love of wisdom or love of country. We are super-competent regarding efficiency and convenience; we are at a loss regarding what it's all for. Yet because the old orthodoxies have crumbled, our "interesting time" paradoxically offers genuine opportunities for renewal and growth. The old Socratic question, "How to live?," suddenly commands serious attention. Young Americans, if liberated from the prevailing cynicism, will readily embrace weighty questions and undertake serious quests for a flourishing life. All they (and we) need is encouragement. This book provides that necessary encouragement by illuminating crucial (and still available) aspects of a worthy life, and by defending them against their enemies. With chapters on love, family, and friendship; human excellence and human dignity; teaching, learning, and truth; and the great human aspirations of Western civilization, it offers people who are looking on their own for meaning, and as well as to people who are looking to deepen what they have been taught or to square it with the spirit of our time. David Papineau [1999. “Normativity and Judgement.” Proceedings of the Aristotelian Society 73 : 16–43.] argues that norms of judgement pose no special problem for naturalism, because all such norms of judgement are derived from moral or personal values. Papineau claims that this account of the normativity of judgement presupposes an account of content that places normativity outside the analysis of content, because in his view any accounts of content that place normativity inside the analysis of content cannot explain the normativity (...) of judgement in the derivative way he proposes. Furthermore, he argues that normative accounts of content along those lines are independently problematic. In this paper I aim to respond to both objections, by arguing that normative accounts of content can be seen as naturalist accounts, even if they place normativity inside the analysis of content; and that normative accounts of content are compatible with a derivative account of norms of judgement of the sort Papi... We investigate and classify the notion of final derivability of two basic inconsistency-adaptive logics. Specifically, the maximal complexity of the set of final consequences of decidable sets of premises formulated in the language of propositional logic is described. Our results show that taking the consequences of a decidable propositional theory is a complicated operation. The set of final consequences according to either the Reliability Calculus or the Minimal Abnormality Calculus of a decidable propositional premise set is in general undecidable, and (...) can be -complete. These classifications are exact. For first order theories even finite sets of premises can generate such consequence sets in either calculus. (shrink)
