The review system on research with human participants in the Netherlands is characterised as a decentralised controlled and integrated peer review system. It consists of an independent governmental body, the Central Committee on Research Involving Human Subjects (or Central Committee), which regulates the review of research proposals by accredited Medical Research Ethics Committees (MRECs). The legal basis was founded in 1999 with the Medical Research Involving Human Subjects Act. The review system is a decentralised arrangement since most research proposal (...) are reviewed by the 30 accredited MRECs in the country. It is a controlled system in which the Central Committee is responsible for the accreditation and oversight of the MRECs and can make legally binding directives for these committees. The assessment of research proposals is an integrated peer review process in which all documents of the research file are reviewed by experts in one committee only. A small number of research proposals are assessed by the Central Committee and not by accredited MRECs. These proposals are on specific research categories such as gene therapy, cell therapy and embryo research. The review of research with surplus human embryos is regulated separately in the Embryos Act. The Central Committee provides support to the accredited MRECs and to researchers and sponsors. It is currently developing an internet portal to reduce the bureaucracy and make the review process more efficient and transparent. The Central Committee stimulates confidence on medical research in society by providing a public trial registry with core data on reviewed research proposals. (shrink)

As clinical ethics consultants move toward professionalization, the process of certifying individual consultants or accrediting programs will be discussed and debated. With certification, some entity must be established or ordained to oversee the standards and procedures. If the process evolves like other professions, it seems plausible that it will eventually include a written examination to evaluate the core knowledge competencies that individual practitioners should possess to meet peer practice standards. The American Society for Bioethics and Humanities has published core (...) knowledge competencies for many years that are accepted by experts as the prevailing standard. Probably any written examination will be based upon the ASBH core knowledge competencies. However, much remains to be done before any examination may be offered. In particular, it seems likely that a recognized examining board must create and validate examination questions and structure the examination so as to establish meaningful, defensible parameters after dealing with such challenging questions as: Should the certifying examination be multiple choice or short-answer essay? How should the test be graded? What should the pass rate be? How may the examination be best administered? To advance the field of health care ethics consultation, thought leaders should start to focus on the written examination possibilities, to date unaddressed carefully in the literature. Examination models—both objective and written—must be explored as a viable strategy about how the field of health care ethics consultations can grow toward professionalization. (shrink)

The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. Most often this selective prehistory entails not only an approving account of ideas that fit in with the current picture but also an effort to repress or marginalize anytíiing that fails so to fit. Bertrand Russell's History Of Western Philosophy is one fairly blatant example of mis strategy at work.1 The story it tells is a Whiggish account of how drinkers managed — against all the odds of metaphysical delusion — to come out at last (with Russell and his peers) on the high plateau oflogical consistency and truth. On the way to this dénouement Russell avails himself ofvarious techniques for pointing up die narrative drift. His coverage takes in all the accredited "major" thinkers, some of whose opinions Russell is hard put to summarize without remarking how nonsensical they appear from a modern (logical) point of view. Elsewhere — as with Leibniz or Kant — he takes the more accommodating line of winnowing out the structures of valid argument and consigning what remains to the history of dead metaphysical abstractions. It is this latter technique that has characterized the approach of analytical philosophers to the history of their discipline. The question is not so much, what did these drinkers mean or knowingly hope to achieve by posing the issues as they did? Rather it is to ask what techniques exist for translating their concerns into an up-to-date idiom based upon certain (mainly linguistic) terms of analytical enquiry. P. F. Strawson's revisionist reading of Kant is probably the best-known example of how such techniques can be used to achieve a distinctively modern understanding of otherwise recalcitrant texts.2 What remains of Kant after this cleaning-up 2 Philosophy and Literature operation is still "metaphysics" of a kind, but relieved of its excess conceptual baggage and couched (as Strawson would claim) in a "descriptive" rather than a "prescriptive" idiom. Thus philosophy comes to terms with its own errant precursors by explaining what they would presumably have said if equipped with die latest analytical tools. The result of such meuiods is to rewrite intellectual history from a standpoint of self-assured logical grasp where present concerns decide what shall count as the relevant or useful aspects ofpast tradition. And the same selective process goes to construct that typecast narrative which treats the "British" and die "Continental" styles of philosophizing as two completely separate, indeed antagonistic lines of descent. Thus it is taken for granted that the two sides are so far apart, with so little in the way of shared methods and assumptions, mat any kind of dialogue is certain to produce mere bafflement or cross-purpose talk. British philosophers with an interest in "Continental" theory feel themselves forced into a marginal role by the highly professionalized ethos that prevails within their discipline. This feeling is only strengthened by their more or less accepting the background mythology that explains how the two "traditions" grew up in a state of hostility often amounting to downright mutual contempt. There are several different versions of this story at present, but they all serve equally to reinforce the sense of incommensurable aims and languages. One (the "ordinary language" version) takes its lead from the later Wittgenstein in arguing that most of the problems that have long vexed philosophers — and continue to vex those "Continental" thinkers — result from dieir use ofa poindess metaphysicaljargon which puts them at odds with the commonsense wisdom of everyday usage. On this account, such thinkers have failed to learn the lesson bequeaüied by a long tradition of misguided speculative thought. They have persisted in errors and delusions of their own creating, hooked on a kind of malign verbal magic — "bewitchment by language," as Wittgenstein described it — which prevents them from seeing the plain sense ofthings. Predatory journals operate as vanity presses, typically charging large submission or publication fees and requiring little peer review. The consequences of such journals are wide reaching, affecting the integrity of the legitimate journals they attempt to imitate, the reputations of the departments, colleges, and universities of their contributors, the actions of accreditation bodies, the reputations of their authors, and perhaps even the generosity of academic benefactors. Using a stakeholder analysis, our study of predatory journals suggests that most stakeholders (...) gain little in the short run from such publishing and only the editors or owners of these journals benefit in the long run. We also discuss counter-measures that academic and administrative faculty can employ to thwart predatory publishing. (shrink)

Recently, there has been a focus on ethics education in STEM and business programs. Scholars, industry representatives, and accreditation bodies have identified ethics education as an element that requires renewed strategies to create better prepared professionals. In this paper, the author argues the importance of educating future technology and business professionals in constructive confrontation, conflict resolution, and creative problem solving. In addition, students need to be provided tools to become self-aware so they can be more assertive in their everyday (...) lives which will lead to more confident decision-making. Ethics curriculum in all fields should provide discussion regarding the normalcy and essential nature of confrontation. Without knowledge and practice of strategy when confrontation is needed, students will be less likely to act when faced with questionable situations in their professional lives. It is the foundation of the distinction we make between journalism and literature, between history and fiction. Literature, Aristotle proposes, (...) is about things that could happen, not about things that have taken place in reality. Literature is thus inscribed in the realm of the imagination. However, imagination does not operate in an epistemological vacuum. A fictional text entertaining no relation with the world would have no meaning. Perhaps giants, dragons and witches do not really exist, and perhaps it is not really possible to cover seven miles with each step of those wonderful boots that Tom Thumb discovered. But we have no difficulty in imagining those things, precisely because they entertain an intimate relationship with forms and things, events and actions that happen in daily life. The details of the relationship between reality and fiction are less important for the present argument than the fact that fiction is embedded in our pragmatic attitudes. 1 Ernst Bloch has given this human tendency a name: The Hope Principle. Our desire for a better world expresses itself in hope, a distinctive feature of the species Homo Sapiens. The importance of the imagination in the project of humanity has received eloquent and systematic treatment in the philosophical work of Hans Vaihinger and Helmuth Plessner. 2 Imagination also gives impetus to history, because it drives us toward the realization of aims and plans that initially lived only in our hearts and minds: “Someone dreaming never remains in the same place.” 3 [End Page 276]Similar things have been asserted about literature, by Horace, Sidney, Matthew Arnold, and others. Reading is supposed to make us better humans, heightening our awareness, increasing our sensibility, and thus indirectly guiding our actions toward the establishment of a better world. Sometimes noble motives are associated with this function. Reading literature, it is then assumed, makes the reader more socially tolerant, more perceptive about other humans, and more politically conscious. This is the so-called Edification Hypothesis. Anthony Savile sums up this view when he submits the thesis that literature has a unique power to make us understand the thoughts and feelings of other human beings. This ethical perspective on literature has been expressed since Greek Antiquity. 4 It will be remembered that Plato condemned literature precisely for this reason: because it diverts our attention from the real world, itself already an imperfect reflection of Pure Ideas. Aristotle rejects this view and develops a theory squarely opposed to that of his teacher. According to him, literature contributes to the elevation of mankind, to paideia. By showing us that which is possible, and by involving us in the inescapable passage of tragic events, readers and spectators are drawn into emotions of fear and compassion, emotions that lead to katharsis, a process that purifies us of megalomania (hubris), safeguarding democratic government and protecting us from unrestrained tyranny. 5The Aristotelian view that literature has an edifying effect had been generally present in Western tradition till about 1800. Until then literature was viewed almost universally as an ethical category. In this article we offer an ontological theorization of care. The article interrogates the self-evident quality of everyday meanings for ‘care’ that might be generated from psychological or biological discourses; we aim to question the way that ‘care’ is applied in a technical or an emotional sense within the field of early childhood education. The article works towards offering a new theorization that does not treat the meaning of ‘care’ as self-evident. If ‘care’ is a way of addressing concern for (...) ourselves as human beings, we think that deepening the theoretical parameters of this concept will add to how we understand the complexity of gender and race relations. By articulating Heidegger’s use of ‘care’ and comparing it to Irigaray’s critique of Heidegger’s work on this concept, we hope to enable professionals and families to view conceptions of ‘care’ outside the familiar definitions applied in everyday discourse. The article treats early childhood education professional practice as an instance of how both gender and race delimit the way in which human relationships can be understood. (shrink)

The implementation in 2009–10 of the Early Years Learning Framework (EYLF) spearheaded the efforts of the Australian Commonwealth government to institute a national curriculum. The theme of the new early childhood framework follows three guiding concepts: Belonging, Being and Becoming. In this article, we discuss these three concepts in order to provide a theoretical context to the Early Years Learning Framework and to enrich the debate surrounding its writing and implementation. In particular, we address the significance of posing Belonging in (...) contiguity with the concepts of Being and Becoming. The authors suggest a strategy to cultivate a deeper appreciation of the dialectical relationships between sameness and difference, belonging and nothingness. Our premise is that ‘belonging’ refers essentially to different beings, and implicitly to the prospect of a ‘together-ness’ or identity according to which different beings are located, understood and associated, in order that Becoming can take effect. We offer these commentaries as a means of deepening conversation about the importance of scholarly approaches to philosophy for early childhood research, and especially with respect to curriculum and pedagogy. Much is said about Middle Eastern and North African publics opposing gender equality, often referring to patriarchal Islam. However, nuanced large-scale studies addressing which specific aspects of religiosity affect support for gender equality across the MENA are conspicuously absent. This study develops and tests a gendered agentic socialization framework that proposes that MENA citizens are not only passively socialized by religion but also have agency. This disaggregates the influence of religiosity, highlights its multifacetedness, and theorizes the moderating roles that gender (...) and sociocognitive empowerment play via gendered processes of agentic dissociations. Using 15 World Values Surveys and multilevel models, our analyses show that most dimensions of religiosity fuel opposition to gender equality. However, the salience of religion in daily life is found to increase women’s support for gender equality and cushion the negative impact of religious service attendance. Also, gender and education moderate the impacts of several religiosity dimensions; for instance, women’s support for gender equality more sharply declines with increased service attendance than men’s. Altogether, this study finds that religious socialization is multifaceted and gendered, and that certain men and women are inclined and equipped to deviate from dominant patriarchal religious interpretations. This article addresses the phenomenology of aesthetic experience. It first, critically, considers one of the most influential approaches to the psychophysics of aesthetic perception, viz. neuroaesthetics. Hereafter, it outlines constitutive tenets of aesthetic perception in terms of a particular intentional relation to the object. The argument comes in three steps. First, I show the inadequacies of the neuroaesthetics of beauty in general and Semir Zeki’s and V.J. Ramachandran’s versions of it in particular. The neuroaesthetics of beauty falls short, because it (...) develops hypotheses of aesthetic experience which have no consequences for the understanding of what art is, that is, how artists produce visual meaning effects in their works. This is so because they make the rewarding feeling of beauty the cornerstone of aesthetic experience. Next, I show why and how aesthetic experience should be defined relative to its object and the tools for meaning-making specific to that object, and not relative to the feeling (of beauty) it may elicit. This paper provides a précis of Ernst Cassirer’s concept of art as a symbolic form. It does so, though, in a specific respect. It points to the fact that Cassirer’s concept of “symbolic form” is two-sided. On the one hand, the concept captures general cultural phenomena that are not only meaningful but also manifest the way man makes sense of the world; thus myth, religion, and art are considered general symbolic forms. On the other hand, it captures the formal structures (...) and semiotic tools thanks to which meaning is constructed within each general symbolic form ; thus, in art, perspective or the golden section are well-known examples of symbolic forms, now in a narrow sense, i.e. they are means to configure parts into an organized, meaningful whole. The paper will comment on art along both these two dimensions, but its main goal is to provide with concrete examples of aesthetic symbolic forms in the narrow sense in order to show how conceptual meaning can be inscribed in the space of aesthetic intuition. Conservation and exhibition of historical works of art run many risks of misrepresentation of the life and meanings of objects. This paper explores the identities of some particularly compelling examples of Byzantine art restored under special circumstances at the Menil Collection in Houston, Texas. This examination of the restoration of frescos and icons, and their particular display histories, reveals the contingencies of our encounters with and explanations of historical art.

This article discusses two well‐known texts that respectively describe learning and teaching, drawn from the work of Freud and Plato. These texts are considered in psychoanalytic terms using a methodology drawn from the philosophy of Luce Irigaray. In particular the article addresses Irigaray's approach to the analysis of speech and utterance as a ‘cohesion between the source of the utterance and the utterance itself’ (Hass, 2000). I apply this approach to ask whether educational tradition has fractured the relationship between pedagogy (...) and the body of the teacher/pupil. Teaching and learning are re‐addressed in ways that challenge the gender‐neutral representation of pedagogy as a systematic technique. (shrink)

The gradual development of European Union (EU) immigration and asylum law has been characterized by two related, ongoing tensions: the conflict between EU competence in this field and national sovereignty, and the friction between immigration control and the protection of human rights. The EU's approach to resolving the two key tensions in this area are assessed by examining the four key subjects addressed by immigration law: visas and border controls, irregular migration, legal migration, and asylum. The European Union has been (...) more active in the fields of visas and border controls than in any other area of immigration and asylum law owing to the early development of a legal framework, originally in the form of the Schengen Convention. Plutarch’s exuberant writings reaped praise in both antique and modern times. Various aspects of his work have been amply studied and analysed, yet some remain less discussed. This paper therefore aims to contribute to the ongoing research of his works by examining Plutarch’s references to stasis in general, and more particularly to the Roman civil wars. Plutarch lived through the civil wars of 69 CE, and although he did not suffer by experiencing them directly, these events no doubt contributed to (...) his views on the role of stasis and civil war, especially in Roman history. While Plutarch does not openly express his convictions on these events, especially not on contemporary occurrences, civil unrest is nevertheless a deliberate and significant theme in all of his writings. This paper presents various examples from Plutarch’s work which illuminate his particular understanding of Roman civil dissension and the ways in which he cleverly and meticulously approached this issue, being aware of the threat it may have posed him during the principate. In this article I examine the opposing ethical forces that animated Heidegger’s brief foray into Nazism, to ask whether the same forces continue to be found in the technocratized university described by Bill Readings. I address Heidegger’s own philosophy as a context in which (...) these conflicting ethical forces are confronted, using metaphorical references to Pollyanna and Cujo. This absorption of literary allusions within a contribution to educational philosophy seeks deliberately to break the stranglehold that empiricism has on the discipline of education. It regards the hegemony of empiricism as an ideological fetishism. I am using the work of Jacques Derrida to deconstruct the idea of the university, with Heidegger’s political opportunism as symptomatic of current patterns of self-marketing, self-promotion, and entrepreneurialism amongst academics.
