In the past decade, digital technology, fiber optics, cellular phones, satellite television, home computers, and the Internet have substantially transformed business, education, and leisure practices. These technologies are becoming so integrated into our daily routines that their ubiquity often goes unnoticed. We are, nonetheless, in the midst of a telecommunications revolution, and the healthcare industry is becoming a major player. The burgeoning field of home-based telemedicine is evidence of this.

Some critiques of cybermedicine claim that it is problematic because it fails to create physician–patient relationships. But, electronically mediated encounters do create such relationships. The issue is the nature and quality of those relationships and whether they are conducive to good patient care and meet the ethical ideals and standards of medicine. In this paper, I argue that effective communication and compassion are, in most cases, necessary for the establishment of trusting and morally appropriate physician–patient relationships. The creation of these (...) relationships requires patients and physicians to take psychological and emotional risks and to make commitments to each other. The problem is that by altering the form and content of verbal and non-verbal behaviors and by limiting the kinds of interactions that can take place, cybermedicine makes risk-free interactions easier and more commonplace and retards the development of physician compassion and patient trust. In doing so, cybermedicine encourages morally inappropriate physician–patient relationships. I argue that Merleau-Ponty''s notion of embodiment and Kierkegaard''s criticisms of disinterested reflection help us to understand how cybermedicine can undermine patient health and well being and why it should be seen as a possible threat to the moral integrity of physician–patient relationships. Based on a general review of international, representative tissue banking policies that were described in the medical, ethics, and legal literature, this paper reviews the range of standards, both conceptually and in existing regulations, relevant to four main factors:(1) commercialization, (2) confidentiality, (3) informed consent, and (4) quality of research. These four factors were selected as reflective of some of the major ethical considerations that arise in the conduct of tissue banking research. The authors emphasize that any policy or ethical (...) guidelines designed to regulate tissue bank research should address all four factors. Whenever this sort of research is conducted between several institutions or several countries, the paper suggests that the relevant entities work collaboratively to harmonize their standards. People living in rural areas make up 20 percent of the U.S. population, but only 9 percent of physicians practice there. This uneven distribution is significant because rural areas have higher percentages of people in poverty, elderly people, people lacking health insurance coverage, and people with chronic diseases. As a way of ameliorating these disparities, e-health initiatives are being implemented. But the rural e-health movement raises its own set of distributive justice concerns about the digital divide. Moreover, even if the (...) digital divide is overcome, e-health services may be of an inferior quality compared to face-to-face medical encounters. In this paper, I argue that before we can fully understand the distributive justice implications of e-health, we must first understand what distributive justice means. I argue that five elements—fairness, quality, accessibility, availability, and efficiency—constitute a general conception of justice and that all of these elements must be considered when evaluating e-health for rural health profession shortage areas. In doing so, it may be necessary to make important tradeoffs among these elements. I then examine the development of e-health programs in light of Rawls’s principle of equal opportunity and Daniels’s notion of species-typical functioning. I conclude that in the context of e-health, Rawls’s principle should be expanded to include geography as a prima facie morally relevant criterion for allocating healthcare benefits. I also conclude that Daniels’s notion of species-typical functioning provides grounds for thinking of health and some healthcare services as special goods. (shrink)

After decades of specialization within the sciences, the development and application of implantable microchips and biosensors are now being made possible by a growing convergence among seemingly disparate scientific disciplines including, among others, biology, informatics, chemistry, and engineering. This convergence of diverse scientific disciplines is the basis for the creation of new technologies that will have significant medical potential. As of today, implantable microchips and biosensors are being used as mental prostheses to compensate for a loss of normal function, to (...) remotely monitor patients' vital signs, to control the delivery of medications, and to communicate with geographically distant healthcare professionals and the outside environment. This is simply a matter of fact, at least for the Western world. But, as a question of value, what are the ethical and social ramifications of this healthcare trek? One million cases of child maltreatment and twelve hundred child deaths due to abuse and neglect occur per year. But since many cases of abuse and neglect remain either unreported or unsubstantiated due to insufficient evidence, the number of children who are abused, neglected, and killed at the hands of family caregivers is probably higher. One approach to combat child abuse in the U.K. has been the employment of hospital-based covert video surveillance (CVS) to monitor parents suspected of Munchausen Syndrome (...) by Proxy (MSBP). The use of CVS, however, raises concerns about voluntary informed consent, research on human subjects, privacy, and the appropriateness of healthcare providers to conduct CVS. More broadly, the use of CVS raises concerns about the ethical life of healthcare institutions and their moral obligations to the families and communities they serve. The U.K. protocol for CVS is examined in light of these concerns. Three alternative CVS protocols and two procedures for selecting a protocol are then proposed for use in the U.S. The paper concludes that any CVS protocol selected for use by hospitals ought to be selected by means of open and democratic processes that permit community input and, subsequently, the possibility of a consensus on the moral status and scope of CVS. Boys, Boyz, Bois concerns questions of ethics, gender and race in popular American images, national discourse and cultural production by and about black men. The book proposes an ethics of masculinity, as ethnics refers to a system of morality and valuation and as ethics refers to a care of the self and ethical subject formation. The texts of analysis include recent films by black/African American filmmakers, gansta rap and hip-hop and black star persona: texts ranging from Blaxploitation and New Black (...) Cinema to contemporary music video to autobiography and the public image of Sidney Poitier. The book is a significant contribution to cultural studies and gender studies and critical race theory. What is distinctive about the book is the question of ethics as a question of race and gender. (shrink)

This chapter discusses the nature of software maintenance in light of software’s ontological status. A realist view of software need not commit us to the otiose position that software maintenance is impossible. Many philosophers and computer scientists have been concerned with drawing attention to software’s dual nature, its being both symbolic and physical, abstract and concrete. There are strong connections to be found between this topic and recent investigations in the philosophy of linguistics, particularly the metaphysics of words. It is (...) shown, contra Irmak, that software can be best understood through a realist type-token distinction employing an ontology of composite objects that was put forward by Katz. This approach employs both non-spatiotemporal abstract types and tokens of those types. Further developing Katz’s realist approach can help to make better sense of the dual nature of computational artefacts and their maintenance than the alternatives outlined. Young claims that a prevalent imbalanced view of maintenance as solely conservative is due to a misunderstanding of the nature of artefacts as being realisations of their producers’ intentions. This is a problem for theories of artefacts that employ intentions, such as the one involved with the realist view of software and software maintenance. Software maintenance on this view is not solely conservative but also adaptive and enhancive, constituting a source of counterexamples to Young’s claim. An alternative explanation of the imbalanced view is provided, based on observations by software engineers, especially Sommerville. (shrink)

Contextualism has been hotly debated in recent epistemology and philosophy of language. The Case for Contextualism is a state-of-the-art exposition and defense of the contextualist position, presenting and advancing the most powerful arguments in favor of the view and responding to the most pressing objections facing it.

A Naive Realist Theory of Colour defends the view that colours are mind-independent properties of things in the environment, that are distinct from properties identified by the physical sciences. This view stands in contrast to the long-standing and wide-spread view amongst philosophers and scientists that colours don't really exist - or at any rate, that if they do exist, then they are radically different from the way that they appear. It is argued that a naive realist theory of colour best (...) explains how colours appear to perceiving subjects, and that this view is not undermined either by reflecting on variations in colour perception between perceivers and across perceptual conditions, or by our modern scientific understanding of the world. A Naive Realist Theory of Colour also illustrates how our understanding of what colours are has far-reaching implications for wider questions about the nature of perceptual experience, the relationship between mind and world, the problem of consciousness, the apparent tension between common sense and scientific representations of the world, and even the very nature and possibility of philosophical inquiry. This paper uses the knowledge account of assertion (KAA) in defense of epistemological contextualism. Part 1 explores the main problem afflicting contextualism, what I call the "Generality Objection." Part 2 presents and defends both KAA and a powerful new positive argument that it provides for contextualism. Part 3 uses KAA to answer the Generality Objection, and also casts other shadows over the prospects for anti-contextualism.

This article presents the case for an approach to consciousness that I call illusionism. This is the view that phenomenal consciousness, as usually conceived, is illusory. According to illusionists, our sense that it is like something to undergo conscious experiences is due to the fact that we systematically misrepresent them as having phenomenal properties. Thus, the task for a theory of consciousness is to explain our illusory representations of phenomenality, not phenomenality itself, and the hard problem is replaced by the (...) illusion problem. Although it has had powerful defenders, illusionism remains a minority position, and it is often dismissed as failing to take consciousness seriously. This article seeks to rebut this accusation. It defines the illusionist programme, outlines its attractions, and defends it against some common objections. It concludes that illusionism is a coherent and attractive approach, which deserves serious consideration. (shrink)

This paper applies social-relational models of moral standing of robots to cases where the encounters between the robot and humans are relatively brief. Our analysis spans the spectrum of non-social robots to fully-social robots. We consider cases where the encounters are between a stranger and the robot and do not include its owner or operator. We conclude that the developers of robots that might be encountered by other people when the owner is not present cannot wash their hands of responsibility. (...) They must take care with how they develop the robot’s interface with people and take into account how that interface influences the social relationship between it and people, and, thus, the moral standing of the robot with each person it encounters. Furthermore, we claim that developers have responsibility for the impact social robots have on the quality of human social relationships. (shrink)

Einem Vorschlag Hegels folgend ging es um eine Auseinandersetzung mit den "Prinzipien des Schonen" bei Kant. Nach anonymer Bewertung der eingegangenen Arbeiten wurde die von Bruno Bauer mit dem Preis geehrt. Wahrend die im Laufe der Jahre gestellten Aufgaben und erteilten Gutachten fast vollstandig erhalten sind, ist das Vorhandensein der von Bauer handschriftlich in lateinischer Sprache verfaten Arbeit (...) eine wissenschaftliche Raritat. Diese Schrift, deren Original sich im Archiv der Humboldt-Universitat zu Berlin befindet, wird hier erstmals publiziert. Eingeleitet durch eine philosophiegeschichtliche Betrachtung der Quelle (D. Moggach) und eine historische Einordnung der Preisschrift (W. Schultze) gestattet die synchrone Gegenuberstellung von lateinischem und deutschem Text dem Leser ein kritisches Studium der Quelle. Dieser Band soll den Auftakt fur weitere Publikationen wissenschaftlich und wissenschaftshistorisch interessanter Quellen des Archivs der Humboldt-Universitat bilden. (shrink)

My focus will be on Richard Feldman’s claim that what we epistemically ought to believe is what fits our evidence. I will propose some potential counter-examples to test this evidentialist thesis. My main intention in presenting the “counter-examples” is to better understand Feldman’s evidentialism, and evidentialism in general. How are we to understand what our evidence is, how it works, and how are we to understand the phrase “epistemically ought to believe” such that evidentialism might make sense as a plausible (...) thesis in light of the examples? Of course, we may decide that there’s no such way to understand evidentialism—that it just isn’t a plausible thesis. I must admit that my suspicions lean in that direction. But the potential counter-examples are put forward, not in a refutational spirit, but as an invitation to evidentialists and potential evidentialists to refine and/or explain their thesis in light of the at least apparent problems that the examples highlight. In this article I examine the architecture and architectural thinking of Finnish Academician Reima Pietilä in relation to his design methodology. Pietilä was an architect with an original, creative, artistic personality, who set out early in his career to develop the form language, and theory of modern architecture, moving it towards an organic expressionism. Finnish nature mysticism was a source of inspiration for him, and ‘nature architecture’ one of his key concepts.

This book examines the politics of diversity, and explores potential sources of support for an inclusive solidarity, in particular political sources of solidarity.

Recently some bioethicists and neuroscientists have argued for an imperative of chemical cognitive enhancement. This imperative is usually based on consequentialist grounds. In this paper, the topic of cognitive self-enhancement is discussed from a Kantian point of view in order to shed new light on the controversial debate. With Kant, it is an imperfect duty to oneself to strive for perfecting one’s own natural and moral capacities beyond one’s natural condition, but there is no duty to enhance others. A Kantian (...) approach does not directly lead to a duty of chemical cognitive self-enhancement, but it also does not clearly rule out that this type of enhancement can be an appropriate means to the end of self-improvement. The paper shows the benefits of a Kantian view, which offers a consistent ideal of self-perfection and teaches us a lesson about the crucial relevance of the attitude that underlies one’s striving for cognitive self-improvement: the lesson of treating oneself as an end in itself and not as mere means to the end of better output. In epistemology, “contextualism” denotes a wide variety of more-or-less closely related positions according to which the issues of knowledge or justification are somehow relative to context. I will proceed by first explicating the position I call contextualism, and distinguishing that position from some closely related positions in epistemology, some of which sometimes also go by the name of “contextualism”. I’ll then present and answer what seems to many the most pressing of the objections to contextualism as I construe it, and (...) also indicate some of the main positive motivations for accepting the view. Among the epistemologists I’ve spoken with who have an opinion on the matter, I think it’s fair to say a majority reject contextualism. However, the resistance has to this point been largely underground, with little by way of sustained arguments against contextualism appearing in the journals,[i] though I have begun to see various papers in manuscript form which are critical of contextualism. Here, I’ll respond the criticism of contextualism that, in my travels, I have found to be the most pervasive in producing suspicion about the view. (shrink)

Mind and Supermind offers an alternative perspective on the nature of belief and the structure of the human mind. Keith Frankish argues that the folk-psychological term 'belief' refers to two distinct types of mental state, which have different properties and support different kinds of mental explanation. Building on this claim, he develops a picture of the human mind as a two-level structure, consisting of a basic mind and a supermind, and shows how the resulting account sheds light on a (...) number of puzzling phenomena and helps to vindicate folk psychology. Topics discussed include the function of conscious thought, the cognitive role of natural language, the relation between partial and flat-out belief, the possibility of active belief formation, and the nature of akrasia, self-deception and first-person authority. Addressing Merleau-Ponty's work Phenomenology of Perception, in dialogue with The Visible and the Invisible, his lectures at the Collège de France, and his reading of Proust, this book argues that at play in his thought is a philosophy of “ontological lateness”. This describes the manner in which philosophical reflection is fated to lag behind its objects; therefore an absolute grasp on being remains beyond its reach. Merleau-Ponty articulates this philosophy against the backdrop of what he calls “cruel thought”, a style (...) of reflecting that seeks resolution by limiting, circumscribing, and arresting its object. By contrast, the philosophy of ontological lateness seeks no such finality-no apocalypsis or unveiling-but is characterized by its ability to accept the veiling of being and its own constitutive lack of punctuality. To this extent, his thinking inaugurates a new relation to the becoming of sense that overcomes cruel thought. Merleau-Ponty's work gives voice to a wisdom of dispossession that allows for the withdrawal of being. Never before has anyone engaged with the theme of Merleau-Ponty's own understanding of philosophy in such a sustained way as Whitmoyer does in this volume. (shrink)
