Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

I respond to Karin de Boer, Thomas Land, and Claudio La Rocca’s comments on Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023). I first provide a quick outline of some of the main claims I make in the book. I then directly address their criticisms, which I group into three categories. The first group of comments raises doubts concerning my characterization of the central tasks of the critique of pure reason. The second targets the fact that (...) I downplay faculty analysis as an essential characteristic of the critique. The third has to do with my claim that the Critique of Pure Reason aims to show that metaphysics is capable of architectonic unity, where this unity is only achievable when we construe metaphysics according to the worldly concept of philosophy. The Simple Counterfactual Analysis (SCA) was once considered the most promising analysis of disposition ascriptions. According to SCA, disposition ascriptions are to be analyzed in terms of counterfactual conditionals. In the last few decades, however, SCA has become the target of a battery of counterexamples. In all counterexamples, something seems to be interfering with a certain object’s having or not having a certain disposition thus making the truth-values of the disposition ascription and of its associated counterfactual come apart. Intuitively, however, (...) it would seem that, if all interferences were absent, the disposition ascription and its associated conditional would have the same truth-value. Although this idea may seem obvious, it is far from obvious how to implement it. In fact, it has become widely assumed that the content of qualifying ceteris paribus clauses (such as ‘if all interferences were absent’) cannot be specified in a clear and non-circular manner. In this paper, I will argue that this assumption is wrong. I will develop an analysis of disposition ascriptions, the Interference-Free Counterfactual Analysis, which relies on a clear and non-circular definition of the notion of interference and avoids the standard counterexamples to SCA while vindicating the intuition that disposition ascriptions and counterfactual conditionals are intimately related. The social virtues are not discussed thematically in the Socratic writings of Plato and Xenophon, but they are on display everywhere. Taking Aristotle's accounts of these virtues as a touchstone, this paper explores the portrait of Socrates as a model of good humour in Xenophon's Symposium. While Xenophon is addressing the same issues as Aristotle, and shares some of his red lines, his conception of the ideal humourist and of virtue in general differs from Aristotle's not only in detail but (...) also in general conception. While he never actually violates the rules Aristotle sets down for eutrapelia, Xenophon's Socrates strives not to avoid opposites but to combine them. It is the careful combining of the spoudaion and the geloion that redeems Xenophon's otherwise outrageous portrait of Socratic humour. This suggests a broader paradigm in which virtuous behaviour is a combination of opposites rather than a middle path. (shrink)

This discussion of pride, shame, and guilt centers on the beliefs involved in the experience of any of these emotions. Through a detailed study, the author demonstrates how these beliefs are alike--in that they are all directed towards the self--and how they differ. The experience of these three emotions are illustrated by examples taken from English literature. These concrete cases supply a context for study and indicate the complexity of the situations in which these emotions usually occur.

This article aims to offer a fresh analysis of two passages in the extensive necromancy episode in Lucan's Bellum Ciuile: the ritual to reanimate the dead soldier's corpse (6.667–73), and the surgical procedure Erichtho then proceeds to undertake (6.750–7), resembling the practice of a vivisection. The study will focus mostly on the strong connection of magic to medical traditions in antiquity, with a commentary on, and analysis of, these verses through the lenses of medical vocabulary, themes and motifs. This essay undertakes an examination that combines a reconstruction of Hegel’s system of needs with a critical analysis of that system. The reconstruction begins by unraveling the philosophical framework Hegel uses in his Philosophy of Right. It presents the evolution of abstract right and morality towards an ethical life and explains why a civil society becomes nec-essary. Furthermore, it explores the interconnectedness of individuals in the system of needs and how freedom may actualize in civil society based on Hegel’s work. (...) Following the recon-struction and the moments of reason in a free-market society, the paper takes a critical point of view upon the system presented by Hegel. It predominantly follows the critique of Marx and demonstrates how, in a free-market society, the freedom provided is only a formal one. In the second part of the critique, the scope of the paper opens up to further points of criticism against a system of needs, especially how sustainability and global inequality may develop on a international scale without any limitations in a globalized market. The essay ties back said points of criticism into Hegel’s philosophy and presents where they were already indicated in Hegel’s philosophy and how they stay relevant all the way up until modern times. Public reason liberalism is defined by the idea that laws and policies should be justifiable to each person who is subject to them. But what does it mean for reasons to be public or, in other words, suitable for this process of justification? In response to this question, Kevin Vallier has recently developed the traditional distinction between consensus and convergence public reason into a classification distinguishing three main approaches: shareability, accessibility and intelligibility. The goal of this paper is to defend (...) the accessibility approach by demonstrating its ability to strike an appealing middle course in terms of inclusivity between shareability and intelligibility. We first argue against Vallier that accessibility can exclude religious reasons from public justification. Second, we use scientific reasons as a case study to show that accessibility excludes considerably fewer reasons than shareability. Throughout the paper, we connect our discussion of accessibility to John Rawls’s model of public reason, so as to give substance to the accessibility approach and to further our understanding of Rawls’s influential model. Famously, in the essay Inquiry Concerning the Distinctness of the Principles of Natural Theology and Morality (Prize Essay), Kant attempts to distance himself from the Wolffian model of philosophical inquiry. In this respect, Kant scholars have pointed out Kant’s claim that philosophy should not imitate the method of mathematics and his appeal to Newton’s “analytic method.” In this article, I argue that there is an aspect of Kant’s critique of the Wolffian model that has been neglected. Kant presents a powerful (...) attack of the idea that philosophy should proceed through the analysis of concepts and argues that we should give up the aim of arriving at “complete” concepts as one of its fundamental desiderata. Importantly, this attack of philosophy conceived as conceptual analysis is distinctive and original if one compares it with Kant’s critique of analysis in the Critique of Pure Reason, which rests on the idea that analysis is insufficient to ground substantial metaphysical truths. I also make an additional point: Scholars have debated whether the appeal to Newton’s analytic method involves a form of empiricism. I submit that this debate is ill-conceived because Kant uses a notion of “given concepts” that is indeterminate with respect to their a priori or a posteriori status. (shrink)

Introduction Hume asks, "What is our idea of necessity, when we say that two objects are necessarily connected together"? He later says that he has answered this question, but it is difficult to see what his answer is, or even to see precisely what the question was. Currently there are two main ways of understanding Hume's views about our idea of necessary (...) connection. These interpretations divide on the question whether Hume allows that we can speak meaningfully of an objective and necessary connection between two events. The one interpretation, which I will call epistemological, says that Hume does allow meaning to that phrase. On this view, justification is the only topic of Hume's negative message about necessary connection. We can mean what we say when we talk about necessary connection, but we cannot justify what we (meaningfully) say. That, according to this interpretation, is the negative outcome toward which Hume aims his investigation of the origin of our idea of necessary connection. He isn't denying we have that very idea; he is denying that its origin allows us to justify applying it to anything. The other interpretation, which I will call psychological, says that Hume does not allow meaning to the phrase, "an objective and necessary connection between two events." According to this interpretation, once we see the origin of our idea of necessary connection, we realize that we cannot mean by "necessary connection" what we thought we meant. Those words allow us to speak only of a certain 218 feeling in our minds, not of an objective feature of the world. Of course, the psychological interpretation partly resembles the epistemological one: it, too, denies that we can justify saying objective necessary connections exist. But on the psychological interpretation this follows a fortiori from the central negative claim, a claim which itself concerns meaning, not justification. In what follows, I will present these two interpretations more carefully and critically, and then I will advance my own. I think Hume was trying to express a view very different in kind from either of the two I've just mentioned. I think we can get a good idea of the kind of view Hume had by looking at Newton's treatment of gravitational force. Roughly, Newton thought that while there certainly are gravitational forces in objects, we can say nothing about them except that they are whatever it is that accounts for a specific set of observable regularities. Hume's views about necessary connection, or causal power, are roughly parallel. He does not doubt that we may speak meaningfully of objective necessary connections — rE we mean just some unknown quality in objects that underlies the constant conjunction of their sensible qualities. Inevitably we try to mean something more than this, but any such attempt is doomed to failure. Showing that we cannot mean something more is the point of investigating the origin of the "idea." I will be arguing that with this interpretation we can handle the sets of texts and problems that undercut the prevailing two interpretations, and reconcile those sets of texts with one another, despite their apparent inconsistency. This interpretation also has the advantage of attributing to Hume a view closely connected with a 219 distinctively eighteenth-century way of setting up these problems. Finally, I think the interpretation brings out nicely an instructive and central failing of Hume's views about necessary connection. 2. The Epistemological View Although there are hints of this kind of interpretation in other books, it is really articulated and defended only in Barry Stroud's book, 2 Hume. In what follows here, I mean to be sketching out and commenting on that interpretation. Hume wants to find out what our idea of necessary connection is. He conducts his investigation according to the dictum, "as we have no idea, that is not deriv'd from an impression, we must find some impression, that gives rise to this idea of necessity, if we assert we have really such an idea." Interpretations of Kant’s account of the forms of “taking-to-be-true” (Fürwahrhalten) have generally focused on three such forms: opinion (Meinung), belief (Glaube), and knowledge (Wissen). A second distinction that has received comparatively less attention is that between conviction (Überzeugung) and persuasion (Überredung). Kant appears to use the distinction between the subjective and the objective sufficiency of a taking-to-be-true to characterize all of these forms. However, it is impossible to account for the differences between them by relying on this latter distinction alone. (...) In turn, this makes it difficult to fit all of these forms into a single classification of taking-to-be-true. In this chapter, I propose a new approach to conviction and persuasion that dissolves these problems. Conviction and persuasion are not single forms of taking-to-be-true with distinctive characteristics, yet it is not useful to treat them as “classes” of taking-to-be-true either. Rather, they are “operators” that determine whether a taking-to-be-true is apt or inapt, depending on whether it rests on a correct evaluation of the grounds we have. (shrink)

The certainty of the personal premises is secured in the second meditation. The certainty of the causal premises, I argue, Arises from their central role in generating reasons for doubt of the kind that interest descartes.

This essay calls attention to a set of linguistic interactions between counterfactual conditionals, on one hand, and possibility modals like could have and might have, on the other. These data present a challenge to the popular variably strict semantics for counterfactual conditionals. Instead, they support a version of the strict conditional semantics in which counterfactuals and possibility modals share a unified quantificational domain. I’ll argue that pragmatic explanations of this evidence are not available to the variable analysis. And putative counterexamples (...) to the unified strict analysis, on careful inspection, in fact support it. Ultimately, the semantics of conditionals and modals must be linked together more closely than has sometimes been recognized, and a unified strict semantics for conditionals and modals is the only way to fully achieve this. From mass murder to genocide, slavery to colonial suppression, acts of atrocity have lives that extend far beyond the horrific moment. They engender trauma that echoes for generations, in the experiences of those on both sides of the act. Gabriele Schwab reads these legacies in a number of narratives, primarily through the writing of postwar Germans and the descendents of Holocaust survivors. She connects their work to earlier histories of slavery and colonialism and to more recent events, such as South (...) African Apartheid, the practice of torture after 9/11, and the "disappearances" that occurred during South American dictatorships. Schwab's texts include memoirs, such as Ruth Kluger's _Still Alive_ and Marguerite Duras's _La Douleur_; second-generation accounts by the children of Holocaust survivors, such as Georges Perec's _W_, Art Spiegelman's _Maus_, and Philippe Grimbert's _Secret_; and second-generation recollections by Germans, such as W. G. Sebald's _Austerlitz_, Sabine Reichel's _What Did You Do in the War, Daddy?_, and Ursula Duba's _Tales from a Child of the Enemy_. She also incorporates her own reminiscences of growing up in postwar Germany, mapping interlaced memories and histories as they interact in psychic life and cultural memory. The idea that healthcare should become more person-centred is extremely influential. By using recent English policy developments as a case study, this article aims to critically analyse an important element of person-centred care, namely, the belief that to treat patients as persons is to think that care should be ‘co-produced’ by formal healthcare providers and patients together with unpaid carers and voluntary organizations. I draw on insights from political philosophy to highlight overlooked tensions between co-production and values like equality and (...) liberty. Regarding equality, I argue that co-production compounds both problems of gender inequality in the distribution of care labour and the challenges associated with securing equal access to care. Turning to liberty, I identify important commonalities between co-production and republicanism in political philosophy, given their shared insistence on common citizens’ civic virtue. Then, I use against co-production some liberal arguments against republicanism, to highlight a problem of over-demandingness. In bringing my argument to a close, however, I wish to caution against hastily rejecting co-production as a policy programme. (shrink)

He took it that there are things about these products of experience that need to be explained, and as a scientist of man he aimed (...) to provide the needed explanation by finding principles that govern the operations of the mind. In what follows I want to consider Hume's account of general ideas, and I want especially to raise the question what it is about them that he wants to explain. In order to see what Hume thinks he should explain about our general ideas, we need first to see what sort of explanatory resources he thinks are available. In the introduction to the Treatise, he proposes to undertake a study of human nature, a study of the particular kind that he calls science of man. He is going to study the human mind using "careful and exact experiments"1 gleaned up from a "cautious observation of human life" as it appears in the "common course of the world" (T xix). The outcome will be the discovery of "principles," and Hume aims to render them "as universal as possible," "explaining all effects from the simplest and fewest causes" (T xvii). By itself this sounds awfully bland. How does it differ from the generalizations any of us might make about human mental life? On one common understanding of Hume, the answer is that he is studying objects we don't ordinarily talk about, using a method of observation we don't ordinarily use. I have argued elsewhere2 that Hume's term, 'perception,' isn't meant to refer to Lockean ideas but to people's states of mind as we ordinarily understand them: dateable episodes of consciousness of a great many types, including episodes of seeing, touching, smelling, tasting and hearing objects in the world around us. Nor, I have argued, does Hume's "cautious observation of human life" (T xix) invariably or even usually take the form of introspection. Rather, the scientist of man attends to a range of the features of perceptions that we notice from time to time in ordinary life. What distinguishes the activities of the scientist of man from those of the ordinary observer of human mental life is that the scientist of man attends mainly just to this range of features, and reflects upon them in a sustained and systematic way. Intimacy: From Transformation to Transmutation The paper reflects the historical and current dynamism of the concept of intimacy. Besides differences between scientific disciplines in understanding what the substance of intimacy is, the recent discourse on change in intimacy has been dominated by the transformation theme introduced by Anthony Giddens (1992). Led by reflections of Richard Sennett (1986) the author draws attention to the opposite aspect of change in intimacy—the change in content, or the "transmutation" of intimacy. Transmutation of intimacy—the substitution (...) of the satisfaction of intimate needs with identity creation—not only contests the very essence of intimacy, but also constitutes a significant challenge for the project of intimate citizenship (Plummer 2003). Recent epidemiological research on the social determinants of health has been used to attack an important framework, associated with Norman Daniels, that depicts healthcare as special. My aim is to rescue the idea that healthcare has special importance in society, although specialness will turn out to be mainly limited to clinical care. I build upon the link between Daniels's theory and the work of John Rawls to develop a conception of public justification liberalism that is suitable to the field of (...) justice and health.
