The central drive and movement of this study is an exploration of the possibility of a new theological ontology, an ontology of meaning. This attempt takes its starting-point in one of the major philosophers of this century, Ludwig Wittgenstein. The theological exploration rests on an interpretation of Wittgenstein as a whole, in function of his dominant interest in meaning. 'Meaning' is the theme which provides continuity between the 'early' and the 'late' Wittgenstein.

Belgium is one of very few countries where euthanasia on the basis of psychiatric illness is legally possible. Three physicians involved in the euthanasia of a 38-year-old woman suffering from psychiatric illness recently faced a criminal trial for “murder by poisoning”, for allegedly having failed to comply with several requirements of the Belgian Euthanasia Law. Although none of the physicians were convicted, the case generated extensive debate, in the media and the general public as well as in the medical profession (...) and among policy makers. In this chapter, we take this trial as the starting point for a critical analysis of the clinical-psychiatric, ethical, and legal issues involved in evaluating euthanasia requests in cases of complex psychiatric disorders. In these cases, the requirements of the Belgian Euthanasia Law could be improved by mandating the advice of two psychiatrists, who are experts in the treatment of the specific condition of the person requesting euthanasia. Simultaneously with the process of evaluating the euthanasia request, there should be a parallel treatment track in which all therapeutic and recovery-oriented options are explored. These two tracks should not be in the hands of the same physician. (shrink)

In Richard Bradley’s book, Decision Theory with a Human Face, we have selected two themes for discussion. The first is the Bolker-Jeffrey theory of decision, which the book uses throughout as a tool to reorganize the whole field of decision theory, and in particular to evaluate the extent to which expected utility theories may be normatively too demanding. The second theme is the redefinition strategy that can be used to defend EU theories against the Allais and Ellsberg paradoxes, a strategy (...) that the book by and large endorses, and even develops in an original way concerning the Ellsberg paradox. We argue that the BJ theory is too specific to fulfil Bradley’s foundational project and that the redefinition strategy fails in both the Allais and Ellsberg cases. Although we share Bradley’s conclusion that EU theories do not state universal rationality requirements, we reach it not by a comparison with BJ theory, but by a comparison with the non-EU theories that the paradoxes have heuristically suggested. Emotional experiences typically labelled “being moved” or “feeling touched” may belong to one universal emotion. This emotion, which has been labelled “kama muta”, is hypothesised to have a positive valence, be elicited by sudden intensifications of social closeness, and be accompanied by warmth, goosebumps and tears. Initial evidence on correlations among the kama muta components has been collected with self-reports after or during the emotion. Continuous measures during the emotion seem particularly informative, but previous work allows only restricted inferences on (...) intra-individual processes because time series were cross-correlated across samples. In the current studies, we instead use a within-subject design to replicate and extend prior work. We compute intra-individual cross-correlations between continuous self-reports on feeling moved and (1) positive and negative affect; (2) goosebumps and subjective warmth and (3) appraisals of closeness and morality. Results confirm the predictions of kama muta theory that feeling moved by intensified communal sharing cross-correlates with appraised closeness, positive affect, warmth and (less so) goosebumps, but not with negative affect. Contrary to predictions, appraised morality cross-correlated with feeling moved as much as appraised closeness did. We conclude that strong inferences on emotional processes are possible using continuous measures, replace earlier findings, and are largely in line with theorising. (shrink)

This book on privacy and data protection offers readers conceptual analysis as well as thoughtful discussion of issues, practices, and solutions. It features results of the seventh annual International Conference on Computers, Privacy, and Data Protection, CPDP 2014, held in Brussels January 2014. The book first examines profiling, a persistent core issue of data protection and privacy. It covers the emergence of profiling technologies, on-line behavioral tracking, and the impact of profiling on fundamental rights and values. Next, the book looks (...) at preventing privacy risks and harms through impact assessments. It contains discussions on the tools and methodologies for impact assessments as well as case studies. The book then goes on to cover the purported trade-off between privacy and security, ways to support privacy and data protection, and the controversial right to be forgotten, which offers individuals a means to oppose the often persistent digital memory of the web. Written during the process of the fundamental revision of the current EU data protection law by the Data Protection Package proposed by the European Commission, this interdisciplinary book presents both daring and prospective approaches. Drawing general inferences on the basis of single-case and small- n studies is often seen as problematic. This article suggests a logic of generalization based on thinly rationalistic social mechanisms. Ideal-type mechanisms can be derived from empirical observations in one case and, based on the assumption of thin rationality, used as a generalizing bridge to other contexts with similar actor constellations. Thus, the “portability” builds on expectations about similar mechanisms operating in similar contexts. This research investigates 3- and 5-year-olds' relative fairness in distributing small collections of even or odd numbers of more or less desirable candies, either with an adult experimenter or between two dolls. The authors compare more than 200 children from around the world, growing up in seven highly contrasted cultural and economic contexts, from rich and poor urban areas, to small-scale traditional and rural communities. Across cultures, young children tend to optimize their own gain, not showing many signs of self-sacrifice (...) or generosity. Already by 3 years of age, self-optimizing in distributive justice is based on perspective taking and rudiments of mind reading. By 5 years, overall, children tend to show more fairness in sharing. What varies across cultures is the magnitude of young children's self-interest. More fairness (less self-interest) in distributive justice is evident by children growing up in small-scale urban and traditional societies thought to promote more collective values. (shrink)

To what extent do early intuitions about ownership depend on cultural and socio-economic circumstances? We investigated the question by testing reasoning about third party ownership conflicts in various groups of three- and five-year-old children (N = 176), growing up in seven highly contrasted social, economic, and cultural circumstances (urban rich, poor, very poor, rural poor, and traditional) spanning three continents. Each child was presented with a series of scripts involving two identical dolls fighting over an object of possession. The child (...) had to decide who of the two dolls should own the object. Each script enacted various potential reasons for attributing ownership: creation, familiarity, first contact, equity, plus a control/neutral condition with no suggested reasons. Results show that across cultures, children are significantly more consistent and decisive in attributing ownership when one of the protagonists created the object. Development between three and five years is more or less pronounced depending on culture. The propensity to split the object in equal halves whenever possible was generally higher at certain locations (i.e., China) and quasi-inexistent in others (i.e., Vanuatu and street children of Recife). Overall, creation reasons appear to be more primordial and stable across cultures than familiarity, relative wealth or first contact. This trend does not correlate with the passing of false belief theory of mind. (shrink)

The relations between rationality and optimization have been widely discussed in the wake of Herbert Simon's work, with the common conclusion that the rationality concept does not imply the optimization principle. The paper is partly concerned with adding evidence for this view, but its main, more challenging objective is to question the converse implication from optimization to rationality, which is accepted even by bounded rationality theorists. We discuss three topics in succession: (1) rationally defensible cyclical choices, (2) the revealed preference (...) theory of optimization, and (3) the infinite regress of optimization. We conclude that (1) and (2) provide evidence only for the weak thesis that rationality does not imply optimization. But (3) is seen to deliver a significant argument for the strong thesis that optimization does not imply rationality. (shrink)

We report the results of one visual‐world eye‐tracking experiment and two referent selection tasks in which we investigated the effects of information structure in the form of prosody and word order manipulation on the processing of subject pronouns er and der in German. Factors such as subjecthood, focus, and topicality, as well as order of mention have been linked to an increased probability of certain referents being selected as the pronoun's antecedent and described as increasing this referent's prominence, salience, or (...) accessibility. The goal of this study was to find out whether pronoun processing is primarily guided by linguistic factors (e.g., grammatical role) or nonlinguistic factors (e.g., first‐mention), and whether pronoun interpretation can be described in terms of referents' “prominence” / “accessibility” / “salience.” The results showed an overall subject preference for er, whereas der was affected by the object role and focus marking. While focus increases the attentional load and enhances memory representation for the focused referent making the focused referent more available, ultimately it did not affect the final interpretation of er, suggesting that “prominence” or the related concepts do not explain referent selection preferences. Overall, the results suggest a primacy of linguistic factors in determining pronoun resolution. (shrink)

Qu'attendre des chercheurs en sciences sociales? Qu'ils fassent tout bonnement leur métier ou qu'à partir de leurs analyses ils s'impliquent dans les problèmes qui relèvent de leur compétence ou même qu'à partir de leur position de chercheur ils prennent publiquement position sur les grandes questions du jour? Ces alternatives sont loin d'épuiser le champ des possibles, mais les énoncer invite à s'interroger sur les rapports qu'entretiennent les travaux de recherche en sciences sociales avec les pratiques sociales qu'elles étudient. Ces questions (...) n'étaient pas étrangères à Philippe Lucas - et c'est peu dire. Elles sont aussi à l'origine de ce livre. Président de l'université Lumière-Lyon II avant d'être nommé recteur de l'Académie de Bordeaux puis de l'Académie de Caen, Philippe Lucas fut aussi et d'abord un chercheur qui concevait son travail de recherche comme un engagement. Sa " sociologie impliquée " supposait la confrontation des points de vue et le débat non seulement après coup, une fois le travail terminé, mais avant tout dès les premières investigations et tout au long de la recherche. Quel meilleur hommage rendre à Philippe Lucas que de reprendre aujourd'hui ces questions qui furent les siennes? Il les avait posées à sa manière mais leur actualité nous frappe, leur importance aussi. Ceux qui ont contribué à cet ouvrage collectif ont tenté d'y répondre et d'abord de les reformuler en proposant tantôt leur témoignage tantôt leurs réflexions de chercheurs sur l'implication et l'engagement : leur propre implication et celle de leurs disciplines, leur propre engagement et celui de leurs disciplines. Dans le sillage de l'Art du récit biblique, de Robert Alter, Ph. Abadie tente de faire ressortir la richesse et la variété des procédés d'écriture qui font du (...) livre des Chroniques une œuvre littéraire véritable. Celle-ci tient fondamentalement à un projet global que révèlent et confirment des « unités kérygmatiques » structurantes et l'ordonnancement de grands ensembles selon divers procédés : technique de répétition et système de périodisation chronologique notamment.It is still paradoxical to recognize the statute of literary work for the books of Chronicles. Long time considered as of “poor reliability” in comparison with the parallel history of the books of Samuel and Kings, these books also seem to be without literary originality in comparison with, notably, the consummate art of the narratives in the books of Samuel. La relation entre la philosophie et la mystique forme une question " à la limite ", que la fatalité a le plus souvent déclinée en une suite d'oppositions frontales : entre le rationnel et l'émotionnel, le logique et le pathologique, le discours et l'indicible... Depuis quelques années cependant, plusieurs motifs portent à reconsidérer cette relation singulière. Une somme d'informations sans précédent sur les diverses traditions mystiques, sur leurs variabilités historiques et géographiques est désormais accessible. En outre, la mystique est devenue (...) un objet œcuménique et interreligieux de premier plan qui invite à reposer la question de l'essence du religieux dans la traversée herméneutique des différences confessionnelles. Enfin, on enregistre une forte demande de redressement spéculatif face à l'essor actuel des sectes et au développement des syncrétismes religieux. Mais le philosophe est-il qualifié pour comprendre la mystique? A quelles conditions? De son côté, le mystique n'a-t-il point tendance à cacher sa dette à l'égard de l'expérience de la pensée, voire des concepts philosophiques? Plus profondément encore, faut-il lier la mystique au seul " religieux "? La philosophie n'est-elle pas un exercice spirituel, une expérience? C'est justement par cette entrée " expérientielle " dans la question que le présent ouvrage trouve son originalité. We investigate the conflict between the ex ante and ex post criteria of social welfare in a new framework of individual and social decisions, which distinguishes between two sources of uncertainty, here interpreted as an objective and a subjective source respectively. This framework makes it possible to endow the individuals and society not only with ex ante and ex post preferences, as is usually done, but also with interim preferences of two kinds, and correspondingly, to introduce interim forms of the (...) Pareto principle. After characterizing the ex ante and ex post criteria, we present a first solution to their conflict that extends the former as much possible in the direction of the latter. Then, we present a second solution, which goes in the opposite direction, and is also maximally assertive. Both solutions translate the assumed Pareto conditions into weighted additive utility representations, and both attribute to the individuals common probability values on the objective source of uncertainty, and different probability values on the subjective source. We discuss these solutions in terms of two conceptual arguments, i.e., the by now classic spurious unanimity argument and a novel informational argument labelled complementary ignorance. The paper complies with the standard economic methodology of basing probability and utility representations on preference axioms, but for the sake of completeness, also considers a construal of objective uncertainty based on the assumption of an exogeneously given probability measure. Judgment aggregation theory, or rather, as we conceive of it here, logical aggregation theory generalizes social choice theory by having the aggregation rule bear on judgments of all kinds instead of merely preference judgments. It derives from Kornhauser and Sager’s doctrinal paradox and List and Pettit’s discursive dilemma, two problems that we distinguish emphatically here. The current theory has developed from the discursive dilemma, rather than the doctrinal paradox, and the final objective of the paper is to give the latter (...) its own theoretical development along the line of recent work by Dietrich and Mongin. However, the paper also aims at reviewing logical aggregation theory as such, and it covers impossibility theorems by Dietrich, Dietrich and List, Dokow and Holzman, List and Pettit, Mongin, Nehring and Puppe, Pauly and van Hees, providing a uniform logical framework in which they can be compared with each other. The review goes through three historical stages: the initial paradox and dilemma, the scattered early results on the independence axiom, and the so-called canonical theorem, a collective achievement that provided the theory with its specific method of analysis. The paper goes some way towards philosophical logic, first by briefly connecting the aggregative framework of judgment with the modern philosophy of judgment, and second by thoroughly discussing and axiomatizing the ‘general logic’ built in this framework. Following a long-standing philosophical tradition, impartiality is a distinctive and determining feature of moral judgments, especially in matters of distributive justice. This broad ethical tradition was revived in welfare economics by Vickrey, and above all, Harsanyi, under the form of the so-called Impartial Observer Theorem. The paper offers an analytical reconstruction of this argument and a step-wise philosophical critique of its premisses. It eventually provides a new formal version of the theorem based on subjective probability.

The paper analyses economic evaluations by distinguishing evaluative statements from actual value judgments. From this basis, it compares four solutions to the value neutrality problem in economics. After rebutting the strong theses about neutrality (normative economics is illegitimate) and non-neutrality (the social sciences are value-impregnated), the paper settles the case between the weak neutrality thesis (common in welfare economics) and a novel, weak non-neutrality thesis that extends the realm of normative economics more widely than the other weak thesis does.

As stochastic independence is essential to the mathematical development of probability theory, it seems that any foundational work on probability should be able to account for this property. Bayesian decision theory appears to be wanting in this respect. Savage’s postulates on preferences under uncertainty entail a subjective expected utility representation, and this asserts only the existence and uniqueness of a subjective probability measure, regardless of its properties. What is missing is a preference condition corresponding to stochastic independence. To fill this (...) significant gap, the article axiomatizes Bayesian decision theory afresh and proves several representation theorems in this novel framework. (shrink)

William Alston’s argument against the deontological conception of epistemic justification is a classic—and much debated—piece of contemporary epistemology. At the heart of Alston’s argument, however, lies a very simple mistake which, surprisingly, appears to have gone unnoticed in the vast literature now devoted to the argument. After having shown why some of the standard responses to Alston’s argument don’t work, we elucidate the mistake and offer a hypothesis as to why it has escaped attention.

The paper develops an objection to the extensional model of time consciousness—the view that temporally extended events or processes, and their temporal properties, can be directly perceived as such. Importantly, following James, advocates of the extensional model typically insist that whole experiences of temporal relations between non-simultaneous events are distinct from mere successions of their temporal parts. This means, presumably, that there ought to be some feature(s) differentiating the former from the latter. I try to show why the extensional models (...) offers no credible ground for positing such a difference. (shrink)

After canvassing with good grace the make-up of cyberspace Andrew Murray wonders, in his recent book The Regulation of Cyberspace, which role traditional lawmakers are left to play in the new cyber-regulatory environment. Murray describes the static `command and control' regulatory model as disruptive and ineffective, and supports instead a dynamic, complimentary, and symbiotic regulatory model, which he presents under the features of an autopoietic environment and systems dynamics theory.Regulatory models, explains Andrew Murray in his recent book The Regulation of (...) Cyberspace, intervene when a `disruptive innovation', such as the Internet, creates a regulatory vacuum. As cyberpaternalists suggest, however, the lack of traditional legal-regulatory control systems does not mean total freedom within cyberspace . On the contrary, as the author contends, `regulators of all forms rush to fill in this vacuum' so that the traditional regulatory mechanism is replaced by private regulatory systems acting, as Joel Reidenberg exposed, as `proxies' to the traditional regulatory system . Murray shares this point, but also gives credit to the views of cyberlibertarians. Cyberlibertarians argue that traditional command and control models are at last ineffective, even when they operate through proxies. In cyberspace, so they claim, regulators and regulatees mingle with each other to such an unheard-of extent that regulatory interventions cannot be effective unless regulatees co-operate actively.In his book, professor Andrew Murray treasures the sound arguments advanced by the cyberlibertarian and cyberpaternalist camps, and draws lessons from both in order to build a dialectic confrontation between static instrument and dynamic instrument thinking in the regulation of cyberspace. He consecrates the pars destruens of his work to explain why lawmakers should eschew the static approach and adheres to the pars construens to expand on a more dynamic and `smarter' regulatory model. The paper has a twofold aim. On the one hand, it provides what appears to be the first game-theoretic modeling of Napoleon’s last campaign, which ended dramatically on 18 June 1815 at Waterloo. It is specifically concerned with the decision Napoleon made on 17 June 1815 to detach part of his army against the Prussians he had defeated, though not destroyed, on 16 June at Ligny. Military historians agree that this decision was crucial but disagree about whether it was rational. (...) Hypothesizing a zero-sum game between Napoleon and Blücher, and computing its solution, we show that it could have been a cautious strategy on the former's part to divide his army, a conclusion which runs counter to the charges of misjudgement commonly heard since Clausewitz. On the other hand, the paper addresses methodological issues. We defend its case study against the objections of irrelevance that have been raised elsewhere against “analytic narratives”, and conclude that military campaigns provide an opportunity for successful application of the formal theories of rational choice. Generalizing the argument, we finally investigate the conflict between narrative accounts – the historians' standard mode of expression – and mathematical modeling. (shrink)

Les conventions jouent ainsi un (...) rôle important dans la coordination économique. La notion de convention est un thème d'étude nouveau pour l'économie. Elle fait aujourd'hui l'objet de très nombreuses recherches. Cet ouvrage ambitionne de clarifier tous les usages du terme " convention " en économie, depuis les travaux qui s'appuient sur la philosophie du langage jusqu'aux thèses développées par " l'Economie des conventions ", en passant par la théorie des jeux. Several disputes about the nature of experience operate under the assumption that experiences have parts, including temporal parts. There's the widely held view, when it comes to temporal experiences, that we should follow James' exhortation that such experiences aren't mere successions of their temporal parts, but something more. And there's the question of whether it is the parts of experiences which determine whole experiences and the properties they have, or whether the determination goes instead from the whole to the parts, (...) as holists have it. But what are parts, or temporal parts, of experiences exactly—what does it mean to say that an experience is “part” of another? Are the participants in those disputes talking about the same thing—is there a univocal notion of “experiential part” available? Are there different kinds of experiential parts? And if there are, is there a systematic way of carving them out? More importantly, how should we conceive of the temporal parts of experiences, and how can we establish that experiences really do have temporal parts, against those who reject the notion? (shrink)

We propose two alternatives to Xu’s axiomatization of Chellas’s STIT. The first one simplifies its presentation, and also provides an alternative axiomatization of the deliberative STIT. The second one starts from the idea that the historic necessity operator can be defined as an abbreviation of operators of agency, and can thus be eliminated from the logic of Chellas’s STIT. The second axiomatization also allows us to establish that the problem of deciding the satisfiability of a STIT formula without temporal operators (...) is NP-complete in the single-agent case, and is NEXPTIME-complete in the multiagent case, both for the deliberative and Chellas’s STIT. Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. I support this view by proposing common normative (...) principles that specify when exploratory concept formation and tool development succeed to initiate scientific change. (shrink)

Farabi (ob 950), philosophe persan originaire des confins des mondes persan et turc (Transoxiane), vient s'établir à Bagdad vers la fin du IXe siècle. Il s'y convertit à la philosophie comme on entre en religion. Il quitte Bagdad en 942 pour s'établir la même année à Damas où il meurt huit ans plus tard. C'est là qu'il met le point final au Régime politique qui est son testament philosophique. Ce traité condense toute sa compréhension de Platon, d'Aristote et de la (...) tradition philosophique tardo-antique. Il y livre en outre la clé d'interprétation de son oeuvre la plus fameuse, La Cité vertueuse, dont le Régime politique approfondit les thèmes centraux. On y découvre deux aspects complémentaires de la politique telle qu'il la concevait. Tout d'abord, la politique, pour être philosophique, se doit de faire de la métaphysique son infrastructure. Il faut partir d'une conception définie du monde et de ses principes pour savoir que la destination de l'homme passe nécessairement par la cité. De plus, la politique comme science a une finalité pratique : critiquer jusque dans leurs fondements les régimes et les religions corrompus de son époque. Le traité est à cet égard un document unique dans l'histoire de la falsafa : un philosophe arabophone adresse à la postérité son jugement sur la civilisation arabo-islamique des IXe Xe siècles. Food choices are a key determinant of dietary intake, with brain regions, such as the mesolimbic and prefrontal cortex maturing at differential rates into adulthood. More needs to be understood about developmental changes in healthy and unhealthy food perceptions and preference. We investigated how food perceptions and preference vary as a function of age and how food attributes impact age-related changes. One hundred thirty-nine participants completed computerized tasks to rate high-calorie and low-calorie food cues for taste, health, and liking, followed (...) by 100 binary food choices based on each participant’s ratings. Dietary self-control was considered successful when the healthier food was chosen. Self-control success ratio was the proportion of success trials over total number of choices. Beta-weights for health and taste were calculated as each attribute’s influence on food preference. Adiposity measurements included BMI z-score and waist-to-height ratio. High-calorie foods were rated more tasty and less healthy with increasing age. Older participants liked high-calorie foods more, and β-taste was associated with age. Significant age-by-WHtR interactions were observed for health and taste ratings of high-calorie foods, β-taste, and marginally for preference of high-calorie foods. Stratifying by WHtR, we found age-related increases in taste and preference ratings of high-calorie foods in the high WHtR group alone. In contrast, age-related decreases in health ratings of high-calorie foods were significant in the low WHtR group alone. Age and β-taste were significantly associated in the high WHtR group and only marginally significant with low WHtR. Although participants rated low-calorie foods as less tasty and less healthy with increasing age, there was no association between age and preference for low-calorie foods. Participants made faster food choices with increasing age regardless of WHtR, with a significant age-by-WHtR interaction on reaction time. There were no age-related effects in self-control success ratio and β-health. These results suggest that individual differences in age and central adiposity play an important role in preference for high-calorie foods, and a higher importance of food tastiness in food choice may contribute to greater preference for high-calorie foods with increasing age. Beyond the predominant paradigm of an essentially rational human cognition, based on the classical binary logic, we want to propose some reflections that are organized around the intuition that the representations we have of the world are weighted with appreciations, for example affective ones. resulting from our integration into a social environment. We see these connotations as essentially ternary in nature, depending on the concepts underlying neutrosophy: either positive, negative or neutral. This form of representation would then influence the very (...) nature of the cognitive process, which in complex real-world situations, has to deal with problems of a combinatorial nature leading to a number of cases too large for our abilities. Forced to proceed by shortcuts on the basis of heuristics, cognition would use these assessments of the representations it manipulates to decide whether partial solutions are attractive for solving the problem or on the contrary are judged negative and are then quickly rejected. There is still the case of a neutral weighting that allows processing to continue. Thus a neutrosophical conception of our representations of the world explains how our cognition functions in its treatment of combinatorial problems in the form of producing processing accelerating heuristics, both in terms of partial solutions selection and processing optimization. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. The inherent value conception of dignity,as here defended, is what is meant in the Swiss Constitution article. (shrink)

Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects.
