Medical aid in dying (MAiD), despite being legal in many jurisdictions, remains controversial ethically. Existing surveys of physicians’ perceptions of MAiD tend to focus on the legal or moral permissibility of MAiD in general. Using a novel sampling strategy, we surveyed physicians likely to have engaged in MAiD-related activities in Colorado to assess their attitudes toward contemporary ethical issues in MAiD.

It is unclear whether the regulatory distinction between non-identifiable and identifiable information—information used to determine informed consent practices for the use of clinically derived samples for genetic research—is meaningful to patients. The objective of this study was to examine patients' attitudes and preferences regarding use of anonymous and identifiable clinical samples for genetic research. Telephone interviews were conducted with 1,193 patients recruited from general medicine, thoracic surgery, or medical oncology clinics at five United States academic medical centers. Wanting to know (...) about research being done was important to 72% of patients when samples would be anonymous and to 81% of patients when samples would be identifiable. Only 17% wanted to know about the identifiable scenario but not the anonymous scenario. Curiosity-based reasons were the most common among patients who wanted to know about anonymous samples. Of patients wanting to know about either scenario, approximately 57% would require researchers to seek permission, whereas 43% would be satisfied with notification only. Patients were more likely to support permission in the anonymous scenario if they had more education, were Black, less religious, in better health, more private, and less trusting of researchers. The sample, although not representative of the general population, does represent patients at academic medical centers whose clinical samples may be used for genetic research. Few patients expressed preferences consistent with the regulatory distinction between non-identifiable and identifiable information. Data from this study should cause policy-makers to question whether this distinction is useful in relation to research with previously collected clinically derived samples. (shrink)

This thesis concerns alternative concatenating operations in extensive measurements and the degree to which concatenating operations are matter of convention. My arguments are directed against Ellis' claim that what prevents us from choosing alternative ways of combining extensive quantities is only convenience and simplicity and that the choice is not based on empirical reasons. ;My first argument is that, given certain relational theories of measurement, there can be no more than one concatenating operation per quantity; because combining operations are the (...) only conclusive distinguishing characteristic among distinct extensive measurements and thus the only thing that can serve as an indicator for the identity of a quantity. Rectangular and collinear concatenation, for example, cannot both be used as a way of combining lengths. However, rectangular concatenation could be used to measure some other extensive quantity since it fulfills the necessary conditions for adequate numerical assignment. ;For those that adopt theories of measurement which can support the claim that dinches measure length, I demonstrate, in the second argument, that rectangular concatenation would be a bad alternative and thus no alternative at all. Implementation of rectangular concatenation requires a new science; a science compatible with dinches violates present invariance principles and a new set must be provided, if possible. It is not clear that there is a set of invariance principles compatible with dinches which also gives basis for a science that explains the phenomena as well as the old one. Moreover, new invariance principles would be unintuitive and would require that certain fundamental concepts change their meaning. For these reasons the choice between them is guided by a number of empirical reasons and is not only a matter of convention. (shrink)

The prevalence of dementia is increasing worldwide but there is still no hope of a cure. Huge resources go into biomedical research, whose reductive ‘enactment’ has severe consequences for women, who are predominantly affected by dementia. To challenge such tragic enactment, this article considers ‘multiple ontologies’ of the most common type of dementia – Alzheimer’s disease – in the popular fictional film adaptations Still Alice and A Song for Martin. Using a post-humanist account of feminist visual studies of technoscience, this (...) comparative film analysis reveals how gender supersedes AD oversteering the hierarchical dualisms between health and pathology, human and nonhuman, and biomedical and artistic modes of knowing about Alzheimer’s. The author argues that these films stress the potential of the arts, as a multisensorial post-humanist embodied state of becoming with AD, to challenge hierarchical dualisms and innovatively contribute to dementia care. In this paper certain parameters of ethical values and attitudes of students in economics from different countries are analysed (attitudes toward work and organisation; goals of work; readiness to work for common benefit, etc.). The basic question was whether, and to what extent, such attitudes differ in countries in transition (former communist countries of Central and Eastern Europe) compared with western countries with a developed market economy and Latin‐American countries. On the basis of empirical research we conclude that there are (...) significant differences, i.e., that students from countries in transition show more self‐oriented attitudes, less readiness to help others and tend to consider work in an organisation primarily as a means to achieve one's own goals (always compared with students from the other two groups of countries). The main explanation for this is found in the transition itself, i.e., conditions and processes in those countries in the 1990s, and less in the heritage of the previous (communist) system. The issue of Holocaust tourism might be a quite sensitive, but nevertheless very important topic in the domain of the Holocaust remembrance. As tourism is often associated with leisure activities, it is quite challenging to put tourism into darker contexts of history and death. Also, different people coming to the Holocaust-related places with different motives make the issue of designing educational tours even more complex. This paper will try to expose questions related to dark tourism, Holocaust tourism, auratic memorial places, (...) and to discuss ethical approaches to the Holocaust memory in the beginning of the 21st century. The text argues for the tourist experience as a memorable and educational tool with an active transformational potential, which will turn the visitor into a witness who further contributes to survival of the legacy of the Holocaust in the future. This paper examines the ‘deep-end’ of the international justice process—the incarceration of persons convicted in specially constituted international criminal tribunals and courts for gross violations of human rights, genocide, crimes against humanity and war crimes with a focus on language rights of such prisoners who are commonly serving sentences in foreign prisons. The punishment phase of the international justice process and its effects are not easily quantifiable and have been largely hidden from view. Although international criminal law asserts that equal (...) treatment before the law requires that there be no significant disparity in punishment regimes from one sentence-enforcing country to another, comparative penology shows that there are considerable differences in the conditions of confinement and the nature of correctional services in the prison systems of different countries. This has a direct impact on post-sentence procedural and rehabilitation rights of which language rights from a key part. In this specific context, and drawing from existing literature, the paper therefore examines the extent to which enforcement practice conforms to the ideal of equal treatment espoused by the tribunals. In this chapter, we focus on collective action and intention, and their relation to conventions, status functions, norms, institutions, and shared attitudes more generally. Collective action and shared intention play a foundational role in our understanding of the social. -/- The three central questions in the study of collective intentionality are: -/- (1) What is the ontology of collective intentionality? In particular, are groups per se intentional agents, as opposed to just their individual members? (2) What is the psychology of (...) collective intentionality? Do groups per se have psychological states, in particular propositional attitudes? What is the psychology of the individuals who participate in collective intentional behavior? What is special about their participatory intentions, their we-intentions, as they are called (Tuomela and Miller 1988), as opposed to their I-intentions? (3) How is collective intentionality implicated in the construction of social reality? In particular, how does the content of we-intentions and the intentional activity of individual agents create social institutions, practices and structures? -/- We first discuss collective action and shared intention in informal groups. Next we discuss mechanisms for constructing institutional structures out of the conceptual and psychological resources made available by our understanding of informal joint intentional action. Then we extend the discussion of collective action and intention to institutional groups, such as the Supreme Court, and explain how concepts of such organizations are constructed out of the concepts of a rule, convention, and status function. In this paper, we examine whether it is possible to improve democracy by encouraging ordinary citizens to participate in political decision-making and if participation in deliberative institutions can make citizens more competent decision-makers. By using qualitative data, we analyze the discussion from the Belgrade citizens? assembly focused on the topic of expanding the pedestrian zone in the city center. The CA was organized in Serbia for the first time, as part of a research project aimed at promoting and advancing innovative (...) democratic practices in the Western Balkans. The goal was to encourage the involvement of citizens in discussions of public interest. Our hypothesis was that, through the process of participation and deliberation in CA, ordinary citizens can make reasonable and informed choices, increase their knowledge of the issue discussed, and become more motivated to participate in political decision-making on the local level. Our qualitative content analysis suggests that deliberation had a positive impact on participants? knowledge of the chosen topic of the assembly. It also shows that citizens used exhaustive explanations rather than brief statements, could differentiate the good arguments from the bad, and more often appealed to general rather than private interests. Participants in the assembly reported a significant increase in interest in political decision-making that affects their lives, as well as a sense of being informed about politics. Finally, we wanted to draw attention to the challenges and open questions that remain, namely those that concern the impact of a deliberative body on political decision-making in the real world. “It's almost like putting salt in a wound, for this person who's already made a very difficult decision,” suggested Meghan Patterson, a licensed obstetrician-gynecologist whom we interviewed in our qualitative study of the experiences of North Carolina abortion providers practicing under the state's Woman's Right to Know Act. The act requires that women receive counseling with state-mandated information at least twenty-four hours prior to obtaining an abortion. After the law was passed, Patterson worked with clinic administrators, in consultation with a (...) lawyer, to write a script to be used in the state-mandated counseling procedure. She and her colleagues took particular steps to mitigate the effects of what she described as HB 854's “forced language”—such as referring to the “father of the child.” While HB 854 stipulated that patients must be informed of the medical risks associated with the particular abortion procedure as well as those of carrying the child to term, Patterson's script made explicit the magnitude of comparative risks, emphasizing that the risks of carrying a pregnancy to term are substantially greater than the risks of an early-term abortion. She felt that these contextualization strategies helped to facilitate trust and rapport in a clinical care situation that proved relationally and morally challenging. In this article, we take up and expand on this point by elucidating an empirically grounded approach to ethically justified care when health care providers face legal or institutional policy mandates that raise possible moral conflicts. Our approach builds on recent bioethics discourse addressing conscience in the practice of medicine. While the concept of conscience has broad philosophical underpinnings relating to moral judgment, agency, and discernments of right and wrong, debates in bioethics have tended to engage the concept primarily vis-à-vis rights of conscientious objection or refusal. Here, we suggest a broader frame for thinking about claims of conscience in health care. Our approach draws on the feminist bioethics and the ethics of care literatures to highlight how providers may be motivated by matters of conscience, including relational concerns, in the active provision of certain forms of care. What emerges are two possibilities: not only conscientious refusal to comply with a policy mandate but also conscientious compliance—working conscientiously within a mandate's confines. (shrink)

This paper concerns the ways in which one can/cannot combine extensive quantities. Given a particular theory of extensive measurement, there can be no alternative ways of combining extensive quantities, where 'alternative' means that one combining operation can be used instead of another causing only a change in the number assigned to the quantity. As a consequence, rectangular concatenation cannot be an alternative combining operation for length as was suggested by Ellis and agreed by Krantz, Luce, Suppes, and Tversky. Strawson style counterexamples to Grice’s account of communication show that a communicative intention has to be overt. Saying what overtness consists in has proven to be difficult for Gricean accounts. In this paper, I show that a common explanation of overtness, one that construes it in terms of a network of shared beliefs or knowledge, is mistaken. I offer an alternative, collectivist, model of communication. This model takes the utterer’s communicative intention to be a we-intention, a kind of intention with (...) a distinctive content that cannot be reduced to an intention in favor of an individual action. I show that the collectivist model can explain overtness in terms of a general feature of we-intentions, namely the requirement that the participants in a shared activity are to intend to act in accordance with meshing subplans. In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations (...) as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. The Austrian School's conventional theory of the firm is based on an attempt to synthesize Coase's concept of the firm as a centrally planned hierarchy with the Austrian theory of entrepreneurship and monetary calculation. This paper is a critique of that program as well as an attempt to outline the alternative theory of the firm, one based on the synthesis of the contractual agency theory of the firm with the same Austrian arguments about entrepreneurship and calculation. The firm in this (...) paper is defined as a nexus of various markets for goods as well as for labor and managerial services rather than as a hierarchy or “organization.” Both the neoclassical and Austrian critiques of the latter concept are utilized to prove that a clear distinction between the market and the firm cannot be established. That distinction is based on the misunderstanding of the firm's dynamics as exclusively tied to the managing/transaction costs ratio as well as on the mischaracterization of inter-firm relations as commanding ones. On the other hand, the central planning view of the firm is equally at odds with the key Mises's argument that rational economic planning is impossible in the absence of market prices. If this is so, the firm, as understood in a Coasian paradigm, would not have any reason to exist, or any reason to contribute positively to economic efficiency, because it would simply represent a centrally planned “island of incalculability” in a wider market setting. Since the firm is a nexus of various markets, its operation is contrary to the Coaseian assumptions led by the price signals. Only insofar as the internal firm's operation is driven by the price signals can the firm be efficient. (shrink)

Stanley and Williamson :411–444, 2001) argue for intellectualism—the thesis that knowing how is a type of knowing that—in part by defending a thesis about the semantics of English ascriptions of knowing how. But ascriptions of practical knowledge seem to exhibit significant crosslinguistic variation. This observation has been invoked to argue that S&W’s analysis reflects a quirk of English rather than a general feature of the concept of knowledge. I argue that the type of argument employed by both S&W and their (...) critics presupposes that the categories of denotational semantics correspond to those of the theory of mental content. But the relation between the semantic theory and the theory of content is more complex than this. Specifically, a closer look at ascriptions of practical knowledge and other obligatory control constructions in various languages shows that semantic theory needs distinctions that are redundant from the perspective of the theory of content, and that important distinctions in the theory of content may fail to correspond to any distinctions in semantic theory. It follows that we may not be able to read off as much about mental states as S&W and their critics try to from the structure of their ascriptions. (shrink)

Now that we know that Earth-like planets are ubiquitous in the universe, as well as that most of them are much older than the Earth, it is justified to ask to what extent evolutionary outcomes on other such planets are similar, or indeed commensurable, to the outcomes we perceive around us. In order to assess the degree of specialty or mediocrity of our trajectory of biospheric evolution, we need to take into account recent advances in theoretical astrobiology, in particular (i) (...) establishing the history of habitable planets’ formation in the Galaxy, and (ii) understanding the crucial importance of “Gaian” feedback loops and temporal windows for the interaction of early life with its physical environment. Hereby we consider an alternative macroevolutionary pathway that may result in tight functional integration of all sub-planetary ecosystems, eventually giving rise to a true superorganism at the biospheric level. The blueprint for a possible outcome of this scenario has been masterfully provided by the great Polish novelist Stanisław Lem in his 1961 novel Solaris. In fact, Solaris offers such a persuasive and powerful case for an “extremely strong” Gaia hypothesis that it is, arguably, high time to investigate it in a discursive astrobiological and philosophical context. In addition to novel predictions in the domain of potentially detectable biosignatures, some additional cognitive and heuristic benefits of studying such extreme cases of functional integration are briefly discussed. In telling the utterer enters into a relationship with an addressee. This relationship appears to be a normative one, i.e., it entails that an utterer has certain obligations to the addressee. But how can an act of telling create such obligations? In this paper, I propose what I call a collectivist account of telling. On this account, the core notion of telling is that of an utterer’s contribution to a joint action. Margaret Gilbert’s rich work on joint action emphasizes the (...) obligations agents of joint action have to one another. This normatively robust view of joint action, coupled with the conception of core telling as a participatory act, points toward the possibility of explaining the obligations speakers have to their addressees as, at least in some cases, the sort of obligations participants in joint action quite generally have to each other to act in a way appropriate to the joint activity. We argue that there is a variety of convention, effective coordinating agreement, that has not been adequately identified in the literature. Its distinctive feature is that it is a structure of conditional we-intentions of parties, unlike more familiar varieties of convention, which are structures of expectations and preferences or obligations. We argue that status functions constitutively involve this variety of convention, and that what is special about it explains, and gives precise content to the central feature of status functions, namely, (...) that objects with status functions can perform their functions only insofar as they have been collectively accepted as having them. Throughout the history of mankind, energy security has been always seen as a means of protection from disruptions of essential energy systems. The idea of protection from disorders emerged from the process of securing political and military control over energy resources to set up policies and measures on managing risks that affect all elements of energy systems. The various systems placed in a place to achieve energy security are the driving force towards the energy innovations or emerging trends in the (...) energy sector. Our paper discusses energy security status and innovations in the energy sector in European Union (EU). We analyze the recent up-to-date developments of the energy policy and exploitation of energy sources, as well as scrutinize the channels of energy streaming to the EU countries and the risks associated with this energy import. Moreover, we argue that the shift to the low-carbon production of energy and the massive deployment of renewable energy sources (RES) might become the key issue in ensuring the energy security and independency of the EU from its external energy supplies. Both RES, distributed energy resources (DER) and “green energy” that will be based on the energy efficiency and the shift to the alternative energy supply might change the energy security status quo for the EU. An influential view about the relationship between publicity and linguistic meaning is brought into question. It has been thought that since public languages are essentially public, linguistic meaning is subject to a kind of epistemic cap so that there can be nothing more to linguistic meaning than can be determinately known on the basis of publicly available evidence (Epistemic Thesis). Given the thinness of such evidence, a well-known thesis follows to the effect that linguistic meaning is substantially indeterminate. In this (...) paper, we consider the sort of reasons offered for the Epistemic Thesis and uncover an unexamined presupposition about the epistemic requirements of communication and the establishment of meaning conventions. We show this presupposition is undermined by independently motivated considerations about communication and convention, giving us good reason to reject the Epistemic Thesis and its corollary about indeterminacy. In her book Democracy and Truth: The Conflict between Political and Epistemic Virtues, Snjezana Prijic Samarzija advocates that a purely procedural justification which defines the authority and legitimacy of democracy only in relation to the fairness of the procedure itself is not enough for a full justification of democracy. Some epistemic values should also be included. This epistemic quality of democracy depends on the quality of the decisions that the democratic procedures produce. In that sense, the author is advocating a (...) hybrid theory that secures harmony between political and epistemic values, favoring deliberative procedure for this purpose, and thus promotes equal respect for both democratic values. In doing so, she is advocating the specific type of division of epistemic labor that I will attempt to critically re-examine here, as well as to bring into question the privileged role of the experts in democratic decision-making. The experience and attitudes of pharmacists towards research ethics through pharmacy practice research is largely unknown. This study sought to examine the pharmacists’ experience if they were research participants and their attitudes on the importance of informed consent in research practice. A cross-sectional survey was employed to achieve the aims of this study. The majority of 433 participating pharmacists were female ; the average age was 43.2 ± 9.5 years, and their average working experience was 15.0 ± 9.6 years. Almost (...) half of the respondents came from a medium chain pharmacy in Serbia. Older pharmacists reported the experience of being informed in detail by the researcher in their practice, had an informal agreement or a written agreement before the research process started, and believed it was necessary to know their rights in research. The more experienced pharmacists reported capturing objective and distant relationships with researchers when participating in pharmacy practice research. There was a significant difference between the experience of male and female pharmacists in the study. Those employed in medium chain pharmacies believed it was necessary to have informal agreement or a written agreement before beginning the research process. Results indicated that pharmacists show positive attitudes toward informed consent and its importance and these attitudes were more emphatically expressed by older and more experienced pharmacists in Serbia. Tekst analizira nacin na koji nastavno osoblje na Beogradskom univerzitetu percipira bolonjski proces, nacelno i unutar lokalnog srpskog socijalnog i univerzitetskog konteksta; razlicite upravne instance unutar univerzitetskog obrazovnog sistema, mesto nastavnika unutar obrisa novog visokoskolskog obrazovnog sistema u procesu bolonjske transformacije. Empirijsku osnovu predstavlja istrazivanje o uslovima rada nastavnog osoblja koje je Centar za obrazovne politike iz Beograda izveo na pet fakulteta Beogradskog univerziteta tokom 2008 godine.
