    Solidarity, Heterarchy, and Political Morality.Massimo Fichera - 2020 - Jus Cogens 2 (3):301-311.
This article claims that, despite its ambivalent relationship with the heterarchical paradigm,A Union of Peoplesis a truly innovative contribution to the complex debate on the European project, especially in the current troubled climate. Its ability to dismantle the prevailing positivist understanding of the interaction between legal orders and to stand out from the overwhelming and often repetitive literature on the philosophy of EU law should be praised. What is especially noteworthy is the idea of “corrective justice.” This notion explains very (...)

    The Idea of Discursive Constituent Power.Massimo Fichera - 2021 - Jus Cogens 3 (2):159-180.
The question addressed by this article is whether a form of constituent power exists at the EU level. It is argued that European integration has not suppressed the idea of people as constituent power. Instead, the idea of ‘people’ has been constructed through the discourses of security and rights. Ever since the early stages of European integration, the security and rights discourses have consisted in the articulation of a meta-constitutional rationale, which is here called the ‘security of the European project’, (...)

Human Brain Organoids: Why There Can Be Moral Concerns If They Grow Up in the Lab and Are Transplanted or Destroyed.Andrea Lavazza & Massimo Reichlin - 2023 - Cambridge Quarterly of Healthcare Ethics 32 (4):582-596.
Human brain organoids (HBOs) are three-dimensional biological entities grown in the laboratory in order to recapitulate the structure and functions of the adult human brain. They can be taken to be novel living entities for their specific features and uses. As a contribution to the ongoing discussion on the use of HBOs, the authors identify three sets of reasons for moral concern. The first set of reasons regards the potential emergence of sentience/consciousness in HBOs that would endow them with a (...)

Lewis et al. (2011) attempted to restore the reputation of Samuel George Morton, a 19th century physician who reported on the skull sizes of different folk-races. Whereas Gould (1978) claimed that Morton’s conclusions were invalid because they reflected unconscious bias, Lewis et al. alleged that Morton’s findings were, in fact, supported, and Gould’s analysis biased. We take strong exception to Lewis et al.’s thesis that Morton was “right.” We maintain that Gould was right to reject Morton’s analysis as inappropriate and (...)

Giovanni Jervis was a prominent figure in the Italian intellectual landscape of the last fifty years. A student of the philosopher-ethnologist Ernesto De Martino, the main focus of his research was on social psychiatry and psychology, the foundations of psychology, and the psychological aspects of social and political problems. This article explores his rethinking of the psychoanalytic criticism of the subject. I shall try to show that Jervis has given shape to the premises of a philosophical anthropology that originally aims (...)

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...)

Ethics, Law and the Politics of Information : A Guide to the Philosophy of Luciano Floridi.Massimo Durante - 2017 - Dordrecht: Imprint: Springer.
This book provides a detailed discussion of the theoretical and practical implications of the change driven by ICTs. Such a change is often much more profound than an emphasis on information technology and society can capture, for not only does it bring about ethical and policy vacuums that call for a new understanding of ethics, politics and law, but it also "re-ontologizes reality", as propounded by Luciano Floridi's philosophy and ethics of information. The informational turn is transforming our understanding of (...)

For Guizot, legal sovereignty is a divine, absolute prerogative precluded from mankind. The best possible form of government is that based upon a representative system, since such a system continuosly shifts the attibution of power from one subject to another. Guizot's analysis, which also denies the modern democratic principle of the sovereignty of the will of the people, examines certain aspects common to all representative systems, such as the relationship between the elected and the electorate and between the majority and (...)

Free Will and Retribution Today.Mario De Caro & Massimo Marraffa - unknown
The paper addresses two issues that have been recently debated in the literature on free will, moral responsibility, and the theory of punishment. The first issue concerns the descriptive project, the second both the substantive and the prescriptive project. On theoretical, historical and empirical grounds, we claim that there is no rationale for fearing that the spread of neurocognitive findings will undermine the ordinary practice of responsibility attributions. We hypothetically advocate two opposite views: that such findings would cause the collapse (...)
