This paper unites Deely’s call for a better understanding of semiotics with Jaeger’s insight into the sophists and the cultural history of the Ancient Greeks. The two bodies of knowledge are brought together to try to better understand the importance of rhetorical processes to political forms such as democracy. Jaeger explains how cultural expression, particularly poetry, changed through the archaic and classical eras to deliver, or at least to be commensurate with contemporary politics and ideologies. He explains how Plato struggled (...) against certain poetry and prose manifestations in his ambition to create a ‘perfect man’ – a humanity which would think in a way which would enable the ideal Republic to flourish. Deely’s approach based on Poinsot and Peirce presents a theoretical framework by means of which we can think of the struggle to influence individual and communal conceptualisation as a struggle within semiotics. This is a struggle over the ways reality is signified by signs. Signs are physical and mental indications which, in the semiotic tradition, are taken to produce human subjectivity – human ‘being’. Deely’s extensive body of work is about how these signs are the building blocks of realist constructions of understanding. This paper is concerned with the deliberate use of oral and written signs in rhetorical activity which has been deliberately crafted to change subjectivity. We discuss: what thought and culture is in terms of semiotics and Jaeger’s depiction of Ancient Greece as an illustration of the conjunction between culture and subjectivity. These two fields are brought together in order to make the argument that rhetoric can be theorised as the deliberate harnessing of semiotic affects. The implication is that the same semiotic, subjectivity-changing potency holds for 21st century rhetoric. However fourth century BCE Athens is the best setting for a preliminary discussion of rhetoric as deliberate semiotic practice because this was when rhetoric was most clearly understood for what it is. By contrast a discussion concentrating on modern rhetoric: public relations; advertising; lobbying; and public affairs would open wider controversies requiring considerably more complex explanation. The greatest threat faced by wild animals often comes from the destruction of their habitats by humans. Traditional environmental-conservation paradigms often fail to prevent this destruction. This paper claims that, where access to habitat is a necessary condition of their continued existence or wellbeing, wild animals have sufficiently strong interests in their habitat to generate rights to it. The paper argues that these rights should be instantiated in the form of collective usufructuary property rights, and, in cases of serious and (...) systematic violation of these rights, wild animals gain a remedial right of secession for their habitat. This paper presents a new way of thinking about the relationship between humans and the nonhuman animals in their care. Most ethical analysis of the treatment of nonhuman animals has focussed on questions of moral status, justice, and the wrongness of harming them. This paper does something different, it examines the role played by trust in interspecies relationships. In both agriculture and laboratory settings, humans deliberately foster trusting relationships with nonhuman animals. An intrinsic feature of the trusting relationship in these (...) settings is that it is created in order to be exploited and betrayed. However, little consideration has been given to asking what a deliberate betrayal of another species says about the character of those who carry out the betrayals. This paper argues that regardless of the moral status of nonhuman animals, a willingness to foster trust in order to exploit the vulnerability of a nonhuman suggests a serious character flaw. Our failure thus far to apprehend systematic forms of betrayal indicates a moral blind-spot when it comes to other species. (shrink)

Animal agriculture predominantly involves farming social animals. At the same time, the nature of agriculture requires severely disrupting, eliminating, and controlling the relationships that matter to those animals, resulting in harm and unhappiness for them. These disruptions harm animals, both physically and psychologically. Stressed animals are also bad for farmers because stressed animals are less safe to handle, produce less, get sick more, and produce poorer quality meat. As a result, considerable efforts have gone into developing stress-reduction methods. Many of (...) these attempt to replicate behaviours or physiological responses that develop or constitute bonding between animals. In other words, humans try to mitigate or ameliorate the damage done by preventing and undermining intraspecies relationships. In doing so, the wrong of relational harms is compounded by an instrumentalisation of trust and care. The techniques used are emblematic of the welfarist approach to animal ethics. Using the example of gentle touching in the farming of cows for beef and dairy, the paper highlights two types of wrong. First, a wrong done in the form of relational harms, and second, a wrong done by instrumentalising relationships of care and trust. Relational harms are done to nonhuman animals, whilst instrumentalisation of care and trust indicates an insensitivity to morally salient features of the situation and a potential character flaw in the agents that carry it out. This paper outlines the moral contours of human relationships with companion animals. The paper details three sources of duties to and regarding companion animals: (1) from the animal’s status as property, (2) from the animal’s position in relationships of care, love, and dependency, and (3) from the animal’s status as a sentient being with a good of its own. These three sources of duties supplement one another and not only differentiate relationships with companion animals from wild animals and other categories (...) of domestic animals such as livestock, but they also overlap to provide moral agents with additional reasons for preventing and avoiding harm to companion animals. The paper concludes that not only do owners and bystanders have direct and indirect duties to protect companion animals from harm, but also that these duties have the potential, in some circumstances, to clash with duties owed to the state and fellow citizens. Predictive risk modelling is a computational method used to generate probabilities correlating events. The output of such systems is typically represented by a statistical score derived from various related and often arbitrary datasets. In many cases, the information generated by such systems is treated as a form of evidence to justify further action. This paper examines the nature of the information generated by such systems and compares it with more orthodox notions of evidence found in epistemology. The paper focuses on (...) a specific example to illustrate the issues: The New Zealand Government has proposed implementing a predictive risk modelling system which purportedly identifies children at risk of a maltreatment event before the age of five. Timothy Williamson’s conception of epistemology places a requirement on knowledge that it be explanatory. Furthermore, Williamson argues that knowledge is equivalent to evidence. This approach is compared to the claim that the output of such computational systems constitutes evidence. While there may be some utility in using predictive risk modelling systems, I argue, since an explanatory account of the output of such algorithms that meets Williamson’s requirements cannot be given, doubt is cast upon the resulting statistical scores as constituting evidence on generally accepted epistemic grounds. The algorithms employed in such systems are geared towards identifying patterns which turn out to be good correlations. However, rather than providing information about specific individuals and their exposure to risk, a more valid explanation of a high probability score is that the particular variables related to incidents of maltreatment are just higher amongst certain subgroups in a population than they are amongst others. The paper concludes that any justification of the information generated by such systems is generalised and pragmatic at best and the application of this information to individual cases raises various ethical issues. Defining privacy is problematic because the condition of privacy appears simultaneously to require separation from others, and the possibility of choosing not to be separate. This latter feature expresses the inherent normative dimension of privacy: the capacity to control the perceptual and informational spaces surrounding one’s person. Clearly the features of separation and control as just described are in tension because one may easily enough choose to give up all barriers between oneself and the public space. How could the capacity (...) for privacy give rise to its absence? Yet both the separation and control features of privacy do seem indispensable to any sensible understanding of it. In this article I propose a cosmopolitan approach to animal rights based upon Kant's right of universal hospitality. Many approaches to animal rights buttress their arguments by finding similarities between humans and non-human animals; in this way they represent or resemble ethics of partiality. In this article I propose an approach to animal rights that initially rejects similarity approaches and is instead based upon the adoption of a cosmopolitan mindset acknowledging and respecting difference. Furthermore, and in agreement with Martha Nussbaum, (...) and Sue Donaldson and Will Kymlicka, I endorse the view that theories of animal rights need to be theories of justice and include a political component. Contra Donaldson and Kymlicka, however, I argue that the starting point for analysis of political theories of animal rights should be at the global rather than national level. Taking animals as strangers, I propose adopting a Kantian cosmopolitan mindset and ethic of universal hospitality towards them. I address how a ius cosmopoliticum that is hospitable to the interests of non-human animals can govern interactions with animals on fair terms, and I respond to concerns that cosmopolitanism cannot accommodate non-human animals because it is a democratic ideal, is grounded in logocentrism or rests upon ownership of territory by humans. An anthology of new translations of essential readings from the classical texts of early Chinese philosophy. It includes the Analects of Confucius, Meng Zi (Mencius), Xun Zi, Mo Zi, Lao Zi (Dao De Jing), Zhuang Zi, and Han Fei Zi, as well as short chapters on the Da Xue and the Zhong Yong. Pedagogically organized, it offers philosophically sophisticated annotations and commentaries as well as an extensive glossary explaining key philosophical concepts in detail.

In previous research, we have argued that private companies should be more open with their scientific research findings. However, our research assumed, somewhat naively perhaps, that public institutions were quite open. Recent findings have suggested otherwise, and in this paper we explore the dilemma faced by industry, universities, and society in attempting to balance the needs of openness (to rapidly advance the body of knowledge), with secrecy (to protect the economic returns to a new innovation).

Marya Schechtman argues that psychological continuity accounts of personal identity, as represented by Derek Parfit's account, fail to escape the circularity objection. She claims that Parfit's deployment of quasi-memory (and other quasi-psychological) states to escape circularity implicitly commit us to an implausible view of human psychology. Schechtman suggests that what is lacking here is a coherence condition, and that this is something essential in any account of personal identity. In response to this I argue first that circularity may be escaped (...) using quasi-psychological states even with the addition of the coherence condition. Second, I argue that there is something right about the coherence condition, and a major task of this paper is to identify its proper theoretical role. I do so by reflection on integration therapies for people with multiple personality disorder (MPD). The familiar distinction between the moral and the metaphysical concept of the person is developed alongside such reflection. Connecting these two issues I argue that coherence acts as a normative constraint on accounts of personal identity, but that the normative dimension of personhood is not essential to our notion of a person tout court. Increasingly, protests occur across borders and are carried out by non-nationals. Many of these protests include elements that break the laws of their host country and are aimed at issues of global concern. Despite the increasing frequency of transnational protest, little ethical consideration has been given to it. This article provides a cosmopolitan justification for transnational disobedience on behalf of self and others. The article argues that individuals may be justified in illegally protesting in other states, and that in some (...) circumstances they may do so even when laws have been legitimately constituted by the domestic constituencies of those states. Using a cosmopolitan reading of the notion of civility and of the civil realm, the article argues that transnational protests are capable of conforming to the normative and conceptual standards necessary for them to be labelled civil disobedience. As a result, they ought to carry a privileged moral status compared with other forms of protest. The article applies the All Affected Principle to argue that a democratic deficit can provide transnational protesters and resident migrants with a right to civil disobedience even where that right is not held by members of the demos they protest within. How do exercises of authority different from requests, threats and advice? It is common to answer this question by emphasising the role of obligation, or the role of justified coercion, to the exclusion of the other. Using a distinction between an office of authority and an exercise of authority, I develop a taxonomy of such views of authority and present arguments against each of them. In place of these views, I argue for a symmetrical view of obligation and coercion within (...) legal authority. On my view, authority is a conformance of one’s will to another’s will that the subject could recognise as consistent with the law’s respect for her, and this implies that obligation and coercion can equally be exercises of authority. Animal activists sometimes engage in vigils and acts of witnessing as forms of political protest. For example, the Animal Save Movement, a global activist network, regards witnessing the suffering of non-human animals as a moral duty of veganism. The act of witnessing is intended to non-violently communicate both attitudes and principles. These forms of activism are unlike other forms of protest, relying for much of their force upon passive, non-confrontational actions. This article explores the ethical character of vigils and witnessing (...) in order to evaluate their role in animal rights activism. It argues that the love-based ethic behind the Animal Save Movement's form of witnessing is overly demanding, overly expansive and overly deferential towards wrongdoers. In its place, this article offers a narrower account of witnessing, detached from controversial spiritual elements. Vigils and conscious acts of witnessing, it is claimed, are political acts aimed at fulfilling duties to seek justice for non-human animals. (shrink)

: The role of vagueness in the Laozi is explored by investigating its connection with "process." First, a hermeneutic methodology is developed and adopted, derived from Peirce's notion of "abduction." Second, this notion is analyzed, and several distinctive characteristics, or "traces," of vagueness are identified. Third, evidence of these traces in the text of the Laozi is collected, with comments on their significance in the Daoist context.

Among theories of personal identity over time the simple view has not been popular among philosophers, but it nevertheless remains the default view among non philosophers. It may be construed either as the view that nothing grounds a claim of personal identity over time, or that something quite simple (a soul perhaps) is the ground. If the former construal is accepted, a conspicuous difficulty is that the condition of causal dependence between person-stages is absent. But this leaves such a view (...) open to an objection from the failure to provide a condition of individuation. If, on the other hand something like a soul is said to ground personal identity over time, such an account turns out to be more suited to a kind of continuity view. (shrink)

We approach the subject of o-minimality from the point of view of tame systems, following the work of Charbonnel and Wilkie. This gives some general sufficient conditions for a system to be model complete and o-minimal. We are then able to obtain the following generalisation of a recent result of Gabrielov : A polynomially bounded o-minimal expansion of the real ordered field by a collection of restricted C∝ functions, which is closed under partial differentiation, is model complete.

I argue that contemporary philosophy of language in the analytic tradition rests on two fundamentally wrong assumptions: empiricism and externalism. After I show why these two assumptions are incorrect, I turn my attention to biological rationalism. Biological rationalism—a research program inspired by the work of Noam Chomsky—is committed to nativism and internalism. I believe biological rationalism provides the best framework to achieve a genuine understanding of language. During the period of growth of e‐commerce, e‐business and online life in general, trust has been identified by a number of authors as a key factor, the absence of which can act as a powerful disincentive to an individual’s engagement in a transaction. This has encouraged a great deal of research into the various facets of trust in an online environment, both theoretical and empirical. One of the many recommendations for business practice that have emerged from this research is the (...) suggestion that online businesses should publish on their website a privacy policy that explains clearly the use that will be made of any personal information collected on the site, the third parties to whom it may be disclosed, and the circumstances under which disclosure may occur. A number of surveys have been conducted that highlight the rather patchy adoption of this recommendation in various countries. We now know, for example, that by no means all online organisations publish an online privacy policy, and that many of those that do exist display a range of serious shortcomings, including poor visibility on the site, incomplete coverage of the main issues of concern and poor readability. However, previous discussion of privacy policies has tended to assume that any particular policy can provide value to its readers by informing them of the privacy practices of its host organisation, and thus also to its publishers through encouraging customers and clients to trust them more than they otherwise would. This assumption is expected to be valid where the policy meets certain criteria, which are either established on the basis of theoretical considerations, or are derived from a kind of best‐in‐breed comparative exercise. This paper seeks to address the question how far privacy policies can ever achieve the goal of providing clear information to website visitors about the privacy practices of an organisation. It reports on an empirical study that was conducted between November 2005 and April 2006 using two groups of University students as subjects. The subjects were asked to read three privacy policies, selected in advance by the author, and to complete a short questionnaire on what the subject thought each policy had to say about certain key privacy issues. The results reveal that there is surprisingly little agreement about what a policy actually means. This has significant implications both for policy writers and their managers, and also for those who are considering entering into a transaction with the host website. There is a need for further research to investigate this question in more detail, but it is clear from these findings that we know less than we thought we did about the ways in which people interpret the notices that they read on websites. Breathing poses an entangled solution. Surfing, in which a human body stands upright inside a rotating barrel of unbreathable whitewater, provides a way to imagine the connection between these two things.The sublime has represented an elevated category of literary language since the classical writer Longinus's On the Sublime (~1st century CE). From the start, the (...) sublime captures grandeur and also an excess that challenges human thinking. Many of the essential Romantic and Post-Romantic tropes of the sublime that would later appear in dense philosophical accounts, from Edmund Burke and Immanuel Kant to Jean-Francois Lyotard and Jacques Derrida, show themselves embryonically in Longinus's brief classical description.1 The key force of sublime style, Longinus emphasizes, is irrationality: "A lofty passage does not convince the reason of the reader, but takes him out of himself. That which is admirable ever confounds our judgment" (1.4). The conceptual violence of the sublime strains our imaginations almost to breaking, and Longinus's intuition that sublimity always sits on the far side of human comprehension becomes a central feature of this idea in literary history. Although we know very little about Longinus the author–neither his name nor the century in which he lived are certain–he fingers the particular pleasurable pain and rupture of coherence that would become the signature of the sublime in modern poetics. The problem with the sublime perspective is that it craves rupture, centers the human imagination, and refuses to make space for nonhuman collaborators. The opposite of the sublime's imaginative conquest of the world may be simple breathing, the taking of alien air into one's lungs and body, and the environmental dependence each breath marks.The philosopher Graham Harman has recently traced the sublime lineage of Burke and Kant to Lyotard, Levinas, Derrida, and other twentieth-century thinkers, in order to reject the concept as fundamentally [End Page 79] anthropocentric. Harman instead advocates for a philosophy that does not require the shaping structures of human perspective. He argues for an ecological art that engages with the world beyond the merely human perspective, "art that explores unforeseen interactions between the different parts of the external world." What Harman terms "unsublime ecology" might reasonably be described as an inhuman ecological perspective. The philosopher reminds us that the sublime has always been, both from Longinus and in Harman's reading explicitly from Kant and Burke to Lyotard and Derrida, a ju-jitsu trick in which the imagination of a (white male) subject reintegrates what it cannot fully comprehend. The list of poetic works whose language most commonly appears as exemplary of the sublime–Milton's Paradise Lost, Shelley's "Mont Blanc," Shakespeare's King Lear, Wordsworth's The Prelude–suggest that the mode appeals to poetic egoists of a particularly masculinine type.2The heroic sublime of these poets and theorists falters on the physical fact of breathing. Each day of their lives, more than 20,000 times per day, every one of these men, even stern, blind Milton dictating his prophetic poem to dutiful daughters after his revolution had failed, drew nonhuman air into and out of his lungs, exchanging oxygen and carbon dioxide. Many paradigmatic forms of animal rights and environmental activism have been classed as terrorism both in popular discourse and in law. This paper argues that the labelling of many violent forms of direct action carried out in the name of animal rights or environmentalism as ‘terrorism’ is incorrect. Furthermore, the claim is also made that even those acts which are correctly termed as terrorism are not necessarily wrongful acts. The result of this analysis is to call into question the terms (...) of public debate and the legitimacy of anti-terrorism laws targeting and punishing radical activism. (shrink)

For Peter Sloterdijk, Friedrich Nietzsche represents nothing short of a "catastrophe in the history of language" -- a new evangelist for a linguistics of narcissistic jubilation. Nietzsche offered a philosophical declaration of independence from humility, a meeting-point of sobriety and megalomania that for Sloterdijk has come to define the very project of philosophy. Yet for all the significance of this language-event named Nietzsche, Nietzsche's contributions have too often been elided and the contradictions at the root of his philosophy too often (...) edited out. As Sloterdijk observes, "Never has an author so insisted on distinction and yet attracted such vulgarity." Nietzsche Apostle, drawn from a speech Sloterdijk gave in 2000 on the hundredth anniversary of Nietzsche's death, looks at the ways in which Nietzsche has been branded over the years through selective compilation, and at the ways in which Nietzsche turned himself into a brand -- a brand announced by his proclaimed "fifth Gospel," _Thus Spoke Zarathustra_. For Sloterdijk, the focus should not be on the figure of Zarathustra or on the "will to power" often used as a kind of philosophical shorthand to sum up Nietzsche's work, but on Zarathustra's act of "speaking" itself. _Nietzsche Apostle_ offers a brief history of self-praise and self-affirmation, an examination of the evolution of boasting, and a very original approach to Nietzsche, philosophy's first designer brand of individualism. Peter Sloterdijk first became known in this country for his late 1980s Critique of Cynical Reason, which confronted headlong the "enlightened false consciousness" of Habermasian critical theory. Two decades later, after spending seven years in India studying Eastern philosophy, he is now attracting renewed interest for his writings on politics and globalization and for his magnum opus Spheres, a three-volume archaeology of the human attempt to dwell within spaces, from womb to globe: Bubbles, 1998; Globes, 1999; Foam, 2004, all forthcoming (...) from Semiotext. In Neither Sun nor Death, Sloterdijk answers questions posed by German writer Hans-Jürgen Heinrichs, commenting on such issues as technological mutation, development media, communication technologies, and his own intellectual itinerary.Iconoclastic and provocative, alternatively sparkling and bombastic, a child of '68 and a libertarian, Sloterdijk is the most exciting and controversial German philosopher to appear on the world scene since Nietzsche and Heidegger. Like Nietzsche, Sloterdijk remains convinced that contemporary philosophers have to think dangerously and let themselves be "kidnapped" by contemporary "hypercomplexities"; they must forsake our present humanist and nationalist world for a wider horizon at once ecological and global.Neither Sun nor Death is the best introduction available to Sloterdijk's philosophical theory of globalization. It reveals a philosophe extraordinaire, encyclopedic and provocative, as much at ease with current French Theory as with Heidegger and Indian mystic Osho Rajneesh. (shrink)

In An Ancient Quarrel Continued, Louis Mackey argues that the relationship of philosophy with the literary arts is more intimate, more problematic, and more interesting than its relationship with the sciences.

In the conventional analysis of human behaviour, power and ethics are frequently considered contrary principles, in that power enforces, while ethics elicits a free response. But, as James Mackey forcefully shows, a more adventurous philosophical study of human morality escapes the sense of contraries, and sets us on a quest for the kind of power that liberates human creativity. It then becomes possible to establish the framework for a critical assessment of the kind of power that ought to be (...) operative in the major structures of human society, civil or ecclesiastical, state governments and church hierarchies. Mackey analyses the religious question which then quite naturally emerges, as to whether this Eros-type power so manifest in human society originates from beyond the more empirical structures of churches, states and 'nature'; and the effort to detect the specifically Christian characterisation of an allegedly ultimate power working in us for final well-being finds its natural context. In what sense is a person addicted to drugs or alcohol incompetent, and so a legitimate object of coercive treatment? The standard tests for competence do not pick out the capacity that is lost in addiction: the capacity to properly regulate consumption. This paper is an attempt to sketch a justificatory framework for understanding the conditions under which addicted persons may be treated against their will. These conditions rarely obtain, for they apply only when addiction is extremely severe and great (...) harm threatens. It will be argued also that to widen the measures currently in place in some jurisdictions, though philosophically well-motivated, would require very strong evidence of a set of conditions disposing a person to an addictive future. It is doubtful that any such currently available evidence is strong enough to justify coercive treatment. Nevertheless, coercive treatment of addiction is already a reality, with the potential for more, and so some discussion will be presented regarding the extraordinary safeguards necessary to prevent misapplication of such treatment policies. Since this was not possible, Graham had them published instead by SOAS as a supplement to their Bulletin. Roth begins the Companion with a painstakingly reproduced computer-input version of Graham's original typewritten manuscript, which he also reorganized so that it corresponds to the (somewhat idiosyncratic) order and structure of Graham's translation.
