This paper argues that Internet access should be recognised as a human right because it has become practically indispensable for having adequate opportunities to realise our socio-economic human rights. This argument is significant for a philosophically informed public understanding of the Internet and because it provides the basis for creating new duties. For instance, accepting a human right to Internet access minimally requires guaranteeing access for everyone and protecting Internet access and use from certain objectionable interferences (e.g. surveillance, censorship, online (...) abuse). Realising this right thus requires creating an Internet that is crucially different from the one we currently have. The argument thus has wide-ranging implications. (shrink)

This major work covers almost all that has been learned about the acoustics of stringed instruments from Helmholtz's 19th-century theoretical elaborations to recent electroacoustic and holographic measurements.Many of the results presented here were uncovered by the author himself over a 20-year period of research on the physics of instruments in the violin family. Lothar Cremer is one of the world's most respected authorities on architectural acoustics and, not incidentally, an avid avocational violinist and violist.The book - which was published (...) in German in 1981 - first of all meets the rigorous technical standards of specialists in musical acoustics. But it also serves the needs and interests of two broader groups: makers and players of stringed instruments are expressly addressed, since the implications of the mathematical formulations are fully outlined and explained; and acousticians in general will find that the work represents a textbook illustration of the application of fundamental principles and up-to-date techniques to a specific problem.The first - and longest - of the book's three parts investigates the oscillatory responses of bowed strings. The natural nonlinearities that derive from considerations of string torsion and bending stiffness are deftly handled and concisely modeled.The second part deals with the body of the instrument. Special attention is given to the bridge, which transmits the oscillations of the strings to the wooden body and its air cavity. We construct a model where every increasing ω-sequence of regular cardinals carries a mutually stationary sequence which is not tightly stationary, and show that this property is preserved under a class of Prikry-type forcings. Along the way, we give examples in the Cohen and Prikry models of ω-sequences of regular cardinals for which there is a non-tightly stationary sequence of stationary subsets consisting of cofinality ω_1 ordinals, and show that such stationary sequences are mutually stationary in the presence of interleaved (...) supercompact cardinals. This article presents a mutual critique of the analytic and phenomenological theory of action. The first perspective focuses on the standard approach introduced by G.E.M. Anscombe. According to Anscombe, actions are events that are intentional under a description. Consequently, the distinction between action and mere behavior depends on the linguistic description of behavior. However, this perspective fails to address the possible transitions between behavior and action. One way to fill this gap is by investigating the specific form of intentionality belonging (...) to striving or tendency. Such an investigation can complement the standard theory of action by illuminating the realm in which volitional and intentional actions are formed. In this regard, it is instructive to examine A. Pfänder’s and E. Husserl’s philosophy of striving and willing. Pfänder’s _Phenomenology of Willing_ (1900) and the essay _Motives and Motivation_ (1911) reflect on the genesis of volition from striving. Both texts view willing as a particular form of striving that may, but does not have to, lead to action. Similarly, Husserl aims to retrace the pre-voluntary roots of willing, but unlike Pfänder, he considers willing and action to be necessarily connected. The second perspective focuses on what analytic philosophy contributes to philosophical action theory: the recognition of language’s constitutive role in determining actions. This is evident not only in terms of how we describe actions (Anscombe), but also in how we ascribe willing, intending, and acting to one another in communicative contexts (H.L.A. Hart). Therefore, a phenomenological investigation of action should be complemented by linguistic analysis. This idea is already outlined in rudiments by Husserl and particularly by Pfänder. (shrink)

A self-fulfilling prophecy in neuroprognostication occurs when a patient in coma is predicted to have a poor outcome, and life-sustaining treatment is withdrawn on the basis of that prediction, thus directly bringing about a poor outcome for that patient. In contrast to the predominant emphasis in the bioethics literature, we look beyond the moral issues raised by the possibility that an erroneous prediction might lead to the death of a patient who otherwise would have lived. Instead, we focus on the (...) problematic epistemic consequences of neuroprognostic SFPs in settings where research and practice intersect. When this sort of SFP occurs, the problem is that physicians and researchers are never in a position to notice whether their original prognosis was correct or incorrect, since the patient dies anyway. Thus, SFPs keep us from discerning false positives from true positives, inhibiting proper assessment of novel prognostic tests. This epistemic problem of SFPs thus impedes learning, but ethical obligations of patient care make it difficult to avoid SFPs. We then show how the impediment to catching false positive indicators of poor outcome distorts research on novel techniques for neuroprognostication, allowing biases to persist in prognostic tests. We finally highlight a particular risk that a precautionary bias towards early withdrawal of life-sustaining treatment may be amplified. We conclude with guidelines about how researchers can mitigate the epistemic problems of SFPs, to achieve more responsible innovation of neuroprognostication for patients in coma. (shrink)

Although the concept of Responsible Innovation (RI) has been applied to different types of innovations, three common assumptions have remained the same. First, emerging technologies require assessment because of their radical novelty and unpredictability. Second, early assessment is necessary to impact the innovation trajectory. Third, anticipation of unknowns is needed to prepare for the unpredictable. I argue that these assumptions do not hold for liminal innovation practices in clinical settings, which are defined by continuous transition on both sides of the (...) threshold between experiment and implementation, and between research and care. First of all, technologies at the center of liminal innovation practices have different characteristics than those typically attributed to emerging technologies. Additionally, the innovation trajectory is significantly different allowing continuous assessment and shaping long after implementation. Finally, these differences demand a reorientation in RI approaches for these cases, away from anticipation of the unknown and uncertain, and returning to observation of the known and predictable. This article is about the post-history of Hobbes’s name for the state and thus about the history of the name ‘Leviathan’ insofar as this name has remained the catchword for the (modern) state to this day (from the late 17th century to the beginning of the 21st century), but above all for that of absolutist-despotic proportions. This story, told here for the first time, is particularly interesting because it ultimately reveals a continuity in the understanding of Hob-bes that suggests that (...) this post-history not only has something to do with Hobbes’s Leviathan itself, but at least as much with its pre-history - with the name ‘Leviathan’, which Hobbes gave the state in reference to the biblical monster of the same name. In 2016, the United Nation’s General Assembly adopted a non-binding resolution regarding ‘The Promotion, Protection and Enjoyment of Human Rights on the Internet’. At the heart of this resolution is the UN’s concern that ‘rights that people have offline must also be protected online.’ While the UN thus recognises the importance of the Internet, it does so problematically selectively by focusing on protecting existing offline rights online. I argue instead that Internet access is itself a moral human right that requires (...) that everyone has unmonitored and uncensored access to this global medium, which should be publicly provided free of charge for those unable to afford it. Rather than being a mere luxury, Internet access should be considered a universal entitlement because it is necessary for people to be able to lead minimally decent lives. Accepting this claim transforms our conception of the Internet from a technology to that of a basic right. (shrink)

The question whether distributive justice is at bottom practice-dependent or practice-independent has received much attention in recent years. I argue that the problem of intergenerational justice resolves this dispute in favor of practice-independence. Many believe that we owe more to our descendants than leaving them a world in which they can merely lead minimally decent lives. This thought is particularly convincing given the fact that it is us who determine to a significant extent what this future world will look like. (...) However, no practices that would trigger distributive obligations exist between distant generations. Thus, if we have to leave more than a minimum for future generations, we cannot conceive of distributive justice in terms of the justification of ongoing social interactions. Rather we have to think of the entire concept as an idea based on persons’ legitimate interests and capacity for well-being, and which abstracts from participation in particular practices. (shrink)

The major theoretical framework relative to the perception of illusory figures is reviewed and discussed in the attempt to provide a unifying explanatory account for these phenomena.

Since the Brexit Referendum in the United Kingdom and the election of Donald Trump as US President in 2016, the term ‘fake news’ has become a significant source of concern. Recently, the European Commission and the British House of Commons have condemned the phenomenon as a threat to their institutions’ democratic processes and values. However, political disinformation is nothing new, and empirical studies suggest that fake news has not decided crucial elections, that most readers do not believe the online fake (...) news stories they read, and that political polarization in Western democracies like the US began to increase long before online fake news existed. The question then is: how exactly does fake news threaten democracies? This paper argues that online fake news threatens democratic processes because it undermines citizens’ epistemic trust in each other. This in turn threatens to undermine the perceived legitimacy and the moral justification of democratic institutions as a whole. While online fake news is a symptom of a much larger issue (how has the Internet affected democracies, and how can we use its positive power while checking its negative effects?), it deserves particular attention given the potential danger it presents for the viability and the legitimacy of the democratic process. When information on a coma patient’s expected outcome is uncertain, a moral dilemma arises in clinical practice: if life-sustaining treatment is continued, the patient may survive with unacceptably poor neurological prospects, but if withdrawn a patient who could have recovered may die. Continuous electroencephalogram-monitoring is expected to substantially improve neuroprognostication for patients in coma after cardiac arrest. This raises expectations that decisions whether or not to withdraw will become easier. This paper investigates that expectation, exploring cEEG’s impacts when it becomes (...) part of a socio-technical network in an Intensive Care Unit. Based on observations in two ICUs in the Netherlands and one in the USA that had cEEG implemented for research, we interviewed 25 family members, healthcare professionals, and surviving patients. The analysis focuses on the way patient outcomes are constructed, the kind of decision support these outcomes provide, and how cEEG affects communication between professionals and relatives. We argue that cEEG can take away or decrease the intensity of the dilemma in some cases, while increasing uncertainty for others. It also raises new concerns. Since its actual impacts furthermore hinge on how cEEG is designed and implemented, we end with recommendations for ensuring responsible development and implementation. (shrink)

Immanuel Kant is recognized as one of the first philosophers who wrote systematically about global justice and world peace. In the current debate on global justice he is mostly appealed to by critics of extensive duties of global justice. However, I show in this paper that an analysis of Kant’s late work on rights and justice provides ample resources for disagreeing with those who take Kant to call for only modest changes in global politics. Kant’s comments in the Doctrine of (...) Right clarify that he thinks we need a coercively enforced global civil condition. But his work also contains ideas that imply that within such a global legal order there must be no extreme forms of poverty and inequality, and that the current holdings of states are by no means conclusive possessions without confirmation by the global legal order we have a duty to establish. Thus, this paper challenges the prevailing interpretation of Kant as a conservative thinker about global justice that is held, for instance, by the leading contemporary liberal thinkers such as John Rawls, Thomas Nagel, and Ronald Dworkin. In the contemporary philosophical literature, political legitimacy is often identified with a right to rule. However, this term is problematic. First, if we accept an interest theory of rights, it often remains unclear whose interests justify a right to rule : either the interest of the holders of this right to rule or the interests of those subject to the authority. And second, if we analyse the right to rule in terms of Wesley Hohfeld’s characterization of rights, we find disagreement (...) among philosophers about what constitutes the conceptual core of political authority: a power-right or a claim-right to rule. In this paper I show that both of these are problematic for a number of reasons. First, if we think that it is only the interests of the holders of a right to rule that justify the possession of authority, the conceptual core of authority must consist in a claim-right. However, this understanding of authority biases our thinking about legitimacy in favor of democratic exercises of power. Second, if we hold such a decisively democratic view of legitimacy, we confront an impasse with respect to addressing global collective action problems. Although it is clear that political authority is necessary or useful for solving these issues, it is doubtful that we can establish global institutions that are democratically authorized anytime soon. The paper suggests an alternative ‘Power-Right to Command View’ of political legitimacy that avoids the democratic bias and allows for thinking about solutions to global problems via global service authorities. O artigo se ocupa da Hermenêutica da facticidade, do filósofo alemão contemporâneo Martin Heidegger (1889-1976). Nosso propósito inicial é apresentar, sumariamente, os termos do referido projeto filosófico e como este pretende uma abordagem do fenômeno humano enfocado como “vida fática” (faktische Leben). Neste modo de visar, importa para Heidegger a determinação dessa vida, a qual ele denomina de “facticidade” (Faktizität), conceito que, ao longo de sua investigação, vai, progressivamente, ganhando importância e centralidade. Tratado no seio de Ontologia: Hermenêutica da Facticidade (...) (preleção do semestre de verão ministrada na Universidade de Friburgo em 1923), o conceito de facticidade tem lugar no tentame de elaboração de um modo de tornar nosso ser mais claro a nossa própria compreensão. Justamente por isso, uma tal hermenêutica de nós mesmos não constitui uma metodologia de interpretação de um objeto que pretensamente seríamos. Assim, hermenêutica diria, antes, do procedimento que, contando com a compreensão que temos de nosso próprio ser, pode tomar o sentido de nosso factum, de nosso fato de ser. Intentamos evidenciar o quanto a hermenêutica da facticidade é tão hermenêutica quanto também fenomenológica e que, a ideia de “tomar o nosso próprio ser nas mãos”. O artigo ainda se empenhará por deixar claro o quanto a facticidade não é um traço natural, substancial ou essencial do ente que somos; em sua caracterização fenomenológica, tal figura constitui, para Heidegger, uma dinâmica de “fazer-se”, o que nos leva a pensar no caráter em aberto e continuamente criador da vida em seu “dar-se”. Ao fim, ensaiamos, como nosso título anuncia, uma indicação do quanto a hermenêutica da facticidade teria a contribuir para o modo de compreender e comportar-se de uma psicologia fenomenológico-existencial. Book review: Reinach, A. (2020) O que é fenomenologia? Uma abordagem platônica. Trad. Luis Henrique Toniolo Serediuk Silva. São Paulo: A Outra Via.

Innovations permeate healthcare settings on an ever-increasing scale. Health technology innovations impact our perceptions and experiences of health, care, disease, etc. Because of the fast pace these HTIs are being introduced in different healthcare settings, there is a growing societal consensus that these HTIs need to be governed by ethical reflection. This paper reports a systematic review of argument-based literature which focused on articles reporting on ethical frameworks to screen or evaluate HTIs. To do this a four step methodology was (...) followed: Literature search conducted in five electronic literature databases; Identification of relevant articles; Development of data-extraction tool to analyze the included articles; Analysis, synthesis of data and reporting of results. Fifty-seven articles were included, each reporting on a specific ethical framework. These ethical frameworks existed out of characteristics which were grouped into five common ones: Motivations for development and use of frameworks; Objectives of using frameworks; Specific characteristics of frameworks ; Ethical approaches and concepts used in the frameworks; Methods to use the frameworks. Although this multiplicity of ethical frameworks shows an increasing importance of ethically analyzing HTIs, it remains unclear what the specific role is of these analyses. An ethics of caution, on which ethical frameworks rely, guides HTIs in their design, development, implementation, without questioning their technological paradigm. An ethics of desirability questions this paradigm, without guiding HTIs. In the end, a place needs to be found in-between, to critically assess HTIs. (shrink)

Following the pioneering studies of the receptive field (RF), the concept gained further significance for visual perception by the discovery of input effects from beyond the classical RF. These studies demonstrated that neuronal responses could be modulated by stimuli outside their RFs, consistent with the perception of induced brightness, color, orientation, and motion. Lesion scotomata are similarly modulated perceptually from the surround by RFs that have migrated from the interior to the outer edge of the scotoma and in this way (...) provide filling-in of the void. Large RFs are advantageous to this task. In higher visual areas, such as the middle temporal and inferotemporal lobe, RFs increase in size and lose most of their retinotopic organization while encoding increasingly complex features. Whereas lowerlevel RFs mediate perceptual filling-in, contour integration, and figure–ground segregation, RFs at higher levels serve the perception of grouping by common fate, biological motion, and other biologically relevant stimuli, such as faces. Studies in alert monkeys while freely viewing natural scenes showed that classical and nonclassical RFs cooperate in forming representations of the visual world. Today, our understanding of the mechanisms underlying the RF is undergoing a quantum leap. What had started out as a hierarchical feedforward concept for simple stimuli, such as spots, lines, and bars, now refers to mechanisms involving ascending, descending, and lateral signal flow. By extension of the bottom-up paradigm, RFs are nowadays understood as adaptive processors, enabling the predictive coding of complex scenes. Top-down effects guiding attention and tuned to task-relevant information complement the bottom-up analysis. (shrink)

Human rights protect the conditions of a minimally decent life of which mental health is an indispensable element. Adequate care for mental health is thus recognized as part of the human right to health. However, for populations living far from urban centers, adequate in-person (mental) health care is often extremely costly and thus not provided. Digital mental health care options have become an effective alternative to in-person treatment. Benefitting from these new digital opportunities, though, requires sufficient access to the internet. Because everyone has a human right to adequate health care, and digital mental health care is now an effective option for progressively realizing this human right for people who live in remote regions, these people also have to be understood to have a right to access to the internet. This right to internet access creates duties for public authorities and the international community to create the required digital infrastructure and (where needed) to cover the costs of internet access where this is the only feasible way of delivering, or progressively realizing, the mental health care that is indispensable for having the opportunity to lead minimally decent lives. In her debate with Michael Blake, Gillian Brock sets out to justify emigration restrictions on medical workers from poor states on the basis of their free-riding on the public investment that their states have made in them in form of a publicly funded education. For this purpose, Brock aims to isolate the question of emigration restrictions from the larger question of responsibilities for remedying global inequalities. I argue that this approach is misguided because it is blind to decisive factors at (...) play in the problem of medical brain drain and consequently distorts the different responsibilities this problem generates. Brock’s strategy, if successful, would effectively lead to punishing emigrating workers from poor states for the free-riding and exploitation that is committed by affluent states – which is a counter-intuitive result. While almost everyone has heard of human rights, few will have reflected in depth on what human rights are, where they originate from and what they mean. A Philosophical Introduction to Human Rights – accessibly written without being superficial – addresses these questions and provides a multifaceted introduction to legal philosophy. The point of departure is the famous 1948 Universal Declaration of Human Rights, which provides a frame for engagement with western legal philosophy. Thomas Mertens sketches the philosophical and (...) historical background of the Declaration, discusses the ten most important human rights with the help of key philosophers, and ends by reflecting on the relationship between rights and duties. The basso continuo of the book is a particular world view derived from Immanuel Kant. 'Unsocial sociability' is what characterises humans, i.e. the tension between man's individual and social nature. Some human rights emphasize the first, others the second aspect. The tension between these two aspects plays a fundamental role in how human rights are interpreted and applied. (shrink)

O propósito do artigo é abordar o conceito de jogo (Spiel) na hermenêutica filosófica de Gadamer, tal como aparece na obra Verdade e Método. Questionamos como o jogo, tratado como metáfora, nos permite compreender conceitos genuinamente hermenêuticos como compreensão e interpretação. O objetivo é mostrar o jogo como uma dinâmica existencial quando a questão é compreender e interpretar. Centramo-nos na noção de compreensão e no campo de jogo que a constitui; também, o quanto a interpretação é formada a partir de (...) estruturas de compreensão prévias e de significados historicamente consolidados. O objetivo, por fim, é indicar como seria engendrada a compreensão em um jogo que estabelece tanto o jogador quanto o jogado. Entre nossas metas específicas, cabe apontar que as interpretações nunca são cabais, estando, portanto, sujeitas a revisões de seus significados na própria dinâmica que os fundamenta. (shrink)

Aim: To elicit preferences for prognostic information, attitudes towards withdrawal of life-sustaining treatment (WLST) and perspectives on acceptable quality of life after post-anoxic coma within the adult general population of Germany, Italy, the Netherlands and the United States of America. Methods: A web-based survey, consisting of questions on respondent characteristics, perspectives on quality of life, communication of prognostic information, and withdrawal of life-sustaining treatment, was taken by adult respondents recruited from four countries. Statistical analysis included descriptive analysis and chi2-tests for (...) dierences between countries. Results: In total, 2012 respondents completed the survey. In each country, at least 84% indicated they would prefer to receive early prognostic information. If a poor outcome was predicted with some uncertainty, 37-54% of the respondents indicated that WLST was not to be allowed. A conscious state with severe physical and cognitive impairments was perceived as acceptable quality of life by 17–44% of the respondents. Clear differences between countries exist, including respondents from the U.S. being more likely to allow WLST than respondents from Germany (OR = 1.99, p < 0.001) or the Netherlands (OR = 1.74, p < 0.001) and preferring to stay alive in a conscious state with severe physical and cognitive impairments more than respondents from Italy (OR = 3.76, p < 0.001), Germany (OR = 2.21, p < 0.001), or the Netherlands (OR = 2.39, p < 0.001). Conclusions: Over one-third of the respondents considered WLST unacceptable when there is any remaining prognostic uncertainty. Respondents had a more positive perspective on acceptable quality of life after coma than what is currently considered acceptable in medical literature. This indicates a need for a closer look at the practice of WLST based on prognostic information, to ensure responsible use of novel prognostic tests. (shrink)

I describe characteristic phenomena of quantum physics that suggest that reality appears to us in two domains: the open and well-known domain of empirical, material things—the realm of actuality—and a hidden and invisible domain of nonempirical, non-material forms—the realm of potentiality. The nonempirical forms are part of physical reality because they contain the empirical possibilities of the universe and can manifest themselves in the empirical world. Two classes of nonempirical states are discussed: the superposition states of microphysical entities, which are (...) nonempirical because observation destroys them, and the virtual states of material systems, which are nonempirical because they are empty. The non-empirical part to physical reality represents a predetermined and hidden order that exists before it is empirical, and the visible world is an emanation out of it. I discuss consequences for our understanding of human nature, the origin of life, and human values. Reality is an indivisible wholeness that is aware of its processes, like a Cosmic Spirit, and it reveals its awareness in the mindlike properties of elementary processes as well as in the human consciousness. Thus, one is led to G. W. F. Hegel's thesis that the Cosmic Spirit is thinking in us. (shrink)

A linearly ordered structure $$ is called o-minimal if every parametrically definable subset of M is a finite union of points and open intervals of M.The main subject of this thesis is the algebraic and model theoretic examination of o-minimal exponential fields $$ whose exponential satisfies the differential equation $\exp ' = \exp $ with initial condition $\exp = 1$. This study (...) is mainly motivated by the Transfer Conjecture, which states as follows:Any o-minimal exponential field $$ whose exponential satisfies the differential equation $\exp ' = \exp $ with initial condition $\exp =1$ is elementarily equivalent to $\mathbb {R}_{\exp }$.Here, $\mathbb {R}_{\exp }$ denotes the real exponential field $$, where $\exp $ denotes the standard exponential $x \mapsto \mathrm {e}^x$ on $\mathbb {R}$. Moreover, elementary equivalence means that any first-order sentence in the language $\mathcal {L}_{\exp } = \{+,-,\cdot,0,1, <,\exp \}$ holds for $$ if and only if it holds for $\mathbb {R}_{\exp }$.The Transfer Conjecture, and thus the study of o-minimal exponential fields, is of particular interest in the light of the decidability of $\mathbb {R}_{\exp }$. To the date, it is not known if $\mathbb {R}_{\exp }$ is decidable, i.e., whether there exists a procedure determining for a given first-order $\mathcal {L}_{\exp }$ -sentence whether it is true or false in $\mathbb {R}_{\exp }$. However, under the assumption of Schanuel’s Conjecture—a famous open conjecture from Transcendental Number Theory—a decision procedure for $\mathbb {R}_{\exp }$ exists. Also a positive answer to the Transfer Conjecture would result in the decidability of $\mathbb {R}_{\exp }$. Thus, we study o-minimal exponential fields with regard to the Transfer Conjecture, Schanuel’s Conjecture, and the decidability question of $\mathbb {R}_{\exp }$.Overall, we shed light on the valuation theoretic invariants of o-minimal exponential fields—the residue field and the value group—with additional induced structure. Moreover, we explore elementary substructures and extensions of o-minimal exponential fields to the maximal ends—the smallest elementary substructures being prime models and the maximal elementary extensions being contained in the surreal numbers.
