In Chinese scholarship, Xunzi is often regarded as an eclectic Confucian master who accepted some form of utilitarian thoughts (e.g. Fung Yu-lan, Mou Zongsan and Xu Fuguan). This characteristic was also observed by some western scholars such as Benjamin I. Schwartz. In a recent study, I argued that the basic character of Xunzi’s philosophy is utilitarianism in a broad sense based on an examination on his intellectual criticism and political criticism. Xunzi asserts that humans are innately driven by self-interested desires, (...) and he evaluates all intellectual works and political behaviours by their utility. However, he does not limit utility to only basic animal desires such as food and sex. In Xunzi’s view, humans also have innate emotions; hence, these emotions should also be accounted for in their utility. This is similar to John Stuart Mill’s redefinition of Bentham’s concept of utility. Are Xunzi’s and Mill’s concepts of utility exactly the same? This question has yet to be examined. This article is a comparative study between utilitarianism and Xunzi’s philosophy which especially explores the compatibility of these two philosophies. (shrink)

Salutary reading for all philosophers, and not only for inductive logicians, philosophers of science and law, this important book presents an elaborate theory of inductive reasoning whose substantive features are as strikingly original as the approach is rare. First, the theory is based on concrete, real, actual, and significant instances of inductive reasoning, e.g., Karl von Frisch’s work on bees; that is, though its aim is genuinely theoretical in the sense that it engages in the proper amounts of idealization, abstraction, (...) systematization, precision, and rigor, it never loses sight of the fact that "theories in the philosophy of science, like theories in science itself, have to face up to the challenge of appropriately accredited experience within their appointed domains". Second, a central subject matter being analyzed is legal reasoning, that is, the types of proofs and arguments used by juries, judges, and lawyers in the Anglo-American system of jurisprudence, where criminal charges have to be proved beyond reasonable doubt and civil cases have to be argued on the balance of probability. Thus, in effect, Cohen’s synthesis of juridical and of scientific reasoning is an admirable example of the bridging of two "cultures." Third, and most importantly, the concept of "inductive probability," in terms of which Cohen makes sense out of his subject matter, is incommensurable with that of "mathematical probability," namely the classical calculus of chance according to which probability is measurable, additive, transitive, and obeys a multiplicational principle for conjunction and a complementational one for negation. This is not to say that "inductive probability" is a hazy, mysterious, or unstructured concept, and Cohen goes to great lengths to show that it is ordinal, modal, and formally analyzable; what it does mean is that essential types of reasoning in science and in law involve probable inferences whose probabilities are nonquantitative. Hence, though Cohen does not stress the qualitative nature of inductive probability, his book will be welcome by those who conceive of philosophy as scientia qualitatum. Specific conclusions reached by Cohen are that, in general, probability may be conceived as degree of provability, that differences in proof-rules generate different special cases of probability, that inductive probability may be viewed as the special case where the proof-rules are incomplete, that inductive probability is to inductive support as deducibility is to logical truth, and that some recent epistemological scepticism may be refuted by Cohen’s inductive logic. Finally, he sees himself in the British inductivist tradition, interpreting his predecessors as groping toward a logic of inductive support and probability rather than a methodology of discovery: from Bacon he develops the notion of eliminative induction but rejects that of induction by enumeration; Mill’s canons are analyzed as special cases of Cohen’s own "method of relevant variables," except for the method of residues, which is rejected as invalid ; he takes his critique of mathematical probability as a vindication of Hume’s thesis that "probability or reasoning from conjecture may be divided into two kinds, viz., that which is founded on chance and that which arises from causes" ; Whewell’s consilience of induction is justified ; and from Keynes, he develops the notion of the "weight" of evidence but rejects his mathematicist approach.—M. The Royal Society possesses three long-focus simple lenses of diameters 195, 210 and 230 mm, all inscribed with the signature ‘C. Huygens’ and various dates in the year 1686. These prove to have been made by Constantine Huygens, the elder brother of the famous Christiaan Huygens. All three lenses have been examined by a variety of physical and chemical methods, both to define their optical characteristics and to establish the composition of dated samples of late-seventeenth-century Continental glass. The focal lengths (...) of 37·9, 50·1 and 65·2 metres found by combination agree with Huygens' own values of 122, 170 and 210 feet respectively, and are so great that practical employment of the lenses in aerial telescopes has rarely been achieved. All are made from the same very poor glass—a heterogeneous and discoloured potash-rich ‘forest glass’—with a refractive index of 1·516, a costringence of 60, and a density of 2·5 g cm−3. The three lenses were ground with just two concave laps, of radii of curvature 27·11 and 71·15 metres, one lens being plano-convex to a high degree of accuracy. A claim by previous investigators that one lens was a ‘light flint’ glass has been disproved. (shrink)

During the set-up phase of an international study of genetic influences on outcomes from sepsis, we aimed to characterise potential differences in ethics approval processes and outcomes in participating European countries. Between 2005 and 2007 of the FP6-funded international Genetics Of Sepsis and Septic Shock project, we asked national coordinators to complete a structured survey of research ethic committee approval structures and processes in their countries, and linked these data to outcomes. Survey findings were reconfirmed or modified in 2017. Eighteen (...) countries participated in the study, recruiting 2257 patients from 160 ICUs. National practices differed widely in terms of composition of RECs, procedures and duration of the ethics approval process. Eight countries used a single centralised process for approval, seven required approval by an ethics committee in each participating hospital, and three required both. Outcomes of the application process differed widely between countries because of differences in national legislation, and differed within countries because of interpretation of the ethics of conducting research in patients lacking capacity. The RECs in four countries had no lay representation. The median time from submission to final decision was 1.5 months; in nine approval was received within 1 month; six took over 6 months, and in one 24 months; had all countries been able to match the most efficient approvals processes, an additional 74 months of country or institution-level recruitment would have been available. In three countries, rejection of the application by some local RECs resulted in loss of centres; and one country rejected the application outright. The potential benefits of the single application portal offered by the European Clinical Trials Regulation will not be realised without harmonisation of research ethics committee practices as well as national legislation. When someone encounters an explanation perceived as weak, this may lead to a feeling of deprivation or tension that can be resolved by engaging in additional learning. This study examined to what extent children respond to weak explanations by seeking additional learning opportunities. Seven‐ to ten‐year‐olds (N = 81) explored questions and explanations (circular or mechanistic) about 12 animals using a novel Android tablet application. After rating the quality of an initial explanation, children could request and receive additional information or (...) return to the main menu to choose a new animal to explore. Consistent with past research, there were both developmental and IQ‐related differences in how children evaluated explanation quality. But across development, children were more likely to request additional information in response to circular explanations than mechanistic explanations. Importantly, children were also more likely to request additional information in direct response to explanations that they themselves had assigned low ratings, regardless of explanation type. In addition, there was significant variability in both children's explanation evaluation and their exploration, suggesting important directions for future research. The findings support the deprivation theory of curiosity and offer implications for education. (shrink)

We propose that IAM and déjà vu may not share a placement on the same gradient, per se, but the mechanism of cue familiarity detection, and a major differentiating factor between the two metacognitive experiences is whether the resulting inward directed search of memory yields retrieved content or not. Déjà vu may manifest when contentless familiarity detection is inexplicable by the experiencer.

A central feature of our waking mental experience is that our attention naturally toggles back and forth between “external” and “internal” stimuli. In the midst of an externally demanding task, attention can involuntarily shift internally with no clear reason how or why thoughts momentarily shifted inward. In the case of external attention, we are typically exploring and encoding aspects of our external world, whereas internal attention often involves searching for and retrieving potentially relevant information from our memory networks. Cognitive science (...) has traditionally focused on understanding forms of internal and external attention separately, leaving a mystery about what sparks the seemingly automatic shifts between the two. Objective: Ethical guidelines are designed to ensure benefits, protection and respect of participants in clinical research. Clinical trials must now be registered on open-access databases and provide details on ethical considerations. This systematic survey aimed to determine the extent to which recently registered clinical trials report the use of standard of care and post-trial obligations in trial registries, and whether trial characteristics vary according to setting. Methods: We selected global randomized trials registered on http://www.clinicaltrials.gov and http://www.controlled-trials.com. We searched for intervention (...) trials of HIV/AIDS, malaria, and tuberculosis from 9 October 2004, the date of the most recent version of the Helsinki Declaration, to 10 April 2007. Results: We collected data from 312 trials. Fifty-eight percent (58%, 95% CI = 53 to 64) of trial protocols report informed consent. Fifty-eight percent (58%, 95% CI = 53 to 64) of trials report active controls. Almost no trials (1%, 95% CI = 0.5 to 3) mention post-trial provisions. Most trials measure surrogate outcomes. Twenty percent (20%, 95% CI = 16 to 25) of trials measure patient-important outcomes, such as death; and the odds that these outcomes are in a low income country are five times greater than for a developed country (odds ratio (OR) 5.03, 95% CI = 2.70 to 9.35, p = < 0.001). Pharmaceutical companies are involved in 28% (CI = 23 to 33) of trials and measure surrogate outcomes more often than nonpharmaceutical companies (OR 2.45, 95% CI = 1.18 to 5.09, p = 0.31). Conclusion: We found a large discrepancy in the quality of reporting and approaches used in trials in developing settings compared to wealthier settings. (shrink)

To many contemporary scholars, Émile Meyerson is a footnote in an obscure history: early twentieth-century French philosophy of science. While the traditions of épistémologie are beginning to enjoy the scrutiny they deserve, Meyerson’s role remains overlooked. This article provides an overview of Meyerson’s philosophical project to help sow the seeds for a more systematic recuperation of its legacy. By orienting his work historically, I elucidate the nature of Meyerson’s critique of positivism, his distinctive method, and the implications these have for (...) the relation between science and philosophy. In particular, I show that for Meyerson positivisme refers not only to the doctrine of Auguste Comte but to a general philosophical tendency. Inseparable from Meyerson’s critique of this tendency is his implementation of a new methodology—épistémologie—according to which reason must be understood through the historical development of science. Épistémologie reveals that positivism not only is an incomplete account of science but is detrimental to its progress. Accordingly, Meyerson hopes to secure science’s right to function according to its own immanent principles, thereby providing prolegomena to all future metaphysics through a historical determination of the nature and limits of human reason. Despite the praise his writing garnered during his lifetime, e.g., from readers such as Einstein and de Broglie, Émile Meyerson has been largely forgotten. The rich tradition of French épistémologie has recently been taken up in some Anglo-American scholarship, but Meyerson—who popularized the term épistémologie through his historical method of analyzing science, and criticized positivism long before Quine and Kuhn—remains overlooked. If Meyerson is remembered at all, it is as a historian of classical science. This paper attempts to rectify both (...) states of affairs by explicating one of Meyerson׳s last and untranslated works, Réel et déterminisme dans la théorie quantique, an opuscule on quantum physics.I provide an overview of Meyerson׳s philosophy, his critique of Max Planck׳s interpretation of quantum physics, and then outline and evaluate Meyerson׳s neo-Kantian alternative. I then compare and contrast this interpretation with Cassirer׳s neo-Kantian program. Finally I show that, while Meyerson believes the revolutionary new physics requires "profoundly" modifying our conception of reality, ultimately, he thinks, it secures the legitimacy of his thesis: that science seeks explanations in the form of what he calls "identification." I hope my research will enable a more general and systematic engagement with Meyerson׳s work, especially with a view to assessing its viability as a philosophical method today. (shrink)

In an article in an earlier edition of the Journal of Medical Ethics (1) Dr Iglesias bases her analysis upon the mediaeval interpretation of Platonic metaphysics and Aristotelian logic as given by Aquinas. Propositional forms are applied to the analysis of experience. This results in a very abstract analysis. The essential connection of events and their changing temporal relationships are ignored. The dichotomy between body and soul is a central concept. The unchanging elements in experience are assumed to be more (...) real than the actual world of experienced process. Such a view makes the analysis of the temporal factors in experience impossible. Its abstractness is quite unsuitable for the analysis of the ontological structure and development of the neonate from fertilisation to birth. A N Whitehead made the notion of organism central to his philosophy. He refused to place human experience outside nature, or admit dualism. His philosophy of organism is an attempt to uncover the essential elements connecting human experience with the physical and biological sciences. Time, change and process are, in his view, more real than the static abstractions obtainable by the use of the fallacy of misplaced concreteness. Use of the latter negates the essential connectedness of events and the importance of temporarily and change (2). In this paper I argue that the embryo, being an organism, is not analysable in terms of thinghood. It is a process. To apply Aristotelian logical concepts to it is to distort the real nature of the datum. (shrink)

Ni-44 at.% Al and Ni-50 at.% Al single crystals were tested in compression in the hard d 001 ¢ orientation. The dislocation processes and deformation behaviour were studied as a function of temperature, strain and strain rate. A slip transition in NiAl occurs from a d 111 ¢ slip to non- a d 111 ¢ slip at intermediate temperatures. In Ni-50 at.% Al single crystals, only a d 010 ¢ dislocations are observed above the slip transition temperature. In contrast, a (...) d 101 ¢ {101} glide has been observed to control deformation beyond the slip transition temperature in Ni-44 at.% Al. a d 101 ¢ dislocations are observed primarily along both d 111 ¢ directions in the glide plane. High-resolution transmission electron microscopy observations show that the core of the a d 101 ¢ dislocations along these directions is decomposed into two a d 010 ¢ dislocations, separated by a distance of approximately 2 nm. The temperature window of stability for these a d 101 ¢ dislocations depends upon the strain rate. At a strain rate of 1.4 2 10 m 4 s m 1 , a d 101 ¢ dislocations are observed between 800 and 1000 K. Complete decomposition of a d 101 ¢ dislocations into a d 010 ¢ dislocations occurs beyond 1000 K, leading to a d 010 ¢ climb as the deformation mode at higher temperatures. At lower strain rates, decomposition of a d 101 ¢ dislocations has been observed to occur along the edge orientation at temperatures below 1000 K. Embedded-atom method calculations and experimental results indicate that a d 101 ¢ dislocations have a large Peierls stress at low temperatures. Based on the present microstructural observations and a survey of the literature with respect to vacancy content and diffusion in NiAl, a model is proposed for a d 101 ¢ {101} glide in Ni-44 at.% Al, and for the observed yield strength versus temperature behaviour of Ni-Al alloys at intermediate and high temperatures. At the time of this writing, the late Myles Brand was the President of Indiana University and a member of the IU Department of Philosophy.

Inasmuch as a good many of the Australian philosophers one would like to see included are not represented, and some of the contributors are no longer teaching in Australia, the title of this volume is somewhat misleading. It contains an introduction by Alan Donagan and the following original essays: J. Passmore, "Russell and Bradley"; L. Goddard, "The Existence of Universals"; B. Ellis, "An Epistemological Concept of Truth"; P. Herbst, "Fact, Form, and Intentionality"; M. Deutscher, "A Causal Account of Inferring"; D. (...) M. Armstrong, "Colour-Realism and the Argument from Microscopes"; K. Campbell, "Colours"; C. B. Martin, "People"; M. C. Bradley, "Two Arguments Against the Identity Thesis"; D. H. Monro, "Mill's Third Howler"; G. Schlesinger, "The Passage of Time." Though the essays are original and admirable, there does not seem to be anything distinctively Australian, rather than American or British, about their contents. Perhaps the most enlightening fact about them is that neither the Andersonian tradition of Sydney nor the Wittgensteinian tradition of Melbourne which dominated the Australian philosophical scene in the early 1950's is pre-eminent any longer, or even in evidence.--A. Although informed consent is an integral part of clinical practice, its current doctrine remains mostly a matter of law and mainstream ethics rather than empirical research. There are scarce empirical data on patients’ perceived purpose of informed consent, which may include administrative routine/courtesy gesture, simple honest permission, informed permission, patient-clinician shared decision-making, and enabling patient’s self decision-making. Different purposes require different processes.

An enjoyable and well-written discussion of the change in the conception of politics from David Hume through Jeremy Bentham, and John Stuart Mill to Beatrice Webb. The longest, most interesting, and most useful section is on Hume, who expresses the dominant view of the eighteenth century that "man is a balanced whole whose object is to live decently and enjoyably." The discussion of Hume is the background for a less favorable consideration of Bentham, Mill, and Webb and although the latter (...) half of the book fails to match the first half in depth and interest, it remains a work which can be recommended and read with joy.—K. Although definitely an historical, rather than a philosophical treatment of the early followers of John Mill, it does give a great deal of detailed information on a relatively unknown and unsuccessful period of J. S. Mill's life—K. A. M.

An applicant to our graduate program in philosophy, accepted as well by one (but only one) other graduate program, wrestles with his decision. Finally he decides to attend the other program, but he thanks me for our offer, telling me, "I'm glad that at least I had a choice." I want to focus a bit on these two stories, for while the central conclusion in each -- something turning on the importance of choice -- is initially compelling, it is also, (...) on reflection, philosophically puzzling. It is compelling, because many of us in similar positions would share this response; phenomenologically, it feels right to us. We want to believe that the central facts of our lives -- whether or not we have children, where we are educated, what career we follow, with 1 whom we join as partners -- contain in them some fundamental element of our own selection and decision. We will be exploring below exactly what will turn out to be important here, and why, but for now, in our pre-reflective grasp of this phenomenon, we can say that it seems to have something to do with the value we place on autonomy, self-governance, self-authorship. We want, metaphorically speaking, to write the story of our own lives. But let me now begin to draw out why I find this insistence on the importance of choice, which so many of us would share, to be so puzzling. Both individuals, in both stories, want to be offered a certain additional option in order to have -- or at least to feel that they have? -- a choice about what they are going to do next. But, on the one hand, we could argue that, even with this added option, they still don't have a "real" choice -- they don't have the choice of doing what they most want to do; and on the other hand, one could argue that even without the added option, they always had some choice. Let me explain. In the first story, my friend certainly doesn't have open to her the option that would have been her first choice (and, in our society, what we might call the standard choice, the most frequently chosen option): to produce a biological child with her partner in a happy marriage.. J.S. Mill's deep interest in French intellectual, political, and social affairs began in 1820 when, in his fourteenth year, he went to France to live for a year with the family of Sir Samuel Bentham. French became his second language, and France his second home, where he died and was buried in 1873. His interest in history began even earlier when, as a child of seven, he tried to imitate his father's labours on the History of British India; though he (...) never wrote a history in his maturity, study of the past remained a passion and helped shape the philosophy of history that informed his views of society and ethics. His intense interest in contemporary French politics also led him to seek connections between historical developments and present trends, both seen by his from a Radical perspective approproate to what he believed to be an age of transition. The English historians of France, including Walter Scott and Thomas Carlyle, as well as the French, some of whom were themselves political figures, are judged by their historical methods, but those methods are seen as having practical effects in shaping as well as revealing the mind of the times. This volume brings together for the first time the essays, running from 1826 to 1849, that meld these abiding interests. They give as well insights into Mill's personal aspirations, his developing view of comparative politics and sociology, his concern for freedom, and his feminism. During these years Mill worked on a published his System of Logic, Book VI of which shows in condensed form the results of the speculations here developed; reading these essays with that work, which made his reputation as a philosopher, enables one to see the effects of romanticism on analytic thought in a way not as clearly evident even in Mill's Autobiography. Independently important, then, the essays in this volume also enable us to interpret anew the practical and theoretical concerns fundamental to his formative years and maturity. John C. Cairns' Introduction demonstrates how the essays reveal, through their reactions to the Revolutions of 1789, 1830, and 1848, and to French historiography, politics, and thought, the effect of France on Mill's ideas, and also the way in which his other concerns influenced his reactions to France. The texts, with the variants and notes that are the hallmark of this edition, are described in John M. Robson's Textual Introduction, which explains the editorial principles and methods. (shrink)

This paper considers the question of whether Mill's account of the nature and justificatory foundations of deductive logic is psychologistic. Logical psychologism asserts the dependency of logic on psychology. Frequently, this dependency arises as a result of a metaphysical thesis asserting the psychological nature of the subject matter of logic. A study of Mill's System of Logic and his Examination reveals that Mill held an equivocal view of the subject matter of logic, sometimes treating it as a set of psychological (...) processes and at other times as the objects of those processes. The consequences of each of these views upon the justificatory foundations of logic are explored. The paper concludes that, despite his providing logic with a prescriptive function, and despite his avoidance of conceptualism, Mill's theory fails to provide deductive logic with a justificatory foundation that is independent of psychology. First, two stories. A friend, after struggling with years of infertility, divorces her husband. Single now, and still grieving her childlessness, she begins to explore the option of single-parent adoption. She tells me that she thinks in the end she will probably decide against adoption, but, in her words, "At least I'll know that I'm childless by choice.".

The subject of empire has emerged as a central concern in political theory. Edmund Burke and John Stuart Mill have been at the center of much recent scholarship on this topic. A number of depictions of Burke as a critic and Mill as a defender of empire rely largely on their writings about India. This article focuses instead on Burke and Mill's writings on the West Indies and America from the standpoint of both thinkers' connection to Scottish Enlightenment historiography. It (...) argues that Burke 's embrace of the notion of a civilizing process helps explain his dismissive treatment of Africans and Indians in the Americans and makes it clear that he was no simple defender of cultural pluralism and difference. Conversely, it argues that Mill's essay, "The Negro Question," and his public criticism of martial law in Jamaica suggest his doubts about the civilizing effect of British rule. By re-examining their writings from this particular geographical and theoretical perspective, the article challenges the new scholarly orthodoxy surrounding Burke 's and Mill's views of the imperial project. So, on 22 July 1865, under the title ‘Philosophy and Punch’, did England's premier comic weekly greet the election of J. S. Mill as MP for Westminster. Mill held his seat for only one term, until the general election of 1868, when his Whig-Liberal colleague Robert Wellesley Grosvenor was re-elected, but Mill was replaced by the loser in 1865, the Conservative W. H. Smith, Jr., who, though he never went to sea, became the ruler of the Queen's navy. The reasons (...) for that reversal have engaged the attention of many, including Mill himself; I should like to introduce into the discussion material from an ignored source, the comic weeklies, which took a continued and close look at Mill's behaviour during his parliamentary years. While this evidence generally does not disconfirm earlier judgments—including my own— it does more than merely add to the induction. First, it shows how different political stances led journals to focus on different aspects of Mill's parliamentary career, and to adopt different rhetorical strategies in portraying him in picture and word. Second, it demonstrates how the hardening of party allegiances during the parliament of 1865–68, which accelerated in the preparatory campaigns for the general election of 1868, affected Mill adversely. Third, it suggests strongly that it was not his ‘crotchets’ or ‘whims’, especially women's suffrage and proportional representation, that damaged his chances for re-election, but his advocacy of causes unpopular with the majority of Liberals as well as with Conservatives.
