Many current Marxist debates point to a crisis of imagination as a challenge to emancipatory thoughts and actions. The naturalisation of the capitalist mode of production within the production of subjectivity is among the chief reasons behind this state of affairs. This article contributes to the debate by focusing on the notion of imagination, marked by a deep ambivalence capable of both naturalising and denaturalising social relations constitutive of the established order. Such an understanding of imagination is constructed from within (...) the framework of historical materialism, and it draws on Spinoza and Marx, taking advantage of the similarities between the two with respect to the constitution of the subject. From this stems an investigation into the imagination as a material force that partakes both in subjection and liberation. This is further demonstrated in regard to juridical forms of subjectivation and the possibility of subverting these forms through imagination. (shrink)

The primary aim of this article is to present the rule of law universalism as a relevant theoretical and socio-political issue that critical legal thought needs to contend with. In order to do so, this issue is described through a Marxist theoretical framework, which aids in identifying the consequences of this universalism. Furthermore, the Marxist theoretical framework is suggested as a countermeasure that allows for going beyond it. The rule of law universalism is analysed as a process connected to establishing (...) hegemony and status quo that affects both the way the law is thought of and practiced. The post-communist context serves in fleshing out some of these consequences. Although the transition is not the main subject of inquiry, it is a starting point to a set of philosophical questions directed towards the rule of law universalism, mainly regarding historical embeddedness and socio-political dependency of the rule of law. The transitional context illustrates the tension between the rule of law treated as a generalized blueprint and the reality it is introduced to. The method of approach to this tension argued for in this paper is Marxian theorization of concept as an interplay between concrete and abstract that underlies historical materialism. This movement within concept is juxtaposed to the universalism. The philosophical investigations are followed by findings from Marxist legal theory that pinpoint the importance of concrete interventions into the legal theory that abate its ever-growing abstractness. In particular, the import of knowledges and practices divorced from the capitalist system is brought into focus. The paper concludes with a brief assessment of the possibility of overturning the rule of law universalism and a discussion on the emancipatory potential of law. (shrink)

Governments are widely viewed by academics and practitioners as the key societal actors who are capable of compelling businesses to practice corporate social responsibility. Arguably, such government involvement could be seen as a technocratic device for encouraging ethical business behaviour. In this paper, we offer a more politicised interpretation of government engagement with CSR where “CSR” is not a desired form of business conduct but an element of discourse that governments can deploy in structuring their relationships with other social actors. (...) We build our argument through a historical analysis of government CSR discourse in the Russian Federation. Laclau and Mouffe's social theory of hegemony underpins our research. We find that “CSR” in the Russian government’s discourse served to legitimise its power over large businesses. Using this case, we contribute to wider academic debates by providing fresh empirical evidence that allows the development of critical evaluation tools in relation to governments’ engagement with “CSR”. We find that governments are capable of hijacking CSR for their own self-interested gain. We close the paper by reflecting on the merit of exploring the case of the Russian Federation. As a “non-core”, non-western exemplar, it provides a useful “mirror” with which to reflect on the more widely used test-bed of Western industrial democracies when scrutinising CSR. Based on our findings, we invite other scholars to adopt a more critical, politicised stance when researching the role of governments in relation to CSR in other parts of the world. (shrink)

The prompt for the interview was to talk about your recently published book, Territorial Sovereignty, but I thought before we got into that you could say something about your earlier work and how that led you to be interested in this particular project that you deal with in the book.

Many political theorists today deny that citizenship can be defended on liberal grounds alone. Cosmopolitans claim that loyalty to a particular state is incompatible with universal liberal principles, which hold that we have equal duties of justice to persons everywhere, while nationalist theorists justify civic obligations only by reaching beyond liberal principles and invoking the importance of national culture. In Liberal Loyalty, Anna Stilz challenges both views by defending a distinctively liberal understanding of citizenship. Drawing on Kant, Rousseau, and (...) Habermas, Stilz argues that we owe civic obligations to the state if it is sufficiently just, and that constitutionally enshrined principles of justice in themselves--rather than territory, common language, or shared culture--are grounds for obedience to our particular state and for democratic solidarity with our fellow citizens. She demonstrates that specifying what freedom and equality mean among a particular people requires their democratic participation together as a group. Justice, therefore, depends on the authority of the democratic state because there is no way equal freedom can be defined or guaranteed without it. Yet, as Stilz shows, this does not mean that each of us should entertain some vague loyalty to democracy in general. Citizens are politically obligated to their own state and to each other, because within their particular democracy they define and ultimately guarantee their own civil rights. Liberal Loyalty is a persuasive defense of citizenship on purely liberal grounds. (shrink)

Background: In modern healthcare, the role of solidarity, altruism and the natural response to moral challenges in life-threatening situations is still rather unexplored. The COVID-19 pandemic provided an opportunity to obtain a deeper understanding of nurses’ willingness to care for patients during crisis. Objective: To elucidate clinical expressions of ontological situational ethics through nurses’ willingness to work during a pandemic. Research design, participants and context: A qualitative study with an interpretive design was applied. Twenty nurses who worked in intensive care (...) unit at two Swedish hospitals during the first, second, and third waves of the COVID-19 pandemic were interviewed. The analysis was interpretative and applied a theoretical ethics perspective. Ethical considerations: The study was approved by the Swedish Ethical Review Authority and informed consent was obtained from all participants. Findings: From a philosophical perspective, the nurses expressed sovereign life expressions of mercy and compassion, which arose spontaneously in response to seeing vulnerable fellow humans. They referenced ‘‘the nurse inside me’’ and their choice of profession as motives to provide care. Ontological situational ethics in culture and norms were noted in the constructs of competence, responsibility, solidarity with colleagues and organization; and interest and learning were driving forces. Ethical demand was evident when nurses expressed ideas of meaningfulness in helping their fellow humans; but themes of ambiguity, exhaustion and unwillingness were also present. Conclusions: The nurses showed a high willingness to care for patients during a crisis. Responding to the ethical demand and to care for vulnerable human beings while risking their own health and lives could be interpreted as an inter-human vocation. These spontaneous altruistic actions saved the lives of many patients during the pandemic and need to be understood and supported. (shrink)

This article discusses two normative questions raised by cases of colonial settlement. First, is it sometimes wrong to migrate and settle in a previously inhabited land? If so, under what conditions? Second, should settler countries ever take steps to undo wrongful settlement, by enforcing repatriation and return? The article argues that it is wrong to settle in another country in cases where one comes with intent to colonize the population against their will, or one possesses an adequate territorial base somewhere (...) else, lacks an urgent interest in moving, and seeks to settle in a new place under conditions where settlement would severely harm the practices of prior occupants. It also argues for a presumption of repatriation and return in the first generation of wrongful settlement and holds that these remedies may be extended to second and higher generations in some – but not all – cases. Pain is a global problem whose social, economic, and psychological costs are immeasurable. It is now seen as the most common reason why people seek medical (including psychiatric) care. But what is pain? This article shows that the discourse of pain tends to suffer from the same problems of ethnocentrism and obscurity as the discourse of emotions in general. Noting that in the case of pain, the costs of miscommunication are particularly high, this article offers a new paradigm for communicating (...) about pain. It shows how the use of natural semantic metalanguage (NSM) techniques developed in linguistic semantics can help in this area, as in other areas concerned with human subjectivity, and can lead to a greater understanding between psychologists, psychiatrists, medical practitioners, social workers, and ordinary suffering mortals. This chapter argues that human and animal minds indeed depend on a collection of domain-specific, task-specific, and encapsulated cognitive systems: on a set of cognitive ‘modules’ in Fodor's sense. It also argues that human and animal minds are endowed with domain-general, central systems that orchestrate the information delivered by core knowledge systems. The chapter begins by reviewing the literature on spatial reorientation in animals and in young children, arguing that spatial reorientation bears the hallmarks of core knowledge and of modularity. (...) It then considers studies of older children and adults, arguing that human spatial representations change qualitatively over development and show capacities not found in any other species. Finally, it presents two new experiments that investigate the role of emerging spatial language in uniquely human navigation performance. (shrink)

Can social phenomena be understood by analyzing their parts? Contemporary economic theory often assumes that they can. The methodology of constructing models which trace the behavior of perfectly rational agents in idealized environments rests on the premise that such models, while restricted, help us isolate tendencies, that is, the stable separate effects of economic causes that can be used to explain and predict economic phenomena. In this paper, I question both the claim that models in economics supply claims about tendencies (...) and also the view that economics, when successful, necessarily follows this method. When economics licenses successful policy interventions, as it did in the case of the Federal Communications Commission spectrum auctions, its method is not to study tendencies but rather to study the phenomenon as a whole. We can understand implicit bias as a person’s disposition to evaluate members of a social group in a less favorable light than members of another social group, without intending to do so. If we understand it this way, we should not presuppose a one-size-fits-all answer to the question of how implicit cognitive states lead to skewed evaluations of other people. The focus of this paper is on implicit bias in considered decisions. It is argued that we have good reasons to (...) assume that imagination plays a vital role in decision making. If this assumption is correct, it offers an explanation for implicit bias in many considered decisions: Human beings who have been frequently exposed to stereotypes have stereotype-congruent expectations as part of their background knowledge. They feed into their imagination, sometimes without their awareness. This model would allow us to explain the key characteristics of implicit bias without recurring to any unconscious attitudes over and above such background knowledge. (shrink)

Positive polarity items (PPIs) are generally thought to have the boring property that they cannot scope below negation. The starting point of the paper is the observation that their distribution is significantly more complex; specifically, someone/something-type PPIs share properties with negative polarity items (NPIs). First, these PPIs are disallowed in the same environments that license yet type NPIs; second, adding any NPI-licenser rescues the illegitimate constellation. This leads to the conclusion that these PPIs have the combined properties of yet-type and (...) ever-type NPIs: what appears to be a prohibition is nothing but “halfway licensing”. The paper goes on to propose a unification of the analyses of rescuable PPIs, NPIs, and negative concord, and questions the grounding of polarity sensitivity in the scalar or the referential semantics of the items involved. Background Transcranial direct current stimulation (tDCS) is a brain stimulation technique currently being researched as an alternative or complimentary treatment for various neurological disorders. There is little knowledge about experiences of the participants of tDCS clinical research, especially from pediatric studies. Methods An interview study with typically developing minors (n = 19, mean age 13,66 years) participating in a tDCS study, and their parents (n = 18) was conducted to explore their views and experiences and inform the ethical analysis. Results (...) Children (10–13 years old) and adolescents (14–18 years old) reported good experiences with the stimulation. Next to financial incentives, main motives to participate in the study were curiosity and the possibility to help develop treatments for children affected by neurological disorders. They could also see a potential of using tDCS in a non-medical setting, especially regarding the provision of equal opportunity, e.g. in education. Parents also presented a positive attitude towards tDCS and their children participation in the basic research study. Nevertheless, their understanding of tDCS was rather poor. Even though many of them understood the techniques, they often did not see the link between the (current) lack of side effects and an absence of longitudinal studies. Parents were also cautious about using tDCS for non-medical/enhancement purposes. Conclusions The study findings show a need for more transparent information about the state of the art of tDCS, its function and what it might be able to offer, especially considering the good acceptability of tDCS. The study aims at exposing Meinong's ideas that may be of interest to analytic philosophers. It contains all the basic information concerning Meinong's theory of objects with a special focus upon 'objectives', which are Meinong's propositions. Meinong's theory of meaning and his epistemological views are discussed in detail. An outline of his conception of truth, which is classified as firmly realistic, is followed by a review of the critical works touching upon Meinong's epistemological ideas. Finally, Meinong's theory of objects is (...) presented as inspiring the development of Meinongian logics, with his Aussersein as the prototype of an all-inclusive semantic domain. The issues considered include reference of terms and sentences as well as the general features of a Meinongian-style semantics. (shrink)

This essay replies to three critics of my book Territorial Sovereignty: A Philosophical Exploration. First, in response to Kit Wellman, I defend the claim that states sometimes have a right against external interference even when their decisions depart from the requirements of social justice. This “right to do wrong” is grounded in respect for a legitimate procedure of collective self-determination, in which the state's members have an important interest. Second, I reply to Michael Blake's concern that there is an inconsistency (...) in my treatment of people's actual wills in politics. I clarify that my view places weight on the actual wills only of “cooperators”, and that cooperators’ actual wills matter because they have claims against alien rule. There is no inconsistency in treating political annexation differently from immigration since immigrants rarely threaten to impose alien rule on cooperators. Finally, I address Adom Getachew's concerns about the imperial dimensions of the states system, arguing that my book contains resources for theorizing remedial claims to land in settler colonial societies and other reparative duties of global justice. This article describes a survey among Finnish business students to find answers to the following questions: How do business students define a well-run company? What are their attitudes on the responsibilities of business in society? Do the attitudes of women students differ from those of men? What is the influence of business education on these attitudes? Our sample comprised 217 students pursuing a master’s degree in business studies at two Finnish universities. The results show that, as a whole, students valued (...) the stakeholder model of the company more than the shareholder model. However, attitudes differed according to gender: women students were more in favor of the stakeholder model and placed more weight on corporate ethical, environmental, and societal responsibilities than their men counterparts – both at the beginning and at the end of their studies. Thus, no gender socialization effect of business school education could be observed in this sense. Business school education was found to shape women and men students’ attitudes in two ways. Firstly, valuation of the shareholder model increased and, secondly, the importance of equal-opportunity employment decreased in the course of education. This raises the question whether the educational context is creating an undesirable tendency among future business professionals. The results further suggest that the sociocultural context can make a difference in how corporate social responsibility is perceived. The article also discusses possible ways to influence the attitudes of business students. (shrink)

It is widely believed that there are some emotions which are universally associated with distinctive facial expressions and that one can recognize, universally, an angry face, a happy face, a sad face, and so on. The "basic emotions " are believed to be part of the biological makeup of human species and to be therefore "hardwired". In contrast to this view, Or tony and Turner have suggested that it is not emotions but some components of emotions which are universally linked (...) with certain facial expressions, or rather with some components of facial expressions. Ortony and Turner have made a good case for this hypothesis. But the theory will be more convincing - and indeed more verifiable - if the postulated "dissociable components of emotions" are formulated in a rigorous, and culture-independent manner. The paper argues that the Natural Semantic Metalanguage, based on universal semantic primitives and devised by the author and colleagues, provides a suitable culture-independent framework. (shrink)

L’article explore les rapports entre l’espace, les publics, l’argent et le temps à travers une évolution de divers lieux de rassemblement à Saint-Pétersbourg dans les années 1990-2010. Prenant leur essor durant la période de « l’entre-deux » systèmes, les clubs émergent tels une expérience « underground », un temps continu vécu par une communauté dans un lieu régulier affranchi des impératifs de rentabilité. Durant les années 2000, les clubs subissent une marchandisation, irrégulière et décalée, qui les amène à passer à (...) une ouverture quasi-permanente en diversifiant l’offre de programmation et de consommation. Une partie des clubs, des bars, ainsi que les « time-cafés » émergeant dans les années 2010, visent dès lors à se constituer des noyaux de publics fidèles, à les maintenir longtemps sur place en soignant un « entre-soi », des sociabilités à la fois ouvertes et exclusives, protégées par certains mécanismes de sélection. Cette composante « sociabilité » l’emporte progressivement sur la composante artistique, elle suspend le principe de maximisation du profit et tend à privilégier un usage libre du temps. Cette tendance semble être reprise par certains établissements culturels d’Etat en quête de modernisation, se positionnant dès lors comme des lieux de rassemblement de proximité. (shrink)

The concept of enhypostaton was introduced into theological discourse during the sixth-century Christological debates, and aimed to elucidate the orthodox doctrine of the unity of two natures in the singular hypostasis of Christ. In spite of the fact that the conceptual content of the term is recognized by contemporary scholarship as pertaining to the core of Christology, the notion of enhypostaton is often described as obscure and not clearly defined. The coining of the term is often ascribed to Leontius of (...) Byzantium, whereas in fact he only followed and developed solutions already introduced into Christological discourse by John the Grammarian. The article aims to clarify the notion by offering a philosophical account of the meaning and theoretical origins of “enhypostaton,” as introduced by John the Grammarian in the context of his discussion of substance as en-hypostatical being. Enhypostaton emerges as the proper way of describing the ontological complements of a particular entity. This seems to be a significant development in the philosophical explanation of substance. Less traditional ways of seeing the field will be subsequently analyzed, yet the conclusion of this exploration will remain critical: we should rather think of an alternative way of seeing moral expertise in the biomedical (...) sphere, founded on plural knowledge of diverse agents who leave their moral presuppositions aside as much as this is possible. This paper points out that a major shift of paradigm is currently going on in the study of the human face and it seeks to articulate and to develop the fundamental assumptions underlying this shift. The main theses of the paper are: 1) Facial expressions can convey meanings comparable to the meanings of verbal utterances. 2) Semantic analysis (whether of verbal utterances or of facial expressions) must distinguish between the context-independent invariant and its contextual interpretations. 3) Certain components of facial (...) behavior (¿facial gestures¿) do have constant context-independent meanings. 4) The meanings of facial components and configurations of components have an inherent first-person and present tense orientation. 5) The basis for the interpretation of facial gestures is, above all, experiential. 6) The meanings of some facial expressions are universally intelligible and can be interpreted without reference to any local conventions. 7) To be fruitful, the semantic analysis of facial expressions needs a methodology. This can be derived from the methodological experience of linguistic semantics. The author illustrates and supports these theses by analyzing a range of universally interpretable facial expressions such as the following ones: ¿brow furrowed¿ (i.e. eyebrows drawn together); eyebrows raised; eyes wide open; corners of the mouth raised; corners of the mouth lowered; mouth open (while not speaking); lips pressed together; upper lip and nose ¿raised¿ (and, consequently, nose wrinkled). This paper considers the relationship between institutions and the “sexual imaginary,” understood as the set of affective and imaginative resources that produce certain forms of sexual subjectivity. Drawing on the work of Cornelius Castoriadis and Moira Gatens, I argue that institutions play an important role in shaping sexual imaginaries. Historically, institutions have been sites in which unjust sexual norms have been reinforced and legitimized. I analyse the growing trend of consent education at Australian universities to explore how institutions may also (...) represent potential sites for contesting and reimagining these norms. Feminist critiques of consent suggest that consent education may in fact reproduce a narrow and conservative vision of sexuality, one that aligns with the neoliberal politics of the contemporary university. This paper contributes to these critiques by exploring how both the neoliberal university and consent theory are premised on a distorted vision of the subject as a rational, disembodied being. I argue that transforming dominant sexual imaginaries requires recognizing and interrogating both how desire permeates institutional spaces and the role of desire in ethical sexual relations. In this paper I argue that the infinite regress of resemblance is vicious in the guise it is given by Russell but that it is virtuous if generated in a (contemporary) trope theoretical framework. To explain why this is so I investigate the infinite regress argument. I find that there is but one interesting and substantial way in which the distinction between vicious and virtuous regresses can be understood: The Dependence Understanding. I argue, furthermore, that to be able to decide (...) whether an infinite regress exhibits a dependence pattern of a vicious or a virtuous kind, facts about the theoretical context in which it is generated become essential. It is precisely because of differences in context that he Russellian resemblance regress is vicious whereas its trope theoretical counterpart is not. (shrink)

In his article “Research Priorities and the Future of Pregnancy” in this issue of CQ, Timothy Murphy evaluates some of the arguments I advanced in an earlier publication, “The Moral Imperative for Ectogenesis.

How do we talk about events we perceive? And how tight is the connection between linguistic and non-linguistic representations of events? To address these questions, we experimentally compared motion descriptions produced by children and adults in two typologically distinct languages, Greek and English. Our findings confirm a well-known asymmetry between the two languages, such that English speakers are overall more likely to include manner of motion information than Greek speakers. However, mention of manner of motion in Greek speakers' descriptions increases (...) significantly when manner is not inferable; by contrast, inferability of manner has no measurable effect on motion descriptions in English, where manner is already preferentially encoded. These results show that speakers actively monitor aspects of event structure, which do not find their way into linguistic descriptions. We conclude that, in regard to the differential encoding of path and manner, which has sometimes been offered as a prime example of the effects of language encoding on non-linguistic thought, surface linguistic encoding neither faithfully represents nor strongly constrains our mental representation of events. International law holds that states are holistically responsible for their acts. Yet what does the ascription of responsibility to the state imply about the responsibility of its citizens? This article argues that most citizens in a representative democracy bear culpability in association with their state's wrongful acts. Most democratic citizens can be blamed for empowering representatives to act on their behalf, and then failing to adequately oversee and dissent from the specific wrongful decisions their representatives made. This gives culpable citizens (...) duties that go beyond compensation, especially duties to foster a reparative social ethos towards state victims. (shrink)

Over the last decade, states have increasingly emphasised the importance of integration, and translated it into legal regulations that demand integration from immigrants. This paper criticises a specific aspect to this development, namely the tendency to make permanent residency dependent on language skills and, as such, seeks to raise doubts as to the moral acceptability of the requirement of linguistic integration. The paper starts by arguing that immigrants after a relatively short period of time acquire a moral claim to permanent (...) residency in their host country. Accordingly, states may not limit residency at their discretion. Nevertheless, three arguments may seem promising for defending the requirement of linguistic integration: that the immigrants’ moral claim conflicts with a stronger moral claim on the part of the larger society, and this makes an infringement of the immigrants’ claim proportionate; that language requirements may be legally demanded as a precondition for permanent residency for the immigrants’ own sake; and that language requirements are defensible, as far as immigrants may be understood to have consented to such regulation upon entry to the country.
