The theme of human biology recurs continually both in feminist and in anti-ferminist literature. Reflection on human biology has seemed to promise answers to the urgent questions of why women everywhere are subordinated and whether and how that subordination can be ended. Invariably, anti-feminists have justified women's subordination in terms of perceived biological differences between the sexes, and feminists have responded to their claims in a variety of ways. In this paper, I want to look critically at the ways in (...) which feminists in the liberal and Marxist traditions have responded to the biologically based challenges of anti-feminism, and to suggest an alternative way of conceptualising the relation between human biology and the social status of women. This paper defends a legal and political conception of sexual relations grounded in Kant’s Doctrine of Right. First, I argue that only a lack of consent can make a sexual deed wrong in the legal sense. Second, I demonstrate why all other legal constraints on sexual practices in a just society are legal constraints on seemingly unrelated public institutions. I explain the way in which the just state acts as a civil guardian for domestic relations and as a civil guarantor (...) for private property and contract relations—and thereby enables the existence of legally enforceable claims. Throughout the aim is to demonstrate that Kant’s relational conception of justice entails that legally enforceable claims regarding sexual deeds are fully justifiable only insofar as they are determined and enforced by a public authority that we may refer to as a liberal democratic welfare state. Reason has regularly been portrayed and understood in terms of images and metaphors that involve the exclusion or denigration of some element-body, passion, nature, instinct-that is cast as "feminine." Drawing upon philosophical insight into metaphor, I examine the impact of this gendering of reason. I argue that our conceptions of mind, reason, unreason, female, and male have been distorted. In describing and explaining the sexes, medicine and science participated in the delineation of what was "feminine" and what was "masculine" in the Middle Ages. Hildegard of Bingen and Albertus Magnus, among others, writing about gynecology, the human constitution, fetal development, or the naturalistic dimensions of divine Creation, became increasingly interested in issues surrounding reproduction and sexuality. Did women as well as men produce procreative seed? How did the physiology of the sexes influence their healthy states and their susceptibility to (...) disease? Who derived more pleasure from sexual intercourse, men or women? The answers to such questions created a network of flexible concepts which did not endorse a single model of male-female relations, but did affect views on the health consequences of sexual abstinence for women and men and on the allocation of responsibility for infertility - problems with much social and religious significance in the Middle Ages. Sometimes at odds with, and sometimes in accord with other forces in medieval society, medicine and natural philosophy helped to construct a set of notions that divided significant portions of the world - from the behavior of animals to the operations of astrological signs - into "masculine" and "feminine." Even cases that seemed to exist outside the definitions of this duality, for example, hermaphrodite features or homosexual behavior, were brought under control by the application of gendered labels, such as "masculine women.". The recent #metoo movement has turned public attention to the problem of sex under conditions of power inequality. Is consent impaired, when you have plenty to lose (e.g. a great professional opportunity) from saying “no” to a sexual advance? And even if consent is valid, is this a morally acceptable situation, especially if one party is aware that their position of relative power will influence the other’s decision to have sex? Such situations bring to the fore not only the issues (...) of coerced sex and quid pro quo harassment (asking for sex in exchange for benefits), but the much more controversial question of whether sex between unequal but otherwise competent consenting adult partners is in principle OK—and whether institutions such as companies, universities, or the state itself should be in the business of regulating such relations. In what follows, I will outline the central concept of power asymmetry and its ethical relevance (section 2). I will then distinguish two main views about the ethics of sexual interaction under conditions of power asymmetry: a Kantian view, which categorically condemns such interactions, and a Millian view, which justifies at least some such interactions (section 3). I then briefly consider three contexts, which raise difficult questions about sex between unequals: the workplace, the university (section 4), and voluntary prostitution (section 5). Physically frail, badly educated girls, brought up to lead useless lives as idle gentlewomen, married to dominant husbands, and relegated to "separate spheres" of life—these phrases have often been used to describe Victorian upper-middle-class women. M. Jeanne Peterson rejects such formulations and the received wisdom they embody in favor of a careful examination of Victorian ladies and their lives. Focusing on a network of urban professional families over three generations, this book examines the scope and quality of gentlewomen's education, their (...) physical lives, their relationship to money, their experience of family illness and death, and their relationships to men (brothers and friends as well as fathers and husbands). Peterson also examines the prominent place of work in the lives of these "leisured" Victorian ladies, both single and married. This study investigates the Proteus effect from the first-person perspective and during avatar embodiment in actual exercise. In addition to the immediate measurements of the Proteus effect, prolonged effects such as next-day perception and exercise-related outcomes are also explored. We theorized the Proteus effect as altered perceived self-concept and explored the association between virtual reality avatar manipulation and self-concept in the exercise context. While existing studies have mainly investigated the Proteus effect in a non-VR environment or after VR (...) embodiment, we aim to contribute to the literature by addressing this concern to explore how the Proteus effect works in actual VR exercise. Through a 2 × 2 between-subject experiment, the results partially support the Proteus effect. Regarding actual physical activity, embodying an avatar with a six pack during exercise creates fewer body movements. No significant effect was found for perceived exertion. We also explored the role of sex as a potential moderator in the association of the Proteus effect on exercise outcomes. The Proteus effect was supported by immediate and next-day self-efficacy for core-muscle exercise only among female participants. The between-subject design allowed us to probe how avatar manipulation of muscular body shape with a six pack as opposed to normal body shape influences participants’ self-concept and exercise outcomes, as limited VR studies have employed within-subject comparisons. This also contributes to the literature by providing an upward comparison as opposed to the previous downward comparison regarding body fitness. The overall results supported the Proteus effect in the context of core-muscle exercise when comparing normal and ideal body shape avatars. However, the Proteus effect as an altered self-concept and its effects on self-efficacy for exercise were supported among females but not males. Whereas the female participants who embodied avatars with a six pack associated themselves more with the muscular concept than other people, the male participants who embodied avatars with a six pack perceived themselves as more normal than others. Evolutionary psychology offers a fairly ‘patriarchal’ picture of sex differences, according to which men are, ‘by nature’, much more polygamously disposed, much more desirous of power over the opposite sex, and much more aggressive than women. However, the picture – at least in its components and – becomes problematic if one looks at the history of conceptions of paternity accepted by our ancestors. It is argued in the paper that the very fact that our ancestors accepted various and essentially different (...) conceptions of paternity casts a shadow of doubt on the ‘patriarchal’ picture of sex differences. Consent governs innumerable everyday social interactions, including sex, medical exams, the use of property, and economic transactions. Yet little is known about how ordinary people reason about the validity of consent. Across the domains of sex, medicine, and police entry, Study 1 showed that when agents lack autonomous decision-making capacities, participants are less likely to view their consent as valid; however, failing to exercise this capacity and deciding in a nonautonomous way did not reduce consent judgments. Study 2 found that (...) specific and concrete incapacities reduced judgments of valid consent, but failing to exercise these specific capacities did not, even when the consenter makes an irrational and inauthentic decision. Finally, Study 3 showed that the effect of autonomy on judgments of valid consent carries important downstream consequences for moral reasoning about the rights and obligations of third parties, even when the consented-to action is morally wrong. Overall, these findings suggest that laypeople embrace a normative, domain-general concept of valid consent that depends consistently on the possession of autonomous capacities, but not on the exercise of these capacities. Autonomous decisions and autonomous capacities thus play divergent roles in moral reasoning about consent interactions: while the former appears relevant for assessing the wrongfulness of consented-to acts, the latter plays a role in whether consent is regarded as authoritative and therefore as transforming moral rights. The evolution of sexual reproduction is a striking case of explanatory pluralism, meaning that one needs to refer to more than one explanation in order to adequately account for it. I develop the concept a domain of phenomena in order to analysis this pluralism. Pluralism exists when a phenomenon can be included in more that one homogeneous domain or in a heterogeneous domain. I argue that in some cases domain partitioning can be used to decrease pluralism, but that in (...) the case of sex domains are overlapping and interconnecting, or in other words bear an orthogonal relationship to one another, and hence cannot be partitioned in such a way as to eliminate pluralism. Anatomy texts are seen as authoritative sources for knowledge about natural sex differences. The concepts of a natural, biological sex and of a natural difference are, however, increasingly difficult to sustain. A growing number of scholars have pointed to the fact that `sex' as much as `gender' is a historical and social construction. This article examines how the multiple-edition anatomy textbook, Gray's Anatomy, has portrayed the sexed body and male/female differences during the course of its publication, 1858 to the present, (...) focusing on specific parts of the anatomy, namely the sex organs or `organs of generation', the pelvis, the skull and the brain. An analysis of textual descriptions and graphic illustrations reveals that the male body has been the stable norm or standard against which the female body has been compared and implicitly judged as underdeveloped, weak or faulty. Only rarely has the male body been compared with the female body. Reflecting long-standing views about sexual complementarity and natural differences between men and women, some comparisons emphasize the reproductive functioning of females or imply that females are intellectually inferior. It would appear that the discipline of anatomy has remained largely immune from broader public debates about sexual inequality and gender representations. (shrink)

Several decades ago, feminists differentiated between the biologically given basis of sex identity (sex) and the socially constructed cultural practices anchored by sex identity (gender). In recent years, many feminists have challenged that distinction, arguing that biological sex is as much a social construct as are the practices comprising gender. I survey two examples from biological studies of sex identity that, by contrast (I maintain), warrant saving the concept of biologically given sex identity. The result is not antithetical to (...) feminism, however, since these studies also suggest that sex identity proliferates beyond the rigid female/male dichotomy. If articulated carefully, this view can avoid metaphysically essentialist baggage while enriching feminist conceptions of sex identity. (shrink)

What is sex? Some feminists have harboured suspicions about this form of question, given its philosophical (or ‘metaphysical’1) pedigree. But philosophy no longer has the disciplinary monopoly on it. Indeed, with regard to sex, the more interesting task today is to pose and to attempt to answer the question from within a transdisciplinary problematic. For the question requires a theoretical response capable of recognizing that it concerns a cultural and political (and therefore neither a specifically philosophical nor a merely empirical) (...) problem. It requires an account of sex which is theoretically satisfying whilst being both adequate to and critical of everyday experience; a critical-theoretical account capable of embracing the everyday experience of sex, its lived contradictions. This article represents a first attempt to construct a transdisciplinary concept of sex to this end. It traces a line from Simone de Beauvoir’s The Second Sex to some recent attempts to define ‘sex’ and various related but importantly different concepts, and ends by proposing an answer to the question ‘What is sex?’ that draws on the philosophy of Immanuel Kant. For our transdisciplinary efforts will of necessity spring from some specific discipline(s) while not remaining confined within them, and not allowing them to remained confined within themselves (which has been something of a problem for philosophy, historically). While much that is admirable in romanticism stems from Kant's philosophy,a better account of how sexuality can be an ethical possibility exceeds the cramped parameters that he imposes. His conception of marriage and its dependence upon a contractual exchange of rights may well be irremediable because of its formal emptinesses. His idea of human love as good will and an interest in the welfare of the beloved is defensible as far as it goes. The nature of freedom has been discussed extensively by Paul Ricoeur in his book Freedom and Nature. This article critically engages with this notion of freedom in the context of survivors of sex trafficking and their lack of experience of freedom. We indicate to what extent Ricoeur’s notion of freedom, as the reciprocal relationship between the voluntary and the involuntary, offers a relational and dynamic understanding of freedom which is highly relevant in the context of survivors of sex trafficking. A (...) mere bodily freedom, an escape from captivity, as often found in reductionist definitions of freedom, does not warrant freedom as volition for survivors of sex trafficking. The development of the full possibilities of freedom remains lacking in this context. This compels one to reconsider freedom as “voluntary-involuntary” freedom and to develop a much more complex, holistic and relational notion of freedom. Aspects like imagination, the affective, fear, desires and human dignity, should all be incorporated in the concept of freedom, which remains bodily, but does not exclude volition in the abstract or even idealistic sense. Such a comprehensive understanding of freedom is paramount for survivors of sex trafficking, but also for further philosophical considerations of freedom. (shrink)

In the United States, sex education is more than just an uncomfortable rite of passage, it's an amorphous curriculum that varies widely based on the politics, experience, resources, and biases of the people teaching it. Most often, it's a train wreck, overemphasizing or underemphasizing STIs, teen pregnancy, abstinence, and consent. In Touchy Subject, philosopher Lauren Bialystok and historian Lisa M. F. Andersen make the case for thoughtful sex education, explaining why it's worth fighting for and which kind most deserves our (...) fight, despite all the inconveniences and compromises along the way. They argue that democratic and humanistic aims can be used to provide the tools to reason about the content and form of sex education. In practice, this amounts to a curriculum that meets what are currently considered highly comprehensive standards, incorporates ethics and civics education, and substantially modifies some aspects of teacher training and school design; it also assigns different responsibilities to different actors inside and outside schools, and it responds to the salient features of young people's evolving worlds, including the inequities that put some students at much higher risk of sexual harm than others. This article presents the Islamic bioethical deliberation on the issue of sex assignment surgery for infants with disorders of sex development or intersexed as a case study. The main objective of this study is to present a different approach in assessing a biomedical issue within the medium of the Maqasid al-Shari’ah. Within the framework of the maqasidic scheme of benefits and harms, any practice where benefits are substantial is considered permissible, while those promoting harms are prohibited. The concept of (...) Maqasid al-Shari’ah which is the mechanistic interpretation of Qur’an and Hadith presents the holistic attention of Islam on many life activities, including healthcare. Indeed, this concept encompasses many aspects of worldly life, both for the human individual and collectively for the whole society. In healthcare, the practice of SAS on DSD newborns has presented an assortment of implications on the future livelihood of the affected individual. The process of decision-making seems to be very multifaceted since every element such as the determination of the ‘correct’ sex and the urgency of early surgery must consider the benefits and harms, as well as the child’s rights and best interest. The application of the concept of Maqasid al-Shari’ah, would convey a pragmatic approach that is often disregarded in Western medicine. This approach considers the right of the individual to live life optimally, individually and socially and practice his faith, precisely, in accordance with the assigned gender. (shrink)

K.B. is a woman working for the United Kingdom National Health Service with a transsexual male partner. Her partner's male gender was not legally recognised in the United Kingdom and consequently they could not marry. Whilst the NHS pension scheme provides for the payment of a survivor's pension, this is only in respect of married partners. The European Court of Justice held that the combination of circumstances that prevented K.B.'s partner from receiving the survivor's pension amounted to sex discrimination in (...) pay contrary to Article 141 of the Treaty establishing the European Community. At first sight, this decision appears to represent a strengthening of the concept of gender equality in European Union law. Yet, the reasoning provided by the Court lacks clarity and coherence. Moreover, the reach of equality is compromised by the Court's determination to exclude any confrontation with the privileged status of heterosexual marriage. (shrink)

In his latest paper, Loland1 tackles the question of whether athletes with differences of sexual development may compete in the women’s division. The topic is one of the most complex in sport and, as such, is fraught with debate. On one hand, the higher testosterone levels of athletes with DSD means they have an unfair performance advantage over their female competitors. On the other hand, it is argued that women with DSD should be able to compete in the gender division (...) with which they identify, especially as many will have been raised with a clear gender identity. Loland uses the Rawlsian notion of ‘fair equality of opportunity’ in which individuals with similar talents and ambitions should have roughly equivalent prospects for competitive success. For example, in most situations in society, one’s age, biological sex, ethnic and religious background, colour of skin, or sexual orientation are irrelevant to whether an individual should be given a job or is eligible for social welfare. In addition to being irrelevant, these factors are also stable—they are inequalities that ‘individuals cannot control or impact in any significant way’.1 However, Loland recognises that some stable inequalities, such as biological sex and body size, are relevant to FEO in sport. This paper explores the relationship between the African communitarian conception of personhood and gender. Defenders of this conception of personhood generally hold that an individual is defined in reference to the community, or that personhood is something that is acquired in community. Such characterisations often ignore the role, if any, that gender plays in that conception of personhood. Our aim in this paper is to critically explore the relationship between the two. In doing this we advance a number of claims. (...) First, we point out that the supposed gender-neutrality of the African communitarian idea of personhood is a more general feature of African philosophy that, for instance, evinces a general lack of attention to issues of gender violence and discrimination. Second, we briefly survey the literature on the communitarian idea of personhood in African thought, in particular the views of Ifeanyi Menkiti and Kwasi Wiredu. Our aim is to demonstrate our hypothesis that this idea of personhood is often construed as a gender-neutral concept. Third, we argue that the relational and community-based nature of the communitarian idea of personhood indicates that it is in fact a gendered notion. We conclude that the assumed gender-neutrality is in conflict with the gendered nature of the communitarian idea of personhood. Fourth, we explore a probable objection to our claim that the communitarian idea of personhood is gendered and therefore vulnerable to gender inequality, by examining Ifi Amadiume’s position that the notion of gender in traditional African cultures was fluid and indicated complementarity rather than inequality between the sexes. In this review essay, I critically evaluate the concept of autonomy and the role that it plays in the philosophy of sex and love in Patricia Marino’s book, Philosophy of Sex and Love: An Opinionated Introduction.

Is Feminism without the agency of sexed subjects possible? Can the problems of a highly gendered world be formulated and tackled without resorting to the notion of fundamental sexual difference? Is it possible for a Feminism that is not based on the assumption of sexed beings to gain any consistency and follow any concerted strategy? The project of this study is not only to show that all these questions can be answered with a full-hearted – Yes! – but to explore (...) the huge scope of conceptual and also practical possibilities that are created by this change of paradigms. Possibilities that are foreclosed – as the first chapters attempt to work out – by Judith Butler’s so important theory of gendered subjects, and limited by Rosi Braidotti’s or Elizabeth Grosz’s endeavours to read Deleuzian concepts under the assumption of Irigarayan sexual difference. Gilles Deleuze’s and Félix Guattari’s thinking provides us with conceptual tools for a thorough analysis of the status quo – and means for conceptualising resistance that do not perpetuate the power structures it is fighting against. Biomedical and social scientists are increasingly calling the biological sex into question, arguing that sex is a graded spectrum rather than a binary trait. Leading science journals have been adopting this relativist view, thereby opposing fundamental biological facts. While we fully endorse efforts to create a more inclusive environment for gender‐diverse people, this does not require denying biological sex. On the contrary, the rejection of biological sex seems to be based on a lack of knowledge about evolution and it champions (...) species chauvinism, inasmuch as it imposes human identity notions on millions of other species. We argue that the biological definition of the sexes remains central to recognising the diversity of life. Humans with their unique combination of biological sex and gender are different from non‐human animals and plants in this respect. This article compares Confucian ethics of Jen and feminist ethics of care. It attempts to show that they share philosophically significant common grounds. Its findings affirm the view that care-orientation in ethics is not a characteristic peculiar to one sex. It also shows that care-orientation is not peculiar to subordinated social groups. Arguing that the oppression of women is not an essential element of Confucian ethics, the author indicates the Confucianism and feminism are compatible.

According to the author, the subordination of Chinese women continued under different models of sex equality in China in the twentieth century. In Reconceiving Women's Equality in China Lijun Yuan discusses and assesses four models of women’s equality. After exposing the common feature of their failure to reach the social ideal of women’s equality, the author proposes a more democratic conception of women’s equality that will allow ideals to continue changing as material circumstances change in different stages of social development.
