Deciding the conflict between various rights and interests, especially in medical ethics where health and lives are in question, has significant challenges, and to obtain appropriate outcomes, it is necessary to properly apply the principles of non-discrimination and proportionality. Using the example of mandatory vaccination policies, we show that this task becomes even more difficult when these principles lead us to counterintuitive and paradoxical results. Although the general purpose of these principles is to ensure that decisions and policies seek the (...) highest and broadest possible enjoyment of rights for all (ie, the least restrictive solution), they achieve the complete opposite when applied to mandatory vaccination policies. To highlight and explain these paradoxical results, we present a typology of fifteen hypothetical mandatory vaccination policies containing various degrees of restriction and apply well-established non-discrimination and proportionality tests from constitutional law to each. We argue that mandatory vaccination policies exhibit two characteristics, namely the non-linear relationship between their general purposes and specific goals and the involvement of life and health, suggesting that more restrictive policies should prevail even though less restrictive policies might fail these tests. Using clearly structured and rigorous methodology from constitutional law, the proposed approach delivers a fresh view on the core ethical principles of non-discrimination and proportionality and a potentially useful tool in helping resolve also other challenges encountered in medical ethics beyond mandatory vaccination policies. Interaction between humans and cats in urban environments is subject to dynamic change. Based on the frequency and quality of relations with humans, we can distinguish several populations of domestic cats : pedigree, pet, semi-feral, feral, and pseudo-wild. Bringing together theoretical perspectives of the Tartu school of biosemiotics and ethological studies of animal societies, we distinguish two basic types of cat cultures: the culture of street cats and the humano-cat culture of pets. The difference between these cultures is documented on (...) the level of zoosemiotic interactions, ecological relations, and human representations. We introduce a threefold model of human-animal interactions in urban environments which steer a careful course between the Scylla of realistic ontology and the Charybdis of social constructivism. A case study on Estonian cat shelters illustrates the significance of cultural representations and institutionalized actions in human-cat cohabitation. (shrink)

I propose a theory aimed at advancing scholarly research in social entrepreneurship. By highlighting the key trade-off between value creation and value capture and explaining when situations of simultaneous market and government failure may arise, I suggest that social entrepreneurship is the pursuit of sustainable solutions to neglected problems with positive externalities. I further discuss the situations in which problems with externalities are likely to be neglected and derive the central goal and logic of action of social entrepreneurs, in contrast (...) to commercial entrepreneurs. Overall, this article provides a conceptual framework that allows understanding the growing phenomena of social entrepreneurship and its role in the functioning of modern society. (shrink)

Following the recent call for advancement in knowledge about business ethics in East Asia, this study proposes a complementary perspective on business ethics in South Korea. We challenge the conventional view that South Korea is a strictly collectivist country, where group norms and low trust determine the norms and values of behavior. Using the concept of civil religion, we suggest that the center of the South Korean civil religion can be seen in the affective ties and networks pervading the economic, (...) political, and social institutions, embedded in and guided by Confucian ideals. We argue that South Korea should be seen not as a collectivist low-trust society, but rather as an affective-relational society, in which the relational context determines whether collectivism or individualism prevails. Further, we assert that trust, the cohesive factor of affective ties and networks, has until now been inadequately captured by conventional surveys. Our proposed perspective contributes to a more holistic picture and a more firmly grounded understanding of business ethics in South Korea. (shrink)

So far overlooked by the international business ethics literature, we introduce, characterize, and normatively analyze the use of affective ties and networks in South Korea from an ethical point of view. Whereas the ethics of using Guanxi in China has been comprehensively discussed, Korean informal networks remain difficult to manage for firms in South Korea due to the absence of existing academic debate and research in this field. In this study, we concentrate mainly on the question of whether foreign firms (...) will and can use affective ties in Korea. The informal social network forms are classified and contrasted with the conventional ethical approaches used in international business ethics to assess which categories can be regarded as ethical or unethical. Finally, foreign firms are advised how to cope with and use different affective network types. Although the nature of affective ties and networks in Korea differs from that found for instance in China, consistent with the conclusion of prior research, we recommend particularistic analysis and decision making regarding the circumstances in which to conclude affective ties and networks and when to opt out. We conclude that foreign firms in Korea should invest in establishing Inmaek, refrain from engaging in Yonjul, and support host country nationals’ Yongo ties. Moreover, it is suggested that foreign firms should find ways to monitor and manage informal ties effectively. (shrink)

In this paper, we show that there are some strong philosophical and exegetical reasons to argue that according to the view developed in the first chapter of Aristotle’s De Memoria, the objects of memory are non-present, or absent, things and events rather than our past acts of awareness of them. We argue that on Aristotle’s account, the objects of memory can be particulars or universals, perceptibles or intelligibles, and that all these kinds of things are past in the same sense, (...) namely, in the sense of previously having been present to the perceiver or knower. Among other virtues, Mental Files Theory provides a straightforward explanation of de jure coreference, i.e. identity of referent guaranteed by meaning alone: de jure coreference holds between terms when these are associated with the same mental file from which they inherit their reference. In this paper, I discuss an objection that Angel Pinillos raises against Mental Files Theory and other similar theories: the theory predicts that de jure coreference should be transitive, just like identity. Yet there are cases, involving ‘slash-terms’, (...) in which transitivity fails, or so it seems. In his book Mental Files, Recanati replies that the mental files theorist can accommodate Pinillos’ exceptions by offering a refined model of merging files, the ‘partial merging’ model. While agreeing with Recanati on the need for such a model, I contend that, pace Recanati and Pinillos, de jure coreference is transitive even in the presence of slash-terms. I will first show that paradoxical consequences ensue if slash-terms are said to de jure corefer with several basic terms at once. Then, building on two different accounts Recanati gives of referential confusion, I will show that on both views, de jure coreference cannot hold because of the behaviour of confused slash-terms. I will conclude that, in Mental Files Theory, a slash-term can, at most, de jure corefer with only one basic term per context. (shrink)

Because philosophical reflections on touch usually start from our ability to perceive properties of objects, they tend to overlook features of touch that are crucial to correct understanding of tactual perception. This paper brings out these features and uses them to develop a general reconception of the sense of touch. I start by taking a fresh look at our ability to feel, in order to reveal its vital role. This sheds a different light on the skin's perceptual potential. While it (...) is commonly observed that tactile experiences have two intentional objects, an external object and one's own body, I will advance a more accurate alternative: in tactile experiences, one becomes aware of what one's body undergoes. This alternative not only fits better with tactility's vital role; it is also key to explaining how active touching provides for a unique contribution to our perceptual relation to material objects. By thus connecting tactility's vital role to the way we rely on touch while manipulating objects, this essay offers a cross-sectional survey of our tactile powers that reveals the interplay between sensing and touching. In this paper I challenge the widespread assumption that the conditions for singular reference are more or less the same as the conditions for singular thought. I claim that we refer singularly to things without thinking singularly about them more often than it is usually believed. I first argue that we should take the idea that singular thought is non-descriptive thought very seriously. If we do that, it seems that we cannot be so liberal about what counts as acquaintance; only (...) perception will do. I also briefly discuss and reject semantic instrumentalism. Finally, I argue that while singular reference is cheap, singular thought comes only at a price. (shrink)

This paper is a comparison of two structural theories of propositions: the theory proposed by Kazimierz Ajdukiewicz in the 1960s and the theory developed by Jeffrey King at the beginning of the 21st century. The first section of the paper is an overview of these theories. The second part is a detailed discussion of significant similarities shared by them. In this section, I also identify and analyze ways in which these theories differ and attempt to determine if these differences are (...) substantial or apparent. In this brief discussion piece I try to offer some considerations in favor of the so-called Simple Intention Theory of demonstratives, which is rejected by Gómez-Torrente. I try to show that the main argument offered against the Simple Intention Theory appears to be based on false data.

This paper focuses on the links between Jakob von Uexküll’s theoretical biology and Adolf Portmann’s conception of organic life. Its main purpose is to show that Uexküll and Portmann not only share a view of the living being as an autonomous and holistically organized entity, but also base this view on the seminal idea of the subjectivity of the organism. In other words, the respective holistic principles securing the autonomy of the living being—the Bauplan, for Uexküll; the Innerlichkeit, for Portmann—share (...) an essentially subjective character. Such principles, indeed, express themselves in a centrally directed and formative way; moreover, in organisms endowed with a central nervous system, they also extend their influence on the overt behavioral sphere and on the organism’s capacity to give meaning to the surrounding reality. The conclusion of the article will show how, though starting from this common background, the two authors develop divergent positions on the issue of the anthropological difference. If Portmann emphasizes the special status of the relationship between the human animal and the world, Uexküll tends to see a substantial continuity in the biosemiotic processes through which human and non-human animals constitute their species-specific worlds of experience. I argue that the adjective δαιμόνιος (‘daemonic’) and the substantivized adjective τὸ δαιμόνιον (‘the daemonic’) that occur in Aristotle’s dream treatises basically mean ‘divine-like,’ denoting an illusory appearance of divine intervention, typically in the form of an alleged god-sent prophetic dream. Yet the appearances to which the terms refer are, in fact, neither divine nor supernatural at all, but involve merely coincidental correlations between the dream and the fulfilling event. It is shown that Aristotle’s use of ‘daemonic’ is traditional and (...) reflects the endoxon that prophetic dreams are closely related to the divine. The paper also examines a set of earlier readings of the daemonic in De divinatione in relation to the proposed interpretation. (shrink)

The nature of unconscious information processing is a heavily debated issue in cognitive science, and neuroscience. Traditionally, it has been thought that unconscious cognitive processing is restricted to knowledge that is strongly prepared by conscious processes. In three experiments, we show that the task that is performed consciously can also be applied unconsciously to items outside the current task set. We found that a same–different judgment of two target stimuli was also performed on two subliminally presented prime stimuli. This was (...) true for target and prime stimuli from entirely different categories, as well as for prime and target stimuli at different levels of abstraction. These results reveal that unconscious processing can generalize more widely than previously accepted. (shrink)

In this contribution, we draw on findings from a non-formal, community music project to elaborate on the relationship between the concept ofeudaimonia, as defined by Seligman, the interactive dimensions of collective free improvisation, and the concept of collaborative creativity. The project revolves around The Ostend Street Orkestra (TOSO), a music ensemble within which homeless adults and individuals with a psychiatric or alcohol/drug related background engage in collective musical improvisation. Between 2017 and 2019 data was collected through open interviews and video (...) recordings of rehearsals and performances. Participant data was analyzed through inductive analysis based on the principles of grounded theory. One interesting finding was the discrepancy in the participant interviews between social relationships indicative of a negative affect about social group interaction versus strong feelings of group coherence and belonging. Video recordings of performances and rehearsals showed clear enjoyment and pleasure while playing music. Alongside verbal reflection through one-on-one interviews video recordings and analysis of moment-to moment observations should be used, in order to capture the complexity of community music projects with homeless people. The initial open coding was aligned with the five elements of the PERMA model. Overall, we observed more focus on Relationship (sense of belonging), Engagement (flow in rehearsals and performances) and Meaning (belonging to something greater than yourself) and less on Positive Emotion and Accomplishment (goal setting). This paper analyses Bohr’s complementarity framework and applies it to biosemiotic studies by illustrating its application to three existing models of living systems: mechanistic biology, Barbieri’s version of biosemiotics in terms of his code biology and Markoš’s phenomenological version of hermeneutic biosemiotics. The contribution summarizes both Bohr’s philosophy of science crowned by his idea of complementarity and his conception of the phenomenon of the living. Bohr’s approach to the biological questions evolved – among other things – from the consequences of (...) an epistemological lesson of quantum theory and in light of complementarity of observer as a priori living creature and ex post scientific explanation of the living. In a manifestation of the phenomenon of the living, each model of living system and its description makes accessible – from its own presuppositions, contexts and concepts – some features which are not accessible from the others. Nevertheless, for a general understanding of that phenomenon, incompatible sophisticated approaches are equally necessary. Bohr’s epistemology of complementarity turns out to be a heuristic and methodical framework for testing the extent to which biosemiotics can become one of the special sciences or its potential as a cross-disciplinary branch of study. Les termes d’espèce naturelle font débat : s’agit-il de termes descriptifs qui exprimeraient des caractéristiques des objets tombant dans leur extension, ou fonctionnent-ils plutôt comme des noms qui désigneraient directement leur espèce, sans l’intermédiaire d’une description? Selon la théorie causale de la référence (TCR), un terme comme « Tigre » nomme directement l’espèce du Tigre grâce à l’ostension d’un échantillon de tigres individuels qui constitue l’étalon de référence pour les usages ultérieurs du terme. Je me propose ici de confronter la (...) TCR à la pratique des noms de taxons telle qu’elle est réglée par le Code International de Nomenclature Zoologique. Je tâcherai de montrer qu’en dépit de contre-exemples avancés récemment, les prédictions de la TCR sont vérifiées par les noms scientifiques d’espèces et de sous-espèces. (shrink)

In this paper I discuss some problems with Aristotle’s characterization of lucky events as events which are “for the sake of something”. I argue that there is no special sense of the phrase “for the sake of something” when applied to lucky events. Qua event, a lucky event has come about for the sake of something and thus unqualifiedly belongs among things that come about for the sake of something. But qua lucky event, it has not come about for the (...) sake of that thing it has come about qua event, but it nevertheless is, or turns out to be, for the sake of something. (shrink)

This article argues against Catton and Dunlap’s claims that the natural environment has been ignored or downplayed in American sociology before the emergence of environmental sociology in the 1970s. By reviewing a collection of 86 sociology textbooks between 1894 and 1980, the article provides quantitative evidence regarding the scope and types of references to the natural environment in mainstream sociology. The bulk of the article is based on an interpretive-historical analysis of the different representations of the environment in the textbook (...) literature. This analysis is carried out from the perspective of the sociology of knowledge, whereby sociological ideas about nature are interpreted in terms of their intellectual milieu and social context. The main finding is that the ‘natural environment’ has been interpreted in different ways and has been put to a variety of epistemological and ideological uses — particularly positivism and functionalism — throughout the history of the discipline. How should we use intellectual history to inform our thinking about freedom in the advent of digital technologies? Quentin Skinner argues that prevalent liberal idiom is unable to address the political challenges in the world of big tech. While liberals consider these challenges in terms of invasion of individual privacy, in Skinner's neo-Roman – and once widely accepted – perspective, the growing datafication of contemporary societies should be considered an affront to liberty. By invoking the figure of ‘paths not taken’, (...) the author of Liberty before liberalism shows, how we may learn from the past without abandoning commitments to contextual accuracy of historical investigation. W niniejszym artykule podejmuje się próbę przeanalizowania zaprezentowanych przez Edytę Stein w O zagadnieniu wczucia opisów relacji między uczuciami, osobą oraz wartościami. Pokaże się przede wszystkim, na czym polega postulowana przez Stein korelacja między osobą a wartościami. Istotne dla tego celu będzie zarysowanie Stein fenomenologii uczucia. W artykule wskazuje się na problematyczność niektórych ujęć proponowanych przez autorkę. Zwraca się uwagę przede wszystkim na niedostateczność analizy przedmiotowej strony uczuć oraz istoty wartości. Centralnym punktem krytyki jest jednak pogląd Stein, traktujący czucie wartości (...) oraz uczucia jako dwa kierunki jednego przeżycia. Pokazuje się, czym w ujęciu autorki jest osoba oraz w jaki sposób dochodzi do jej fenomenologicznej konstytucji. Stawia się również omawiane zagadnienia w kontekście intersubiektywności. Argumentuje się, że według Stein własne życie emocjonalne człowieka posiada istotne znaczenie dla rozumienia innych osób. Analizę O zagadnieniu wczucia pogłębia się przez wskazanie na pewne zmiany w ujęciu zagadnień aksjologicznych w późniejszych rozprawach Stein. (shrink)

This volume provides the reader with the substantial evidence, presented here for the first time in a chronological manner, of the essential place that Dionysus occupied in Greek and Roman political thought. The eleven chapters that make up the volume are authored by an interdisciplinary team of scholars (including four top specialists in the field, Cornelia Isler-Kerényi, Richard Seaford, Richard Stoneman and Jean-Marie Pailler) and cover the period from archaic Greece to the late Roman empire. The reader can therefore observe (...) how the political ideas and motifs rooted in Greek classical thought were continued, adapted, and developed in successive periods of history. The contributors reconstruct the political significance of Dionysus by examining different kinds of evidence: historiography, poetry, coins, epigraphy, art, and philosophy. They discuss the place of the god in the politics of Greek city-states, explore the long tradition of imitating Dionysus that ancient leaders, from Alexander the Great to the Roman emperors, manifested in various ways, as well as demonstrate how the political role of Dionysus was reflected in Orphism and Neoplatonist philosophy. Dionysus and Politics provides an excellent introduction to a fundamental feature of ancient political thought which until now has been largely neglected by mainstream academia. Jak powstają świadome umysły? stanowi obszerne podsumowanie jego dotychczasowych rozważań na temat roli odczuwania i emocji w kształtowaniu świadomego umysłu. Artykuł jest przeglądem oraz krytycznym omówieniem podstawowych tez i idei zawartych w publikacji. Przedstawiono strukturę książki wraz z syntetycznym omówieniem treści poszczególnych rozdziałów oraz krótką ocenę.

The paper offers a conceptual and phenomenological analysis of the language of depersonalization. The depersonalization syndrome or disorder has no known common pathogenesis and shows no characteristic behavioral manifestations. A conceptual analysis of the key terms in the subjective complaints would therefore have consequences for clinical research into the phenomenon of depersonalization.

The article proposes to analyse whether the current configuration of national migration legislation from Arendt's perspective on the universalization of human rights and Agamben's reflections on bare life and the state of exception demonstrates its capacity to protect the human rights of people undergoing forced migration. To this end, a literature review of a bibliographical nature was used, using the historical procedure method. In order to interpret the effectiveness of the current configuration of the human rights of this vulnerable group, (...) an analysis of international and national legislation on migration was carried out, focusing mainly on the case of the New Brazilian Migration Law. To this end, a theoretical discussion was built to understand how human rights are framed considering the situation of migration and statelessness in the face of an increasingly prevalent state of exception. It was noted that the constitutive fragility of forced migrants is a perennial situation, aggravated by the political inaction of nation states. It has also been noted that there is a need for states and international organizations to adopt new practices to promote the human dignity of forced migrants. (shrink)

Growth of different body parts in humans is sensitive to different resource constraints that are mediated by parental investment. Parental investment can involve the expenditure of material, cognitive, and emotional resources on offspring. Cranial volume, an important predictor of cognitive ability, appears understudied in this context. We asked whether there are associations between growth and family structure, self-reported estimates for resource availability, and sibling number; and whether these constraints relate to head and body growth in a similar manner. We assessed (...) the associations between parental investment, height, and cranial volume in a cross-sectional study of Estonian children. Height correlated negatively with the number of siblings but this association became negligible in a model controlling for birthweight, parental heights, and mother’s age at birth. Unlike height, cranial volume was unrelated to sibling number, but it was negatively associated with self-reported meat and general resource shortage. Cranial volume was related to family structure and paternal education. Children living with both birth-parents had larger heads than those living in families containing a step-parent. Since these family types did not differ with respect to meat or general resource shortage, our findings suggest that families including both genetic parents provide non-material benefits that stimulate predominantly cranial growth. For the studied developmental period, cranial volume appeared a more sensitive marker of growth constraints than height. The potential of using cranial volume for quantifying physical impact of non-material parental investment deserves further attention. (shrink)

Business Ethics: A European Review, EarlyView.

The social cognition of domestic cats is a scarcely studied topic due to the reputation of the animal as individualistic. Nevertheless, cats are capable of cognitively demanding cooperative activities such as a communal nest-moving. The cognitive abilities of free-ranging cats are evaluated against the background of the shared intentionality hypothesis, proposed by a research group of Michael Tomasello. Although their comparative studies are carried out on chimpanzees, they are valuable as a source of conceptual work linking empirical cognitive studies with (...) the philosophical accounts of joint agency. We critically analyze theoretical cognitive concepts interpreting the triadic interactions of great apes and the collective hunting among chimpanzees. Contrary to the shared intentionality hypothesis, it is argued that cats have cognitive abilities to share attention, truly cooperate and constitute shared meanings. Finally, we introduce the concept of the natural interaction ritual by Randall Collins and outline its significance for our case study about cats as well as for a general biosemiotic theory of the development of symbols.
