In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. Academics from diverse disciplines are recognizing not only the procedural ethical issues involved in research, but also the complexity of everyday “micro” ethical issues that arise. While ethical guidelines are being developed for research in aboriginal populations and low-and-middle-income countries, multi-partnered research initiatives examining arts-based interventions to promote social change pose a unique set of ethical dilemmas not yet fully explored. Our research team, comprising health, education, and social scientists, critical theorists, artists and community-activists launched a five-year research partnership on (...) arts-for-social change. Funded by the Social Science and Humanities Research Council in Canada and based in six universities, including over 40 community-based collaborators, and informed by five main field projects, we set out to synthesize existing knowledge and lessons we learned. We summarized these learnings into 12 key points for reflection, grouped into three categories: community-university partnership concerns, dilemmas related to the arts, and team issues. In addition to addressing previous concerns outlined in the literature, we identified power dynamics hindering meaningful participation of community partners and university-based teams that need to be addressed within a reflective critical framework of ethical practice. We present how our team has been addressing these issues, as examples of how such concerns could be approached in community-university partnerships in arts for social change. (shrink)

Despite the ubiquity of healthcare simulation and the humanities in medical education, the two domains of learning remain unintegrated. The stories suffused within healthcare simulation have thus remained unshaped by the developments of narrative medicine and the health humanities. Healthcare simulation, in turn, has yet to utilize concepts like co-construction and narrative competence to enrich learners’ understanding of patient experience alongside their clinical competencies. To create a conceptual bridge between these two fields (including narrative-based inquiry more broadly), we redescribe narrative (...) competence via Ronald Heifetz’s distinction of “technical” and “adaptive” challenges outlined in his adaptive leadership model. Heifetz, we argue, enriches learners’ self-understanding of the unique demands of cultivating narrative competence, which can be both elucidated on the page and tested within the charged yet supportive simulation environment. We introduce Co-constructive Patient Simulation (CCPS) to demonstrate how working with simulated patients can support narrative work by drawing on the clinical vicissitudes of learners in the formulation and enactment of case studies. The three movements of CCPS—resensing, retelling, and retooling—told through learner experiences, describe the affinities and divergences between narrative medicine’s sequence of attention, representation, and affiliation; Montello’s three forms of narrative competence (departure, performance, change), and Heifetz’s three steps (observe, interpret, and intervene) of adaptive leadership. Infant-directed speech, the particular form of spontaneous language observed in interactions between parents and their infants, is a crucial aspect of the mother-infant interaction and an index of the attunement of maternal linguistic input to her infant communicative abilities and needs during dyadic interactions. The present study aimed to explore linguistic and pragmatic features of IDS during mother-infant interactions at 3-month of infant age. The effects of infant, maternal and dyadic factors on IDS were explored. Results evidenced few differences between (...) the groups on IDS linguistic characteristics. Moreover, observing the interaction of birth status and dyadic co-regulation, full-term mothers varied their IDS pragmatic features according to the quality of co-regulation while preterm mothers did not. Parenting stress was associated to specific linguistic IDS features independently from the birth status. Findings are discussed underling implications for the study of preterm dyads interactions and the importance to consider the interplay of several factors in affecting the quality of IDS. (shrink)

One central tenet of the Modern Evolutionary Synthesis , and the consensus view among biologists until now, is that all genetic mutations occur by “chance” or at “random” with respect to adaptation. However, the discovery of some molecular mechanisms enhancing mutation rate in response to environmental conditions has given rise to discussions among biologists, historians and philosophers of biology about the “chance” vs “directed” character of mutations . In fact, some argue that mutations due to a particular kind of mutator (...) mechanisms challenge the Modern Synthesis because they are produced when and where needed by the organisms concerned. This paper provides a defense of the Modern Synthesis’ consensus view about the chance nature of all genetic mutations by reacting to Jablonka and Lamb’s analysis of genetic mutations and the explicit Lamarckian flavor of their arguments. I argue that biologists can continue to talk about chance mutations according to what I call and define as the notion of “evolutionary chance,” which I claim is the Modern Synthesis’ consensus view and a reformulation of Darwin’s most influential idea of “chance” variation. Advances in molecular genetics are therefore significant but not revolutionary with respect to the Modern Synthesis’ paradigm. (shrink)

Typical theory of mind tasks assess children’s ability to attribute a false belief in order to predict or explain an action. According to these standard tasks, young children do not represent the independent (mistaken) beliefs of others until the fourth year—yet long before this, children are able to track speakers’ intentions in order to learn new words. Might communication be a privileged domain for theory of mind? In the present study we explored pre‐schoolers’ ability to track a false belief in (...) order to acquire a novel word. A puppet labeled a novel object in a false belief condition (contents of a box had been switched without her knowledge), and a true belief condition (contents switched in her presence). Children were significantly better at tracking the puppet’s false belief in the word‐learning task than in a standard false belief test. Possible reasons for this advantage are discussed, and the suggestion made that representation of mental states may emerge precociously in the service of communication. (shrink)

In 2022, the Camden Coalition Medical-Legal Partnership began providing civil and criminal legal services to substance use disorder patients at Cooper University Health Care’s Center for Healing. This paper discusses early findings from the program’s first year on the efficacy of the provision of criminal-legal representation, which is uncommon among MLPs and critical for this patient population. The paper concludes with takeaways for other programs providing legal services in an addiction medicine setting.

During his multiannual reflection Sismondi seems reluctant to define his concept of city, while devoting most of his energy to the importance of cities self-government – starting with his famous Histoire des Républiques italiennes au Moyen Age. This essay tries to frame his reflection in the intersection between his economic and constitutional proposals. In the background stands a continuous dialogue with Adam Smith, revisited through the relationship that the canton of Geneva has had during the Restoration with its rural population.

While Wittgenstein’s work has been extensively investigated in relation to many other important and influential philosophers, there is very little scholarly work that positively investigates the relationship between the work of Wittgenstein and Wilhelm Dilthey. To the contrary, some commentators like Hacker (2001a) suggest that Dilthey’s work (and that of other hermeneuticists) simply pales or is obsolete in comparison to Wittgenstein’s own insights. Against such assessments, this article posits that Wittgenstein’s and Dilthey’s thought most crucially intersects at the related topics (...) of scientism on the one hand and scientific and philosophical method on the other. In reconstructing Dilthey’s conceptions of understanding versus explaining and central points of Wittgenstein’s Remarks on Frazer’s Golden Bough, it becomes apparent that they share a staunch rejection of scientism and use the notion of understanding as a means to prevent methodologies from the natural sciences encroaching onto the human sciences (in Dilthey’s case) and philosophy (in Wittgenstein’s case). Notwithstanding a number of central ways in which these thinkers differ, this article closes by suggesting that there is some evidence according to which Wittgenstein, like Dilthey, can reasonably be understood as championing some central tenets of the hermeneutical tradition. The efforts of some institutional review boards (IRBs) to exercise what is viewed as appropriate oversight may contribute to deceit on the part of investigators who feel unjustly treated. An organizational justice paradigm provides a useful context for exploring why certain IRB behaviors may lead investigators to believe that they have not received fair treatment. These feelings may, in turn, lead to intentional deception by investigators that IRBs will rarely detect. Paradoxically, excessive protective zeal by IRBs may actually encourage misconduct (...) by some investigators. The authors contend that, by fostering a climate in which investigators perceive that they receive fair and unbiased treatment, IRBs optimize the likelihood of collegial compliance with appropriate participant protections. There is a close conceptual relation between the notions of religious disenchantment and scientific naturalism. One way of resisting philosophical and cultural implications of the scientific image and the subsequent process of disenchantment can be found in attempts at sketching a reenchanted worldview. The main issue of accounts of reenchantment can be a rejection of scientific results in a way that flies in the face of good reason. Opposed to such reenchantment is scientific naturalism which implies an entirely disenchanted worldview. (...) However, one of the main problems of scientific naturalism are placement problems. A reenchanted worldview does have the conceptual resources to avoid placement problems, yet seems to throw out the baby with the bathwater. A dilemma results: the Scylla of an undesirable scientific naturalism and the Charybdis of a rampant, seemingly prescientific reenchanted worldview. In this article I argue that there is a safe middle passage between these two options, i.e. the recently proposed liberal naturalism which allows for a moderate normative reenchantment. Liberal naturalism lets us have it both ways: avoiding the placement problems while retaining a necessary and reasonable adherence to science, thereby avoiding both an all-too restrictive scientific naturalism. To understand better why evidence of student cheating is often ignored, a national sample of psychology instructors was sampled for their opinions. The 127 respondents overwhelmingly agreed that dealing with instances of academic dishonesty was among the most onerous aspects of their profession. Respondents cited insufficient evidence that cheating has occurred as the most frequent reason for overlooking student behavior or writing that might be dishonest. A factor analysis revealed 4 other clusters of reasons as to why cheating may be (...) ignored. Emotional reasons included stress and lack of courage. Difficult reasons included the extensive time and effort required to deal with cheating students. Fear reasons included concern about retaliation or a legal challenge. Denial reasons included beliefs that cheating students would fail anyway and that the worst offenders do not get caught. The reasons why instances of academic dishonesty should be proactively confronted are presented. (shrink)

Academic dishonesty among students is not confined to the dynamics of the classrooms in which it occurs. The institution has a major role in fostering academic integrity. Ways that institutions can have a significant impact on attitudes toward and knowledge about academic integrity as well as reducing the incidence of academic dishonesty are described. These include the content of an effective academic honesty policy, campus-wide programs designed to foster integrity, and the development of a campus-wide ethos that encourages integrity.

This article explores four major areas of moral concern regarding virtual reality technologies. First, VR poses potential mental health risks, including Depersonalization/Derealization Disorder. Second, VR technology raises serious concerns related to personal neglect of users’ own actual bodies and real physical environments. Third, VR technologies may be used to record personal data which could be deployed in ways that threaten personal privacy and present a danger related to manipulation of users’ beliefs, emotions, and behaviors. Finally, there are other moral and (...) social risks associated with the way VR blurs the distinction between the real and illusory. These concerns regarding VR naturally raise questions about public policy. The article makes several recommendations for legal regulations of VR that together address each of the above concerns. It is argued that these regulations would not seriously threaten personal liberty but rather would protect and enhance the autonomy of VR consumers. (shrink)

The article examines the food-implications that Augustine assigns to the different groups catalogued in the unfinished work De haeresibus. The aim isto check whether eating habits (and, if so, what eating habits) could be a criterion of heretical identity and identification. On concluding the examination it was found that the eating habits identified by Augustine are a very significant component (and sometimes even discriminatory) used to determine the heretical character of individual dissident groups. However, this same plurality of eating habits (...) which sometimes oppose each other, cannot be reduced to a single paradigm which is able to define the quid faciat hereticum in a broader and more comprehensive manner. In Augustine‟s mind, the heretical identity (and identification) is not reducible to a standard and unique formula. (shrink)

Naturalism is the current orthodoxy in analytic philosophy. Naturalism is the conjunction of the (ontological) claim that all that truly exists are the entities countenanced by the natural sciences and the (epistemological) claim that the only true knowledge is natural-scientific knowledge. Drawing on some recent work in Critical Theory, this article argues that naturalism qualifies as an ideology. This is the case because naturalism meets three key aspects shared by paradigmatic cases of ideology: (i) naturalism has practical consequences and implications (...) of a specific kind, (ii) those endorsing naturalism fall prey to a dual deception: having false meta-level beliefs about naturalism as being without alternative, and (iii) naturalism has a tendency towards self-immunisation. The article ends by suggesting we pull naturalism out of our collective cognitive backgrounds onto the main stage of critical discourse, making it a proper topic for philosophical critique again. The paper argues that the main limits of the Davidsonian proposal, which lie in the very attempt to apply Tarskian theory of truth to natural languages, are partially overcome later by Davidson himself. Above all in his paper A NiceDerangement of Epitaphs (1986), Davidson rejects the very idea of an “invariance of meaning” and proposes a “second” notion of equivalence, described as the research of momentary and always changing points of convergence of interpreter and speaker,depending on contextual information. This convergence is possible because of a “deeper equivalence,” a common cognitive apparatus that allows communication to take place. At any rate, as the paper aims to demonstrate, this solution seems to simply shift the problem on to another level of explanation. Once this level of “deeper equivalence” is reached, there is too no explanation of exactly how a translator can understand contextual implications in order to graspfunctional equivalence. (shrink)

Within the Christian theological tradition there has always been a variety of perspectives on hell, usually distinguished according to their views about the duration of hell’s torments for the damned. Traditionalists maintain that the suffering of the damned is everlasting. Universalists claim that eventually every person is redeemed and arrives in heaven. And conditional immortalists, also known as “conditionalists” or “annihilationists,” reject both the concept of eternal torment as well as universal salvation, instead claiming that after a finite period of (...) suffering the damned are annihilated. Conditionalism has enjoyed somewhat of a revival in scholarly circles in recent years, buoyed by the influential biblical defense of the view by Edward Fudge. However, there has yet to appear a book-length philosophical defense of conditionalism... until now. In Hell and Divine Goodness, James Spiegel assesses the three major alternative theories of hell, arriving at the conclusion that the conditionalist view is, all things considered, the most defensible position on the issue. An oft-defended claim of a close relationship between Gentzen inference rules and the meaning of the connectives they introduce and eliminate has given rise to a whole domain called proof-theoretic semantics, see Schroeder- Heister (1991); Prawitz (2006). A branch of proof-theoretic semantics, mainly developed by Dosen (2019); Dosen and Petric (2011), isolates in a precise mathematical manner formulas (of a logic L) that have the same meaning. These isomorphic formulas are defined to be those that behave identically in inferences. The (...) aim of this paper is to investigate another type of recently discussed rules in the literature, namely grounding rules, and their link to the meaning of the connectives they provide the grounds for. In particular, by using grounding rules, we will refine the notion of isomorphic formulas through the notion of hyper-isomorphic formulas. We will argue that it is actually the notion of hyper-isomorphic formulas that identify those formulas that have the same meaning. (shrink)

Our perception of where touch occurs on our skin shapes our interactions with the world. Most accounts of cutaneous localisation emphasise spatial transformations from a skin-based reference frame into body-centred and external egocentric coordinates. We investigated another possible method of tactile localisation based on an intrinsic perception of ‘skin space’. The arrangement of cutaneous receptive fields (RFs) could allow one to track a stimulus as it moves across the skin, similarly to the way animals navigate using path integration. We applied (...) curved tactile motions to the hands of human volunteers. Participants identified the location midway between the start and end points of each motion path. Their bisection judgements were systematically biased towards the integrated motion path, consistent with the characteristic inward error that occurs in navigation by path integration. We thus showed that integration of continuous sensory inputs across several tactile RFs provides an intrinsic mechanism for spatial perception. (shrink)

We fear there is too much focus on the semantic question of whether we should call particular practices and emerging bio-technologies such as CRISPR ‘eugenics’, rather than the more important question of how we should view them from the perspective of ethics and policy. Lookism refers to discrimination based on physical attractiveness or the lack thereof. A whole host of empirical research suggests that lookism is a pervasive and systematic form of social discrimination. Yet, apart from some attention in ethics and political philosophy, lookism has been almost wholly overlooked in philosophy in general and epistemology in particular. This is particularly salient when compared to other forms of discrimination based on race or gender which have been at the forefront of epistemic injustice as a (...) topic of research. This paper argues that lookism is associated with various forms of epistemic injustice. In the specific case of lookism, hermeneutic injustice takes the shape of the taboo of acknowledging that unattractive people are unattractive. This, on the one hand, results in a hampered understanding of one’s own situation insofar as one is deterred from seeing one’s looks as one major factor for one’s social position. On the other hand, this hermeneutic injustice serves as the backdrop of instances of a special kind testimonial injustice in which the ugly person’s burgeoning realization that their looks influence their social standing detrimentally is discounted due to the pejorative nature of ascribing someone the property of being unattractive or ugly.
