The present article critically examines three aspects of Graham Priest's dialetheic analysis of very important kinds of limitations (the limit of what can be expressed, described, conceived, known, or the limit of some operation or other). First, it is shown that Priest's considerations focusing on Hegel's account of the infinite cannot be sustained, mainly because Priest seems to rely on a too restrictive notion of object. Second, we discuss Priest's treatment of the paradoxes in Cantorian set-theory. It is shown that (...) Priest does not address the issue in full generality; rather, he relies on a reading of Cantor which implicitly attributes a very strong principle concerning quantification over arbitrary domains to Cantor. Third, the main piece of Priest's work, the so-called “inclosure schema”, is investigated. This schema is supposed to formalize the core of many well-known paradoxes. We develop a Bayesian framework for thinking about the way evidence about the here and now can bear on hypotheses about the qualitative character of the world as a whole, including hypotheses according to which the total population of the world is infinite. We show how this framework makes sense of the practice cosmologists have recently adopted in their reasoning about such hypotheses.

For three decades Frank Cioffi has been at the center of the debate over Freud's legacy and the legitimacy of psychoanalysis.

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

This paper investigates whether, or not, the behavior of animals without speech can manifest beliefs and desires. Criteria for the attribution of such beliefs and desires are worked out with reference to Jonathan Bennett's theory of cognitive teleology: A particular ability for learning justifies attributing such beliefs and desires. The conceptual analysis is illustrated by examinations of cognitive ethology and considers higher-order intentionality. It is argued that the behavioral evidence only supports the attribution of first order beliefs and that languageless (...) animals therefore could not possess higher-order intentionality. They are only capable of forming simple, i.e., first-order beliefs about their environment. (shrink)

In this paper we present some concepts and their relations that are necessary for modeling autonomous agents in an environment that is governed by some (social) norms. We divide the norms over three levels: the private level the contract level and the convention level. We show how deontic logic can be used to model the concepts and how the theory of speech acts can be used to model the generation of (some of) the norms. Bayesian psychology, in what is perhaps its most familiar version, is incomplete: Jeffrey conditionalization is not a complete account of rational belief change. Jeffrey conditionalization is sensitive to the order in which the evidence arrives. This order effect can be so pronounced as to call for a belief adjustment that cannot be understood as an assimilation of incoming evidence by Jeffrey's rule. Hartry Field's reparameterization of Jeffrey's rule avoids the order effect but fails as an account of how new evidence (...) should be assimilated. (shrink)

His discusssions extend from Wittgenstein's reflections on human sacrifice and other ritual practices dealt with by Frazer to Freud's account of the sources of anxiety, depression, dreams and laughter. The temporal granularity of consciousness may be far less fine than the real-time information processing mechanisms that underlie our sensitivity to small temporal differences. It is suggested that conscious time perception, like space perception, is subject to errors that belie a unitary underlying representation. E. R. Clay's concept of the “specious present,” an extended moment represented in consciousness, is suggested as an alternative to the more common notion of instantaneous experience that underlies much reasoning based on the “time of arrival” (...) in consciousness. Ayahuasca is an Amazonian psychoactive shamanic brew that often elicits spontaneous, intense, and meaningful imagery narratives related to psychological and physical healing, problem solving, knowledge acquisition, community cohesion, creativity, and spiritual development. My EEG and phenomenology ayahuasca research found it caused the greatest changes in EEG beta coherence from 25 to 30 cycles per second compared to a resting state before ayahuasca ingestion. Enhanced beta coherence indexes significantly greater information exchange between cortical regions and is congruent with the reported enhanced (...) richness, complexity, and profundity of ayahuasca experiences. I developed the creative cycle processes model that identifies in ayahuasca reports distinct experiential change processes and describes how these processes, neuroscience, psychotherapy, mythological, and other transdisciplinary evidence can be coherently integrated to explain ayahuasca benefits. The model suggests three change process stages together underlie one emergent dynamic creative cycle process. The sequential stages are Form dismantling and healing processes, form creation processes, where novel forms spontaneously combine, and form expression processes, where emergent experiences are embodied. The model suggests that these three stages repeat cyclically in human development in an ongoing process of dismantling and generation producing more creative experiences and expressive forms. The present article represents a further critical use of this material that we deem worthy of publication.in this vital and splendidly crafted work, Bethany Henning recovers a philosophy of aesthetic wisdom far richer (...) than the narrow epistemological lens dominant today. From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In accepting the unconscious, European thought has taken strides to acknowledge and address such ills. Henning wonders whether America might accept "a dynamic unconscious, were it presented with an alternative mythology" (10) and finds a viable candidate in Dewey's underappreciated notion of qualitative immediacy: an "aesthetic (directly felt) connection between ourselves and [End Page 77] the world" (Henning 5). In affirming the unconscious depth of experience, this American reconfiguration welcomes "aesthetic experience back into our philosophical lives" (Henning 5).When embodied meaning supplements cognitive reflection, we come to champion "the sensuous, lived body" as "the primary reality" of qualitative immediacy—a felt aesthetic unity punctuated by "impulsions" arising from an organism's needs (Henning 69). As "a site of adaptive adjustments," Henning continues, "the body is responsive to the brink of coalescence at the point of contact with the world, in which things that are 'outside of it' belong to it" (71). "To move adeptly into aesthetic experience means to be skilled at loosening focal consciousness" so as to cultivate "the essential porousness of the world" (130).With this, the body-mind relation becomes a problem of normative aesthetics, not epistemology. There are problems with both the theoretical logic and the interpretation of data in Christie and Barresi's interesting article. The general pattern of results is easily incorporated into an information-processing framework compatible with Dennett's analysis. In particular, different aspects of the illusory motion event are queried at different times and these aspects are not in conflict, so no revision of conscious content is necessary. Second, too much interpretive weight is placed on an anomalous pair of data points that do not (...) seem fully interpretable within the author's framework and are probably susceptible to one of several alternative interpretations proposed here, though further investigation is necessary. Although Pessoa et al. imply that many aspects of the filling-in debate may be displaced by a regard for active vision, they remain loyal to naive neural reductionist explanations of certain pieces of psychophysical evidence. Alternative interpretations are provided for two specific examples and a new category of filling-in (of visual detail) is proposed.

In The Democratic Horizon: Hyperpluralism and the Renewal of Political Liberalism, Alessandro Ferrara seeks a philosophical breakthrough from what looks like it could be a pending dead-end for democracy. The best hope, Ferrara superbly maintains, lies through an extension or updating – a “renewal,” as he calls it – of lines of thought bequeathed to us, by John Rawls and others, under the name of political liberalism. Somewhere near the crux of Ferrara’s reflection stands a class of institutional fixtures whose (...) name is missing from his title. I mean the class “constitution.” I use that word to name a country’s scriptural basic law, its publicly cognizable corpus of canonically worded sentences ordaining the country’s basic institutional framework. My suggestion will be that it is no less tellingly a “constitutional” than a “democratic” horizon that Ferrara’s work, in conjunction with Rawls’s, shows us to be facing. (shrink)

Sohn-Rethel’s great idea was to ‘socialise’ Kant’s transcendental subject by combining it with Marx’s commodity-form. In so doing, he took on three challenges simultaneously: a) the timeless validity of modern natural science; b) the social genesis of empirically pure forms of cognition; and c) socialisation occurring through a purely social synthesis. However, Sohn-Rethel construed Marx’s value-form analysis as an empirical exchange of commodities and held that such exchange performs a real abstraction – in this way, he laboured under the very (...) semblance that money engenders at the surface of society by virtue of its function qua means of exchange. This semblance can be rendered transparent by, on the one hand, explaining value in terms of capitalist valorisation rather than as a product of abstraction, and, on the other, developing money as the measure and form of this valorisation. In my paper “On the Probabilities of Conditionals,” I claimed, mistakenly, that David Lewis’s four triviality results and Alan Hájek’s proof depend on the application of the following principle to conditionals containing nested conditionals.

John Rawls proposed, as what he called “the liberal principle of legitimacy,” that coercive exercises of political power can be justified to free and equal dissenters when “in accordance with a constitution (written or unwritten) the essentials of which all citizens, as reasonable and rational, can endorse.” Does “unwritten constitution” there refer to norms of constitutional import, but that subsist only as custom, not as law? To norms that subsist as common law but not as code law? To empirical regularities (...) of political practice, as opposed to normative rules and standards? Which interpretation is best? (shrink)

This article reconstructs Badiou’s oeuvre from the vantage point of the last volume of his Being and Event trilogy. It determines the perspective and task of The Immanence of Truths and demonstrates in what way an “absolute ontology” is the result of an act of forcing that serves as the measure for a truth’s truthness. This allows to argue that Badiou’s is and always was a philosophy of freedom.

In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. Secular change in sex ratios is examined in relation to experience in the family. Two theoretical perspectives are outlined: Guttentag and Secord’s (1983) adaptation of social exchange theory, and sexual selection theory. Because of large-scale change in number of births and typical age differentials between men and women at marriage, low sex ratios at couple formation ages existed in the U.S. between 1965 and the early 1980s. The currently high sex ratios, however, will persist until the end of the century. (...) High sex ratios appear to be associated with lower divorce rates, male commitment to careers that promise economic rewards, male willingness to engage in child care, higher fertility, and higher rates of sexual violence. Sexual selection theory calls attention to intrasexual competition in the numerically larger sex. (shrink)

By the example of deafness the article examines the ethical problems that arise when preimplantation genetic diagnosis is used for the intentional heredity of genetic defects. In the first two sections the relevant rules of the German Embryo Protection Law and the motives of deaf couples to desire a handicapped child are explained. Subsequently, it is asked whether the positive selection of genetic defects can harm or otherwise wrong the future child. Moreover, a possible duty of prospective parents to prefer (...) an embryo which will most probably experience a higher quality of life is discussed. Finally, the question is raised whether parents have a right to refuse medical treatment that may alleviate their child's handicap. As a result, it is argued that neither a legal ban on the positive selection of handicapped embryos nor compulsory treatment of deaf children are ethically justified. (shrink)

Zunächst werden vier Legitimationstheorien, die in der aktuellen Diskussion häufig vertreten werden, untersucht und aus verschiedenen Gründen zurückgewiesen. Als Basis der Rechtfertigung scheiden damit individuelle Eigentumsrechte, der Verlauf der Geschichte, die Gerechtigkeit der staatlichen Herrschaft sowie die Selbstbestimmung nationaler Gemeinschaften aus. Abschließend wird die Auffassung vertreten, die Legitimität der staatlichen Gebietshoheit gründe in dem – gegebenenfalls in einem Referendum zu klärenden (...) – Mehrheitswillen der ortsansässigen Bevölkerung.
