While Corporate Social Responsibility (CSR) is often seen to involve voluntary and deliberative approaches such as certification, governments have recently stepped into the picture through national legislation. France’s Law on Duty of Vigilance adopted in 2017 is a landmark case of such legislation. Years of voluntary CSR certification schemes led by Civil Society were replaced by a new philosophy of fighting for mandatory CSR controlled by a judge. We depict the change of mindset and the related change of roles inside (...) the coalition of Civil Society actors represents a Machiavellian Moment. The combination of collective civil society actors’ roles (namely nongovernmental organizations and labor unions) as Machiavellian _Virtue_ with disruptive events as Machiavellian _Fortuna_ made the law’s adoption possible. Based on this case study, we provide an analysis of civil society roles in the development of CSR-related legislation. (shrink)

Exploration of the political roles firms play in society is a flourishing stream within corporate social responsibility research. However, few empirical studies have examined multiple levels of political CSR at the same time from a critical perspective. We explore both how the motivations of managers and internal organizational practices affect a company’s choice between competing CSR approaches, and how the different CSR programs of corporate and civil society actors compete with each other. We present a qualitative interpretative case study of (...) how a French children’s clothing retailer develops CSR practices in response to accusations of poor working conditions and child labor in its supply chain. The company’s CSR approach consists of superficial practices, such as supplier audits by a cooperative business-organized nongovernmental organization and philanthropic activities, which enable managers to silence more radical alternative models defended by other NGOs, activists, and trade unions. By this approach, the core business model based on exploitative low-cost country sourcing remains intact through self-regulated CSR. Through the case study, we develop a framework of dynamism in competing CSR programs. We discuss the implications of our study for CSR researchers, company managers, and policy makers. (shrink)

La réflexion philosophique, dont l'ouverture à l'univers dans lequel nous nous découvrons - avec une acuité proportionnelle à un étonnement renouvelé - n'a pas de limites, n'en est que plus tributaire des sciences et des techniques, des arts et de multiples activités qui régissent plus ou moins fructueusement notre expérience. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. Guillaume Collett questions to what extent we can locate Deleuze within the Lacanian School during the late-1960s, prior to Guattari. In so doing, he offers a new, integrated reading of Deleuze's The Logic of Sense by understanding it as a 'psychoanalysis of sense', and gives a new interpretation of Deleuze's conception of philosophy itself. The Psychoanalysis of Sense shows that Deleuze was not merely aware of the debates animating the Lacanian School during the 1960s: he sought to contribute to (...) them. Emphasising his appropriation of the work of post-Lacanian Serge Leclaire, Collett explains how Deleuze constructed a more singular and immanent theory of the linguistic structure of the unconscious - granting the erogenous body a larger structuring role. Many results in logic and mathematics rely on techniques that allow for concrete, often visual, representations of abstract concepts. A primary example of this phenomenon in logic is the distinction between syntax and semantics, itself an example of the more general duality in mathematics between algebra and geometry. Such representations, however, often rely on the existence of certain maximal objects having particular properties such as points, possible worlds or Tarskian first-order structures. -/- This dissertation explores an alternative to such representations (...) known as possibility semantics. Its core idea is to replace maximal objects with ordered systems of partial approximations. Although it originates in the semantics of modal logic and the representation of abstract ordered structures, I argue that it has far-reaching mathematical, foundational and philosophical significance, especially in the context of semiconstructive mathematics, a foundational framework that does not assume any fragment of the Axiom of Choice beyond the Axiom of Dependent Choices. -/- The dissertation is divided in two main parts. The first part explores various applications of the mathematical framework underlying possibility semantics to lattice theory and non-classical propositional logics. A major theme is the development of constructive dualities for various categories of lattices, which are related to standard non-constructive dualities via Vietoris constructions. -/- The second part of the dissertation explores the alternative foundational setting of semi-constructive mathematics, focusing on three applications of possibility semantics for classical first-order logic to the philosophy of the mathematical infinite. In particular, we introduce generic powers, a semi-constructive analogue of ultrapowers in classical model theory, and we explore the merits of these structures from a foundational, conceptual and historical viewpoint. Galileo asked in his Dialogue of the Two New Sciences what relationship exists between the size of the set of all natural numbers and the size of the set of all square natural numbers. Although one is a proper subset of the other, suggesting that there are strictly fewer squares than natural numbers, the existence of a simple one-to-one correspondence between the two sets suggests that they have, in fact, the same size. Cantor famously based the modern notion of cardinality (...) on the second intuition, but recent advances in mathematical logic (most notably, numerosity theory) have renewed an interest in the question whether Cantor’s way out of Galileo’s paradox was the only possible one. I present a new solution to Galileo’s paradox and argue that it is a better alternative to the Cantorian solution than numerosity theory. In fact, I argue that it is the best possible way out of Galileo's Paradox that can be based on the "Euclidean" intuition that the whole is always greater than any of its proper parts. (shrink)

In this paper, we examine Sextus Empiricus' treatise Against the geometers . We first set this treatise in the overall context of the sceptic's polemics against the liberal arts. After a discussion of Sextus' attitude to the quadrivium , we discuss the structure, the sources and the target of the Against the geometers . It appears that Euclid is not Sextus' source, and neither he, nor the professional geometers, seem to be Sextus' main targets. Of course, Sextus never really makes (...) clear his precise target, but his attacks are rather directed against geometry as a means of modelling the physical world, thus ruining the support geometry was intended to bring to the physical part of dogmatic philosophy. Critically, but without polemics, he creates a portrait of Heidegger in his time, using all available sources—lectures, letters, and the notorious “black notebooks.” Payen chronicles Heidegger’s “changing destinies”: after the First World War, an uncompromising Catholicism gave way to a vigorous striving for a philosophical (...) revolution—fertile ground for National Socialism. The book reflects a life of light and shadow. Heidegger was a great philosopher and teacher who cultivated friendships and love affairs with Jews but also was an anti-Semitic nationalist who lamented the “Judaization of German intellectual life.”. The development of phenomenology in nineteenth‐century German philosophy is that of a particular stream within the larger historical‐philosophical complex of Austro‐German philosophy. As the “grandfather of phenomenology” resp. the “disgusted grandfather of phenomenology,” but also as the key figure on the “Anglo‐Austrian Analytic Axis”, Brentano is at the source of the two main philosophical traditions in twentieth‐century philosophy. This chapter focuses mainly on his place in nineteenth‐century European philosophy and on the central themes and concepts in his philosophy that were (...) determinant in the development of the philosophy of his most gifted student: Edmund Husserl. Despite the variety of stances which Brentano expressed on ontology, metaphysics, and psychology over the course of his career, the five general principles remain central to his whole philosophy throughout: they have an important place in what could be called Brentano's philosophical worldview or system. In this paper, we try to define some aspects of a political ethics in Merleau-Ponty's phylosophy. It is possible to describe a recurring and structural problem in his political work: the question of «humanism». This problem implies that the goal of any policy consists in the «institution» of a symbolic link between human beings. We argue that the problem of humanism structures the political thought of the philosopher and explains Merleau-Ponty's relation toMarxism and to history. The courage of the institution, (...) which can be an answer to the problem of humanism, embodies the fondamental political virtue. A virtue that Merleau-Ponty calls «virtue without any resignation». In light of the political facts of his time and his own experience, Merleau-Ponty tries, in the preface to Signs, to detect a general structure of history and culture. Concerned with establishing a concrete philosophy, the French philosopher never detached his political reflection from the particularity of circumstances. This article proposes to take up both the spirit and method of Merleau-Ponty. With regard to the spirit, this is a matter of seeing whether the analyses in the preface to Signs still (...) make sense for us today. With regard to method, we try to develop an interpretation anchored in the current experience of French politics. This rootedness in current events is fundamental if we do not want to betray the concern for contingency, the sign of a concrete political approach. We will find that the ethics of engagement defined by Merleau-Ponty in the expression, “virtu without resignation” could also be the response to certain contemporary problems. (shrink)

The Political Imaginary.Reflections on Merleau-Ponty’s reading of MachiavelliThis essay attempts to set in relief an aspect of Merleau-Ponty’s political thought that has still received little study: his conception of the political imaginary. This fertile aspect of his political thought appears explicitly in his reading of Machiavelli as it is developed in “Note on Machiavelli”, which appeared for the first time in 1949. In this note, Merleau-Ponty treats the specific problem of power. In trying to characterize this, Merleau-Ponty comes to discover (...) the inevitably imaginary dimension of the political space.To begin, this essay retraces the aim and scope of Machiavelli’s thought, while bringing to the fore those aspects in his political reflections that are properly imaginary. Next, the essay compares these reflections to those Merleau-Ponty had on the political imaginary in the same period as his courses on childpsychology at the Sorbonne (held between 1949 and 1952). Following the descriptions of the phenomenon of the imaginary, this time from the phenomenological point of view, the third and final section of this essay will articulate the analyses of the “Note on Machiavelli” together with the theoreticaljustification of the political imaginary and will show how these analyses are inscribed in the heart of Merleau-Ponty’s path. The Grand Challenges literature brings under its umbrella a wide variety of disjointed phenomena but runs the risk of reinventing the wheel as well as overlooking incremental progress and past work. To avert this, scholars need to (dis)connect (dis)similar issues, build on past research on these issues, and create opportunities for generalizability through theoretical examinations.

Unlike in physics, the category of thought experiment is not very common in biology. At least there are no classic examples that are as important and as well-known as the most famous thought experiments in physics, such as Galileo’s, Maxwell’s or Einstein’s. The reasons for this are far from obvious; maybe it has to do with the fact that modern biology for the most part sees itself as a thoroughly empirical discipline that engages either in real natural history or in (...) experimenting on real organisms rather than fictive ones. While theoretical biology does exist and is recognized as part of biology, its role within biology appears to be more marginal than the role of theoretical physics within physics. It could be that this marginality of theory also affects thought experiments as sources of theoretical knowledge. Of course, none of this provides a sufficient reason for thinking that thought experiments are really unimportant in biology. It is quite possible that the common perception of this matter is wrong and that there are important theoretical considerations in biology, past or present, that deserve the title of thought experiment just as much as the standard examples from physics. Some such considerations may even be widely known and considered to be important, but were not recognized as thought experiments. In fact, as we shall see, there are reasons for thinking that what is arguably the single most important biological work ever, Charles Darwin’s On the Origin of Species, contains a number of thought experiments. There are also more recent examples both in evolutionary and non-evolutionary biology, as we will show. Part of the problem in identifying positive examples in the history of biology is the lack of agreement as to what exactly a thought experiment is. Even worse, there may not be more than a family resemblance that unifies this epistemic category. We take it that classical thought experiments show the following characteristics: They serve directly or indirectly in the non-empirical epistemic evaluation of theoretical propositions, explanations or hypotheses. Thought experiments somehow appeal to the imagination. They involve hypothetical scenarios, which may or may not be fictive. In other words, thought experiments suppose that certain states of affairs hold and then try to intuit what would happen in a world where these suppositions are true. We want to examine in the following sections if there are episodes in the history of biology that satisfy these criteria. As we will show, there are a few episodes that might satisfy all three of these criteria, and many more if the imagination criterion is dropped or understood in a lose sense. In any case, this criterion is somewhat vague in the first place, unless a specific account of the imagination is presupposed. There will also be issues as to what exactly “non-empirical” means. In general, for the sake of discussion we propose to understand the term “thought experiment” here in a broad rather than a narrow sense here. We would rather be guilty of having too wide a conception of thought experiment than of missing a whole range of really interesting examples. (shrink)

Knowledge based privacy policies are more declarative than traditional action based ones, because they specify only what is permitted or forbidden to know, and leave the derivation of the permitted actions to a security monitor. This inference problem is already non trivial with a static privacy policy, and becomes challenging when privacy policies can change over time. We therefore introduce a dynamic modal logic that permits not only to reason about permitted and forbidden knowledge to derive the permitted actions, but (...) also to represent explicitly the declarative privacy policies together with their dynamics. The logic can be used to check both regulatory and behavioral compliance, respectively by checking that the permissions and obligations set up by the security monitor of an organization are not in conflict with the privacy policies, and by checking that these obligations are indeed enforced. Révolutionnaire radical, ayant vu et approuvé le caractère destructeur du nazisme, le recteur de Fribourg a réservé d'autres surprises dans ses journaux philosophiques, dans lesquels il évoque par exemple l'"auto-anéantissement du "juif"". Alors que le philosophe est devenu un objet d'incompréhension et d'horreur, nombre de spécialistes en appellent désormais à l'histoire. C'est cette réhistoricisation que l'auteur (...) a entreprise dans ce livre. Refusant la polémique, l'adoration et la détestation, il s'emploie à comprendre l'homme et le penseur, de l'intérieur et en son temps, par le biais de toutes les sources disponibles : cours, lettres, textes de circonstance, de même que ces Cahiers noirs qui suscitent tant d'émoi. Excédant largement le IIIe Reich, le cheminement de Heidegger fut heurté : il commença par un catholicisme intransigeant, qui laissa la place, après la Première Guerre mondiale, à une volonté farouche de révolution philosophique, terreau dans lequel son nazisme vint jeter de profondes racines qui survécurent à l'effondrement du régime d'Adolf Hitler. De cette biographie se dégage un portrait fait d'ombres et de lumières : grand philosophe, maître, ami ou amant de juifs ou d'étrangers, Heidegger fut aussi un nationaliste antisémite, inquiet de l'"enjuivement" de son peuple et soucieux de son rôle historique prééminent. Cet article propose de réfléchir sur la nature des images animées, à partir sur trois thèses de Kendall Walton. Le philosophe américain, bien connu dans le monde analytique pour un livre sur les arts représentationnels, Mimesis as Make-Believe (1990), discute très régulièrement de films, mais aucune de ses recherches n’a à proprement parler versé dans la philosophie du cinéma. C’est pourquoi, cet article se demande à quoi ressemblerait une philosophie waltonienne du cinéma. Pour ce faire, je présente et discute trois (...) propositions tirées des travaux de Walton : (1) les œuvres de fiction ne sont pas définies comme des contre-vérités, (2) les dépictions nous donnent à imaginer autant qu’à percevoir ce qu’elles représentent, (3) les photographies nous placent dans une relation épistémique objective avec leurs sujets. De là, j’élabore une interprétation waltonienne de la distinction entre l’image fictive et l’image documentaire. (shrink)

Is phenomenology nothing else than descriptive psychology? In the first edition of his Logical Investigations (LI), Husserl conceived of phenomenology as a description and analysis of the experiences of knowledge, unequivocally stating that “phenomenology is descriptive psychology.” Most interestingly, although the first edition of the LI was the reference par excellence in phenomenology for the Munich phenomenologists, they remained suspicious of this characterisationof phenomenology. The aim of this paper is to shed new light on the reception of descriptive psychology among (...) Munich phenomenologists and, at the same time, to offer a re-evaluation of their understanding of realist phenomenology. (shrink)

This article offers an overview of the risks related to some representations of epigenetics in the process of making social and medical recommendations. After exploring different representations of epigenetics in popular literature and media discourses, I identify some of the premature conclusions that could emerge from such discourses, stressing issues related to parental responsibility—especially as they relate to women—regarding the transmission of epigenetic marks. I then propose some epistemological considerations regarding developmental biology in order to draw a more nuanced picture (...) of epigenetic responsibility. I argue that such considerations are important to clarify our general understanding of epigenetic research as well as its potential translation outside the scientific area. (shrink)

Corporate codes of ethics, which have spread in the last decades, have shown a limited ability to foster ethical behaviors. For instance, they have been criticized for relying too much on formal compliance, rather than taking into account sufficiently agents and their moral development, or promoting self-reflexive behaviors. We aim here at showing that a code of ethics in fact has meaning and enables ethical progress when it is interpreted and appropriated with practical wisdom. We explore a model that represents (...) an uncommon organizational code of ethics: the monastic Rule of St. Benedict, written in the sixth century and still used today. Our empirical study—conducted in several monasteries living under this rule—shows that organization members interpret this rule, both hermeneutically and ethically, to adapt it to situations. They also appropriate this rule as a way of life and treat it as a dynamic framework that helps them to follow their purpose within their organization. This exceptional code actually offers an alternative model for practicing codes of ethics, in a virtue-ethical manner, beyond mere compliance with the text. The way in which reflexive and active agents practice the code, both individually and collectively, shapes their organizational experience and fosters their moral development. (shrink)

In the 1990s, large insurance companies failed in virtually every major market, prompting a fierce and ongoing debate about how to better protect policyholders. Drawing lessons from the failures of four insurance companies, When Insurers Go Bust dramatically advances this debate by arguing that the current approach to insurance regulation should be replaced with mechanisms that replicate the governance of non-financial firms.Rather than immediately addressing the minutiae of supervision, Guillaume Plantin and Jean-Charles Rochet first identify a fundamental economic rationale (...) for supervising the solvency of insurance companies: policyholders are the "bankers" of insurance companies. But because policyholders are too dispersed to effectively monitor insurers, it might be efficient to delegate monitoring to an institution--a prudential authority. Applying recent developments in corporate finance theory and the economic theory of organizations, the authors describe in practical terms how such authorities could be created and given the incentives to behave exactly like bankers behave toward borrowers, as "tough" claimholders. We therefore introduce a dynamic modal logic that permits not only to reason about permitted and forbidden knowledge to derive the permitted actions, but (...) also to represent explicitly the declarative privacy policies together with their dynamics. The logic can be used to check both regulatory and behavioral compliance, respectively by checking that the permissions and obligations set up by the security monitor of an organization are not in conflict with the privacy policies, and by checking that these obligations are indeed enforced. "Contrairement à une idée reçue, Hegel n'est pas un penseur perdu dans des abstractions logiques. La folie, la mort et l'éducation sont au centre de la pensée du philosophe allemand et forment un ensemble cohérent, concourant à caractériser l'homme comme une nature en conflit entre une particularité figée et un universel auquel il lui faudrait s'élever. Why did Thomas More write two versions of his History of King Richard III, one in English and the other in Latin? Critics tend to answer this question by arguing that the two versions were not destined for the same audience: the Latin for a continental elite, the vernacular for a larger British readership. Although perfectly convincing, this explanation may not be the only one: this paper tries to underline the existence of another motivation, one of a literary nature. The (...) History of King Richard III indeed combines two historiographical models: the ancient and classical monograph as illustrated by Sallust, and the medieval tradition of the chronicle. The oscillation between English and Latin may reflect More's wish to renovate the genre of the medieval chronicle, accomplished by an hybridization with classical Latin models—as if More attempted to grasp the best of both traditions in order to initiate a new means of writing history.
