This paper attempts to examine how the concept of character in Tosaka’s philosophy presents us with the distinctive features of a situated epistemology. To do this, I will make comparative, although by no means exhaustive, use of the work of Heinrich Rickert. I will not attempt to argue that Rickert was Tosaka’s main interlocutor; however, I will show that the concept of character can be understood as a response to one of the challenges posed by the neo-Kantian philosopher: how (...) can history be grasped philosophically without falling into metaphysical reduction or subjective relativism? Although the principle of informed consent is well established and its importance widely acknowledged, it has met with criticism for decades. Doubts have been raised for a number of different reasons. In particular, empirical data show that people regularly fail to reproduce the information provided to them. Many critics agree, therefore, that the received concept of informed consent is no more than a myth. Strategies to overcome this problem often rest on a flawed concept of informed consent. In this paper, (...) it is suggested that informed consent is a communicative act between two persons. The challenge is to elucidate the norms and constraints for successfully performing such a communicative act. The view developed here has major consequences with regard to the standards for information disclosure as well as for the general scope of informed consent. (shrink)

In this paper we want to briefly illustrate the ways in which technical, ethical and political judgements of various kinds are interwoven in the processes of healthcare decision-making in the UK. Drawing upon the research for the “Choices in Health Care” project we will borrow the notion of the hidden curriculum from education to illuminate the nature of resource allocation decision processes. In particular we will indicate some of the fundamental but largely hidden political factors in play in these processes (...) and the importance of the inchoate and implicit notion of “NHS values” in shaping UK resource allocation policies. We suggest that these more diffuse, holistic and system level value judgements are both central to understanding priority setting and at the same time difficult to reduce or abstract out into lists of single values/principles. The use of informed consent for surgery or research has been widely studied; however, its use in other areas of clinical practice has received less attention. This study investigates how doctors and nurses understand informed consent in relation to the prescription and administration of medicines in secondary care. It uses a qualitative analysis of semi-structured in-depth interviews with 19 doctors and 6 nurses recruited from various specialties in a teaching hospital. The results indicate a striking gap between official and actual (...) standards of practice. Providing information, assuring adherence and communication about potential treatment harms were raised as key issues instead of the principal goals of informed consent. Rather than simply treating these findings as support for a 'deficit' account of professionalism, the paper concludes that we need a richer and more grounded account of exactly when hospital medication decisions need to be subjected to the highest standards of informed consent. The aim of the present paper is to analyse compactness properties of nonmonotonic inference operations within the framework of model theory. For this purpose the concepts of a deductive frame and its semantical counterpart, a semantical frame are introduced. Compactness properties play a fundamental in the study of non-monotonic inference, and in the paper several new versions of compactness are studied.

ABSTRACT Various mechanisms to ensure the protection of subjects in human research have been suggested, including the presence of witnesses during the informed consent process. For our commentary on the use of witnesses and their potential role and responsibility during the consent process, we start by addressing current guidelines for human subjects research in four Latin American countries. By using examples from public health research, we highlight some of the practical difficulties of using witnessed consent, from becoming a meaningless ritual (...) at one end of the spectrum to the research subject feeling intimidated or coerced to participate at the other. Apart from these practical difficulties, it is unclear what responsibility the witness could and should have. We argue that there are important ethical questions about the role of witnesses that have not been adequately addressed in national and international regulations. This work addresses these gaps and argues that more debate is required to define the role and responsibilities of witnesses in the consent process, their training requirements and whether a universal legal requirement for witnessed consent, regardless of the type of research, is desirable. Taking this feature into account leads to a modification of Stokes’ laws of the relation between friction and viscosity in continuous media. We derive the observed order of magnitude of the microfriction, for rotation as well as translation, and its approximately correct dependence on the radii of moving and solvent molecules.

Ausgehend von den Marburger Philosophen Hermann Cohen und Paul Natorp, vertieft Barth deren transzendentalen Systemgedanken zu einem radikalen Prinzip, das die Wirklichkeitsfrage neu aufwirft. Letztere wird zwar auch in Kants zweiter Kritik gestellt, doch nicht im Sinne einer Handlungstheorie, sondern mit der (...) Absicht aufzuweisen, dass es so etwas wie praktische Vernunft überhaupt «gibt». Genau darin aber erkennt Barth den Kern der Philosophie der Existenz, wodurch sich seine Philosophie der Praktischen Vernunft ' wie Sein und Zeit 1927 erschienen ' in einer noch zu erhellenden Verwandtschaft zu Martin Heidegger befindet. Dennoch könnte die Ausgangslage beider Philosophen verschiedener nicht sein. Weder Sein noch Tod geben die Leitlinien von Barths Interpretation vor, vielmehr die transzendental verstandene Vernunft und der Mensch, der wesensmässig vom Anspruch praktischer Verwirklichung herausgefordert ist. Grundsätzlicher als ethische Normen und Regeln werden hier die Grundlagen der praktischen Vernunft erachtet, die im Horizont von Platons «Idee des Guten» und Kants Begriff der «Pflicht» eine eigenständige Wirklichkeit beansprucht. Dass der Philosoph Barth auch offen ist für die Dimension der Glaubenswahrheiten zeigte sich schon bei seiner Mitarbeit an der «Dialektischen Theologie» in den frühen Zwanzigerjahren des 20. Can an artificially intelligent tool be a part of a human’s extended mind? There are two opposing streams of thought in this regard. One of them can be identified as the externalist perspective in the philosophy of mind, which tries to explain complex states and processes of an individual as co-constituted by elements of the individual’s material and social environment. The other strand is normative and explanatory atomism which insists that what is to be explained and evaluated is the behaviour (...) of individuals. In the present contribution, it is argued that counterintuitive results turn up once atomism tries to appropriate insights from psychological externalism and holism. These results are made visible by technological innovations, especially artificially intelligent systems, but they do not result from these innovations alone. They are rather implicit in situated cognition approaches which join both theoretical strands. This has repercussions for explanatory as well as ethical theorising based on situated cognition approaches. It is a fairly rare constellation that new technological options, namely artificial intelligence, raise doubts concerning a philosophical theory, namely extended mind theory. (shrink)

Después de la nada intenta corregir algunos sesgos persistentes y subyacentes en los libros disponibles en español sobre filosofía japonesa: el nacionalismo metodológico, el criterio en la selección de los autores y la categorización de la transmisión del conocimiento de figuras, escuelas o textos de la contemporaneidad filosófica en Japón. De este modo, el valioso aporte de esta obra no es solo (...) sumarse a la tarea de proyectar globalmente la filosofía japonesa para hacerla más accesible al lector hispanohablante, sino también contribuir al esfuerzo de identificar los temas filosóficos contemporáneos que surgen en y desde Japón, recuperando autores poco estudiados como Tsuchida Kyōson, Miki Kiyoshi, Tosaka Jun, Maruyama Masao, Tanaka Mitsu, Karatani Kōjin o Nagasaki Hiroshi, entre otros. Heinrich Rickert (1863-1936) war einer der bedeutendsten deutschen Philosophen vor dem Zweiten Weltkrieg und gilt neben Wilhelm Windelband als einer der Hauptvertreter der südwestdeutschen Schule des Neukantianismus. Seine auch heute noch anregende Philosophie hatte großen, interdisziplinären wie internationalen Einfluss. Die philologisch-kritische Ausgabe macht die Schriften endlich wieder verfügbar.
