Herbert Spencer (1820–1903), Victorian philosopher, biologist, sociologist and political theorist, one of the founders of Social Darwinism and author of the phrase 'survival of the fittest', was nominated for the Nobel Prize for Literature in 1902, losing out to Theodor Mommsen. Spencer left his post at The Economist in 1857 to focus on writing his ten-volume System of Synthetic Philosophy, a work that offers an ethics-based guide to human conduct to replace that provided by conventional religious belief. Published in (...) 1879, this volume seeks to demonstrate that social evolution tends towards greater individualism, altruism and co-operation. Spencer argues that it is possible to establish rules of right conduct on a scientific basis, and declares that this work is the culmination of his life's study. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. The author addresses the question as to whether russell and whitehead "provide an explication of the idea that arithmetical truths are tautologies." he thinks their achievement was in developing an axiomatic system in which the "interpreted propositions are tautologies," but not in proving this of mathematics. The differentiation of trait anxiety and depression in nonclinical and clinical populations is addressed. Following the tripartite model, it is assumed that anxiety and depression share a large portion of negative affectivity, but differ with respect to bodily hyperarousal and anhedonia. In contrast to the tripartite model, NA is subdivided into worry and dysthymia, which leads to a four-variable model of anxiety and depression encompassing emotionality, worry, dysthymia, and anhedonia. Item-level confirmatory factor analyses and latent class cluster analysis based on (...) a large nation-wide representative German sample substantiate the construct validity of the model. Further evidence concerning convergent and discriminant validity with respect to related constructs is obtained in two smaller nonclinical and clinical samples.
