Photonic Crystals is the first book to address one of the newest and most exciting developments in physics--the discovery of photonic band-gap materials and their use in controlling the propagation of light. ABSTRACT:Despite widespread attention to corruption and organizational change in the literature, to our knowledge, no research has attempted to understand the linkages between these two powerful organizational phenomena. Accordingly, we draw on major theories in ethics, sociology, and management to develop a theoretical framework for understanding how organizational change can sometimes generate corruption. We extend anomie theory and ethical climate theory to articulate the deinstitutionalization of the normative control system and argue that, through this deinstitutionalization, organizations have the potential to (...) become incubators for corruption. We qualify this process by proposing conditions more ripe for anomie and under which this deinstitutionalization is more likely to occur, propounding moderating relationships that influence organizational reconfiguration. Examples of turbulence in the contemporary business environment that can trigger change highlight our discussion. We conclude with managerial implications, offering means by which the deleterious effects of corruption may be arrested or controlled. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. Background While prenatal surgery historically was performed exclusively for lethal conditions, today intrauterine surgery is also performed to decrease postnatal disabilities for non-lethal conditions. We sought to describe physicians' attitudes about prenatal surgery for lethal and non-lethal conditions and to elucidate characteristics associated with these attitudes. Methods Survey of 1200 paediatric surgeons, neonatologists and maternal–fetal medicine specialists. Results Of 1176 eligible physicians, 670 responded. In the setting of a lethal condition for which prenatal surgery would likely result in the child (...) surviving with a severe disability, most respondents either disagreed or strongly disagreed that they would recommend the surgery. Male physicians were twice as likely to recommend surgery for the lethal condition, as were physicians who believe that abortion is morally wrong. Older physicians were less likely to recommend surgery. For non-lethal conditions, most respondents agreed that they would recommend prenatal surgery, even if the surgery increases the risk of prematurity or fetal death. Compared with MFMs, surgeons were less likely to recommend such surgery, as were physicians not affiliated with a fetal centre, and physicians who were religious. Conclusion Physician’s attitudes about prenatal surgery relate to physicians’ beliefs about disability as well as demographic, cultural and religious characteristics. Given the variety of views, parents are likely to receive different recommendations from their doctors about the preferable treatment choice. (shrink)

The United States is at a crossroad in its treatment of Chapter 11 of the Bankruptcy Code, which deals with reorganization of bankrupt organizations. It is vital that the issues surrounding the debate be properly framed. This paper attempts to do just that by reviewing the evolution of bankruptcy law, assessing the impact of Chapter 11 leniency on societal stakeholders, considering bankruptcy as a strategic option, and addressing the ethical and societal issues that arise from the use of Chapter 11 (...) to avoid massive litigation or to abrogate labor contracts. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Loneliness in medicine is a serious problem not just for patients, for whom illness is intrinsically isolating, but also for physicians in the contemporary condition of medicine. We explore this problem by investigating the ideal physician-patient relationship, whose analogy with friendship has held enduring normative appeal. Drawing from Talbot Brewer and Nir Ben-Moshe, we argue that this appeal lies in a dynamic form of companionship incompatible with static models of friendship-like physician-patient relationships: a mutual refinement of embodied virtue that draws (...) both persons together. The ideal physician-patient relationship has a dialectical character that fosters each member's improvement of phenomenologically recognizing and embodying moral virtues. A key component of this dynamic is a commitment to the common goal of the patient's health, realized through joint interactivities and conversations over time. The physician's presence to the patient's suffering—understood best as an alienating phenomenological condition for the patient—orients and discloses possibilities for virtuous caregiving by structuring the meanings of the goals, conversations, and joint narrative constitutive of their relationship. Presence to suffering, paradoxically, is perhaps an important prerequisite for this dynamic partnership. These activities dialectically build an interpretive horizon of understanding through which moral goods and character refinement—in and for the other—may become revealed for both persons in their shared being-in-the-world. This analysis of suffering, mood, and revealing of (possible) moral goods has implications for addressing the modern problem of loneliness for patients and physicians, who are increasingly inhibited from building flourishing relationships with each other. In lieu of an abstract, here is a brief excerpt of the content:Hume's Demarcation Project John Losee Demarcation, Ideas and Impressions David Hume sought to exclude certain concepts from the domain of empirically significant discourse. He was critical of talk about "substances" that bear qualities, "forces" that cause motions, "powers" that produce effects, "necessary connections" that determine sequences of events, "extension without matter" and "time independent of succession or change in any real existence."1 Hume proposed a demarcation ofideas, a (...) demarcation intended to exclude these notions. The demarcation project, if successful, would exclude Locke's notion of "substance" as well as Newton's notions of "Absolute Space" and "Absolute Time." Some interpreters have taken the demarcation project to be the centrepiece of Hume's philosophy. Others have seen it to be an incidental aspect of Hume's search for an empirical theory of human nature. I believe that David Pears was correct to insist that an acceptable account ofHume's philosophy include both the "destructive emphasis" and the "constructive emphasis."2 Hume's demarcation project is based on a presumed relation, or relations, between ideas and impressions. Hume made the following claims about "simple ideas," those ideas that "admit of no distinction nor separation" (T 2): 1)every simple idea in its first appearance is derived from some impression (Derivability Principle); 2)every simple idea in its first appearance copies some impression (Copy Principle); 3)every simple idea represents some impression (Representation Principle); 4)simple ideas and impressions resemble one another; 5)simple ideas correspond to impressions; 6)every simple idea is borroVd from some impression; Volume XVII Number 2 51 JOHN LOSEE 7)for every simple idea there is some temporally antecedent impression; and 8)impressions cause simple ideas. Primafacie, these claims are empirical claims about the genesis of our ideas. But within Hume's demarcation project these claims also function as criteria for membership in the class of simple ideas. Those ideas that satisfy the criteria constitute raw material from which complex ideas are formulated. Complex ideas are constructed from simple ideas. However, they are not copies of simple ideas. Aparticular complex idea is empirically significant provided that, 1) it is derivable from simple ideas; and 2) each of those simple ideas is derivable from impressions. The Case of the Missing Shade ofBlue Tensions arise within the demarcation project in part because Hume employs nonequivalent criteria—Derivability Principle, Copy Principle, Representation Principle—as if they were equivalent. The tension is acute in the case of the missing shade ofblue. The "missing shade" is an idea formulated by a person with extensive experience of colours, but no prior exposure to the shade in question. If this idea is a simple idea, then it is false that every simple idea copies some antecedent impression. Why did Hume cite—in both Treatise and Inquiry—this apparently destructive exception? Bernard Rollin has suggested that Hume may have cited the missing-shade-of-blue example as a rhetorical device toprotecthis dichotomous divisionofpropositionsinto those that are analytic a priori and those that are synthetic a posteriori (including the Derivabihty Principle).11 John O. Nelson agreed that Hume is concerned to emphasize the contingent, empirical status of the Derivabihty Principle.12 Nelson suggested that Hume sought tomake two points. The first pointis that an exception to the Derivability Principle is empirically possible. The second point is that thought-experiments like the missing-shade example are inadequate to establish conclusions about matters offact. To entertain such thought-experiments is to lapse into hypothetical speculation, a violation ofthe "experimental method ofreasoning."13 Perhaps it was for this reason that Hume dismissed the missing-shade case as unimportant. Quentin Tarantino’s filmography, especially since the turn of the century, seems to be an argument for the moral justification of revenge. Bill and his D.iV.A.S. hit-squad (from Kill Bill); Adolf Hitler and Hans Landa (from Inglourious Basterds); “Monsieur” Calvin Candie and his loyal house slave Stephen (from Django Unchained); Stuntman Mike and the Manson family killers (from Death Proof and Once Upon a Time in Hollywood); and Daisy Domergue and General Sanford Smithers (from The Hateful Eight) – they all had (...) it coming, and audiences celebrate when they get what they deserve. Revenge, Tarantino reminds us, is a dish best served cold. But is it really the kind of thing that can be morally justified? To see whether it is, this chapter explores arguments both historic and contemporary. After delineating revenge from legal justice and simple retribution and exploring how Tarantino’s films argue for moral justification of revenge, we will consider common everyday arguments on the topic, as well as the relevant arguments of Plato, Baruch Spinoza, Thomas Hobbes, John Locke, Friedrich Nietzsche, Trudy Govier, Suzanne Uniacke, Andrew Oldenquist, Simone de Beauvoir, Joshua Gert, Gilead Bar-elli, David Heyd, Robert Nozick, and others. The inaugural title in the new, Open Access series BSPS Open, The Material Theory of Induction will initiate a new tradition in the analysis of inductive inference. The fundamental burden of a theory of inductive inference is to determine which are the good inductive inferences or relations of inductive support and why it is that they are so. The traditional approach is modeled on that taken in accounts of deductive inference. It seeks universally applicable schemas or rules or a single (...) formal device, such as the probability calculus. After millennia of halting efforts, none of these approaches has been unequivocally successful and debates between approaches persist. The Material Theory of Induction identifies the source of these enduring problems in the assumption taken at the outset: that inductive inference can be accommodated by a single formal account with universal applicability. Instead, it argues that that there is no single, universally applicable formal account. Rather, each domain has an inductive logic native to it. Which that is, and its extent, is determined by the facts prevailing in that domain. Paying close attention to how inductive inference is conducted in science and copiously illustrated with real-world examples, The Material Theory of Induction will initiate a new tradition in the analysis of inductive inference. An infinite lottery machine is used as a foil for testing the reach of inductive inference, since inferences concerning it require novel extensions of probability. Its use is defensible if there is some sense in which the lottery is physically possible, even if exotic physics is needed. I argue that exotic physics is needed and describe several proposals that fail and at least one that succeeds well enough.

Contrary to formal theories of induction, I argue that there are no universal inductive inference schemas. The inductive inferences of science are grounded in matters of fact that hold only in particular domains, so that all inductive inference is local. Some are so localized as to defy familiar characterization. Since inductive inference schemas are underwritten by facts, we can assess and control the inductive risk taken in an induction by investigating the warrant for its underwriting facts. In learning more facts, (...) we extend our inductive reach by supplying more localized inductive inference schemes. Since a material theory no longer separates the factual and schematic parts of an induction, it proves not to be vulnerable to Hume's problem of the justification of induction. (shrink)

John Barrow is increasingly recognized as one of our most elegant and accomplished science writers, a brilliant commentator on cosmology, mathematics, and modern physics. Barrow now tackles the heady topic of impossibility, in perhaps his strongest book yet. Writing with grace and insight, Barrow argues convincingly that there are limits to human discovery, that there are things that are ultimately unknowable, undoable, or unreachable. He first examines the limits on scientific inquiry imposed by the deficiencies of the human mind: (...) our brain evolved to meet the demands of our immediate environment, Barrow notes, and much that lies outside this small circle may also lie outside our understanding. For instance, if the secrets of the atom are to be found only by recreating extreme environments at great financial cost, just how much should we devote to that quest?
