The goal of this paper is to propose a unified approach to the split scope readings of negative indefinites, comparative quantifiers, and numerals. There are two main observations that justify this approach. First, split scope shows the same kinds of restrictions across these different quantifiers. Second, split scope always involves low existential force. In our approach, following Sauerland, natural language determiner quantifiers are quantifiers over choice functions, of type <<,t>,t>. In split readings, the quantifier over choice functions scopes above other (...) operators (such as intensional verbs like must or can). Determiner quantifiers leave a choice-function trace when they move and this trace combines with the noun restriction, which is interpreted low. That split scope always involves low existential force is derived, without stipulation, from Kratzer’s idea that low existential force can be achieved via binding (into the noun restriction). Images are objects of work in the laboratory. On its face, this work is achieved through talk Yet the talk attached to these images makes reference to other images, which are drawn from varcous environments. In this article, four such environments are identified: the domain of laboratory practice; the context of invisible physical reactions; the future image as it will appear in publication; and the domain of case precedents and reference scenarios from the field. The work of image analysis brings (...) the outside of the image into it and takes the inside out. Thus it can be seen that images are not just taken, they are designed and made. (shrink)

The author introduces a normative conception of coherence, derived from a pragmatic interpretation of the application of norms to concrete cases. A distinction is made between the justification of a norm and its application. In the case of moral norms, justification and application can be analysed as two different discursive procedures which give rise to different aspects of the principle of impartiality. Impartial justification requires a procedure by which all interests concerned are taken into account whereas impartial application requires a (...) procedure where all features of a situation are considered. The complete description of a concrete case makes necessary a coherent interpretation of all the valid norms which are prima facie applicable. This requirement of an ideal coherent system of norms is restricted to interpretive “paradigms” in the case of legal norms, because it is necessary to produce singular judgments under the restrictive conditions of scarce time and incomplete knowledge. Recent findings suggest impaired motor skill development during infancy in children later diagnosed with autism spectrum disorders (ASD). However, it remains unclear whether infants at high familial risk for ASD would benefit from early interventions targeting the motor domain. The current study investigated this issue by providing 3-month-old infants at high familial risk for ASD with training experiences aimed at facilitating independent reaching. A group of 17 high-risk (HR) infants received 2 weeks of scaffolded reaching experiences using “sticky mittens,” and (...) was compared to 72 low-risk (LR) infants experiencing the same or alternative training procedures. Results indicate that HR infants – just like LR infants – show an increase in grasping activity following “sticky mittens” training. In contrast to LR infants, evidence that motor training encouraged a preference for faces in HR infants was inconclusive. (shrink)

In this paper the author criticizes the way Robert Alexy reconstructs the relationship between legal and practical reasoning. The core of Alexy's argumentation (Alexy 1978) is considered the claim that legal argumentation is a “special case” of general practical discourse. In order to question this claim, the author analyzes three different types of argument: (1) that legal reasoning is needed by general practical discourse itself, (2) that there are similarities between legal argumentation and general practical discourse, (3) that there is (...) a correspondence between certain types of argument in general practical discourse and in legal argumentation.**. In their scholarly target article, Gilead et al. explain how abstract mental representations and the predictive brain enable prospection and time-traveling. However, their exclusive focus on intrapsychic capacities misses an important point, namely, the degree to which mind and brain are tuned by the environment. This neglected aspect of adaptive cognition is discussed and illustrated from a cognitive-ecological perspective.

This paper contributes to a theory of rational choice for decision-makers with incomplete preferences due to partial ignorance, whose beliefs are representable as sets of acceptable priors. We focus on the limiting case of `Complete Ignorance' which can be viewed as reduced form of the general case of partial ignorance. Rationality is conceptualized in terms of a `Principle of Preference-Basedness', according to which rational choice should be isomorphic to asserted preference. The main result characterizes axiomatically a new choice-rule called `Simultaneous (...) Expected Utility Maximization'. It can be interpreted as agreement in a bargaining game (Kalai-Smorodinsky solution) whose players correspond to the (extremal) `acceptable priors' among which the decision maker has suspended judgment. An essential but non-standard feature of Simultaneous Expected Utility choices is their dependence on the entire choice set. This is justified by the conception of optimality as compromise rather than as superiority in pairwise comparisons. (shrink)

Für die Technikwissenschaften haben solche wissenschaftstheoretischen Untersuchungen jedoch bisher kaum stattgefunden. Was etwa die analytische Wissenschaftstheorie für die Naturwissenschaften geleistet hat, steht daher für die Technikwissenschaften noch aus. Denn das technische Wissen unterscheidet sich vom wissenschaftlichen Wissen in seiner inneren Struktur. (...) Diese Struktur aufzuklären ist eine lohnende Aufgabe, weil deren Kenntnis hilft, besser mit Technik umzugehen. Die in diesem Band vorgelegten analytischen Studien zur Wissenschaftstheorie der Technikwissenschaften behandeln - ausgehend vom Problem der Formalisierung und der Wahrheitsfrage in der Philosophie - die Grundeinheit des technischen Wissens, die technologische Regel, und den Aufbau und Zusammenhang technologischer Theorien. In a constitutional democracy, the imputation of a legal violation to an individual must be related to the fact that democratic approval of a norm - under limiting conditions - is coupled with the obligation to follow that norm. The neutrality of modern law toward the quality of motives for following a norm, however, challenges the assumption of such a connection. This challenge is overlooked by those who take the position that individual imputation should be based on the morally autonomous (...) individual's self-contradiction. In contrast, deterrence theories fail to see the other relevant aspect, namely that individual imputation cannot be completely divorced from the perspective of the individual as a citizen, who could indeed follow the norm because of his insight into the reasons for its validity. Individual imputation takes account of this double classification of a person subject to law as citizen and as private autonomous legal subject only if the actor is addressed as citizen in the reasoning given to support the determination of culpability without simultaneously requiring him to actually adopt the perspective of a citizen. Die individuelle Zurechnung einer Rechtsverletzung muß in einem demokratischen Verfassungsstaat etwas damit zu tun haben, daß mit der demokratischen Zustimmung zu einer Norm unter einschränkenden Bedingungen - auch die Verpflichtung zur Normbefolgung verbunden ist. Gegen die Vermutung eines solchen Zusammenhangs spricht jedoch die Neutralität des modernen Rechts gegenüber der Qualität der Motive seiner Befolgung. Dies wird von denjenigen Positionen übersehen, die eine individuelle Zurechnung auf den Selbstwiderspruch der sittlich autonomen Person gründen wollen. Dagegen übersehen präventive Schuldtheorien den anderen Aspekt, daß sich individuelle Zurechnung nicht gänzlich von der Perspektive des Staatsbürgers lösen darf, der eine legitime Norm aus Einsicht in die Gründe ihrer Geltung auch befolgen könnte. Der doppelten Codierung der Rechtsperson als Staatsbürger und als privatautonomes Rechtssubjekt entspricht die individuelle Zurechnung nur dann, wenn der Täter durch die Begründung des Schuldurteils als Staatsbürger angesprochen wird, ohne daß ihm ein Wechsel in die Perspektive eines Staatsbürgers auch zugemutet würde. Relations between discrete and continuous complexity models are considered. The present paper is devoted to combine both models. In particular we analyze the 3-Satisfiability problem. The existence of fast decision procedures for this problem over the reals is examined based on certain conditions on the discrete setting. Moreover we study the behaviour of exponential time computations over the reals depending on the real complexity of 3-Satisfiability. This will be done using tools from complexity theory over the integers.

The perhaps most challenging problem for a panentheistic paradigm in Christian god-talk consists in integrating the trait of personhood in the monistic horizon of this approach. A very helpful way to this goal seems to be the concept of imagination. Its logic of an “as if” represents a modified variation of Kant`s idea of the postulates of reason. Reflections of Jürgen Werbick, Douglas Headley, and Volker Gerhardt substantiate the philosophical and theological capabilities of this solution which also include a sensibility (...) for the ontological commitments included in the panentheistic approach. The essay presents Saul Kripke's argument for mind/body-dualism and makes the suppositions explicit on which it rests. My claim, inspired by Richard Boyd, is that even if one of Kripke’s central suppositions - the principle of necessity of identities using rigid designators - is shared by the non-traditional identity theorist, it is still possible for her to rebut Kripke’s dualism.

In the paper I voice my dissatisfaction with the author's essay because I think that the proposed “McClellean shift” from skeptical to trusting theism faces serious problems. The troubles are mainly caused by the way in which McClellan suggests to extend and “amend” the theist’s argument via the Moorean shift (which is intended to be a counter-argument to the atheist’s evidential argument from evil). But McClellan's proposal is no amendment at all, as it robs the theist's Moore-inspired argument its entire (...) logico-probabilistic force. (shrink)

In his essay Tracy Lupher (henceforth, TL) is concerned with Robert Kane's (1984) version of the modal ontological argument (MOA). As he correctly points out, Kane's argument is valid only if the accessibility relation between possible worlds is assumed to be symmetric. TL's remarks pave the way to thinking that the MOA is intended to establish the existence of a perfect being as a matter of logical necessity. Moreover, given TL's undisputed supposition (even shared by Kane) that S5 - in (...) which the accessibility relation is symmetric - captures the notion of logical necessity, the real issue becomes whether the premise of the MOA is true. Contrary to TL's main claim, the discussion thus shifts back from technical arguments for why the appropriate modal logic must have a symmetric accessibility relation to metaphysical, theological, or conceptual considerations about the notion of a perfect being itself. I argue that it is only due to such considerations that we even start to ponder the question of what modal logic is the appropriate one to choose. (shrink)

We start from the assumption that the real valued observables of a quantum system form a Jordan algebra which is equipped with a compatible Lie product characterizing infinitesimal symmetries, and ask whether two such systems can be considered as independent subsystems of a larger system. We show that this is possible if and only if the associator of the Jordan product is a fixed multiple of the associator of the Lie product. In this case it is known that the two (...) products can be combined to an associative product in the Jordan algebra or its complexification, depending on the sign of the multiple. (shrink)

Anthropologische Medizin (AM) i. S. Viktor von Weizsäckers sieht grundlegende Selbsterfahrungen des Menschen (Leiblichkeit, Zeitlichkeit u. a.) für den Umgang von Arzt und Krankem als zentral. Sie ist offen für die leiblich-seelische Betroffenheit, für die mögliche Stellvertretung des Physischen und Psychischen und sieht den Kranken als Subjekt und Objekt, das sich selbst zugleich Subjekt und Objekt ist. „Umgangslehre“ kennzeichnet AM als Handlungswissenschaft, die der „Doppelstruktur sachlicher und personaler Entsprechung von Mensch in Not und Mensch als Helfer bzw. Krankheit und Medizin“ (...) folgt. Sie unterscheidet Krankheit und Kranksein sowie klinische und (natur-)wissenschaftliche Objektivität. Lebensweltliche und psychosoziale Faktoren beeinflussen das Kranksein. Als Umgangslehre setzt anthropologisch-klinische Wissenschaft „an die Stelle der Objektivitätslehre der Erkenntnis eine personalistische […] Erkenntnislehre“, die auch ihre methodischen, handlungslogischen Sach- und Wertbegründungen reflektiert. In their (2008) article Liar-Like Paradox and Object Language Features C.S. Jenkins and Daniel Nolan (henceforth, JN) argue that it is possible to construct Liar-like paradox in a metalanguage even though its object language is not semantically closed. I do not take issue with this claim. I find fault though with the following points contained in JN’s article: First, that it is possible to construct Liar-like paradox in a metalanguage, even though this metalanguage is not semantically closed. Second, that the (...) presented examples of Liar-like paradox are supposed to be counterexamples to Tarski’s diagnosis of the classic Liar paradox. Third, that JN fail to notice Tarski’s postulate. And finally, that JN fail to recognize that the world they are pondering is not among the possible worlds. (shrink)

The characterization of thought as a subject reflection about a given object is expressed by an enunciation of predicative order. The introduction of the possibility of a type of thought that it is not constituted in virtue of this presupposition brings a lot of difficulties, which is responsible for why Lloyd treats this theme as an enigma of Greek philosophy, i.e, non-discursive thinking. Plotinus seems to make a distinction between rational and intellectual thought, taking as a starting point the _sui (...) generis_ definition of a thinking that thinks itself. The intriguing nature of this description, i.e, the self-thinking as non-discursive thought, has raised studies with the primary aim to understand how it works this type of thinking. Then to clarify what does it mean to adopt the non-discursive approach. This paper intends to analyze the cited problem in the light of the “non-predicative” of Santos. The hypothesis is that by applying this concept to the discussion it will contribute to increase clarification on the distinction between reason and Intellect. That exercise will be conducted in majority through the reading of V.3 [49] of Plotinus _Enneads_. The nature of the intellectual thought would be non-predicative and the rational would be predicative. (shrink)
