The controversy over judicial activism is as old as the question whether law is “made” or “found” by the courts, and is die quintessential living question for legal philosophers. Here the practical meets the abstract, as Supreme Court justices must, explicitly or not, adopt some philosophical viewpoint in deciding how general constitutional propositions do, or do not, decide current concress te controversies.

Nineteenth-century references to the syllogism by J. S. Mill and Oliver Wendell Holmes Jr. reveal a distinct approach to the logic of inference in the formative years of pragmatism. In the latter may be found an element of the emergence of generals from particulars. Fallibilism in law and science reflects their social dimension as part of the communal ordering of experience. This implies a distinct approach to uncertainty, as experience yet to be integrated within a developing system of classification.

Vygotsky measured his ‘zone of proximal development’ in years. To do this, he needed a scheme of age periods, and a set of tasks that could diagnose the next age period without defining it. In this paper, we compare the age periods in his late lectures with Halliday’s categories of logico-semantic expansion as used by three adolescent writer/speakers. We find that the tendency to elaborate and embed clauses grows with expertise, while the tendency to tell stories wanes. Previous research has suggested that bodily signals from internal organs are associated with diverse cortical and subcortical processes involved in sensory-motor functions, beyond homeostatic reflexes. For instance, a recent study demonstrated that the preparation and execution of voluntary actions, as well as its underlying neural activity, are coupled with the breathing cycle. In the current study, we investigated whether such breathing-action coupling is limited to voluntary motor action or whether it is also present for mental actions not involving any overt (...) bodily movement. To answer this question, we recorded electroencephalography (EEG), electromyography (EMG), and respiratory signals while participants were conducting a voluntary action paradigm including self-initiated motor execution (ME), motor imagery (MI), and visual imagery (VI) tasks. We observed that the voluntary initiation of ME, MI, and VI are similarly coupled with the respiration phase. In addition, EEG analysis revealed the existence of readiness potential (RP) waveforms in all three tasks (i.e., ME, MI, VI), as well as a coupling between the RP amplitude and the respiratory phase. Our findings show that the voluntary initiation of both imagined and overt action is coupled with respiration, and further suggest that the breathing system is involved in preparatory processes of voluntary action by contributing to the temporal decision of when to initiate the action plan, regardless of whether this culminates in overt movements. -/- . Sexual behaviour and mate choice are key intervening variables between attachment and life histories. We propose a set of predictions relating attachment, reproductive strategies, and mate choice criteria.

The first volume of this series presents fifteen selected papers dealing with a variety of topics in ontology, philosophy of mind, and philosophy of language.

This article addresses the question of whether we should conceive of mechanisms as productive of change in a regular way. I argue that, if mechanisms are characterized as fully regular, on the one hand, then not enough processes will count as mechanisms for them to be interesting or useful. If no appeal to regularity is made at all in their characterization, on the other hand, then mechanisms can no longer be useful for grounding prediction and supporting intervention strategies. Attachment theory ( Bowlby, 1969/1982 ) posits the existence of internal working models as a foundational feature of human bonds. Radical embodied approaches instead suggest that cognition requires no computation or representation, favoring a cognition situated in a body in an environmental context with affordances for action ( Chemero, 2009 ; Barrett, 2011 ; Wilson and Golonka, 2013 ; Casasanto and Lupyan, 2015 ). We explore whether embodied approaches to social soothing, interpersonal warmth, separation distress, and support seeking could replace (...) representational constructs such as internal working models with a view of relationship cognition anchored in the resources afforded to the individual by their brain, body, and environment in interaction. We review the neurobiological bases for social attachments and relationships and attempt to delineate how these systems overlap or don’t with more basic physiological systems in ways that support or contradict a radical embodied explanation. We suggest that many effects might be the result of the fact that relationship cognition depends on and emerges out of the action of neural systems that regulate several clearly physically grounded systems. For example, the neuropeptide oxytocin appears to be central to attachment and pair-bond behavior ( Carter and Keverne, 2002 ) and is implicated in social thermoregulation more broadly, being necessary for maintaining a warm body temperature (for a review, see IJzerman et al., 2015b ). Finally, we discuss the most challenging issues around taking a radically embodied perspective on social relationships. We find the most crucial challenge in individual differences in support seeking and responses to social contact, which have long been thought to be a function of representational structures in the mind (e.g., Baldwin, 1995 ). Together we entertain the thought to explain such individual differences without mediating representations or computations, but in the end propose a hybrid model of radical embodiment and internal representations. SUPERANNO A unique collection of photographs by WRA photographer Hikaru Iwasaki focuses on resettlement using photos of Japanese Americans following their release from WRA camps from 1943 to 1945. Author Lane Hirabayashi explores the use of photography in the WRA mission to encourage “loyal” Japanese Americans to return to society at large, and convince Euro-Americans this was safe. Hirabayashi also assesses the success of the WRA project, and the multiple uses of the photographs over time.

_ Convention_ was immediately recognized as a major contribution to the subject and its significance has remained undiminished since its first publication in 1969. Lewis analyzes social conventions as regularities in the resolution of recurring coordination problems-situations characterized by interdependent decision processes in which common interests are at stake. Conventions are contrasted with other kinds of regularity, and conventions governing systems of communication are given special attention.

Paulin and Cahill‐Lane explore the origins of event processing and event prediction in animal evolution. They propose that the evolutionary benefit of being able to predict and thus to quickly react to anticipated events may have triggered the evolution of the earliest nervous systems.

This is the second volume of philosophical essays by one of the most innovative and influential philosophers now writing in English. Containing thirteen papers in all, the book includes both new essays and previously published papers, some of them with extensive new postscripts reflecting Lewis's current thinking. The papers in Volume II focus on causation and several other closely related topics, including counterfactual and indicative conditionals, the direction of time, subjective and objective probability, causation, explanation, perception, free will, and rational (...) decision. Throughout, Lewis analyzes global features of the world in such a way as to show that they might turn out to supervene on the spatiotemporal arrangement of local qualities. (shrink)

This paper transposes for evaluation in relation to the concerns of Plato’s Politicus a claim developed by Verity Harte in the context of his Philebus, that ‘external imposition of a practical aim would in some way corrupt paideutic [philosophical] knowledge’. I argue that the Politicus provides a case for which the Philebus distinction may not allow: ruling, or statecraft, as embodying a form of knowledge that can be answerable to practical norms in a way that does not necessarily subordinate or (...) corrupt its epistemic norms. I argue further that while Harte shows that the Philebus develops a view of the ethical value for a knower in being a knower, the Politicus for its part does not develop any view of the ethical value for a knower in being a ruler. This paper puts forward two claims about funding carbon capture and storage. The first claim is that there are moral justifications supporting strategic investment into CO2 storage from global and regional perspectives. One argument draws on the empirical evidence which suggests carbon capture and storage would play a significant role in a portfolio of global solutions to climate change; the other draws on Rawls' notion of legitimate expectations and Moellendorf's Anti-Poverty principle. The second claim is that where to pursue this (...) strategic investment poses a morally non-trivial problem, with considerations like near-term global distributive justice and undermining legitimate expectations favouring investing in developing regions, especially in Asia, and considerations like long-term climate impacts and best uses of resources favouring investing in the relatively wealthy regions that have the best prospects for successful storage development. Nikki Lane Bringing Flesh to Theory: Ethnography, Black Queer Theory, and Studying Black Sexualities As Dorothy Hodgson tells us, the most common features of an ethnographic project involve “talking to, participating with, and observing the people who produce... texts, exploring the contexts of their ideas and actions, and often studying how their situations, ideas, and actions (...) change over time.”1 Practically, this often involves spending months, and more often years, in a particular field site, where one develops relationships with members of the group, community, or institution being studied. Ethnographers are positioned in a place to observe, but also place their bodies on the line—participating, when possible, in the quotidian practices of the group. This observation and participation is captured in the form of “field notes” that may relay in the form of “thick description,” what the ethnographer sees as she observes and participates in various cultural and social practices.2 As such, ethnography requires reflexivity because the ethnographer must constantly consider how her body is affecting and is effected by the communities and institutions in which she is embedded. The benefit of this reflexive ethnographic approach is that, as Faye Ginsburg notes, it “has the capacity to reveal the fault lines in 1. Allen’s ¡Venceremos?, Mignon Moore’s Invisible Families, and Mireille Miller-Young’s A Taste for Brown Sugar represent an exciting trend within an interdisciplinary body of research that I am referring to as Black sexuality studies. What links these projects is their use of ethnographic methodologies to understand how Blackness informs racialized gender and sexuality in the everyday experiences of their interlocutors. In relying on ethnography, to varying degrees, they are in conversation with and expand upon methodological trends within Black feminist studies and Black queer studies. Further, the Black sexuality studies projects reviewed here question the (hetero)normative bent within the field of African American studies, the normatively white subject position that exists within queer theory, and the lack of attention to issues of sexual pleasure within Black feminist theory. Some investigators of the rubber hand illusion (RHI) have suggested that when standard RHI induction procedures are employed, if the rubber hand is experienced by participants as owned, their corresponding biological hands are experienced as disowned. Others have demurred: drawing upon a variety of experimental data and conceptual considerations, they infer that experience of the RHI might include the experience of a supernumerary limb, but that experienced disownership of biological hands does not occur. Indeed, some investigators even categorically deny that (...) any experimental paradigm has been employed or any evidence can be adduced to support the claim that disownership experiences occur during the RHI. It goes without saying that RHI experiences can be elusive, and that there is some evidence to support claims that supernumerary limb experiences can sometimes occur. Here, however, we test the claim that the conscious experience of disownership can occur during the RHI. In order to test this claim, we developed two new online proxies—onset time for the illusion and illusion duration—and combined these with established questionnaires that concern the conscious contents of the RHI, in particular ownership/disownership experiences. Both online proxy data and post hoc questionnaire data converge in supporting the claim that disownership experiences do occur, at least when the left hand is the object of investigation. Our findings that onset time and illusion duration are reliable measures suggest that investigations of the RHI stand to benefit by devoting more attention to data collected while the RHI is being experienced, in particular data concerning temporal dynamics. Judith Butler and Catherine Malabou’s recent exchange, ‘You Be My Body for Me: Body, Shape and Plasticity in Hegel’s Phenomenology of Spirit’, is remarkable because in their rereading of Hegel’s famous lord and bondsman parable, rather than focusing on recognition, work, or even desire, Butler and Malabou each wonder about how Hegel contributes to a new way of thinking about ‘having’ a body and how coming to ‘be’ a body necessarily involves a kind of dispossession. Butler and Malabou’s reading of (...) Hegel is congruent with a current shift on the left away from a liberal politics of recognition to a Marxist analytic of dispossession: a move, in other words, away from liberal ‘solutions’ of redistribution – of either goods or recognition – towards thinking through issues of settler colonialism, forced migration and empire. Butler and Malabou’s piece points towards the insight that Hegel’s parable must be thought in terms of the political history of possessive individualism, and so in terms of the history of juridically defined property relations; the history of regarding both the body and the land as property. The ‘two valences’ of dispossession, in other words, refers in fact to a logic of property relations, one between those who ‘have’ property and those who are juridically defined as propertyless. Left-wing authoritarianism remains far less understood than right-wing authoritarianism. We contribute to literature on the former, which typically relies on surveys, using a new social media analytic approach. We use a list of 60 terms to provide an exploratory sketch of the outlines of a political ideology – tribal equalitarianism – with origins in 19th and 20th century social philosophy. We then use analyses of the English Corpus of Google Books (n > 8 million books) and scraped unique tweets from (...) Twitter (n = 202,582) to conduct a series of investigations to discern the extent to which this ideology is cohesive amongst the public, reveals signatures of authoritarianism and has been growing in popularity. Though exploratory, our results provide some evidence of left-wing authoritarianism in two forms: (1) a uniquely conservative signature amongst ostensible liberals using measures derived from Moral Foundations Theory and (2) a substantial prevalence of anger, relative to anxiety or sadness, in tweets analyzed for sentiment. In general, results indicate that this worldview is growing in popularity, is increasingly cohesive, and shows signatures of authoritarianism. (shrink)
