In a recent paper, Kevin Krein argues that the notion of self-competition is misplaced in adventure sports and of only limited application altogether, for two main reasons: (i) the need for a consistent and repeatable measure of performance; and (ii) the requirement of multiple competitors. Moreover, where an individual is engaged in a sport in which the primary feature with which they are engaged is a natural one, Krein argues that the more accurate description of their activity is not 'competition', (...) but an attempt at harmonious interaction. I raise a number of problems against both criteria and argue that traditional and adventure sports do both involve self-competition on at least two levels: bettering one's previous performance and resisting the desire to quit. I argue that self-reflexive competition is not so much with one's self (which is philosophically absurd), but within one's self, between conflicting motivations and desires. I explore what is involved in self-reflexive competition, particularly at a phenomenological, self-constituting level, and raise the question of whether it is appropriate for activity in wilder natural environments. In the occupational health setting, codes developed by international agencies have substantial import on protecting working populations from harm. This is particularly so under globalisation which has transformed processes of production in fundamental ways across the globe. As part of the process of revising the Ethical Code of the International Commission on Occupational Health, an Africa Working Group addressed key challenges for the relevance and cogency (...) of an ethical code in occupational health for an African context through an iterative consultative process.DiscussionFirstly, even in the absence of strong legal systems of enforcement, and notwithstanding the value of legal institutionalisation of ethical codes, guidelines alone may offer advantageous routes to enhancing ethical practice in occupational health. Secondly, globalisation has particularly impacted on health and safety at workplaces in Africa, challenging occupational health professionals to be sensitive to, and actively redress imbalance of power. Thirdly, the different ways in which vulnerability is exemplified in the workplace in Africa often places the occupational health professional in invidious positions of Dual Loyalty. Fourth, the particular cultural emphasis in traditional African societies on collective responsibilities within the community impacts directly on how consent should be sought in occupational health practice, and how stigma should be dealt with, balancing individual autonomy with ideas of personhood that are more collective as in the African philosophy of ubuntu. To address stigma, practitioners need to be additionally sensitive to how power imbalances at the workplace intersect with traditional cultural norms related to solidarity. Lastly, particularly in the African context, the inseparability of workplace and community means that efforts to address workplace hazards demand that actions for occupational health extend beyond just the workplace.SummaryA stronger articulation of occupational health practice with advocacy for prevention should be an ethical norm. Ethical codes should ideally harmonize and balance individual and community needs so as to provide stronger moral authority guidelines. Preston's (2011) challenge to the moral presumption against geoengineering is applied to carbon dioxide capture and storage (CCS) in Scotland, United Kingdom. Qualitative data is analysed to assess if and how Preston's arguments play out in practice. We argue that the concepts of 'lesser evil' and prioritising human well-being over non-interference in natural processes do bring different value positions together in support of CCS, but that not all people see short-term carbon abatement as the 'least worst' option or a suitable (...) way to prioritise human well-being. John Venn is remembered today as the inventor of the famous "Venn diagram." The postmortem fame of the namesake diagram has until now eclipsed Venn's own status as one of the most accomplished logicians in his day. Praised by John Stuart Mill as a "highly successful thinker" with much "power of original thought," Venn profoundly influenced nineteenth-century philosophers, ranging from Mill and Henry Sidgwick to Charles Sanders Peirce. Venn was heir to a clerical, Evangelical dynasty but religious doubts led (...) him to resign Holy Orders and instead turn to an academic life, writing influential textbooks on probability theory and logic and advocating for education reform, including for women's education. Venn also collaborated with Francis Galton in the unofficial Anthropometrical Laboratory, and, through his writing and teaching, a direct line can be traced from Venn and his circle to the development of analytic philosophy in the work of W. E. Johnson, G. E. Moore, Bertrand Russell, and C. D. Broad. Through family descent, Venn was connected to eminent Victorians like Leslie Stephen and Virginia Woolf. This essential book explores Venn's life and work in context, taking readers on his journey from Evangelical son to Cambridge don. Developing countries have been faced with declining expenditures in health and social services, increasing burdens posed by both communicable and non-communicable diseases, and economic systems poorly geared to fostering sustainable development for the poorest and most marginalized. Under such circumstances, the challenges facing health practitioners in countries in transition are complex and diverse, and require the balancing of many conflicting imperatives. This is particularly so in (...) relation to the development of public health policy, where equity, redress of past inequalities, and the god of social justice may seemingly be pitted against macroeconomic adjustments required for national economic development in an increasingly globalized economic order.For example, pressures to deregulate as part of a market-oriented development philosophy will increase the risks from occupational hazards in populations desperate for paid employment. ABSTRACTMost scholars agree that meaning and intelligibility are central to Heidegger’s account of Dasein and Being-in-the-world, but there is some confusion about the nature of this intelligibility. In his debate with McDowell, Dreyfus draws on phenomenologists like Heidegger to argue that there are two kinds of intelligibility: a basic, nonconceptual, practical intelligibility found in practical comportment and a conceptual, discursive intelligibility. I explore two possible ways that Dreyfus might ground this twofold account of intelligibility in Heidegger: first in the distinction (...) between the hermeneutic and apophantic “as”, and second in the presence and absence of the as-structure. I argue that neither approach succeeds because practical intelligibility is always already discursive and discursive articulation is a condition of practical comportment. (shrink)

This article defends legal instrumentalism, i.e. the thesis that law is distinguished among social institutions more by the means by which it serves its ends, than by the ends it serves. In Kelsen's terms, '[L]aw is a means, a specific social means, not an end.' The defence is indirect. First, it is argued that the instrumentalist thesis is an interpretation of a broader view about law that is common ground among theorists as different as Aquinas and Bentham. Second, the following (...) familiar fallacies that seem to stand in the way of accepting the thesis are refuted: (1) If law is an instrument, then law can have no non-instrumental value. (2) If law is an instrument, then law always has instrumental value. (3) For law to be an instrument, there must be generic end that law serves. (4) If law is an instrument, law must be a neutral instrument. These claims are all wrong. In passing, the instrumentalist thesis is distinguished from other, unrelated, views sometimes associated with instrumentalism, including Brian Tamanaha's diagnosis of the vices of American law, and the views of those who think that jurisprudence is an instrument in the service of social ends. "The subject of this book is an extremely important one. The treatments are good, and the whole is considerably more than its parts. I strongly recommend it.

This paper argues against the conception of sport as theatre. Theatre and sport share the characteristic that play is set in a conventionally-defined hypothetical reality, but they differ fundamentally in the relative importance of audience and the narrative point of view. Both present potential for participants for development of selfhood through play and its personal possibilities. But sport is not essentially tied to audience as is theatre. Moreover, conceptualising sport as a form of theatre valorises the spectator’s narrative as normative (...) for sport experience over that of the participant athlete or player, eliding player experience. Imposition of external narratives over experience risks fossilising interpretation and inhibits the beneficial effects of play for self-realisation, especially as a form of self-examination and creation through internal self-narrative. The argument of this article is that what I term generic globalization has created unprecedented opportunities for advances in human rights universally, but that the dominant actually existing historical form of globalization ? capitalist globalization ? undermines these opportunities. Substantively, I argue that taking the globalization of human rights seriously means eliminating the ideological distinction that exists between civil and political rights on the one hand, and economic and social rights on the other. Doing this systematically undermines the three central (...) claims of capitalist globalization ? namely, that globalizing corporations are the most efficient and equitable form of production, distribution and exchange; that the transnational capitalist class organizes communities and the global order in the best interests of everyone; and that the culture-ideology of consumerism will satisfy our real needs. The mathematician William Kingdon CliTord (1845–1879) is generally remembered as a potentially great man whose life was cut short before his genius was fully realized. During his lifetime CliTord was well known in London as a public intellectual and noted authority on science. He was also an iconoclast, a leader in the application of Darwinian principles to areas beyond biology, and a proponent of non-Euclidean geometry. Unlike other agnostics, CliTord did not mourn the loss of his religious belief, nor did he worry that a secularized society would bring about general social decay. While other scientiWc naturalists worried that a collapse of religion would destroy morality and lead to social disintegration, CliTord willingly ceded the universal truths religion oTered, embracing the uncertainty that scientiWc knowledge actually entailed. He even dared to call himself an atheist. However, CliTord’s death at age 34 curtailed the trace of his thought. What remains is consigned to his scant private notebooks and collected works. Perhaps it was the brevity of his life that has led to his neglect within the history of science; no comprehensive appraisal of his mathematical work has been written. Madigan gives a brief history of the Victorian crisis of faith, CliTord’s mathematical work, and the biographical details of his life. He presents the argument CliTord makes within “The Ethics of Beliefz”, and outlines the critical response from his contemporaries, including founding members of the Metaphysical Society William George Ward and Richard H. Hutton, poet Matthew Arnold, physiologist George John Romanes, and American psychologist and philosopher William James. This volume contains a facsimile reprint of the 1883 Boston edition of Studies in Logic by Members of the Johns Hopkins University, edited by Charles S. Peirce. In relation to this work there are three mutually related aspects of Peirce’s thought which deserve to be particularly emphasized: the community structure of science as propagated and practiced by Peirce; his consideration of the fundamental relationship between logic and semiotics; and his emphatic plea for a historisation of science and, (...) hence, of semiotics. A reformulation of our understanding of freedom is required if we are adequately to confront the environmental crisis. Engaging the debate between biocentric ecologists and sociocentric ecologists, I argue that the biocentric effort to ascribe rights (negative liberty) to nature is misbegotten. In turn, I suggest that the sociocentric effort to seek ecological realignment through the extension of human reason (positive liberty) is equally problematic. Martin Heidegger, who rejects both “negative” and “positive” notions of liberty, offers an understanding of human (...) freedom that constitutes an ecologically attuned alternative. (shrink)
