Owing to technological advances, genomic medicine is moving from specific to broader genetic analyses and from specialised to mainstream services. Sahan et al 1 point to complex ethical cases encountered by clinical laboratory scientists in the context of genomic medicine’s expansion. The authors discuss debates on interpreting and reporting genetic results, offering extended genetic testing and differences in the perceived responsibility of clinical laboratory scientists in different settings. As demonstrated by the case examples in the article, while genomic medicine holds (...) the promise of providing clinical answers, its mainstreaming can introduce a new type of ‘odyssey’ for patients and/or relatives, such as when there are uncertain findings. The integration of genomics in healthcare at large can also impact communication decisions and perceptions of responsibility for clinical laboratory scientists. Clinical laboratory scientists might report less to non-specialists than to genetic/genomic specialists, as they feel responsible for minimising the potential of non-specialists misunderstanding, misinterpreting or miscommunicating the genetic findings to patients.1 In this way, the perceived responsibility affects patients and the type and amount of genetic information they receive. This paper presents an experimental study investigating artificial grammar learning (AGL) in monolingual and bilingual children, with and without dyslexia, using an original methodology. We administered a serial reaction time (SRT) task, in the form of a modified Simon task, in which the sequence of the stimuli was manipulated according to the rules of a simple Lindenmayer grammar (more specifically, a Fibonacci grammar). By ensuring that the subjects focused on the correct response execution at the motor stage in presence of (...) congruent or incongruent visual stimuli, we could meet the two fundamental criteria for implicit learning: the absence of an intention to learn and the lack of awareness at the level of resulting knowledge. The participants of our studies were four groups of 10-year-old children: 30 Italian monolingual typically developing children, 30 bilingual typically developing children with Italian L2, 24 Italian monolingual dyslexic children and 24 bilingual dyslexic children with Italian L2. Participants were administered the modified Simon task developed according to the rules of the Fibonacci grammar and tested with respect to the implicit learning of three regularities: (i) a red is followed by a blue; (ii) a sequence of two blues is followed by a red and (iii) a blue can be followed either by a red or by a blue. Results clearly support the hypothesis that implicit learning took place, since participants of all groups became increasingly sensitive to the structure of the input, implicitly learning the sequence of the trials and thus appropriately predicting the occurrence of the relevant items, as manifested by faster reaction times in predictable trials. Moreover, group differences were found, with bilinguals being overall faster than monolinguals and dyslexics less accurate than controls. Finally, an advantage of bilingualism in dyslexia was found, with bilingual dyslexics performing consistently better than monolingual dyslexics and, in some conditions, at the level of the two control groups. These results are taken to suggest that bilingualism should be supported also among linguistically impaired individuals. (shrink)

The present study had two main aims: to determine whether deaf children show higher rates of key behaviors of ADHD and of Conduct Disorder—CD— than hearing children, also examining whether the frequency of these behaviors in deaf children varied based on cochlear implant use, type of school and level of receptive vocabulary; and to determine whether any behavioral differences between deaf and hearing children could be explained by deficits in inhibitory control. We measured behaviors associated with ADHD and CD in (...) 34 deaf and hearing children aged 9–10 years old, using the revised Spanish version of the Conners scale. We then assessed inhibitory control ability using a computerized Stroop task and a short version of the Attention Network Test for children. To obtain a measure of the level of receptive vocabulary of the deaf children we used a Spanish version of the Carolina Picture Vocabulary Test for Deaf and hearing-impaired children. Deaf children showed significantly higher rates of behaviors associated with ADHD and CD, and over 85% of cases detected with high risk of ADHD-inattentive type in the entire present sample were deaf children. Further, in the group of deaf children a negative correlation was found between receptive vocabulary and frequency of disruptive, aggressive, or antisocial behaviors associated with CD. However, inhibitory control scores did not differ between deaf and hearing children. Our results suggested that the ADHD-related behaviors seen in deaf children were not associated with a deficit in inhibitory control, at least in the interference suppression subcomponent. An alternative explanation could be that these behaviors are reflecting an adaptive strategy that permits deaf children to access information from their environment which is not available to them via audition. In the State of Bernstein, operating a motor vehicle on a suspended license is a misdemeanor, punishable by permanent loss of one’s license. Officer Krupke arrests everyone who does this, as Tony has. But Tony says, “Gee, Officer Krupke, can’t you bend the rules? I went to your high school, you know.” Tony’s using a euphemism. He’s really asking Krupke to break the rules. Is there, however, a non-euphemistic way to bend a rule of law, without breaking it? More precisely, (...) can we ever bend a rule while still applying it, in some sense, or is this just doubletalk? Consider the case of Maria, whose driver’s license has also been suspended. Maria lives with her mother in a remote area, twenty miles from the nearest doctor. Maria’s mother comes down with a fever of one hundred two. It’s not life-threatening, but Maria wants to spare her mother suffering and hasten recovery, so she drives to the hospital herself, rather than waiting for an ambulance to make the trip out and back. Unfortunately for Maria, the statute contains no applicable exception. I stipulate that this statute is not unjust or otherwise defective, as written. Suppose there are conclusive reasons for legislators not to complicate the statute with exceptions broad enough to cover cases such as Maria’s. Writing such exceptions would encourage sub-optimal misapplication of the exception by judges and sub-optimal misconduct by legal subjects who would anticipate judicial misapplication of the statutory exception. Nevertheless, most will agree that Maria has strong reasons to act as she does. Rare is the writer who insists that rules of law trump all other reasons that bear on legal subjects. Some will insist that we give Maria’s mother a condition more life-threatening before they’ll assent. (shrink)

Simone Martini’s panel painting of St Ladislas of Hungary, founder of the Árpád dynasty and a prototypical crusading knight, attests to the transnational character of Filippo Sangineto’s patronage in Santa Maria della Consolazione, Altomonte (Calabria). The attribution to Sangineto, count of Altomonte and seneschal of Provence, has long been debated, but he is agreed to have been a formidable patron with an ambitious plan for Altomonte. Like many Italian royals, aristocrats, cardinals, and merchants, Filippo commissioned artworks to Sienese artists (...) in Avignon. This study’s approach also sheds light on the iconography as the choice of Ladislas can be connected to the Crusade of Smyrna (1343-1345). The article proposes a reconstruction of Santa Maria della Consolazione, with two small, matching polyptychs set against the screen, one by Bernardo Daddi (two wings survive in Altomonte) and the other by Simone, composed of the painting of Ladislas and the Phillips Collection’s Christ on the Cross. One scene from Wim Wenders’ film “Alice in the cities” provokes us to think again about childhood. It’s a fresh polaroid snapshot, where we can see the faces of an adult (Phillip Winter) and a child (Alice) blending and mixing. Starting from this image, this paper makes its way through the movie’s plot, reflecting on the power of freedom that arises from an encounter with children and childhood. First, we examine the relationship between Winter and his job as a photo-journalist, (...) discussing the character of his existential anguish and his supposed indisposition to becoming, which seems to be clear in the way that he reads his own photographs. In a second moment of the film, we understand Alice’s arrival on the scene as something capable of dispersing the circumstances that are constraining him by hurling him into the unpredictable. This event is crystallized in one poetic gesture: the girl confronts the adult with her own face by drawing a self-portrait. Facialization and deterritorialization are twoconcepts that we weave into our discussion, working off the philosophical thinking of Georges Didi-Huberman, Gilles Deleuze and Félix Guattari. Finally, we propose that worry as a value, characteristic of children and travelers, can produce an opening that offers an escape into a freedom of release–or, so to speak, a defacialized freedom. In this paper we argue that to adequately capture the complicated relationship between Descartes' work and late medieval thought, philosophers need to think not only about his ideas but also about his presentation and choice of genre. Reading the Meditations as a mere discursive treatise containing a progressive and consistent set of arguments intended to establish a particular philosophical position fails to appreciate the eponymous genre that Descartes explicitly chose to employ in writing them. Instead, we argue that reading the (...) text in light of the long tradition of contemplative meditative literature opens up a radically new way of interpreting the Meditations as a “mystagogical” project of spiritual edification and epistemic and volitional transformation. During such a transformation, the meditator undergoes a series of revelatory experiences structurally similar to those we find in various so-called “mystical” or “mystagogical”literature, in the Christian West. We show how paying attention to these mystagogical aspects of the Meditations can open up new avenues for understanding the connection between the theoretical, practical, and theological aspects of Descartes' thought. Such a reading resolves a number of seemingly glaring problems and peculiarities in the Meditations including the Cartesian circle, and the tension in the Cartesian notion of the freedom of the will. We also argue that the odd detours the meditator takes in the Sixth Meditation through physiology are not mere digressions but rather mark an often overlooked aspect of the mystagogical story – the return to embodiment as a transformed self. Indeed, the overly intellectualist emphasis of contemporary scholars on both the contemplative aspects of mystagogical literature and the epistemological focus of Descartes' project in the Meditations have caused them to largely overlook the ways in which the aim of both medieval and Cartesian meditation involves a transformative re-orientation of the whole person and their understanding of the world – one which has practical, moral, and social consequences that have gone underexplored in discussions of these texts. In this conceptual article, we argue that defining corporate social responsibility and corporate social irresponsibility as opposite constructs produces a lack of clarity between responsible and irresponsible acts. Furthermore, we contend that the treatment of the CSR and CSI concepts as opposites de-emphasizes the value of CSI as a stand-alone construct. Thus, we reorient the CSI discussion to include multiple aspects that current conceptualizations have not adequately accommodated. We provide an in-depth exploration of how researchers define CSI and both identify (...) and analyze three important gray zones between CSR and CSI: the role of harm and benefit, the role of the actor and intentionality, and the role of rectification. We offer these gray zones as factors contributing to the present lack of conceptual clarity of the term CSI, as a concept in its own right, leading to difficulties that researchers and managers experience in categorizing CSI acts as distinct from CSR. Phronesis is essential for good decision‐making and actions. This literature review shows how phronesis has been discussed and related to elements of the field of administration and organizations. A search in the database systems Scopus, EBSCO, Web of Science, and Scielo, based on eligibility criteria, resulted in 43 theoretical and 14 empirical works. The analysis of these studies showed the most significant empirical contributions, the most cited authors, methods, journals, and central themes addressed in studies on phronesis to understand ethics (...) in business. From a virtue ethics perspective, we discuss the major theoretical and empirical contributions, as well as the implications of a restricted understanding of phronesis when it is treated apart from other elements of the virtue ethics framework. We present a synthesis of the concepts of phronesis, based on dimensions of magnitude and amplitude of the conceptions, ranging from formal to substantive phronesis, and covering individual, organizational, or societal levels of analysis. We argue that a substantive conception of phronesis within virtue ethics may improve our understanding of ethics because it assumes the interdependence of phronesis and moral virtues, integral anthropology, and the common good. Spectroscopy is a scientific topic at the interface between Chemistry and Physics, which is taught at high school level in relation with its fundamental applications in Analytical Chemistry. In the first part of the paper, the topic of spectroscopy is analyzed having in mind the well-known Johnstone’s triangle of chemistry education, putting in evidence the way spectroscopy is usually taught at the three levels of chemical knowledge: macroscopic/phenomenological, sub-microscopic/molecular and symbolic ones. Among these three levels, following Johnstone’s recommendations the macroscopic (...) one is the most useful for high school students who learn spectroscopy for the first time. Starting from these premises, in the second part of the paper, we propose a didactic sequence which is inspired by the historical evolution of spectroscopic instruments from the first spectroscopes invented by Gustav Kirchhoff and Robert Bunsen in 1860 to the UV–vis spectrophotometers which became common since the 1960s. The idea behind our research is to analyze the conceptual advancements through the history of spectroscopy and to identify the key episodes/experiments and spectroscopic instruments. For each of them, a didactic activity, typically an experiment, is then proposed underlining the relevant aspects from the chemistry education point of view. The present paper is the occasion to reflect on the potentialities of an historical approach combined with a laboratorial one, and to discuss the role of historical instruments and related technological improvements to teach spectroscopy. This paper spells out the ways in which we need to be pluralists about “human nature”. It discusses a conceptual pluralism about the concept of “human nature”, stemming from post-essentialist ontology and the semantic complexity of the term “nature”; a descriptive pluralism about the “descriptive nature” of human beings, which is a pluralism regarding our self-understanding as human beings that stems from the long list of typical features of, and relations between, human beings; a natural kind term pluralism, which is (...) a pluralism that concerns the choices we have in deciding how to apply the kind term “human”; and an explanatory pluralism that results from the causal complexity of life. Because of the complexity of being human, which gives rise to these pluralisms, being human is, the paper claims, a kaleidoscopic affair, and one far from concerning the life sciences only. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Seeing is not believing, contrary to what popular idioms might claim. But what exactly is the difference? This question is the focus of The Border Between Seeing and Thinking, the long-awaited monograph by philosopher Ned Block.

To have a well-functioning principle of academic freedom, we need to distin-guish critique from an infringement of academic freedom. To achieve this goal, this paper presents three necessary conditions for something to be an infringe-ment of academic freedom. These conditions allow to delineate cases in which at least one of the three conditions is not fulfilled. These are contrast cases that might – at first glance – look like infringements of academic freedom but are, in fact, not so. I will (...) refer to five such kinds of contrast cases: (1) discrimination and thus a more general kind of unjust treatment of a person engaged in aca-demic affairs, (2) infringement of freedom of speech or other non-academic intel-lectual freedoms, (3) mere critique, (4) justified critique that leads to justified limitations of someone’s academic freedom, and (5) cases of deep disagreement. Special attention will be given to vulnerabilities concerning unjustified silencing of critique, which haunt fields that lack clear and agreed-on ethical or academic standards. (shrink)

In the literature, the pragmatic dimension of metaphors has been clearly acknowledged. Metaphors are regarded as having different possible uses, especially pursuing persuasion. However, an analysis of the specific conversational purposes that they can be aimed at achieving in a dialogue and their adequacy thereto is still missing. In this chapter, we will address this issue focusing on the classical distinction between the explanatory and persuasive uses of metaphors, which is, however, complex to draw at an analytical level and often (...) blurred and controversial also from a theoretical point of view. Building on the analysis of explanation in different theories and fields of study, we show how it can be conceived as characterized by a cognitive and a pragmatic dimension, where the transference of understanding is used pragmatically for different dialogical goals - such as informing, making a joint decision, and most importantly persuading. In this sense, the cognitive effects of understanding are not incompatible with a persuasive dialogical purpose. This theoretical proposal will be applied to examples drawn from the medical context, to show how a pragmatic approach to explanation can account for the complexity of the cases that can be found in actual dialogical contexts. Real-world judgements and decisions often require choosing from an open-ended set of options which cannot be exhaustively considered before a choice is made. Recent work has found that the options people do consider tend to have particular features, such as high historical value. Here, we pursue the idea that option generation during decision making may reflect a more general mechanism for calling things to mind, by which relevant features in a context-appropriate representational space guide what comes to mind. In this (...) paper, we evaluate this proposal primarily based on what comes to mind in different familiar categories. We first introduce an empirical approach for deriving the space of features that people use to represent items in a particular category and for locating the category members that come to mind within that space. We show that in both familiar and ad hoc categories, a category member’s location along certain dimensions of the derived feature space predicts its likelihood of coming to mind. Next, we show that category members from these feature space locations come to mind by default in a way that is somewhat impervious to conscious control. We then demonstrate that the extent to which a given dimension is a predictor of what comes to mind within a category is related to how relevant that feature is for representing the category in question, using a novel measure of general feature relevance. Finally, we illustrate the usefulness of this framework in the context of a decision making task. We close with the proposal that people call category members to mind according to their location in representational space, specifically based on the predicted usefulness of considering category members with particular features. The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality and (...) famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. This paper applies crip theory (McRuer, 2006, 2018) as well as other key conceptual tools from disabled childhood studies (Runswick-Cole et al., 2018) and disability studies in education (Cousik & Maconochie, 2017) as a tactic intended to question and resist the story of overcoming as it manifests itself within the discourses and practices of self-regulation in early learning classrooms. This paper offers a brief overview of the range of self-regulation strategies enacted within educational settings in Ontario, Canada, that purport to (...) support young children in overcoming themselves on their way to normalcy. This paper also engages in crip theory as a strategy to both question and disrupt the taken for granted assumption that self-regulation entails a return towards or a sustaining of the efficient and productive neoliberal individual in school systems. Finally, this paper considers how we might not only invite but embrace the disruptions that occur when embodied differences refuse to be overcome by demands to self-regulate. Ultimately, a key aim of this paper is to resist how discourses and practices of self-regulation in Early Childhood Education and Care (ECEC) establish the overcoming narrative as a means to cure, fix or exclude embodied differences while contemplating the vibrant possibilities embedded within learning with and from disabled childhoods. Bajo la premisa de que el desarrollo de los procesos de memorialización debe atenderse más allá del cumplimiento normativo por parte del Estado, puesto que estas prácticas de memoria territoriales en El Mochuelo subvierten (...) el estatismo y la homogeneidad con los cuales se instauran las verdades oficiales. ABSTRACT Heterotopia concept, defined by Michel Foucault as another space, is taken up in this article to analyze the processes of construction, management, and implementation of the Museo Itinerante de la Memoria y la Identidad de Los Montes de María, El Mochuelo (Itinerant Museum of Memory and Identity of Los Montes de María, El Mochuelo). Inasmuch as Buddhism’s professed goal is the elimination of all attachment to the material world, a pre-occupation with that materiality would immediately strike the disinterested observer as strange, if not improper. Indeed, the monastic tradition eschews engagement with what we colloquially refer to as artistic endeavour, as it detracts from the discipline required to attain the ultimate goal of “snuffing out” the flame that perpetuates suffering (LaFleur 2003, Introduction). Yet, the path to liberation is trodden in the material world, and (...) its manifestations, perceived and processed through the physical senses, are necessary instruments and tools to that end. Cognition of the nature of actions and their fruits can only be achieved by engaging with their manifestations and permutations, using the techniques and disciplines that have been developed in the course of Buddhism’s history. However, the monastic tradition forms but a small part of the Buddhist tradition and the contributions to this volume are concerned in the main with artefacts that circulated outside the cloisters. They present a fascinating purview of how Buddhist ideas and practices circulated in pre-modern Japanese society, showing core beliefs about the Buddhist cosmos and how people from non-monastic walks of life (mainly in the spheres of politics and the aristocracy) availed themselves of that understanding of the world they lived in. This multi-disciplinary collection interrogates the role of human rights in addressing past injustices. The volume draws on legal scholars, political scientists, anthropologists and political philosophers grappling with the weight of the memory of historical injustices arising from conflicts in Europe, the Middle East and Australasia. It examines the role of human rights as legal doctrine, rhetoric and policy as developed by states, international organizations, regional organizations, and non-governmental organizations. The authors question whether faith in human rights is justified as balm (...) to heal the past injustice or whether such faith nourishes both victimhood and self-justification. These issues are explored through three discrete sections: moments of memory and injustice, addressing injustice and questions of faith. In each of these sections authors address the manner in which memory of past conflicts and injustice haunt our contemporary understanding of human rights. The volume questions whether the expectations that human rights law can deal with the past injustice has undermined the development of an emancipatory politics of human rights for our current world. В своей книге «Занятия философией с детьми в начальной школе: сложная деятельность» Берри Хисен утверждает, что занятие философией с детьми является формой парресии, поскольку побуждает детей говорить свободно и открыто. Парресия изменяет отношения между взрослым и ребенком. Серьезное отношение взрослых к детям как полноправным гражданам дает детям возможность серьезно относиться к себе, а также нести ответственность за свои мысли и чувства. Обосновывая свои мысли и чувства и прислушиваясь к мнению своих сверстников, дети становятся критическими слушателями не только других, но и самих себя. Они узнают, что то, что они думают и чувствуют, имеет вес, имеет значение в глазах других, что повышает самооценку. В процессе философствования дети также вырабатывают свои собственные критерии («пробные камни») реальности. Более того, для ощущения целостности и обоснованности того, кто мы есть, необходимо самопознание, что дает нам осознание цели и направления развития. (shrink)

In this work we present the complex relationship between sound and color in musical creation throughout history that continues to be fruitful in current musical composition. Synesthesia in music establishes a correspondence between sound and color and has been a constant debate since the 17th century. The complex nature of sound appears from ancient Greece in the school of Pythagoras in which the number becomes the configurator of harmony. Since then, different aesthetic attempts have arisen to relate color and sound (...) that reach today's electronic procedures in contemporary music. (shrink)

O presente artigo tem por objetivo apresentar as contribuições da estética da existência em Foucault para o âmbito da educação. Inicialmente será apresentado, em linhas gerais, os três domínios de sua produção teórica: Arqueologia do Saber, Genealogia do Poder e Estética da Existência. Posteriormente, será exposto mais profundamente a terceira fase de sua obra, destacando as ideias acerca do conceito do Cuidado de Si e a sua relação com o ambiente escolar e a formação docente. A estética da existência caracteriza-se (...) como o terceiro domínio foucaultiano e concerne na ideia da vida como obra de arte, onde por meio das práticas de si, cuidado de si, governo de si, _parrhesía_ e exame de consciência o sujeito torna-se capaz de estilizar sua existência, moldando sua vida e sendo artesão de si mesmo. Os apostes teóricos que fundamentam a pesquisa, além do Michel Foucault, são: Veiga-Neto (2016), Brandão (2011), Barcelos, Rabelo e Rodrigues (2009), entre outros autores. Esses correlacionam a obra do Filósofo Michel Foucault com a Educação. A partir da relação estabelecida entre a Estética da Existência e a Educação, percebeu-se que a escola têm sido, desde a sua fundação até os dias de hoje, um espaço que prioriza a disciplina e a normatização. Portanto, faz-se necessário introduzir nesse espaço saberes que possibilitem um novo modo de formar os sujeitos para que esses sejam conscientes e desfrutem da sua liberdade, que por muitas vezes lhes é retirada.
